Please consider this a formal complaint concerning sanitary sewer wastewater


and storm water pollution events on the south side of Bismarck ND.

Focus of Complaint

Formore than20 years, residents along South 12 Street and other low areas of
south Bismarck have been fighting a losing battle for relief from flooding
during periods of heavy rain. Despite numerous complaints to the city, and
news video broadcasts of the flooding, the City chooses to ignore the problem
and the effects it has on residential dwellings and businesses. Due to the City
of Bismarck's negligence, the situation has deteriorated over the years to such
an extent is has now become a full-blown health and environmental hazard.
During certain rain events, runoff from the rain and spillage of raw sewage
combine and create a toxic concoction that overwhelms the outdated and
inadequate water disposal infrastructure that is now in place. Furthermore,
because there is inadequate capacity to manage the water, the toxic brew floods
resident's yards, depositing raw sewage and other debris on lawns and areas
where children play.This rancid water seeps under mobile homes and causes
havoc including settling of the homes, and an ideal climate for mold and other
health hazards. Businesses floors are flooded and stained, buildings damaged,
and walls water stained. Needless to say, this has a negative accumulative
effect on property values.
Over the years, the city of Bismarck has continued to direct more water to the
area and the conditions deteriorate year by year. The main channel that runs
from the south side fire station to the river is outdated and poorly maintained to
such an extent it no longer can handle more inflows. The sanitary sewer
infrastructure is also insufficient and thus the raw sewage spews out onto the
streets.

The immediate hazard is to the children in the affected areas. It is common to


see young children playing in the toxic water while human wastes floats near

them.

It is also of concern the amount of raw sewage dumped into the Missouri

River due to this debacle.

In light of the above, and determining there will be no recourse from the
city, it is requested that the North Dakota State Heatth Department
intercede on behalf of the affected citizens of the cify of Bismarck, and that
the Health exercise supervision and control over the city of Bismarck, and
cause the following and other remedies the Department of Health deems
appropriate.

l....Cause the City

of

Bismarck

to file a plan of

remedy and

implementation with the Health Department.


2....Cause the City of Bismarck to pay for an independent third party to
monitor damage and contamination, and the flow of raw sewage into the
Missouri River, and that the monitoring entity be free of city interference
and report to the North Dakota State health Department.

3....Cause

an immediate moratorium on any commercial projects

exceeding $3,0001000

until remedies concerning the above are put in place.

4....Before ANY commercial project that will affect the flooding areas, can
start, an environmental impact statement with public input must be filed
and approved by the state.

5....That the State Health Department exercise supervision and control


until such time it deems the City of Bismarck has acted in good faith and
remedied the situation.
