Naresh Kadyan, non official Member, State Committee for Slaughter Houses,

Department of Urban and Local Bodies (Govt. of Haryana) agenda items for
the meeting, to be held on 19-2-16: Resignation under protest.
I have gone through the agenda supplied by the Department, which was
neither prepared nor endorsed by the Member Convener, appointed by the
court of law, whereas I have not received the complaint of then Commissioner
of Municipal Corporation, Gurgaon. I welcome the item for the terms of non
official members of this committee because there was no mechanism for the
terms along with the sitting fee, TA and DA for non officials, I tried my best to
perform, besides the non cooperation of the field functionaries, like Sh. Vikas
Gupta, IAS and Sh. Shakti Singh, HCS, under protest, because these Govt.
officials, doesnt want to perform and failed to work, as per orders passed by
the Honble Supreme Court of India, keeping in view the Swach Haryana,
matter was taken up with the DoPT twice, hence I offer my resignation from
this committee under protest and I will submit my observations before the
court of law. It is further intimated to the house that I have lodged many
FIRs against the unlawful slaughter houses, keeping in view the duties and
functions decided by the court of law, hence I may kindly be allowed to
withdraw all my complaints lodged as non official member because I have no
time, money and energy to assist prosecution, as my performance needs
recognition, respect and appreciation instead of insult and non cooperation
from the public servant, who are duty bound and paid for their performance.
1. As per verbal orders of then Chairman of the Committee, my agenda
items, which were defer for next meeting, may kindly be considered.
2. Kindly refer to the orders passed by the Honble Supreme Court of
India in CWP No. 309 of 2003, duties and functions were defined of this
committee but I am sorry to say that field functionaries of the Urban
and Local Bodies along with Panchyati Raj Institutions, totally failed to
perform accordingly to the duties and functions decided of the District
Committees for Slaughter Houses because unlawful slaughter houses
cum meat shops are openly functioning, concerned officials of the both
Urban and Local Bodies with Panchyati Raj are not initiating to crack
down, Ambala Municipal Corporation, even allowed unlawful
slaughtering in their own shops, unregistered and unlicensed meat

shops are working all around in Haryana, whereas some meat shops are
regularized by the Administration but animal and birds are being
unlawfully slaughtered, violating the Slaughter House Rules, 2001.
As per orders passed by the Authorities of the Urban and Local Bodies,
field functionaries of this Department failed to obey the Administrative
orders, hence compliance of these orders may kindly be considered,
while recording Annual Confidential Reports of the Commissioners /
Joint Commissioners / Executive Officers / Secretaries / Chief Sanitary
Inspectors / Sanitary Inspectors etc.
As per Notification, Panchyati Raj Institutions are also failed to
perform, unlawful slaughter houses cum meat shops are openly
functional, no lists are being prepared for further cracking down, hence
DDPO / BDPOs annual confidential reports also needs attention.
The District wise census of animals and birds doesnt allow for the
establishment of meat export units, within the jurisdiction of Haryana,
even in Mewat District two major slaughter houses are functional and
third was ready to function, whereas this Tapkan proposal was never
approved by the State Committee for Slaughter Houses, the operator
already have Slaughter House at Unnav in UP then why he is coming to
Haryana, which is not feasible as per census of animals and birds all
around, so all unlawful permissions and no objections needs to be
withdrawn. It would also be pertinent to mention here that grant in aid
from the Govt. of India attract new proposals of the meat export units,
which needs to be declined.
Field functionaries may kindly be directed to survey the area about
demands of meat supply, keeping in view the consumption and then
prepare a project reports for modification and establishments of new
slaughter houses, only for local consumption, to meet out the demands
not for meat export.
Animals are being badly abused, while shifting in non ISI goods
transport vehicles, whereas Ministry of Road Transport and Highways,
notified the Central Motor Vehicle (Eleventh Amendment) Rules, 2015
and animals / birds can be shifted as per their shape and size, whereas
section 94 of the Haryana Motor Vehicle Rules also defined the process
of animal shifting, Cattle Transport Rules, 1978 amended in 2001 also

defined the mechanism but without pre transport permit, which


required under section 96, animals are being abused, hence
responsibilities may kindly be fixed on the Deputy Director cum
Secretary, SPCAs for any violation. It would also be pertinent to
mention here that Honble Supreme Court of India also uphold animal
rights and clarified the transportation system of animals:
Extracts of some Paras of Supreme Court order dated 7.5.2014 in SLP
(C) No.11686 of 2007:
Para 77.

