Elite Air (UK) Ltd. - TERMS & CONDITIONS FOR


BALLOON FLIGHT VOUCHERS
Flight Vouchers issued by Elite Air (UK) Ltd. entitle the holder to a balloon flight with
Elite Air (UK) Ltd. for one passenger. Balloon flight Vouchers have no value stated
on them and entitle the holder to the balloon flight agreed during booking. Flight
Vouchers are refundable within 14 days, (see refunds below). Exceptionally and
specifically, Bristol Balloon Fiesta Flight Vouchers may only be redeemed for the
flight slot for which they were purchased; they may not be carried over and used the
following year and they are non-refundable, but they may be used to fly at a later
date within 12 months of purchase. The actual balloon flight will be carried out by
Elite Air (UK) Ltd, however, in very exceptional circumstances, by a third party
balloon operator designated by us. Vouchers carry a unique serial number which
must be quoted when dealing with Elite Air (UK) Ltd. and its operatives. Vouchers
must be kept safely and securely and should be taken on the day of the flight and
surrendered to the operator or alternatively sent to the operator if requested to
secure the booking. e-Vouchers can be printed, or if preferred can be presented
electronically, for example on a tablet or smartphone.

Validity
The Voucher validity period is 12 months from date of purchase unless otherwise
stated. Flights must be booked and undertaken prior to the expiry date printed on the
front of the Voucher, otherwise the Voucher will be deemed to be invalid and no
liability will be accepted by Elite Air (UK) Ltd. You must contact us within 3 months of
the purchase date shown on the voucher to discuss booking your flight. This booking
must be for a date within 12 months of the purchase date. If you do not take your
flight within the validity period, the voucher will expire at the end of its validity period
and you will lose your entitlement to a flight. We will not make any refund in these
circumstances. It is the responsibility of the passenger to make contact to re-book a
postponed flight in order that the operator has the opportunity to complete the
contract.

Availability
The recipient is free to book their preferred date within the Voucher validity period.
Flights are subject to availability and, in some cases, may be subject to weather
conditions (we always advise telephoning the office before you set out to confirm that
the flight will take place). To avoid disappointment we recommend that customers
book well in advance. During peak periods it may be necessary to allow a longer
notice period although we may be able to fit in a booking at short notice. We
recommend booking as early as possible as you must have undertaken your flight
before the expiry date printed on the front of your Voucher. We strongly advise that
you do not make any travel, accommodation or other arrangements until you have

received confirmation of your booking from the flight operator. Once a flight has been
undertaken with us your Voucher will be deemed to be used at that point.

Extensions
The validity period of Vouchers may be extended only at Elite Air (UK) Ltd.'s
absolute discretion for a period of 6 months upon payment of a nominal
administration fee. This fee, along with the original Voucher, must be returned to
Elite Air (UK) Ltd. for an extension to be processed. If the price of your chosen flight
has increased, you will have to pay the difference between the new price and your
Voucher. Please note that expired Vouchers cannot be extended under any
circumstances.

Refunds
A full refund is available, as long as your Voucher is returned to us within 14 working
days of receipt, if bought directly from Elite Air (UK) Ltd. A refund can only be made
to the purchaser and if payment was originally made by credit/debit card the refund
will be made to the same card. A refund cannot be given once a booking has been
made, extended or expired. All transactions are in GBP. Elite Air (UK) Ltd. is not
liable for any fees imposed by your bank, building society or any other third party
organisation as a result of placing an order from overseas. Fluctuations in exchange
rates may mean that you receive a differing amount back from the original paid total
once conversion from GBP to required currency has taken place. Elite Air (UK) Ltd.
will not reimburse losses arising from such fees or conversions and will refund only
the amount received in GBP at time of order. Exceptionally, Vouchers bought for the
Bristol Balloon Fiesta are non-refundable but may be used at a later date within 12
months of purchase.

The flight
It is intended that the balloon will be in the air for approximately one hour but the pilot
has absolute responsibility for deciding the duration and conduct of any flight and the
appropriate time and place of any landing with regard to flight safety reasons which
are paramount and overriding at all times. We cannot guarantee the duration of a
flight or that it will follow any particular direction.
Hot air balloon flights are completely dependent upon the weather and are regulated
by the Air Navigation Order. It may be necessary to postpone a flight at any time if in
our judgement the conditions are not safe or the flight would not be permitted under
the Air Navigation Order. We will give you as much warning as operational
procedures allow of any postponement but in order to ensure safety we reserve the
right to postpone a flight at any time up to the moment of launch. In the event of a
flight being cancelled due to adverse weather conditions, or for any other reason,
alternative dates will be available on enquiry with Elite Air (UK) Ltd. Operations
Office.

