PALAWAN STATE UNIVERSITYSAN VICENTE CAMPUS
STUDENT GOVERNMENT
ORGANIZATION

PREAMBLE

We, the college students of Palawan State University San Vicente Campus,
imploring the aid of Almighty God, in order to establish a government, foster bonds
of affection, respect and unity, uphold our ideals and commitment, instill with the
students the values of service, integrity and equality, develop student leadership
and effectively govern all members in the organization, do hereby ordain and
promulgate this Constitution and By-Laws.
Article I
NAME AND DOMICILE
Section 1.
This organization shall be known as the Palawan State University San
Vicente Campus Student Government Organization, and abbreviated as PSU-SVC
SGO.
Section 2.
The official address of PSU-SVC SGO shall be at Palawan State
University, San Vicente Campus, San Vicente, Palawan.
Article II
DECLARATION OF PRINCIPLE
Section 1.
The PSU-SVC SGO shall uphold the Constitution and shall adhere to the
guiding principles of service, integrity, loyalty, freedom, cooperation, peace and
equality for the attainment of its objectives.
Section 2.
The PSU-SVC SGO shall assist in developing camaraderie among the
students and shall uphold their welfare.
Section 3.
The PSU-SVC SGO shall interact with other organizations recognized by
the Student Affairs Office for the betterment of the student body.
Section 4.
The PSU-SVC SGO shall see to it that the leadership potential of every
member is developed.
Section 5.
The PSU-SV SGO shall ensure the safety and well being of its members.
Article III
MEMBERSHIP
Section 1.
All bona fide College students shall automatically be members of this
organization.
Section 2.
Every member shall be required to pay a membership fee of P250.00
every semester.
Article IV
BILL OF RIGHTS
Section 1.
Every member of this organization shall have the right to enjoy the
freedom of speech, of expression, or of the press.
Section 2.
Every member shall have the right to peaceably assemble and petition
the PSU-SVC SGO for redress of grievances.
Section 3.
Every member shall have the right to information on matters of the
students concern and access to official records, documents, books and similar
things of public character pertaining to decisions or transactions of PSU-SVC SGO.
Section 4.
Every member shall have the right against the imposition of excessive
fines, fees, and contributions.
Section 5.
No member shall be subjected to disciplinary action or suspension
without due process of law.
Article V

DUTIES AND OBLIGATIONS

Section 1.
Every member shall uphold the Constitution, aims and principles of
the PSU-SVC SGO.
Section 2.
Every member shall cooperate with the duly appointed and elected
officers of the PSU-SVC SGO for the attainment, development and preservation of a
just and orderly student government.
Section 3.
Every member shall report to the body any relevant information
affecting the integrity and reputation of the organization.
Article VI
SUFFRAGE
Section 1.
Suffrage may be exercised by all bona fide college students of PSU.
Section 2.
The Commission on Students Elections (COMSELEC) shall provide a
system for securing the secrecy and sanctity of the ballots.
Article VII
THE LEGISLATIVE DEPARTMENT
Section 1.
The legislative power shall be vested in the Senate.
Section 2.
The Senate shall compose of twelve Senators who shall be elected at
large by the students of PSU San Vicente Campus.
Section 3.
No student shall be a Senator unless he has at least two consecutive
semesters residence in the University immediately preceding the election, with at
least fifteen units load and no failing grade in any subject taken during the
preceding semesters.
Section 4.
The term of office of the Senators shall be one year and shall
commence after the proclamation.
Section 5.
The Senate shall elect its President and Pro Tempore by a majority vote
of all its members.
Section 6.
The Senate shall approve the proposed plans, programs, and project
proposals before they are referred to the Executive Department for implementation;
legislate laws, instructions or any important regulation that may be deemed
necessary to establish and maintain an orderly student government; appropriate
funds for activities concerning the interest of the student body and decide before
the duly constituted body contracts and financial agreements, investigations or
inquiries and other matters which may arise during their term of office and which
are related to the exercise of their function.
Section 7.
The Senate President shall preside over regular legislative meetings,
assume full responsibility for the maintenance of an orderly and active legislative,
head the Senate Committee on Inquiry which shall be responsible for the General
Assembly in case the President and Vice President are absent and shall assume the
full responsibility and function of the President and Vice President in case of
permanent vacancy in their offices or any circumstances rendering them incapable
of discharging their functions due to impeachment, permanent disqualification or
culpable violation of the Constitution.
Section 8.
The Senate Pro Tempore shall assist the Senate President in the
regulation of the legislative functions, preside over regular legislative assembly in
case of the absence of the Senate President and sign in behalf of the legislative
department any pertinent document, contract or other agreement when the Senate
President cannot otherwise do the said function due to valid reasons which will be
determined by the majority of the Senators present during the said meeting for the
said purpose.