We, therefore, hold that AWBI is right in its stand that

Jallikattu, Bullock-cart Race and such events per se violate Sections 3,


11(1)(a) and 11(1)(m)(ii) of PCA Act and hence we uphold the notification
dated 11.7.2011 issued by the Central Government, consequently, Bulls
cannot be used as performing animals, either for the Jallikattu events or
Bullock-cart Races in the State of Tamil Nadu, Maharashtra or elsewhere
in the country. We, therefore, make the following declarations and
directions:
(1) We declare that the rights guaranteed to the Bulls under Sections 3
and 11 of PCA Act read with Articles 51A(g) & (h) are cannot be taken
away or curtailed, except under Sections 11(3) and 28 of PCA Act.
(2) We declare that the five freedoms, referred to earlier be read into
Sections 3 and 11 of PCA Act, be protected and safeguarded by the States,
Central Government, Union Territories (in short Governments), MoEF
and AWBI.
(3) AWBI and Governments are directed to take appropriate steps to see
that the persons-in-charge or care of animals, take reasonable measures to
ensure the well-being of animals.
(4) AWBI and Governments are directed to take steps to prevent the
infliction of unnecessary pain or suffering on the animals, since their
rights have been statutorily protected under Sections 3 and 11 of PCA Act.
(5) AWBI is also directed to ensure that the provisions of Section
11(1)(m)(ii) scrupulously followed, meaning thereby, that the person-in-

charge or care of the animal shall not incite any animal to fight against a
human being or another animal.
(6) AWBI and the Governments would also see that even in cases where
Section 11(3) is involved, the animals be not put to unnecessary pain and
suffering and adequate and scientific methods be adopted to achieve the
same.
(7) AWBI and the Governments should take steps to impart education in
relation to human treatment of animals in accordance with Section 9(k)
inculcating the spirit of Articles 51A(g) & (h) of the Constitution.
(8) Parliament is expected to make proper amendment of the PCA Act to
provide an effective deterrent to achieve the object and purpose of the Act
and for violation of Section 11, adequate penalties and punishments
should be imposed.
(9) Parliament, it is expected, would elevate rights of animals to that of
constitutional rights, as done by many of the countries around the world,
so as to protect their dignity and honour.
(10) The Governments would see that if the provisions of the PCA Act and
the declarations and the directions issued by this Court are not properly
and effectively complied with, disciplinary action be taken against the
erring officials so that the purpose and object of PCA Act could be
achieved.
(11) TNRJ Act is found repugnant to PCA Act, which is a welfare
legislation, hence held constitutionally void, being violative of Article
254(1) of the Constitution of India.
(12) AWBI is directed to take effective and speedy steps to implement the
provisions of PCA Act in consultation with SPCA and make periodical
reports to the Governments and if any violation is noticed, the
Governments should take steps to remedy the same, including appropriate
follow-up action.
8. Infirmaries are also not functioning, which are necessary, as per section
35 of the Prevention of Cruelty to Animals Act, 1960 / animal species
wise feeding charges are also not fixed by the Animal Husbandry
Department.
9. Animal Welfare Board of Haryana along with Gau Seva Ayog have
been notified, with the similar animal welfare motive, hence mechanism

