Summary on Country report

Introduction
As firstly on Oct. 1, 2007 India ratifies the United Nation Convention on Right of Person with
Disability. ).The Convention, like all other International Convention, required that India
implement the rights and guarantee provided in it and also change existing laws in order to bring
them in conformity with the principle of the Convention. The UNCRPD contain both kinds of
provisions. One of the fundamental obligations contained in the convention in the Convention is
that national law should guarantee the enjoyment of the rights enumerated in the Convention.
Except in the rare case that the law in a country already conforms fully to the requirement of the
Convention, a state party will normally have to amend existing laws or introduced new laws in
order to put convention into practice. The extent of this change is dependent on the existing law
of the country. In India the legal system is broadly composed of those laws which pertain
specifically to PWDs like The Mental Health Act (1987); The National Trust Act (1999) and
Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act,
1995. In addition, certain provisions of the Code of Criminal Procedure 1908, the India Penal
Code 1860 and the Indian Evidence Act, 1882 have to be amended in order to include provisions
for reasonable accommodation which are required in order to realize the rights under Article 13.
Hence, almost every right and entitlement under the convention requires that, for the full
realization of the right, certain existing domestic laws will have to be amended, repealed or
supplemented in order to add entitlement.
Country Reports
The need of special focus drawn on Women and children with disability. Several NGOs were
established for Person with disabilities and they provide the necessities to lead a convenient life
(like Bhagwan Mahaveer Viklang Sahayata Samiti (BMVSS), National Federation for the Blind) and
other initial are almost same as given under UNCRPD). There are 7 National Institute working in

different part of the country for professional and technical outlook towards disability. Some other
initiative like NHRC, Constitutional Rights including fundamental Rights and DPSP are drawn

for the welfare of all citizen include person with disability. Others are same as mentioned in
UNCRPD.
Conclusion
India was one of the first major countries to ratify the United Nations Convention on the Right of
Person with Disability (UNCRPD) in 2007, it thus become incumbent on India to harmonise all
its relevant domestic laws and policies with this International Treaty. UNCRPD also require
states to generate robust data in order to demonstrate their compliance with the obligation.
Article 35 of the UNCRPD mandates nations to submit country reports on its effective
implementation. All the reports are submitted by welfare committee working for the disabled
persons who include ministry of social justice and empowerment, the central coordination
committee with the stakeholder Representative, Panchayati Raj Institution and urban local
Bodies are associated in the functioning of the district disability Rehabilitation Centers. They are
in place for implementation of the National policy also.
