CONDITIONS FOR ENTITLEMENT


Rendered at least 1 year of service
(service within 12 months, whether
continuous or broken, reckoned from the
date employee started working)

Service Incentive Leave is


convertible to cash.

Should be an SSS member employed at


the time of delivery or miscarriage; must
have given the required notification to SSS
through employer and must have paid at
least 3 monthly contributions within the 12
month period before date of contingency
Must be an employee at the time of
delivery; he is cohabiting with his spouse
at the time she gives birth or suffers
miscarriage; he has applied for paternity
leave with employer within reasonable
period of time; wife has given birth or
suffered miscarriage

Maternity benefit limited to


first 4 deliveries or
miscarriages.

has filed an application for special leave
within a reasonable period of time from
date of expected surgery; she has
undergone surgery through gynaecological
disorders.

The only requirement is a certification from


the barangay chairman, or barangay
councillor or prosecutor or the Clerk of
Court that an action relative to the matter is
pending.

Gynecological Disorders
disorders that would require
surgical procedures such as
but not limited to dilatation
and curettage and those
involving
the
female
reproductive organ such as
the vagina, cervix, uterus,
fallopian
tubes,
ovaries,
breasts, adnexa, and pelvic
floor as certified by a
competent physician.

Physical and/or mental incapacity of a
spouse certified by medical practitioner

Declaration of nullity or annulment of
marriage
Abandonment of spouse for at least 1 year
Unmarried father/mother who has preferred
to keep and rear his/her child/children
Any other person who solely provides
parental care and support to a child
Any family member who assumes the
responsibility of head of the family as a
result of death, abandonment,
disappearance, or prolonged absence of the
parents or solo parent

Shall not be convertible to

Parental leave of 7

service, whether continuous or broken; has
notified his/her employer that he/she will
avail of it within a reasonable period of
time; has presented to his/her employer a
Solo Parent ID which may be obtained
from DSWD office of the city or
municipality he/she resides

A change in the status or


circumstance of the parent
claiming the benefit such
that he/she is no longer
left alone with the
responsibility of
parenthood shall terminate
his/her eligibility for the
benefit