may kindly be developed for fruitful coordination towards prevention of


cruelty to animals. It would also be pertinent to mention here that
AWBI appreciated the decision of this Committee, widely circulated all
over India and then Central Motor Vehicle Rules was amended, many
times declaration of cow progeny as state animal of Haryana, was
discussed and recommended by this committee, hence again I am
placing this agenda to declare COW as state animals of Haryana
without disturbing the status of black buck as it was done in Rajasthan
because Camel and Chinkara, both are state animals of Rajasthan,
similar practice can be adopted here in Haryana, when OX became
state animal of Bihar then why not COW in Haryana?, where Gauvansh
Sanrakshan and Gausamvardhan Act, 2015 enforced and under section
19 of this Act, Govt. of Haryana can make the rules, adopting COW as
state animal of Haryana.
10.Poultry birds may kindly be included in the state bye laws of the meat
shops and following legislations may kindly be implemented as per
letter and spirit:
# Food Safety and Standards Authority of India guidelines, rules and
regulations.
# Prevention of Cruelty to Animals Act, 1960.
# Haryana Panchyati Raj Act, 1994.
# Slaughter House Rules, 2001
# Cattle Transport Rules 1978 amended 2001 read with the Central
Motor Vehicle (Eleventh Amendment) Rules, 2015.
Section 94 of the Haryana Motor Vehicle Rules.
# Haryana Municipal Corporation Act, 1994 .
# Haryana Municipal (Regulation of sale of meat) Bye laws, 1976 (Policy
on Meat Shops defective).
# Haryana Municipal (Regulation of slaughter Houses) Bye laws, 1977.
# Gauvansh Sanrakshan and Gausamvardhan Act, 2015.
11.Child labour also found at slaughter houses cum meat shops but as per
Slaughter Houses Rules, 2001, age of child defined as 18 years, whereas
per law concerned, age defined as 14 years, hence Slaughter Houses
Rules, 2001 needs to be amended, as per Child Labour Act, so Honble

Supreme Court of India may kindly be intimated through Member


Convener.
12.Training Course on Good Governance to be held from 25.04.2016 to
29.04.2016 at ISTM, New Delhi, hence similar state level training
workshop may kindly be arranged, module attached for approval.
13.The Prohibition of Cow Slaughter Rules, 1972 re notified under
Gauvansh Sanrakshan and Gausamvardhan Act, 2015, under which
beef and beef products are accepted as diet on medical advice, FSSAI
asked me to approach ICAR for confirmation of medicinal values but as
per law existed Cow progeny cant be slaughtered then there are no
question of beef / beef products consumption, hence Committee may
kindly consider my concern about and recommend the suspension of
this Prohibition of Cow Slaughter Rules, 1972. I have moved CWP No.
200 of 2016, which was dismissed by the Honble Punjab and Haryana
High Court; hence I prepared Appeal before the Honble Supreme
Court of India.
14.Experimentation on animals also prohibited in India, even import of
cosmetics tested on animals are also banned then how we can offer cow
progeny for any experimentation under law?
15. Camels are being transported towards UP from Rajasthan via Haryana
for slaughtering purpose, whereas FSSAI disapproved camel meat for
human consumption but there are no legislations for camel
transportation, hence Committee may recommend introduction of
camel transportation rules and regulation, directing all District
Committee Chairmans cum Deputy Commissioners to issue preventive
orders on camel transportation in goods transport vehicles.
16. All Regional Transport Authorities, may kindly be directed to get
affidavit from the owners of the vehicles, while passing that they will not
carry animals, if carried then registration needs to be cancelled, keeping
in view the Central Motor Vehicle (Eleventh Amendment) Rules, 2015
read with Cattle Transport Rules, 1978 amended in 2001 and section 94
of the Haryana Motor Vehicle Rules.
17. Satakpuri based Slaughter House, complaints were investigated by the
SDO (AH) but Central Motor Vehicle (Eleventh Amendment) Rules,
2015 read with Cattle Transport Rules, 1978 amended in 2001 and

