newprogressreport
EPAissuedreportingonhowstatesaredoinginmeeting
theirChesapeakeBayWatershedcleanupmilestones.
ForPennsylvania,therewerenosurprisesitwasbad
news.
HalfofPennsylvaniaiswithintheChesapeakeBayWatersheddrainagearea.
Pennsylvaniadidnotmeetits2015goalfornitrogenandsedimentpollutionreduction
(althoughitdidforphosphorus)andwillnotmeetits2017goalsfornitrogenandphosphorus,
butwillmeetitsgoalforsediment.
EPAalreadyhasPennsylvaniaatsocalledbackstoplevelsforagriculturaland
urban/suburbanstormwatersectors.Thismeanstheyhavesubstantialconcernswith
Pennsylvaniasstrategytoimplementmeasurestoachievethegoalsanditmaytakefederal
actiontogetthestatebackontrack.
InitsevaluationFriday,EPAsaid
Pennsylvaniaslatestplan
forgettingitsChesapeake
Baycleanupprogrambackontrackdoesnotincludeanymilestonestoincreasethenumberof
agriculturalconservationpracticesonthegroundandnoadditionalrequestsformoreresources
tomakethathappen.
EPAspecificallyofferedPennsylvaniacontractorassistancetobuildthecapacityfor
developingManureManagementPlansandAgriculturalErosionandSedimentationPlansin
prioritywatershedsinsupportofthestatesefforts.
EPAsaiditwillalsobeconductingitsownassessments(meaninginspections)ofanimal
feedingoperationstodeterminewhetherthefarmsarecomplyingwithstateManureandErosion
andSedimentationPlanrequirements.
EPAsaiditmayalsoofferassistancetolocalinitiativesdesignedtoassistPennsylvania

inachievingitsnutrientandsedimentreductiongoals.
EPArecommended,PennsylvaniaandtheotherstatesintheSusquehannaRiver
Watershed,developastrategytoreducenutrientandsedimentloadsnow
comingthroughthe
ConowingoDam
asaresultofitsreservoirfillingupandlosingitstrappingcapacity.
AmongthespecificobligationsmissedortobecompletedbyPennsylvaniawere
Didnotcompletethedevelopmentandimplementationofitsfarmconservationtrackingand
reportingsystemin2015
Didnotincreaseimplementationofprioritypracticestoimprovewaterqualitysuchasgrass
buffersandnutrientmanagement
EPAexpectsPennsylvaniatodevelopalistofgeographicareaswiththegreatestnutrient
pollutantloadreductionpotentialinordertotargetfundingtothoseareas
Didnotincreaseimplementationofstormwatermanagementbestmanagementpracticesin
urbanareastoaddresstheloadreductionscurrentlycommittedto
EPAexpectsPennsylvaniatoincludeamilestonetodevelopatradingandoffsetpolicyfor
postconstructionstormwater

ChesapeakeBayFoundation
,said,WhilePennsylvaniaisontracktomeetits2017targetfor
reducingtheamountofsedimentdamagingourwaterways,ithasalongwaytogoifitisto
reducenitrogenandphosphoruspollution,mainlyfromagriculture.
PennsylvaniasrebootedstrategycanbeacatalystfortheCleanWaterBlueprintto
reducepollutiondamagingourriversandstreams,butwithoutthenecessaryfundingitwillnot
succeed.Sadly,itisstillunclearwhenorifthosevitalresourceswillbemadeavailable.
ItistimeforPennsylvaniatomakecleaningupourriversandstreamsapriority.Our
citizenshavearighttocleanwaterandasweapproachthecleanupmidpointof2017,itis
unacceptablethattheCommonwealthcontinuestolanguishinmeetingitsgoals.

