SECTION - 1
NOTICE INVITING QUOTATION AND TERMS & CONDITIONS
1.0

GENERAL

1.1

QUOTATION NOTICE
Sealed Quotations (Percentage Rate) are invited by RITES Ltd., a Public Sector
Enterprise under the Ministry of Railways, acting for and on behalf of the Bhartiya
Rail Bijlee Company Ltd(BRBCL)( Employer), as an Agent and Power of Attorney
Holder, from contractors for the work comprising of Felling of trees and
transportation of timber for Nabinagar TPP(4x250MW) Distt Aurangabad, Bihar
State

1.2

Estimated Cost of Work

The work is estimated to cost about Rs. 4.48 lakh. This Estimate, however, is given
merely as a rough guide. The quantity of usable and fuel timber have been assessed
taking average yield of timber as 0.75 cum per tree.

1.3

Time for Completion

The time allowed for completion of the work will be 45 days which will be reckoned
from the 3rd day after the date of issue of Letter of award, or from the first day of
handing over the site, whichever is later.

1.4

Brief Scope of Work

1.4.1

i) Felling of trees
ii) Cutting of trunk, branches etc
iii) Transporting of timber from Nabinagar to forest depot

2.3 Quotation documents downloaded from RITES website shall be considered valid
for participating in the quotation process. During the scrutiny of downloaded quotation
document, if any modification/correction etc. is noticed as compared to the original
documents posted on the website, the bid submitted by such a bidder is liable to be
rejected.

3. EARNEST MONEY
The Quotation should be accompanied by Earnest Money of Rs 5000.00 (Rupees Five
thousand only) in any of the forms given below:Bankers Cheque / Pay Order/ Demand Draft payable at Lucknow, drawn in
favour of RITES Ltd.
3.1 Any Quotation not accompanied by Earnest Money in an acceptable form shall be
rejected by the EMPLOYER/RITES as non-responsive.
3.2 Refund of Earnest Money
The Earnest Money of all the bidders except whose quotation has been accepted will
be returned as soon as work is awarded.
3.4 The Earnest Money is liable to be forfeited
a)

4.0

if after quotation opening during the period of bid validity or issue of Letter of
award, whichever is earlier, any bidder
i)

withdraws his quotation or

ii)

makes any modification in the terms and conditions of the quotation

which are not acceptable to the EMPLOYER/RITES.

SUBMISSION OF QUOTATION
The bidder shall submit the Quotation in sealed envelope containing following:Earnest Money and Quotation document with duly filled in Schedule (Bill) of
quantity (Percentage Rate quotation) . The quotation document should bear the dated
initials of the bidder along with name and address the company on each page.

4.1

Deadline for submission of Quotation

4.1.1 Quotation must be received by the RITES at the following address not later than
15.00 hrs. on 28.12.2015. In the event of the specified date for the submission of the
Quotation being declared a holiday/Strike/Bandh or on any account by the RITES, the
Quotations will be received up to the appointed time on the next working day.
4.1.2 Address for submission of Quotation: Office of Project Manager, RITES Ltd

4.2

Late Quotation/ Delayed Quotation

Any Quotation received by the RITES after the specified date and time of receipt of
quotation will be returned unopened to the bidder.

5.0

5.1

EMPLOYER/RITESS RIGHT ON ACCEPTANCE OF ANY QUOTATION

(i)

If required, the EMPLOYER/RITES may ask any bidder the breakdown of unit
rates. If the bidder does not submit the clarification by the date and time set in
the EMPLOYER/RITESs request for clarification, such quotation is likely to
be rejected.

(ii)

The competent authority on behalf of the EMPLOYER/RITES does not bind

himself to accept the lowest or any other quotation and reserves to himself the
authority to reject any or all the quotations received without the assignment of
any reason. All quotations in which any of the prescribed conditions is not
fulfilled or any condition is put forth by the bidder shall be summarily rejected.

The bidder whose quotation has been accepted will be notified of the award by the
RITES by issue of a `Letter of award
The Letter of award will be sent to the Contractor in two copies; one of which he
should return promptly, duly signed and stamped. The Letter of award will be a
binding Contract between the RITES and the Contractor.