section 94 of the Haryana Motor Vehicle Rules were ignored /


overlooked and no CCTV coverage was checked by the investigating
team, likewise CCTV footage never monitored by the concerned SHOs
/ Secretaries of SPCAs, hence DDAH may kindly be directed, to ensure
each and every consignment of animals, entered in the Satakpuri
slaughter house and after confirmation of the pre transport permit
along with monitoring after CCTV footage at the front entry gate and
examining the health of animals then issue health certificate otherwise
concerned officials be hold responsible for any lapses, similar practices
are to be applied in the slaughter house of the Gitwako Farms India Pvt.
Ltd in Mewat along with rest of Slaughter Houses approved by the
APEDA and Pollution Control Board including Panchkula, Gurgaon
and Sonipat District based poultry birds slaughter houses.
18. All unlawful slaughter houses cum meat shops, where animals and
birds are being slaughtered be shut down / crack down at once, whereas
licensed meat shops also be directed, not to slaughter animal and birds
at their shop. It would also be pertinent to mention here that Hissar
slaughter house get all permission then why it was not yet functional,
like wise Rewari slaughter house needs to be shifted from present place
because this slaughter house along with Faridabad and Yamunanagar
slaughter houses are functioning illegally, violating Slaughter House
Rules, 2001. It has been observed that Rohtak, Sonipat, Palwal, Sirsa,
Gurgaon, Mewat, Ambala and Karnal Police failed to lodge FIR against
unlawful slaughter houses, even complaints were given to them, hence
NOTICE through Advertisement in leading News papers may kindly be
given for awareness.
It is further submitted that I have faced defamatory and non cooperative
behavior from then Commissioner at Ambala Sh. Shakti Singh, during
conducting training, as approved by this Committee, hence Sh. Shakti Singh,
HCS may kindly be asked for non compliance of observations and
recommendations submitted before him, neither tenancy of unlawful
slaughter houses cum meat shops canceled, offenders were not booked,
unlawful encroachments were not removed even front gate of the Ambala City
office, similar behavior was faced while meeting with then Commissioner,

Gurgaon Municipal Corporation, concerned Govt. official Sh. Vikas Gupta,


IAS, now working as Director, Urban and Local Bodies, Haryana, hence he
may be directed to change his mindset, while dealing with non official
members.
If Committee feels and appreciate my tireless services for cause without any
extra financial gain and benefit then I can move further otherwise I may
kindly be allowed to move resignation from this committee because I am not
satisfied with the functioning of field functionaries, if Committee needs my
services then I can give full time as Consultant to stream line the process all
over Haryana, without any financial gain and profit, as missionaries for
animal rights and their welfare.
At last I beg unconditional apology from all members of this house, if any my
action, dedicated efforts towards cause of animal rights and their welfare,
hurt their feelings, while performing my duties and functions, as defined
under article 51 A (g) of Indian Constitution.

Proof of burden on the accused instead of prosecution and pre transport permit be
mandatory, as required under section 96 of the Cattle Transport Rules, 1978
amended in 2001.
Cow progeny export from Haryana be prohibited.
Section 3 of the Prevention of Cruelty to Animals Act, 1960 be strictly followed by
the custodian of cow progeny, if failed then this offense be cognizable and non
bailable with strong punishments in legal terms.
Cow progeny be declared as State animals of Haryana, in domestic animal category,
where as Govt. of Bihar adopted ox as state animal.
Pension for old, unproductive and disabled cow progeny be introduced.
Feeding, treatment, care and shelter charges be framed, as required under section
35 of the Prevention of Cruelty to animals Act, 1960.
Male calves of cow progeny needs protection and their services can be utilized for
agriculture, manufacturing of panchgavya, vermi compost, bio-gas etc.
All offenses against the Prevention of Cruelty to Animals Act, 1960 be cognizable,
non bailable with strong punishments, in legal terms, it is further requested to
introduce Haryana State Animal Welfare Act, 2014.
The Prevention of Cruelty to Animals (Establishment and Regulation of Societies
for Prevention of Cruelty to Animals) Rules, 2001 be implemented, State and
District level units be notified.
Infirmaries be functional, to keep cow progeny during court trails, which are
required under section 35 of the Prevention of Cruelty to Animals Act, 1960.
All offenses against the Prevention of Cruelty to Animals (Transport of Animals on
Foot) Rules, 2001 be cognizable, non bailable in legal terms along with strong
punishments.
The Prevention of Cruelty to Animals (Registration of Cattle Premises) Rules, 1978,
The Transport of Animals Rules, 1978, The Prevention of Cruelty to Draught and
Pack Animals Rules, 1965, amended 1968 and The Prevention of Cruelty to Animals
(Licensing of Farriers) Rules, 1965 also needs amendment.
Animal rights and their welfare subject be introduced in all Educational
Institutions, slaughtered animal skin and leather be prohibited.
Animal abuser be directed not to possess the custody of animals during court trials,
if convicted then permanently debar the possession of animals till the convicted
person last breath.
Bans the import of the machines that are used for the slaughtering of animals /
cows? In fact the BJP government has increased the subsidy on the import of these
equipments from 6% to 10%.
Implement the National Cattle Commission Report, 2002.

Implement the recommendations of the Rajya Sabha Committee on Petitions about


ban on meat export from India.