HouseBill1391
(Everett)thatwouldhaverequiredoilandgascompaniestopayleaseholderstheminimum
royaltyamounttheyareowedbystatelaw.
Rep.GregVitali(DDelaware),MinorityChairoftheHouseEnvironmentalResources
andEnergyCommittee,offeredtwoamendments,theprimaryonetoeliminatetheprovision
makingDEPstartoveronsettingupdatedstandardsforconventionaldrillingoperations.The
amendmentwasdefeatedbyavoteof55to140.

offeredanamendmenttoshortenedthetimeforlegislativereviewofaproposedplantocomply
withtheEPACleanPowerClimatePlansayingtheexistingscheduleisentirelytoolong.The

FortheCleanPowerPlantohavemaximumclimateandeconomicbenefitfor
Pennsylvania,theDepartmentofEnvironmentalProtectionmustretaintheflexibilitytodevelop
athoughtfulplaninatimelyfashion,said

RegulatoryAffairsManagerfortheEnvironmentalDefenseFund.SenateBill1195needlessly
delaysandcomplicatesthisprocess,addinglayersoflegislativereviewtoanalreadyexhaustive
regulatoryprocess.
Pennsylvaniasenergycompaniesdeservetohavetheregulatorycertaintytomake
prudent,neartermdecisionsaboutpowersectorinvestmentsundertheCleanPowerPlan,butSB
1195jeopardizesthisopportunitybycreatingplanningdelaysthatwillhurt,ratherthanhelp,
Pennsylvania.
WestronglyurgetheHousetorejectthislegislativeredtape,andhopethatGovernor
WolfwillmakeitclearthatanylawthathamstringstheabilityofhisAdministrationtocarryout
executivefunctionsefficientlyandthoughtfully,willbevetoed.Thelongerthestatehastowait
tosubmitacustomizedplan,thelesstimePennsylvaniabusinesseshavetoadapttoitinaway
thatcanbestsecurejobsandprotectPennsylvaniasenvironment.

ThisfollowsseveralweeksofworkbetweentheWolfAdministrationandthelegislature
thatculminatedinabipartisanagreementthatwillmodernizeandstrengthenenvironmental
protectionsatoilandgassitesinPennsylvania.
TheOfficeoftheAttorneyGeneralwillnowreviewtheregulationsbeforetheyare
publishedasfinalinthePABulletin.

Thegovernoralsoannouncedthathisadministrationwillworkwiththelegislatureto
draftconventionalChapter78regulationstowhichallsidescanagree.
SenateBill279requiredtheDepartmentofEnvironmentalProtectiontostartitsprocess
overtoupdateconventionaldrillingregulations.
Iampleasedtohavereachedbipartisanagreementwiththelegislatureonthe
unconventionaloilandgasregulations,whichwillbetterprotectthehealthofourenvironment
andourresidents,saidGov.Wolf.Thesenewsafeguardsfurthermygoalofimprovingthe
protectionofwaterandpublicresources,aswellaspublichealthandsafety,andalsoaddress
landownerconcerns,enhancetransparency,andimprovedatamanagement.Theseregulations
havebeenunderdevelopmentformorethanfiveyears,throughthreeseparateadministrations
andhavebenefitedfromanunprecedentedprocessofengagementandpublicparticipation.I
wouldliketothankbothDemocratsandRepublicansforworkingtogetherwithme,andforthe
commitmentbothsidesshowedtoensuringourenvironmentandourpeoplearesafe.
Theconventionalandunconventionaldrillingregulationsaimedtoassuretheprotection
ofpublichealth,safety,andtheenvironment.

thefederalOfficeofSurfaceMiningReclamationandEnforcementattheU.S.Departmentof
theInterior,whodescribesthecomplexityofreclaimingabandonedcoalminesandpreventing
thepollutionofstreamsandwaterwaysfromminedischarges,ataskheestimateswillcostas
muchas$15billion.
ThenaroundtablediscussionpicksuponthistopicwithKurtKlapkowski,theDirector

heightened,"saidDunn."Thereisavitalconnectionamongtheriversandstreamsandarea
residentsandvisitors,andthesesojournsandotheractivitiesplannedbyriveradvocatescanonly
strengthenthosebonds."