Article VIII
THE EXECUTIVE DEPARTMENT
Section 1.
The executive power shall be vested in the President of the PSU- SVC
SGO. He may create special committee whose functions and duties will be specified.
Such committees may be terminated upon completion of the purposes for which
they were created.
Section 2.
No student may be elected President unless he has at least four
consecutive semesters residence in the University, at least fifteen units load and no
failing grade in any subject taken during the preceding semesters.
Section 3.
There shall be a Vice President who shall have the same qualifications
and term of office and be elected with and in the same manner as the President. He
may be removed from office in the same manner as the President. The Vice
President shall be the Head of the Oversight Committee that monitors the progress
of the PSU-SV SGO projects and activities. In case of permanent vacancy due to the
Presidents disqualification, removal from office, voluntary resignation or permanent
incapacity to discharge his functions, the Vice President shall assume the office of
the unexpired term of the President.
Section 4.
There shall be a Secretary who shall keep all the records of the
Organization and make the minutes and records available to members upon
request.
Section 5.
There shall be a Treasurer who shall collect and keep all funds of the
Organization, make a financial report at the end of every semester of his term of
office, sign all financial transactions prior to the submission of members upon
request and report all financial transactions of the Organization during the General
Assembly, regular and special meetings.
Section 6.
There shall be an Auditor who shall audit financial reports presented by
the Treasurer three days before the submission to the Organization and sign all
financial transactions made by the Organization.
Section 7.
There shall be a Business manager who shall supervise all the business
transactions made by the Organization and shall report all business transactions of
the Organization during the general assembly, regular and special meetings.
Section 8.
There shall be a Public relations officer who shall disseminate
information, announcements or any important messages from the Organization to
all student government officers and shall make formal correspondence with the
elected Department Officers in the Campus.

Article IX
THE JUDICIARY DEPARTMENT
Section 1.
The judicial power of the PSU-SVC SGO shall be vested in the judiciary.
Judicial power includes the duty of judiciary to see the actual controversies involving
rights which are equally demandable and enforceable, and to determine whether or
not there has been a grave abuse of discretion amounting to lack of or excess of
jurisdiction on the part of any branch or instrumentality of the PSU-SVC SGO.

Section 2.
The judiciary shall be composed of the Chief Justice who shall be a
PSU-SVC faculty member and six justices from each department who shall be
appointed by the President with the concurrence of the Senate.
Section 3.
No student shall be appointed member of the judiciary unless he is a
bona fide student of the PSU-SV, of good moral character and must me at least in
the junior or senior years.
Section 4.
The judiciary shall exercise original jurisdiction in all cases between
students of the University and in cases questioning the constitutionality of the acts
of the officers of PSU-SVC SGO. A two-thirds (2/3) vote of all its members shall be
necessary to declare and act unconstitutional.
Section 5.
No decision shall be rendered by the body without expressing therein
clearly and distinctly the facts and the law on which it is based.
Article X
A. COMMON PROVISION
Section 1.
The Constitutional Commission which shall be independent are the
Commission on Student Elections, Commission on Impeachment and Commission on
Audit.
B. THE COMMISSION ON STUDENT ELECTIONS
Section 1.
There shall be a Commission on Student Elections composed of a
Chairman who is a PSU faculty members, one student representative from each
department and one representative from the official University Organization at the
time of their appointment by the Dean of Student Affairs are bona fide student and
must not hold any elective or appointive position in the PSU-SV SGO which shall set
guidelines in the Constitution.
Section 2.
The commission on Student Elections shall exercise the following
powers and functions.
1. Enforce and administer all laws and regulations relative to the conduct of an
election, plebiscite, initiative, referendum and recall.
2. Decide, except those involving the right to vote all questions affecting
elections, including determination of the number and location of polling
places, appointment of election officials and inspectors.
3. Deputize the Naval Reserve Officers Training Corps (NROTC) for the exclusive
purpose of ensuring free orderly, honest, peaceful and credible elections.
4. Enforce effective measures to minimize election spending, including
limitation of places where propaganda materials shall be posted, and to
prevent and panelize all forms of election fraud, offenses, and malpractice
and nuisance candidates.
Section 3.
A free and open party system shall be allowed to evolve according to
the free choice of the students, subject to the provisions of the article.
Section 4.
Political parties shall not be represented in the COMSELEC. However,
they shall be entitled to appoint poll-watchers in accordance with the law.
Section 5.
Bona fide candidates for any office shall be free from any form of
harassment.
Section 6.
Funds, certified by the commission as necessary to defray the
expenses for holding regular and special elections, plebiscites, initiatives, referenda
and recalls shall be provided in the regular and special appropriation, and one
approved shall be released automatically upon certification by the chairman of the
commission.
C. THE COMMISSION ON IMPEACHMENT

