Having visited all the concerned site (s) and examined all the volumes (I To V), general
commercial terms conditions & post qualification criteria, technical specifications & data sheets,
conditions & specifications for operation & maintenance, approved vendor list, preamble to price
schedules & price schedule etc. including Addenda / Corrigenda / Amendments to the above, for the
execution of the above contract, we the undersigned offer to design, engineering, supply, installation,
testing & commissioning including comprehensive operation and maintenance for three years in
conformity with the Drawings, Conditions of Contract, Specifications, Preamble to Price Schedules,
Price Schedule, Annexure, Bidding Documents, including Addenda / Corrigenda

If we fail to provide required facilities to the Employer's representative or any

other person / agency by the employer to perform on his behalf for carrying out
the inspection and testing of materials and workmanship

If we incorporate into the works, materials before they are tested and approved
by the Engineers representative

If we fail to deliver raw / clear water of required quantity according to the

conditions / stipulations of the contract, the Engineer in charge will be at liberty
to take any action including termination of contract and impose at his absolute
discretion any liquidated damages penalties and / or reject the complete and
part portion(s) of the work (s).
We undertake, if our bid is accepted, to complete and deliver the works in accordance with the
contract within stipulated time limit as prescribed in notice inviting the tenders inclusive of
monsoon, from the date of issue of Letter of Acceptance issued to us by you.
We agree to abide by this bid for a period of 180 days from the last date of submission for
receiving the same and it shall remain binding upon us and may be accepted at any time before
the expiry of that period.

In the event of our bid being accepted, we agree to enter into a formal contract agreement with
you incorporating the conditions of contract thereto annexed but until such agreement is
prepared this bid together with your written acceptance thereof shall constitute a binding
contract between us.

We agree, if our bid is accepted, to furnish performance bond / security in the forms and of
value specified in the conditions of contract of a sum equivalent to 10 % of the contract price
for due performance of the contract.

We have independently considered the amounts of liquidated damages shown in various

sections of the bid documents and agree that they represent a fair estimate of the damages
likely to be suffered by you in the event of the work not being completed by us in time.

PREAMBLE TO PRICE SCHEDULES

The bid is for parties to SITC of HSCF Pump set, MCC Panel, at Boratwada, Adiya, Vejavada, Dadka,
Sami, Runi Head works of.SSWP-1 RWSS Dist :- Patan
district specified in this tender contract for pumped water supply scheme.
1.

The bidder shall quote his firm and fixed lump sum price for the entire work under this contract,
defined in more details in various sections of this bid document.

2.

The rates and prices shall be submitted in the formats given in the enclosed Price Schedules B.
Rates and prices received in any other formats will be rejected and the Bids will be disqualified.

3.

It will be entirely at the discretion of the Employer to accept or reject the bidders design proposal,
without giving any reasons whatsoever and the bidder shall not be permitted to withdraw his bid on
this account.

4.

In Price Schedule - B, bidder shall quote his fixed price for different items of work on item rate basis
for all the items listed in the schedule. Prices quoted in Schedule - B only will be considered for price
evaluation & shall form a part of the Contract Agreement.

5.

Each item is to be individually priced in ink and the amounts shall be added up to arrive at the Total
of each Price Schedule. No column in the Schedules of prices shall be left blank except where the
item description requires the item to be priced on "as applicable basis. The item shall not be priced
if it is not applicable to the bidders design, in which case the bidder shall add the words NOT
APPLICABLE. The wording in the item description is for subject matter guidance only; clause
references are indicative only and all other relevant clauses shall also be referred to. The prices shall
allow for all the works covered under the bid and all liabilities and contractual obligations whether
separately specified or not. Items against which no prices are quoted shall not be separately paid for
and the bidder shall be deemed to have covered the cost of execution of such items (according to the
requirements of the bid document) in the prices quoted for other items.

Only Price Abstract of Schedule - B will be considered for financial evaluation of the bid. While
Price Schedules B shall be the basis to work out a schedule of Interim payments during supply /
work with the successful bidder.

7.

The bidder shall be deemed to have allowed in his price for provision, maintenance and final removal
of all temporary works of whatsoever nature required for construction including temporary bunds,
diverting water, pumping, dewatering etc. for the proper execution of works. The rates shall also be
deemed to include any works and setting out that may be required to be carried out for layout of all
the works involved.

8.

Prices shall be entered in figures and in words. Where there is a discrepancy between the unit rates
and the amount entered, the latter shall govern.

9.

The price schedules are to be read in conjunction with the conditions of contract, the specifications
and other sections of these bid documents and these documents are to be taken as mutually
explanatory of one another.

10.

Prices quoted by the bidder shall be firm for the entire period of contract without any escalation.

11.

The bidder shall interpret the data furnished and carry out any additional survey work, or
investigation work required at his own cost.

12.

The prices quoted shall also include the cost of materials utilised for testing.

13.

The bidder should acquaint himself with the site conditions including the access to work site(s). The
successful bidder shall have to make suitable access to all work site(s) at his own cost. These
accesses may be used by the other contractors working for GWSSB.

14.

(a)

If the Bid of the successful bidder is seriously unbalanced in relation to the estimated cost of

the work/ item (s) to be performed under the Contract, GWSSB, may require the bidder to produce
detailed rate price analysis for any of all Items of the Bid of the quantities to demonstrate the internal
consistency of this rate Price with the construction methods proposed. After evaluation of the rate
analysis, the GWSSB may require, that, the amount of the Performance Security set forth in Clause
No.7 of volume-I General terms and Conditions above of the contract be increased at the expense
of the successful Bidder to a level sufficient to protect the GWSSB, against financial loss in the event
of default of the successful Bidder under the contract.
(b)

In respect of those items for which the quoted rates are more than 10% above the overall

percentage of accepted tender, the payment of such items in the running bills shall be made at
estimated rate of that item plus or minus overall variation percentage of the accepted tender plus 5%
of the estimated rate of that item. The balance amount as per accepted tender rate shall be withheld
from the running bills and will be released on satisfactory completion of work in final bill. No
interest will be payable for such withheld amount as per Circular No AB/cm-1-2/11-12-53/3321od
dt 06/05/2014. This shall be taken care of by way of payment schedule and quoted rates need not be
changed. (This conditional shall be applicable to the relevant pares of PAYMENT in the Volume of
Price bid and schedule of payment in technical specifications also)
(c)

The contract performance for actual execution and the payments to be made for the work

shall be based on such bid rates as per (b) and (c) above wherever applicable.
(d)

Any decision of GWSSB regarding the rates at which payment shall be made in accordance

with the above Clauses shall be final and binding to the Bidder.
15.

Expenses made by contractor towards insurances of employees & plant machineries will also be
reimbursed on production of Original Payment voucher.

16.

Prices quoted by the bidder shall be firm & fix inclusive of all taxes & duties, octroi, work contract
tax and other levies including all taxes (Excluding Insurance for Machineries & Contractors
manpower) for the entire period of Contract (i.e. 2 Months) ) without any price escalation. Insurance
Policy should be assign in favour of Executive Engineer, P. H Mech Division Palanpur

17.

The contractor shall have to pay the labor registration fee of Rs 25/- labor and annual contribution of
Rs. 75.00 to the government labour department.

Payment shall be made as & when funds are made available by Head Office after adherence to
departments fund requirement & procedure thereof. The GWSSB shall not under any circumstances
relax these of terms of payment and will not consider any alternative payments terms. Bidders should
therefore in their own interest note this provision.