CBFandthe
PAGrowingGreenerCoalition
launchedtheCleanWaterCountscampaign
in2014,urginglocalgovernmentsacrosstheCommonwealthtopassresolutionsandjoinin
callingonlegislatorsinHarrisburgtoinvestinlocalcleanwaterprogramsandpractices.
Carbonisthe25thcountytoadoptaCleanWaterCountsresolution,meaningtheeffort
nowrepresentsmorethanonethirdofPennsylvania'spopulation.
Theother24countiestosignonareBerks,Cameron,Centre,Cumberland,Dauphin,
Erie,Fayette,Franklin,Greene,Indiana,Jefferson,Luzerne,McKean,Montgomery,Montour,

Roughly
19,000milesofPennsylvaniawaters
arepolluted.Agricultureisthelargest
sourceofpollutiontotheCommonwealth'sstreamsandrivers.Thatpollutionoccurswhen
nitrogen,phosphorus,andsedimentrunofffarmfieldsintolocalwaterways.
AccordingtotheDepartmentofEnvironmentalProtection,thereareabout47milesof
pollutedwaterwaysinCarbonCounty40ofthosearedamagedbyacidminedrainage.
"Healthyfamilies,strongcommunitiesandathrivingPennsylvaniaeconomydependon
cleanwater,"saidHarryCampbell,CBF'sPennsylvaniaexecutivedirector."Weapplaudand

Billprogramshelpsfarmersandforestlandownersinstall
variousconservationpracticesthatresultinhealthiersoil,
cleanerair,moreabundantfishandwildlifehabitatand
cleanerwater.
SinceoverhalfofPennsylvanialieswithintheChesapeakeBayWatershed,farmersand
forestlandownersplayamajorroleinhelpingtocleanuptheBaybyinstallingwaterquality
conservationpracticesthatassistthePennsylvaniameetitsTotalMaximumDailyLoad(TMDL)
goalsinthewatershed.
Since2008,NRCShasprovided
morethan$268.5million
infinancialassistanceto
PennsylvaniafarmersandforestlandownersintheChesapeakeBayWatershedthroughanumber
ofFarmBillPrograms,includingtheEnvironmentalQualityIncentivesProgram(EQIP),

ChesapeakeBayWatershedInitiative(CBWI)programandConservationStewardshipProgram
(CStP),amongothers.
IntheBayWatershed,thesefundshavebeenutilizedprimarilyfornutrientreduction,
erosionandsedimentcontrol,streamcorridorprotection,andoveralllandscapehealth.On
average8085percentofPennsylvaniasfundsaredevotedtolivestockproducersandthose
croplandproducerswhoapplymanureoncropland.
From20082015,PANRCSappliednutrientmanagementtomorethan157,000acres
andinstalled759wastestoragefacilities,morethan6millionsquarefeetofheavyusearea
protection,andover3millionlinearfeetoffencetoimprovepastureandstreamconditions.
WhileNRCShasallocatedfundsthroughouttheWatershed,ithasalsotargetedmoniesin
severalkeywatershedswithinPennsylvaniasportionoftheBayWatershed,includingtheUpper
KishacoquillasandYellowCreeks.
Nearly$4millionhasbeentargetedtokeyhighprioritywatershedsandNationalQuality
Initiative(NWQI)areasthathavebeendeterminedbytheUSGeologicalSurveytohave
excessivenitrogen,sedimentandphosphorus.
Withinthesekeywatersheds,PANRCShasalsotargetedfundsusingaprecision
conservationefforttoinstallkeyconservationpractices,likebuffersandnutrientmanagement,
onfieldsthathavethehighestpercentageofleachingsoilsandphosphorusrunoff.
Underthe2008FarmBill,PANRCShasinvestedmorethan$9milliontofundabout
214additionalfulltimeemployeesthroughpartnershipagreements.
Theseemployeesprovidetechnicalassistancethroughthe
ChesapeakeBayFoundation
,
PheasantsForever,localResourceConservationandDevelopment(RC&D)Councilsand
ConservationDistricts.
Forexample,PANRCShassuppliedfundstosupportthepartnershipagreements

