POLITY(LAKSHMIKANTH)

SCHEDULED & TRIBAL AREAS:


Constitutional Provisions: Art-244(Part-10) of CONST; 5th Schedule; 6th Schedule;
Art-244: Constitution envisages special system of Administration for certain areas designated as 'Scheduled areas or Tribal
Areas'.
5th Schedule: Deals with Administration & Control of Scheduled area & Scheduled Tribes in any state except the four
States(Assam,Meghalaya,Mizoram,Tripura).
6th Schedule: Deals with administration of Tribal areas in 4-Northeastern states (Assam,Meghalaya,Mizoram,Tripura).

Administration of Scheduled Areas(SAs):


5th-Schedule contains the provisions for administration of SAs
SAs are treated differently from other areas in the country bcos they are inhabited by 'aboriginals' who are economically &
socially backward.
Specials efforts need to be made to improve their condition.
The normal administrative machinery operating in country is not extended to SAs.
Central govt has greater responsibility for these areas.
CONST requires Prez to appoint Commission to report on Admin of SAs & welfare of STs in the state. Till now 2commissions: U.N.Dhebar(1960),Dilip Singh Bhuria(2002).

Administration of Tribal Areas(TAs):

6th-Schedule contains the provisions for administration of TAs in 4-Northeastern states.


The tribes in these states have not assimilated(absorbed) much to the life & ways of other people in these states.
So these areas are treated differently by CONST and Autonomy for Self Govt.
Assam: The North Cachar Hills District, The Karbi Anglong District, The Bodoland Territorial Areas District.
Meghalaya: Khasi Hills District, Jaintia Hills District, The Garo Hills District
Mizoram: The Chakma District, The Mara District, The Lai District
Tripura: Tripura Tribal Area District

Features of Administration(6th schedule):


1. Autonomous Districts; Come under executive authority of State.
2. Governor empowered to organize & reorganize autonomous districts; can divide district into several autonomous regions;
Can appoint commission to examine & report on any matter relating to administration of the Autonomous districts or
regions; can dissolve a district or regional council(recommendation of commission).
3. District Council for each Autonomous District. Consist of 30-members, 26-selected by adult franchise & 4-nominated by
Governor. Each autonomous region also has separate regional council.
4. District & regional Councils administer the areas under their jurisdiction; Can make laws on certain specified matters; can
constitute village councils or court; can establish,construct,manage Primary schools, dispensaries, markets, ferries,
fisheries, roads,etc; can asses & collect land revenues & impose certain specified tax.
5. Act of Parliam/State Legislature do not apply to Autonomous Districts & Autonomous regions. They can be applicable with
certain modifications/exceptions