Restrictions
All hot air balloon flights are subject to restrictions. These include (but are not limited
to) age, height, weight, physical and medical restrictions so please check before
making your booking. It is your responsibility that you are medically fit to fly. If in any
doubt you must consult your doctor as our pilots and operatives are not qualified and
are unable to make medical assessments of passengers. You must not fly if you are
suffering from any significant medical condition, or have recently undergone surgery,
we may ask you to provide a certificate of your fitness to fly from your doctor or
specialist. It is necessary that you disclose any aspect of your medical or physical
condition that could be considered to affect your safety or the safety of others. You
must not fly if you are pregnant or under the influence of alcohol and/or drugs. You
are required to sign a certificate of medical fitness to fly, which will be sent to you
along with your flight Vouchers. Please sign and return to our Operations Office or
ensure you bring it along with you on the day of the flight. This information is
required to allow us to exercise our duty of care for your safety.
Ballooning activities intrinsically involve the possibility of physical risks greater than
those encountered in daily life, even though they are conducted under the
supervision of commercial pilots who exercise all due precautions to ensure safety.
By taking part in such ballooning activities passengers are understood to be fully
aware of these risks. Our paramount consideration is your safety and the safety of
others participating in the flight and you must obey all requests and instructions
issued by any of our representatives and take particular care to abide by any safety
instructions given. The pilot has complete discretion under the Air Navigation Order
as to whether to allow you to take part in the flight and will refuse to allow you to do
so if in his/her opinion you would be a risk to the safe conduct of the flight, to the
balloon, to other passengers or to yourself. In these circumstances you will lose your
entitlement to a flight.
We will only fly children over the age of 8 years and whose height exceeds 1.2m. A
child under the age of 16 years will only be flown if accompanied by a responsible
adult appointed by the parent(s) or guardian.
You should wear such appropriate clothing as is advised to you in advance of the
flight and as further detailed in the brochures and associated literature supplied to
you.
In the interests of safety and operational requirements we cannot undertake the
carriage of passengers whose declared weight exceeds 18 stones (114 kg),
however, in special circumstances this restriction can be waived but there will be an
additional fee of 50 per person.
Smoking is not permitted within 50 metres of any part of the balloon nor during flight.
If you are unsure of any of our terms please telephone our Operations Office and we
will be happy to advise you.

Transport
Elite Air customers will be required to meet us at the stated launch site and will be
returned by us to the same location post flight. A special chauffeur service is
available if purchased as an upgrade and customers may be collected and returned
to a location of their choice as agreed during the booking. Specifically, during the
Bristol Balloon Fiesta, all customers will be required to meet us at the Fiesta Site at a
pre-arranged time in the passenger boarding area and upon completion of the flight,
customers will be returned to the Fiesta Site only. Exceptionally, if an upgraded
chauffeur service has been agreed and purchased, we will transfer our customers to
a location as agreed at the time of booking. We will make every effort to return to the
site in time for night glows but we are unable to guarantee this due to traffic
restrictions and the post flight landing location. Spectators and friends are usually
welcome, but some venues may have restrictions on spectators due to safety
regulations. Participants are advised to check with our Operations Office when
booking. We are only able to carry Voucher holders with us in our retrieve vehicles
due to insurance regulations.

Security
Vouchers are valuable documents and cannot be replaced if they are lost, damaged
or stolen and are invalid if altered or tampered with. Elite Air (UK) Ltd. accept no
liability in these circumstances. Under exceptional circumstances, Vouchers may be
replaced by Elite Air (UK) Ltd. for a nominal administration charge.

Problems on the day


We welcome your feedback on all of our experiences. If you encounter a problem on
the day, please immediately bring it to our attention so we have a chance to put
matters right. If you have attempted resolution but the problem was not resolved on
the day, please write to us within a week of your experience (providing your Voucher
serial number, participants name and venue details, including who you spoke to on
the day) and we will be happy to investigate the matter. The address to write to is;

Liability cover
Elite Air (UK) Ltd. are fully insured and will indemnify participating Voucher holders
against damage to equipment they use, and against liabilities to third parties, subject
to limits and compliance with their rules, terms and conditions. Our retrieve vehicles
are insured for flight participants and Elite Air (UK) Ltd. staff only. Other companions,
not participating in the flight are not permitted to travel in our retrieve vehicles.

Competition prizes, special offers and promotional


offers
These may have restrictions including (but not limited to) dates and times of use,
validity periods and experience range or content so please be sure to check these
before purchasing. Competition Prizes, Special Offers and Promotional Offers
cannot be refunded or extended unless otherwise specified. (A promotional product
refers to a Voucher which was sold at a discounted price or as part of a special offer,
whether or not this is stated on the Voucher). Competitions are for UK residents only.

Third parties and re-sale


A person who is not named on the face of the Voucher or recorded as the purchaser
by Elite Air (UK) Ltd. has no right under the Contracts (Rights of Third Parties) Act
1999 to enforce any terms and conditions of booking. A Voucher which has been resold (for example, through internet auction sites or by any other means) without our
prior consent will be considered invalid. Neither Elite Air (UK) Ltd. nor any of its
experience operators will be under any obligation to provide any service.
These terms and conditions do not affect your statutory rights as a consumer, and
are governed by and in accordance with English law. The purchaser of a Voucher
and/or the participant in an experience agrees to the jurisdiction of the English
courts. All the clauses and sub clauses in Elite Air (UK) Ltd.s terms and conditions
are independent of each other. If one clause or sub clause is invalid or
unenforceable, this will not affect any other clause or sub clause. These terms &
conditions are subject to change.
The details listed above are the terms and conditions applied to Elite Air (UK) Ltd.
Vouchers and experiences. Your statutory rights are not affected.