NRCScontinuesconservationeffortsfocusedonwaterqualitywithintheChesapeake
BayWatershedtodaythroughthe2014FarmBill.
UnderanewprogramcalledtheRegionalConservationPartnershipProgram(RCPP),
NRCScoinvestswithpartnersininnovative,workable,andcosteffectiveapproachestobenefit
farming,forestoperations,localeconomies,andthecommunitiesandresourcesinawatershedor
othergeographicarea.
In2015,PennsylvaniaNRCSreceivedfundingfortwoRCPPprojectsintheChesapeake
BayWatershed.Thetwoprojectsprovidemorethan$3millioninfinancialassistancethrough
EQIPandadditionaltechnicalassistanceforhighpriorityconservationpracticessuchasriparian

TheDepartmentofEnvironmentalProtectionTuesdayannouncedithasenteredintoaconsent
assessmentofacivilpenaltyintheamountof$42,666.77withCL&W,Inc.ofDunmore,
LackawannaCounty,forviolationsassociatedwithafueloilreleaseintotheLackawannaRiver
inJulyof2014.
Theleak,ataScrantonpropertyownedbythecompany,causedanundeterminedamount
offueltoentertheriverandcoattheriverbankandvegetationformorethanamiledownstream.
ThispenaltyaimstofurthertheeffortsbyDEPandlocalcitizensgroupstokeepthe
LackawannaRivercleanandhealthy,saidMikeBedrin,DirectorofDEPsNortheastRegional
OfficeinWilkesBarre.Companiesmustbeawareoftheirresponsibilitiestotheriver.
ThespillatthepropertyonNorthWashingtonAvenuegeneratedfromaninactive
508,000galloncapacityabovegroundstoragetankcontainingNo.6fueloil,whichatonetime
poweredonsiteboilersusedforsteamgenerationthroughoutthecitywhenthepropertywas
operatingasCommunityCentralEnergyCorporation.
ThepropertywaspurchasedbyCL&W,Inc.in1997.
DEPdeterminedapipingvalveatthebaseofthetankwasdamaged,whichreleasedfuel
intoanemergencycontainmentareaaroundthetank.
Theproductescapedthecontainmentareathroughundergroundsewerpipingandentered
thecombinedsewerandstormwatercollectionsystem.Heavyrainspushedthefuelthroughthe
systemwhereitdischargedtoboththesewagetreatmentplantandtheLackawannaRiver.
AsubsequentinvestigationbyaconsultanthiredbyCL&Wdeterminedthetankhad
eitherbeenvandalizedortamperedwithpriortotheleak.
CL&WtookactiontoaddressthecontaminationalongtheLackawannaRiverand
remediatecontaminationatthestoragetanklocation.Thefinalreportssubmittedtothe
departmenttodemonstratethecompletionoftheenvironmentalcleanupwereapprovedonMay
28,2015.
ThereleaseisaviolationofboththeCleanStreamsLawandStorageTankandSpill
PreventionAct.
ThecivilpenaltywillbedistributedbetweenDEPsCleanWaterFundandtheStorage
TankFundforprogramsresponsibleforreleasepreventionandenvironmentalcleanup.
Nearly$9,000ofthemoneyisbeingrecoupedbyDEPforemergencyresponsecosts

PennStateStudentSustainabilityAdvisoryCouncil
recentlypresented
15recommendations
aimedatadvancing
sustainabilityinitiativesaroundtheUniversitytomembers
ofPennStatesadministration.
Thecouncildevelopedtherecommendationsoverthecourse
ofthesemester,workingcloselywithrepresentativesfrom
variousPennStateunits,suchastheOfficeofPhysical
Plant,HousingandFoodServices,StudentAffairsand
TransportationServices.

