S.4901: Scope and application of chapter

No vehicle, combination, or load exceeding size or weight limitations may be operated on any highway.

Unless in possession of a permit.

S.4902: Restrictions on use of highways and bridges

The state or local authorities may restrict access based on weight or size because:
o
The highway or bridge may be damaged
o
Hazardous traffic conditions exist

Signs will be erected within 25 feet of each end of a bridge or portion of highway
S.4903: Securing loads in vehicles

In general, all loads must be fastened or secured to prevent leaking, detachment, etc.

Loads of Logs
o
Must be equipped with vertical stakes at least as high as the load.
o
Loads greater than 6 feet in length must be secured by 3 binders.
o
Loads 6 feet or less in length must be secured by 2 binders.

Loose Garbage
o
Must have 4 solid sides.
o
All garbage must be removed at disposal site.
o
No vehicle used to transport garbage can be used to transport food.

Baled Garbage
o
No bales shall be uncovered
S.4904: Limits on number of towed vehicles

No motor vehicle may tow more than 1 other vehicle.

Farm tractors may tow 2 vehicles.

Saddle-mount operations: 3 trucks not longer than 75 feet total length.

A dolly not exceeding 10 feet may be towed by a motor vehicle.


S.4905: Safety requirements for towed vehicles

Connection between vehicle and towed vehicle shall be of sufficient strength.

Distance between vehicles shall not exceed 15 feet.

If distance exceeds 5 feet:


o

Red flags 12 inches square shall be displayed on connection

Red light will be used during hours of darkness.

Wheels of trailer may not deflect more than 6 inches.

2 safety chains of equal length shall be crossed under any ball-and-socket type hitch or pintle hook without a locking device.

If any of the lighting equipment on the rear of the vehicle is obstructed, then such equipment must be displayed on the rear of the trailer.
o

Exception: (Commercial) Implements of husbandry operated between sunrise/sunset.

S.4906: Fire Apparatus This chapter does not apply to fire apparatus.
S.4907: Penalties

General fine for violations of this chapter = $300

Violations of permits = $500

Expired, void, or invalidated permits = $1000

S.4909: Transporting foodstuffs in vehicles used to transport waste

A person commits a violation of this section if:


o

Transports food in a vehicle used to transport waste.

Accepts food transported in a vehicle used to transport waste.

Penalty:

1st offense = $1000 - $10,000

Subsequent = $5000 - $25,000

Any vehicle used shall be forfeited

Owner of vehicle must pay for proper disposal of waste left in vehicle

S.4921: Width of vehicles

Total width (including load) not to exceed 8 feet.

Implement of husbandry or vehicle used for highly perishable crops:

14 feet 6 inches

Sunset to sunrise

May 20 to October 15

Not on freeways

Mirrors may extend on each side a maximum of 6 inches.

S.4922: Height of vehicles

Height (including load) not to exceed 13 feet six inches.

S.4923: Length of vehicles

Length (including load and bumpers) not to exceed 40 feet.

A combination transporting nondivisible cargo may not exceed 70 feet.

S.4924: Limitations on length of projecting loads

No load shall extend beyond 3 feet to the front.

No load shall extend beyond 6 feet to the rear.


o

Any load over 4 feet to the rear shall display 12-inch red flags at the end of the load.

A red light shall be used during hours of darkness.

S.4925: Width of projecting loads on passenger vehicles

No load may extend beyond the left side of the vehicle.

No load may extend more than 12 inches beyond the right side of the vehicle.

Exception: Emergency vehicles

S.4941: Maximum gross weight of vehicles

No vehicle/combination shall have a gross weight exceeding 80,000 pounds.


o

Remember: Always cite under 4941(a)

S.4942: Registered gross weight

No vehicle/combination/trailer shall have a gross weight exceeding the registered gross weight.

S.4945: Penalties

Set fine of $75

Additional fine of $75 for every 500 lbs. in excess of 3,000 lbs. over the maximum or registered gross weight.

If gross weight exceeds the applicable gross weight allowed under 4941(a) [refer to charts in 4941(b) and (c)] = fine is doubled.

Only 1 penalty shall be imposed.

S. 4962: Conditions of permits and security for damages

Every permit shall be carried in the towing vehicle and shall be open to inspection by any police officer.

Penalty

Any permit that is altered, forged, or counterfeited = $5000 fine

S.4973: Permits for movement of modular housing unit

Permit issued for any housing unit that exceeds 14 feet in body width, but does not exceed 16 feet in width.

Must be escorted by 2 pilot cars one leading, one following

Shall only be moved:


o

9AM Sunset: Mon-Thurs

9AM Noon: Friday

S.4981: Weighing and measurement of vehicles

Any police officer has the authority to require a vehicle to be driven to stationary scales to be weighed within 2 miles.

Portable scales must be recalibrated every 90 days.

S.4982: Reducing or readjusting loads of vehicles

The driver of a vehicle with a size or weight violation shall be required to reduce, reposition, or readjust his load so as not to exceed limitations
before continuing travel.

The operator shall have 4 hours to adjust an axle weight violation in order to avoid prosecution.