Section 1.
There shall be a commission on impeachment composed of a Chairman
and six Commissioners who shall be a bona fide PSU Students duly appointed by the
Dean of Student Affairs.
Section 2.
The COI shall investigate and decide cases filed against any PSU-SVC
SGO officer.
Section 3.
Officers of the Supreme Council and lower council may be removed
from office in impeachment for inefficiency and negligence of duty, conviction of
culpable violation of the Constitution, misuse of the PSU-SVC SGO funds, abuse of
authority and other misbehavior.
Section 4.
A verified compliant for impeachment may be filed by any officer of the
Supreme Council and Lower Council or any student upon a resolution or
endorsement by any member thereof and referred to the Commission shall submit
to the Legislative Department within ten days from the receipt of such verified
complaint together with the corresponding resolution.
Section 5.
The decision of the COI shall be final and irrevocable.
D. THE COMMISSION ON AUDIT
Section 1.
There shall be a Commission on Audit (COA) composed of a Chairman
and two Commissioners who shall be bona fide students of PSU. The Chairman and
Commissioners shall be appointed by the President with the concurrence of the
Senate Committee on Appointments.
Section 2.
The COA shall have the power, authority and duty to examine, audit
and settle all accounts pertaining to receipts and expenditures or uses of funds by
the PSU-SVC SGO. It shall keep the general account of the PSU-SVC SGO and all
recognized organizations from the jurisdiction of the Commission on Audit.
Section 4.
All organizations are obliged to pass their financial statements duly
signed by the President, Treasurer and Auditor of such entity to the COA before the
end of each semester.
Article XI
ELECTIONS AND QUALIFICATIONS
Section 1.

The elective position for the SGO-SVC will be the following:

a. Executive Department
President
Vice President
Secretary
Treasurer
Auditor
P.R.O
Business Manager
b. The twelve (12) senators to compose the Legislative Department.
c. One representative, governor and vice-governor from each
department to seat embank as members of the executive department
Section 2.
Qualifications of Candidates
2.1 President:
a. Must be enrolled in the University prior to the conduct of elections.
b. Must have enrolled in the University for at least two (2) consecutive
semesters prior to the election without failing grade in the academic subjects and at
least a third year student.
c. Must be of good moral character.