Thisyear,recommendationsfellintotheareasof
energy

fiscalresponsibility
,
diversity
,
waste
and
education
.Diversityisabrandnewsubcommitteestartedthisacademicyear.
Ithinkdiversityisawonderfuladdition,saidDylanHumenik,councilcochair.Not
manypeoplethinkofsustainabilityanddiversityasbeingrelated,buttheyaredefinitely
intertwined.
Whilemanyoftherecommendationswerenewthisyear,severalwerecarriedoverfrom
previoussemesterswiththegoaltobuildonprogressthegrouphasmade.
Thecouncilsenergysubcommitteehashadongoingrecommendationsaroundthe
installationofelectricvehicle(EV)chargingstations,andtheyveseenprogresswiththecreation
ofthenewPennStatePolicyBS21,whichoutlinesproceduresfortheprocurementanduseof
EVchargingstations.
Thisyear,ontheheelsofthatsuccess,thesubcommitteerecommendedcreatinga
constructionpolicythatrequirestheUniversitytoconsiderinstallingpreliminarywiringforEV
chargingstationsinbuildingprojectsthatinvolveundergroundworkorarelocatednearparking
areas,sincethelargestcostassociatedwithEVchargingstationsistheundergroundwire
installation.
Inaddition,thegroupisworkingtocontinuethemomentumtowardthefirstpublicEV
chargingstationinstallation.
Abigmilestoneforuswouldbegettingthefirstpublicelectricvehiclechargingstation
oncampusintheNittanyLionInnparkingdeck,whichisaveryrealpossibility,saidHumenik.
Thediversitysubcommitteeputforthanewrecommendationrelatedtothe
MorningStar
SolarHome
.ThegroupadvocatedforthehousetobesupportedbyStudentAffairswiththegoal
ofincreasingtheuseofthehousetofosterdiverseexchangesandpromotesustainability.
Oneofthemostindepthrecommendationscamefromthewastesubcommittee.The
grouptackledthelackofoutdoorrecyclingbinsoncampus.
Wecurrentlydonthavewidespreadoutdoorrecyclingoncampus,Humeniksaid.
Thisspring,thesubcommitteemadealotprogressandtheOfficeofPhysicalPlantwasableto
doawasteaudit.Nowwehavesomeharddatatobackupthisneed.
Thegroupfoundthat40percentofwhatisthrownawayinoutdoorbinsisplastic.They
alsodidacostanalysis,takingintoconsiderationthe
CentreCountylandfill
andrecyclingcosts,
andfoundthatplasticrecyclingwouldsavetheUniversitymoney.
Thecouncilrecommendedrepurposingsomeofthecurrenttrashbinsasplasticrecycling
bins,beginningwithapilotgroupof1520binsinhightrafficareasofcampus.Inthefuture,the
grouphopesaluminumrecyclingwillalsobeconsidered.
SomeoftheothersuggestionsthecouncilpresentedincludedcreatinganEnergy
Ambassadorsprogram,exploringasociallyresponsibleinvestmentportfolio,andrequiring
sustainablemetricstobeconsideredinpurchasingdecisions.
Thecouncilwillfollowtheserecommendationscloselyandcontinuetomeetwithkey
stakeholderstoprovideinputastheinitiativesmoveforward.Thecommitteechairswillalso
continuetomeetwiththePennStateadministrationtoupdatethemontheprogressofthese
initiatives.
Noneoftheserecommendationsarejustoneyearandwemoveon.Wefollowthese

