CHAPTER I
INTRODUCTION
A criminal record or police record is a record of a person's criminal history,
generally used by potential employers, lenders etc. to assess his or her trustworthiness.
The information included in a criminal record and the existence of a criminal record
varies between countries and even between jurisdictions within a country. In most cases
it lists all non-expunged criminal offences and may also include traffic offences such as
speeding and drunk-driving.
The Police Criminal Record System (PCRS) is a computerized system that
allows countries to access and exchange information regarding citizens, criminal
convictions in an efficient way. It was implemented in April 2012.
In that criminal case records and Strafregisterbescheinigung (criminal record
certificate) are maintained by the Register Division (Strafregisteramt) of Federal
Police Bureau Vienna (Bundespolizeidirektion Wien). In order to access a criminal
record in a person must complete a form with relevant identification and pay a fee (in
July 2014, currently 28.60 Euro, or 16.40 Euro if it is for the purposes of employment).
Requests for a criminal record certificate can be taken to Police stations and will be
processed and provided to the applicant immediately, or a person can request for a
hard-copy to be posted to an address .A request for a criminal record certificate can
come in two forms restricted and unrestricted disclosure. An application at the request
of a future employer will be issued a restricted disclosure, which only contains
unexpanded convictions and may not include less serious convictions. An unrestricted
disclosure certificate is exclusively for specific state agencies (for example, firearms
licensing bodies, military and law enforcement agencies), and, even then, is only issued
in specific circumstances. This type of criminal record certificate contains details of all
convictions. All criminal offences are recorded on the Criminal Register. Convictions are
removed from the Criminal Register upon expiry of the penalty, which generally occurs

when the penalty ends, but can extend to up fifteen years after the penalty has been
completed. The only exception is life sentences which are not removed from the
Criminal Register.
In Old System, they only use hand written to record some files for criminal case,
therefore it is too and slow our court processes are for victims,
In this New System, the police do not have to fulfill your request until they have received
any information they reasonably need to identify you and find the information you want.
The police application forms will explain what details they will need to find the
information you have requested, and what proof of ID they will need to see. For
example, they may ask you when you have been in contact with the police and why,
using the form will help the police to find all your information and may therefore speed
up your request.

DEFINITION OF TERMS
The violation of state and federal laws or the violation of individuals' constitutional rights
by police officers; also when policecommit crimes for personal gain.
Police misconduct and corruption are abuses of police authority. Sometimes used interc
hangeably, the terms refer to a widerange of procedural, criminal, and civil violations. Mi
sconduct is the broadest category. Misconduct is "procedural" when itrefers to police wh
o violate police department rules and regulations; "criminal" when it refers to police who
violate state andfederal laws; "unconstitutional" when it refers to police who violate a citi
zen's CivilRights; or any combination thereof.Common forms of misconduct are excessi
ve use of physical or DeadlyForce, discriminatory arrest, physical or verbalharassment,
and selective enforcement of the law.
Police corruption is the abuse of police authority for personal gain. Corruption may invol
ve profit or another type of materialbenefit gained illegally as a consequence of the offic
er's authority. Typical forms of corruption include Bribery, Extortion,receiving or fencing
stolen goods, and selling drugs. The term also refers to patterns of misconduct within a
given policedepartment or special unit, particularly where offenses are repeated with th
e acquiescence of superiors or through otherongoing failure to correct them

related to our topic about police crime record. To put our inspection into a wider context,
we commissioned a review of the literature on the integrity of police-recorded crime
data. The review, completed by Ms Patricia Mayhew 25, formerly of the Home Office
and currently a member of CSAC, assesses what literature is available, its quality and
its main findings. The primary focus is on academic literature relating to England and
Wales. It has, however, also drawn on some material relating to other countries, and
from some writers who would not ordinarily be regarded as academics.

RELATED STUDY
A criminal record is the formal record of offences that youve been convicted of
because youve either pleaded guilty or been found guilty. If youve been found not
guilty, it will not show up in your record. If youve been convicted in more than one state,
you may have more than one recordone in each state. Generally, police will not
release your criminal record without your consent, but there are exceptions, including
requests from other police forces and courts. You might need a copy of your criminal
record to apply for a job, work as a volunteer, work with children, apply for insurance or
get an overseas visa. A criminal court will review your record when deciding an
appropriate penalty for an offence or before granting bail.
If youre found guilty or plead guilty to an offence, the magistrate may decide not
to record a conviction. In this case, you generally wont have a criminal record but there
are exceptions so its best to check with the magistrate. When you answer questions
about your criminal history, ensure you fully understand the question. You may be asked
if youve been charged with breaking the law or found guilty, which is different from
whether you have a recorded conviction. Some job applications require you to disclose
whether youve been found guilty or pleaded guilty in court, such as when you apply for
a blue card to work with children.
Criminal records may also be covered by the Spent Convictions Scheme. This
means in some situations, you dont have to disclose old minor convictions after a
certain amount of time has passed. The scheme also protects your criminal record from
being used and disclosed in an unauthorized way. It covers convictions for minor
federal, state and foreign offences, with protection depending on the type of offence.
The scheme also covers pardons and quashed convictions. Some offences are
excluded from the scheme, but they are very limited.

- The main source of data on our study was from the police station that needs

our system. To make their record clean, faster than hand writing system and be safe
because it automatically save from the main folder.