6.0 SPECIAL CONDITIONS

6.1

The trees are in Railway land and in BRBCL land. The work is to
be executed as per the extent rules & guidelines of Department of
Forest, Government of Bihar.

6.2

. The stacking of usable timber and fuel timber shall be done

separately as per instructions of site engineer.

6.3.

The trees which are along Railway track, safety as per Railway
rules will be followed by contractor.

6.4

The measurement of the timber shall be done at site. The volume

of usable timber shall be calculated by measuring the length of
log and average of the diameter at minimum three places .The
diameter will be measured by measuring circumference. The
volume of the fuel timber shall be calculated by measuring the
length, width and height of the trolley in which it is filled in for
transportation. The height will be measured upto the height of
timber in the trolley.
Contractor will transport and deposit the timber to the nominated
Forest Depot. The receipt of the timber issued by Forest Depot ,
acknowledging the quantity of timber transported from site, will
be submitted to RITES/BRBCL by contractor.

6.5

Contractor shall indemnify RITES/BRBCL for any damage / loss

to its machine /manpower during the course of this work.

6.6

Contractor will be responsible for compliance of all statutory

requirements for executing all works under this contract. The
permission for cutting of trees will be arranged by BRBCL.

6.7

The items of work given in the BOQ includes all operation of

cutting of trees, making logs, stacking, loading, transporting and
unloading, stacking at Forest Depot. The item also includes any
other work which is required to complete the work to the
satisfaction of Engineer-in-charge and nothing extra shall be
paid.

6.8.

The rate includes all taxes/levies/octroi etc, excluding service tax.

Service tax shall be reimbursed on submission of proof of
deposit.

6.9

The work shall be done as per instructions of Engineer in charge.

7.0PAYMENT
7.1 Payment will be released after deposition of the timber in the nominated Forest depot
and submission of receipt thereof.
8.0SETTLEMENT OF DISPUTES
8.1 In case of a dispute the decision of competent authority of Employer/RITES will be
final and binding on contractor.

1.

I/We have read and examined the Notice Inviting Quotation and Conditions , Schedule
(Bill) of Quantity ( Percentage Rate Quotation), for the work.

2.

I/We hereby submit percentage rate quotation for the execution and completion of the
work as per Schedule (Bill) of Quantity ( Percentage Rate Quotation) within the time
specified and in accordance in all respects with the special conditions, and instructions
in writing referred to in Notice Inviting Quotation and Conditions .

3.

We agree that our quotation shall remain valid for a period of 30 days from the due
date of submission thereof and not to make any modifications in its terms and
conditions.

4.

A sum of Rs. ___________ (Rupees _________ only) is hereby forwarded in the form
of Bankers cheque/Demand Draft issued in favour of RITES Ltd., payable at
_________ as the Earnest Money.

5.

If I/We withdraw my/our quotation during the period of quotation validity or before
issue of Letter of award whichever is earlier or make modifications in the Terms and
Conditions of the Quotation which are not acceptable to the EMPLOYER/RITES, then
the RITES shall, without prejudice to any other right or remedy, be at liberty to forfeit
entire Earnest Money absolutely.

6.

If, I/We fail to commence the work within the specified period, I/We agree that the
RITES shall, without prejudice to any other right or remedy available in law, be at
liberty to forfeit the Earnest Money.

7.

Further, I/We hereby agree that in case of forfeiture of Earnest Money as aforesaid in
paras 5 to 6, I/We shall be debarred for participation in re-quotationing process of the
work.

8.

On issue of Letter of award by the RITES, I/We agree that the said Earnest Money
shall be retained by the RITES towards Security Deposit, to execute all the works
referred to in the Quotation document and Conditions contained or referred to therein
and to carry out such deviations as may be ordered, upto maximum of 50%

13.

I/We understand that the EMPLOYER/RITES is not bound to accept the lowest or
any quotation he may receive. I/We also understand that the EMPLOYER/RITES

reserves the right to accept the whole or any part of the quotation and I/We shall be
bound to perform the same at the rates quoted.
14.