d. Must have no pending cases concerning cases of immorality,

disturbance of peace, drug addiction, and frequent alcoholism and outside
political affiliation.
Note: Cases mentioned above must be proper beyond reasonable doubt at the
office of the COMSELEC.
2.2 Vice President, Secretary, Treasurer, Auditor, P.R.O., Business
Manager, Senators, Governor, Vice Governor and Representatives:
a. Must be enrolled in the University prior to the elections.
b. Must be of good moral character.
c. Must have no pending case as enumerated in Article XI Sec. 2.1(d)
d. In case of old students, they must possess no failing grades in the
previous semesters.
2.3 Supporting papers may be attached to the Certificate of Candidacy.
(Concerning all candidates)
a. Certification from the office of the Director that the student is
currently enrolled, with no failing grades in the previous semesters (in case of old
students).
b. Certification from the Guidance Councilor or Director as the case
may be that the student is of good moral character.
c. 2 pcs of 1x1 or 2x2 current ID picture.
2.4 For the newly established political party/lies which intent to
participate in the election; the following requirements should be accomplished for
the accreditation:
a. Constitution and By-Laws
b. Declaration of Principle and Objectives;
c. List of members; and
d. Programs of Government.
Section 3.
Campaign period and Election Materials.
A candidate may distribute leaflets, may put up campaign posters,
streamers, and the like on designated areas identified by the COMSELEC. However,
they may also use ribbons and name tags for identification purposes.
Designation area: Covered walk, Bulletin Boards near the Library.
The candidates may start campaigning room to room on the day prescribed
by the COMSELEC.
They should secure permit from the office of the Director to conduct room-toroom campaign on the day prescribed by the COMSELEC.
Prior to the conduct of the General Elections, a grand rally of all Political
parties shall be held as agreed upon by the representative of the parties concerned
with approval of the COMSELEC. The sequence of the rally shall be fixed by the
representatives of every political party to be submitted to the Office of the
COMSELEC.
Section 4.
No littering.
Candidates may use campaign materials as enumerated in Article Xviii
Sec 8 of the Constitution and By-Laws but to be removed after the election by the
party concern.
Section 5.
Voting Procedures.
5.1 The student voters shall present their school ID or registration form
of any personal ID to the election teller.
5.2 He/She signs his/her name in the official voters list before the
issuance of an official ballot.
5.3 The voter casts his vote in the election booth and drops the ballot
in the ballot box.

Section 6.

Counting of Ballots.
Immediately after the close of the voting, the COMSELEC, together with
the poll watchers of different political parties shall count the total number of votes
cast from the ballot box and count the total number of ballots in the ballot box if it
tallies with the official lists.
Section 7.
Proclamation of Winning Candidates.
The COMSELEC proclaims the winning candidates as soon as the
official result of the general elections has already been submitted to the office
concerned.
Section 8.
SGO elections shall be conducted every year on the third week of July.
Article XII
THE DEPARTMENT ORGANIZATION
A. DUTIES AND FUNCTIONS OF OFFICERS
Section 1.
The President of the PSU-SVC SGO shall exercise general supervision
over the Department Organizations and other students associations in the Campus.
Section 2.
The Department Organization and other organizations shall govern and
administer the activities of their respective colleges/departments upon
recommendations from the Office the PSU-SVC SGO.
Section 3.
The Department Organization shall be composed of officers elected by
the respective constituents of their departments.
Section 4.
Each department Organization shall have a power to create its own
source of revenues.
Section 5.
The term of office of elective Department Organization officials shall be
a period of one year and shall commence after the proclamation.
Section 6.
There shall be a President for each Department Organization who shall
exercise executive power. He shall preside over the Department Organization
meetings, sign and approve documents pertaining the organizations projects and
activities, supervise projects and activities of the department, create special
committees whose functions and duties will be specified, and which such
committees may be terminated upon completion of the purposes for which they are
created and represent his department in every general meeting of the PSU-SVC SGO
and other activities requiring his attendance.
Section 7.
There shall be Vice President who shall assume the office of the
unexpired term of the President in case of permanent vacancy arising due to the
Presidents disqualification, removal from the office, voluntary resignation or
permanent incapacity to discharge his functions.
Section 8.
There shall be a Secretary who shall keep all the records of his
department organization and make the minutes and records available to members
of his department upon request.
Section 9.
There shall be Treasurer who shall collect and keep all funds of the
department organization and make the minutes and records available to members
of his department upon request.
Section 10. There shall be an Auditor who shall audit the financial report presented
by the Treasurer at least three days before submission to the President.
Section 11. There shall be Business Manager who shall supervise al business
transactions made by the Department organization.
Section 12. There shall be a Public Relations Officer who shall disseminate
information, announcements or important messages from the Department
Organization to members of his department and make formal correspondence to the
Public Relations Officer of the PSU-SVC SGO.
B. REQUIREMENTS FOR RECOGNITION