Ministry of Road Transport and Highways introduce draft rules for livestock
transportation for public comments, OIPA - Indian People for Animals along with
Animal Welfare Party suggestions:
1. All crime against animals should be cognizable and non bailable in legal terms.
2.
Special fast track courts be introduce to try and decide, the crime against animals,
under time frame policy.
3.
No appeal, should lie against convictions.
4.
Camel and Elephant transportation also covered under these draft rules.
5.
Animal can not be treated as goods, they can't travel by weight, because they can
shift as per their shape and size.
6.
Vehicle be confiscated for second offense against animals and registration be
cancelled.
7.
Vehicle owner also be booked and arrested, in crime against animals.

Present draft rule is an eye wash, nothing new in it because IS:14904:2007 and
IS:5238:2001 with IS:5236:1982 already existed and ineffective in India because,
neither vehicle manufacturing companies providing said ISI specified vehicles in
open market nor passed by the Competent Authorities and animals are being
shifted in goods transport vehicles, without ISI specifications, hence non ISI vehicles
be prohibited to carry animals.

Chandigarh March 16 Haryana Government has removed Naresh Kadian, a non-official


member of State Committee for Slaughter Houses.
While stating this here today Haryana Urban Local Bodies Minister, Mrs. Kavita
Jain said that the Chief Minister Mr. Manohar Lal has approved his removal from the
committee, adding that Naresh Kadian was an employee of Haryana Khadi and Village
Industries Board from April 15, 1984 to August 7, 2014 but he never brought this fact to
the notice of the government. Also, he did not seek any approval from his office for
nomination as non-official member of the committee.
She said that Khadi and Village Industries Board revealed that his service record was
very poor and he was charge sheeted eight times, suspended three times and twice
remained on willful absence. An FIR was also registered against him by the State Vigilance
Bureau, Gurgaon which is still pending. He misbehaved with the Commissioner, Municipal
Corporation, Gurgaon who also requested government to initiate proceedings against him,
she added.

Spoken with Minister concerned today on March 17, 2016 but she refused to
confirm said statements, on her behalf, issued by the DPR, Haryana.

Please find orders passed by the Supreme Court of India in CWP No. 88 of
2016: (10). The Governments would see that if the provisions of the PCA Act
and the declarations and the directions issued by this Court are not properly
and effectively complied with, disciplinary action be taken against the
erring officials so that the purpose and object of PCA Act could be achieved.
Shri Vikas Gupta, IAS had been Commissioner, Gurgaon Municipal Corporation
but he failed to perform his official duties as defined under Haryana
Municipal Corporation Act, 1994, neither he prepared the complete list of
unlawful slaughter houses and meat shops, besides it he called tenders for
establishment of new slaughter houses without approval of State Committee for
Slaughter Houses, when I approached him not to do so and place the matter
before District Committee then he misbehaved with me, likewise his proposal
was to import equipment's for slaughter house, ignoring make in India vision
of Prime Minister of India, we have strongly protested Vikas Gupta wrong,
biased and unlawful acts, keeping in view the demand of meat consumption
along with the census of animals to be offered for slaughter, at last
proposal was turn down due to non feasibility of proposal, hence Vikas Gupta
misused the public money without applying his mind, besides it he failed to
issue license to meat traders as per legal provisions, I have lodged many
FIR's intimating the involvement of all Local Bodies officials including
Vikas Gupta, now he is posted as Director, Urban and Local Bodies, Haryana
but he never obeyed the directions issued in CWP No. 309 of 2003 read with
attached orders. Now he may be submitting his self appraisal for the year
2015-16, hence adverse remarks may kindly be recorded in his ACR and
vigilance inquiry may kindly be ordered for Vikas Gupta tenure as
Commissioner, Gurgaon Municipal Corporation, besides it his biased and
unlawful action also needs to be investigated, why he mishandled my
resignation dated 19-2-2016 from the Membership of State Committee for
Slaughter Houses, Haryana and prepared false and baseless proposal for my
removal before the Chief Minister, concealing actual facts and figure,
defamatory press release was also issued on March 16, 2016 by the DPR and
Vikas Gupta is responsible along with Khadi Board Raj Krishan Sharma, both
lodge false and bogus complaint against me for no reasons.