advocateforactiononclimatechangeandtheincreaseddeploymentofenergyefficiency,wind

,adiversenetworkofenvironmental,publichealth,faith,outdoorandcivicgroupsand
cleanenergybusinesses,whichsupportthedevelopmentofaCleanPowerPlantoreducecarbon
pollutionfrompowerplants.
Thedayofmorethan100legislativemeetingsbeganwitharallyincluding
environmentaladvocates,healthprofessionals,localresidentsandmore.
HundredsofPennsylvanianshavetrekkedtoHarrisburgtotakebacktheCapitolfrom
pollutersfortheClimateMajority,saidAdamGarber,fielddirectorfor
PennEnvironment
and
anorganizeroftheevent.Theyarehereonbehalfofthemillionsofparents,anglers,students,
faithleaders,businessownersandmillionsmoretobuildacleanenergyfuture.And,wewont
letthepollutersstopus.
Whilethevastmajorityofscientistsagreethatworldwidemanmadeclimatechangeisa
settledissue,thesamecannotbesaidformanylegislators,whowanttodelayPennsylvanias
implementationoftheCleanPowerPlan,saidRep.SteveMcCarter(DMontgomery),a
memberoftheHouseEnvironmentalResourcesandEnergyCommittee.Wecannottreadwater
onthisissuewemustmoveforwardandworktotampdownonourgreenhousegasemissions.
AndtheonlyrealhopefordoingsoistheCleanPowerPlan.
ClimatechangeisexpectedtohavedramaticimpactsinPennsylvania,accordingtoPenn
StateUniversitys
2015ClimateImpactsAssessmentReport
.
Worsenedairqualityincludingsmogpollutionexacerbatedbyhottersummerswilllikely
causemoreasthmaattacksandcanevenleadtoearlydeath.Misseddaysofschoolandwork
andincreasedhospitalizationsmayalsooccurduetothehealthimpactsofpoorairquality.
Exposuretonewinsectbornediseaseswillbethelikelyresultofwarmerwinters,with
possibledevastatingimpactsonagricultureinthestate.Andextremeweatherincludingmore
severestormscouldimpactelectricalgridreliability,whileincreasedfloodingcouldthreatenthe
supplyofsafedrinkingwater.
Gov.WolfhascommittedtodevelopaStatePlanforcompliancethatreducespower
plantpollutionby32percentby2030underthe
CleanPowerPlan
.
ClimateandCleanEnergyDayparticipantsurgedlegislatorstosupportastrongState

PlantoprotectPennsylvaniasenvironment,economyandthehealthofitsresidents.Actionon
climatechangewillalsosaveconsumersmoneyonenergycostsandcreatejobsinthefieldsof
cleanenergyandenergyefficiency.
Climatechangeisapublichealthchallengethatdemandsaction,saidHannahRyan,a
pediatricnurse,memberofPhysiciansforSocialResponsibilityandPennEnvironmentvolunteer.
Airpollutionexacerbatedbyclimatechangecanhavedangerousimpactsuponourentire
population,butchildrenareespeciallyvulnerable.
SergeantGeraldBrownisaVietnamWarveteran,PurpleHeartrecipient,fatherof12,
grandfatherof30andgreatgrandfather,wholivesinPhiladelphia.Hespokeaboutthe
disproportionateimpactsofclimatechangeonminorityandlowincomecommunities,whichare
morelikelytolivenearsourcesofpollutionsuchaspowerplants.
Iamconcernedforthefutureofmyowngrandchildren,someofwhomhaveasthma,as
wellasforcommunitiesofcolorwhowillsuffermorefromclimatechangeandhavefewer
resourcestoadapt,Brownsaid.
Manyfrontlinefossilfuelextractioncommunitieseconomiesaredominatedbythe
miningandfrackingindustries,saidVeronicaCoptis,deputydirectorofthe
Centerfor
CoalfieldJustice
inSouthwestPennsylvania.TheCleanPowerPlanwillnotonlyhelpcleanup
ourenvironmentbutprovideresourcesforeconomictransitionandjobretrainingfordisplaced
workers.Thisisabsolutelyessentialforpeoplelikemewhowishtoliveandraisefamiliesinthe
coalfields.

ThisisdespitetheoverwhelmingsupportexpressedbyPennsylvaniansforaStatePlan

Infact,eightintenPennsylvanians(82percent)supportthedevelopmentofaStatePlan
toreducecarbonpollutionandincreasetheuseofcleanenergyandenergyefficiency,according
tobipartisanpollingconductedbyPublicOpinionStrategies.
