5) Describe your impressions of the Counsel for the

defendant/Respondent his/her apprearance, demeanor,


advocacy skills, etc . Give specific example to support your
impression.

The Counsel for the respondent appearing before the judge during
our court visit was smartly dressed, looking very professional in line with
the dressing code in a court room. He looked confident to start submitting
his case. He spokes clearly and concisely when submitting his contentions.
He also respect the judge presiding as whenever the judge interfered him,
he will pause and listen to what the judge said and also he replied with I
understand , Yang Arif or Indeed, Yang Arif. He submit his ground politely
eventhough he sometimes stuttered a bit as he said I humbly request the
court to allow the accused to appeal. The counsels demeanor and
advocacy skills were fine. He tried to assist the judge and repeat his
points politely when he was asked to do so.
However , there are few things which we observed which slightly
changed our expectation towards the Counsel where he did not answer
the questions given by the court precisely. When the judge asked the
Counsel whether he was going to dismiss or to accept the previous
judgement , the Counsel began submitting irrelevant points instead of
answering the question given that the judge had to asked him the
question twice. Next , our expectation towards a lawyer while submitting
his case is he must have be well-prepared before submitting to the court
however the expectation faded as the Counsel did not prepare medical
evidence when he submitted that his client suffered from Irritable Bowel
Sydrome. The medical evidence is the most important document that the
lawyer may have succeed in his claim however he failed to present in
before the court. Furthermore , the counsel included both Bahasa Malaysia
and English language while submitting his case without asking the
permission from the court. He also laughed while trial to what the judge
said which we believe was quite inappropriate.
Above all , eventhough there are some things lacking we believe
that the Counsel had tried his best to appear polite and clear before the
judge while submitting his case. The Counsel did actually give some
relevant points which the court agreed and try to consider.

6 ) Describe any observations you made about the other


courtroom observers (eg. The public) and court personnel
(security, court reporter, clerk, etc)

There was no outsiders other than us during the trial , only the family of
the accused was there. They listen attentively during the trial. No one
make any unpleasant sound and movements. Next, the security during
the trial did went out from the court politely. He bowed before the judge
each time he goes out. The security did their job well-done when escorting
the accused in and out of the court.
Basically the courtroom observers and court personnel followed the
courtroom etiquette during the trial and there was no distraction made to
the court . The trial was smooth and end with a judgement by the judge
which followed the proper procedure of trial in court.