Section 1.
Department organization shall be recognized for a period of one year
upon the submission of the following:
a. Complete and true copy of organizations constitution and by-laws, signed
by all its officers;
b. List of officers of the organization who are currently enrolled in the
university during their term of office; indicating their addresses and the
college to which they belong;
c. Certification from the registrar that all the members of the organization
are student of the University; and
d. Letter of acceptance by at least one (1) faculty adviser chosen by the
organization as the adviser.
Section 2.
Renewal of recognition shall be made on a yearly basis for this purpose
the Organization will be required to submit. In addition to the above requirements, a
list of activities in the previous semester or year, an accurate statements of its
finances for the same period, to be certified by its President and Treasurer.
Section 3.
A student organization which was found, after having the opportunity
to be heard, to have violated the rules and regulations of Palawan State University
or any of its units, may be denied recognition, refused extension of recognition,
have its recognition, cancelled, or any of its privileges curtailed.
C. CONDUCT OF FUND RAISING ACTIVITY
Section 1.
Any duly recognized student organization desiring to conduct a fund
raising activity should write a letter to the University President, through channels,
requesting for permission to conduct the fund raising activity. The letter must
include the following information:
a. Nature and purpose of the activity;
b. Date and venue;
c. Manner by which the funds raised shall be used;
d. Price/denomination per tickets
e. Financial estimated of the activity; and
f. Beneficiaries of the fund raising activity
Article XIII
FUNDS, FEES, SOURCES AND DISBURSEMENT
Section1.
Funds of PSU-SVC SGO shall come from the following:
a. Semestral membership fee
b. Fund raising activities sponsored by the PSU-SVC SGO
c. Fines imposed on absences during the activities of the University or of the
PSU-SVC SGO.
d. Donations
Section 2.
Funds shall be kept in the campus vault under the custody of the
campus disbursing officer and the local collecting officer.
Section 3.
The funds of PSU-SVC SGO can be taken out of the vault only by the
treasurer after having been duly approved by the PSU-SVC SGO President and a
majority of Senators in concordance with the local collecting officer and campus
disbursing officer.
Article XIV
GENERAL PROVISIONS
Section 1.
Section 2.

The official seal of the PSU-SVC SGO is ______________

The PSU-SVC SGO shall be the Supreme Organization of the campus.

Section 3.
There shall be a regular open forum between the PSU-SVC SGO
members and the campus administrators at the date, time and place decided by the
PSU-SVC SGO President and the student affairs coordinator.
Section4.
The PSU-SVC SGO shall have regular consultation with the campus
director at the date, time and place decided upon by both parties.
Section 5.
All elected PSU-SVC SGO Officers shall take oath of office and shall
defend his constitution.
Section 6.
All outgoing PSU-SVC SGO Officers shall be required to formally
turnover all records of the remaining funds and properties, duties and
responsibilities to the incoming PSU-SVC SGO officers on the oath taking
ceremonies.
Section 7.
All laws passed by the Senate shall take effect immediately upon
approval of the PSU-SVC SGO President unless otherwise provided.
Section 8.
All existing organizations in the campus and those that shall be
formed thereafter shall submit their constitution and by-laws and coordinate with
the PSU-SVC SGO for recognition, unit and harmonious relationship.
Section 9.
Funds raised for specific purposes shall not be diverted to other
projects unless otherwise approved by the PSU-SVC SGO Officers.
Section 10. The name of PSU-SVC SGO shall not be used for unjust, unlawful or
immoral ends.
Article XV
AMMENDMENTS OR REVISIONS
Section 1.
Any amendments to or revisions of this constitution maybe proposed
by:
1. The PSU-SVC SGO Senate up in a vote of two-thirds (2/3) of all its members;
or
2. A constitutional convention upon the PSU-SVC SGO may call by a vote of all
its members.
Section 2.
Amendments to this constitution may be otherwise directly proposed
by the students through an initiative upon a petition of at least twenty per centum
of the total members of the bona fide students of PSU of which every department
must be represented by at least five per centum of the bona college students
therein.
