SERVICE LEVEL AGREEMENT

Arrangements will be made to discuss a further contract to apply from 1st April 2016 during the financial
year 2015/16.

Background
For Governing Bodies to function effectively and to fulfill the increasingly complex range of
responsibilities that they must discharge, it is vital to ensure that the Governing Body knows that the
schools physical assets, its staff and pupils have adequate insurance cover.
Over many years there has been a successful working relationship between Insurance Services and
schools in the delivery of an effective high quality insurance service. A combination of economies of
scale and regularly seeking competitive tenders for external insurance cover means that an extremely
cost effective insurance service can be offered to schools.

Details of services to be provided


Insurance Services (the Service Provider) provides a comprehensive and professional insurance service
for the whole of the local authority, including schools. Insurance cover is either obtained externally from
insurance companies or is provided under self-insurance arrangements operated by the Council. All
insurance claims are settled on a strict legal liability basis by the Service Provider in accordance with the
specified perils covered under this agreement or by external loss adjusters acting on behalf of the
Councils insurers or the Service Provider.
Insurance Services will arrange and maintain appropriate insurance cover for assets and other
appropriate risks as outlined below and to keep records of claims for each policy.
Property Insurance - Fire and specified additional perils (All Buildings and Contents) including
increased costs of working. Subject to an excess of 500 each incident
Employers Liability.

Public Liability, including Officials Indemnity.
Libel and Slander and Land Charges.
Professional Negligence.
Motor Vehicle Insurance - School Minibus. Subject to an excess of 250 each incident
Fidelity Guarantee
Engineering Insurance - Lifts, boilers and pressure vessels.
Pecuniary Insurances Money (as defined in the insurance policy).
Personal Accident - Work Experience; Teachers curricular and out of School Activities; Pupils and
Governors.
Travel Insurance for UK and overseas school trips
Provide advice, as requested, at cluster groups on insurance arrangements and claims matters
Provide to individual schools advice on all aspects of insurance related issues.
To process claims received from the client within 14 days, providing that full information is detailed on
the appropriate claim form.
To co-ordinate non-injury insurance claims submitted by clients including negotiating with loss
adjusters to achieve fair claims settlements and to assist in the recovery of uninsured losses against
negligent parties where possible.
On public liability personal injury claims to provide investigation services and support to the school
from accident investigation throughout the life cycle of the claim including support at court if the case is
heard at trial.
To settle all liability claims on a strict legal liability basis.
The public liability, officials indemnity, libel and slander and personal accident insurances have all been
extended to apply to Governors, including the Governors of Voluntary Aided schools.
Separate additional insurance cover can be obtained for no additional administrative charge, but the
school will need to meet the costs of the additional premiums
Schools that convert to academies will become responsible for ensuring they set up their own insurance
programme and this agreement will cease.
The excess in respect of property damage, theft etc will increase to 500 each incident from 01/04/15.
The current excess (200) has been maintained for several years but that position is no longer
supportable without an increase in premiums. As an overall increase would penalise those schools with
claim free records, an increase in excess is the fairest alteration to the cover provided.

Service standards and quality


The Service Provider will maintain a full service during normal office working hours, including during
school holiday periods. Any major incidents that occur outside of normal working hours should be
reported to Insurance Services at the first opportunity.
All claims received from the Client will be dealt with promptly. The Service Provider undertakes to
comply with the timescales applicable to the class of claim including the timescales set by the Ministry
of Justice under the Protocol for Low Value Personal Injury Claims submitted through the Claims Portal.
The Service Provider undertakes to discuss service level provision with the Client as required.
The Service Provider also undertakes to review the quality and nature of the services provided for the
Client as requested by the Client. The Service Provider further undertakes to provide all necessary
information to the Client to support the basis of the charge.

Responsibilities
An all-inclusive insurance package will be provided en-block to each school. Any school effecting
separate insurance arrangements must do so en-block and this agreement will then cease to have
effect. These alternative insurance policies must be examined by the Authoritys Insurance Manager and
an appropriate charge may be made for this service. Inadequate insurance cover must be remedied
immediately.
The Client will not enter into any correspondence with any claimant or their agent direct after a claim
has been submitted to the Service Provider unless specific permission is granted by the Service Provider.
The Service Provider will liaise with any claimant, claimants representative, Insurers and the Client as to
any further information they require.
On discovery of any event which may give rise to a claim, the Client will report the event by telephone,
email or in writing to Insurance Services as soon as possible.
On receipt of any correspondence indicating that a personal injury claim is likely to be made the Client
must e-mail the correspondence immediately to the Service Provider the same day to ensure the Service
Provider can comply with the legal requirement to acknowledge receipt of the claim within 24 hours.
On non-personal injury claims the Client must also provide a completed claim form to Insurance Services
within 14 days of the incident. In the case of liability claims received directly by the Client, any
correspondence received must be forwarded immediately and unacknowledged to Insurance Services.
The Client is not permitted to authorize any repairs following an insured occurrence without permission
from the Service Provider, except in cases of emergency. In the case of suspected or confirmed arson, all
occurrences must be reported to Insurance Services as soon as possible following discovery.
The Client must comply with all reasonable requests for information from the Service Provider in a
timely manner
The Client will report any changes in risk that may affect the insurance arrangements to the Insurance
Manager.
The Service Providers staff will carry appropriate identification when visiting the Client and should be
given access to all relevant documentation and information on request to enable the service
specification to be provided as agreed.

Charges
The basis of charge has changed from previous years in that there are no optional covers the insurance
provided to each school will include all the insurance cover previously described as Prime or Optional.
Charges to individual schools will be now be based on a combination of
a) Property Premium - based on the reinstatement value of their buildings and contents
b) Pupil Premium - based on a rate applicable to pupil numbers
c) Premium for any motor vehicles
and will reflect the risk presented by each school
The charge for each school in 2015/16 will be no greater than the charge made on the previous basis for
2014/15 (assuming pupil numbers are the same) although cover which may not have been selected
previously is now automatically included providing additional benefit.
The fee for Smartwater is included in the above charges.

Method of Payment
The Client will be invoiced after the 1st September 2015.
