Plan

Purpose
ThepurposeoftheEmergencyOperationsPlanforBillingsCounty/Citiesis:
Todefinetheresponsibilitiesofdepartmentsoflocalgovernment(countyandcity)and
appropriateprivateentities;and
Toensureacoordinatedeffortbylocal,state,andfederalgovernment,aswellasprivate
responseforces,tosavelivesandtoprotectpropertyandtheenvironmentintheeventofan
emergencyordisaster

Assumptions

Properimplementationofthisplanwillreduceorpreventlossoflife,damagetopropertyandthe
environment.KeyofficialswithinBillingsCountyareawareofthepossibleoccurrenceofanyemergency
ormajordisasterandtheirresponsibilitiesintheexecutionofthisplan.

A. Thecountycommissionandcitycouncilshaveoverallstatutoryresponsibilityforthecontinued
use,developmentandmaintenanceofthisplan.Delegationofresponsibilitiestodepartment
headsdoesnotabrogatetheauthorityofheadsoflocalgovernmentstomakenecessary
decisionsorchangestotheplanfortheprotectionoflive,propertyandtheenvironment.

B. Thecontentsofthisplanmustbeknownandunderstoodbythosepeopleresponsibleforits
implementation.Theemergencymanagerisresponsibleforbriefingpersonnelandcounty/city
officialsconcerningtheirroleinemergencymanagementandthecontentsofthisplanin
particular.

C. Departmentheadsareresponsiblefordevelopmentandmaintenanceoftheirrespective
functionsandtasksintheplan.

D. Inaddition,eachfunctionalcoordinatorandtaskcoordinatormustmaintainsupporting
standardoperationprocedures(SOPs)describinghowfunctions/taskswillbeaccomplishedor
implemented.SOPsarelocatedatappropriatefunctionalfacilitylocationsandwillbeupdated
yearlybytheappropriatecoordinator.

E. Anannualreviewofthisplanwillbeconductedbyallofficialsinvolvedinitsexecution.The
emergencymanagerwillcoordinatethisreviewandanyrevisionanddistributionfound
necessary.

F. Theplanwillbetestedatleastonceayearintheformofasimulatedemergencyexercisein
ordertoprovidepractical,controlledexperiencetofunctionalcoordinatorsandtask
coordinatorsresponsibleforplanmaintenanceandresponse.

ConceptofOrganizations

A.General

Itistheresponsibilityofgovernmenttoprotectlife,propertyandtheenvironmentfromtheeffectsof
hazardouseventsusingthefourphasesofemergencymanagement:preparedness,response,recovery
andmitigation.Thisplanisbasedontheconceptthattheemergencyfunctionsperformedbyvarious
groupsrespondingtoanemergencywillgenerallyparalleltheirnormaldaytodayfunctions.Tothe
extentpossible,thesamepersonnelandmaterialresourceswillbeemployedinbothcases.

Localgovernment,becauseofitsproximitytotheseevents,hastheprimaryresponsibilityfor
emergencymanagementactivities.Otherlevelsofgovernmentprovideresourcesnotavailableatthe
locallevel.Iflocalresources(county,cityandprivate)arenotavailable,thecounty/citymayrequest
assistancethroughthecountyemergencymanagementofficeafterthepoliticalsubdivisionhasissueda
disasteroremergencydeclaration.Whentheemergencyexceedscountygovernmentscapacityto
respond,assistancefromthestategovernmentwillberequestedthroughtheNorthDakotaState
DivisionofEmergencyManagement.Afterthecountyhasissuedadisasteroremergencydeclaration,
theGovernorwillrequestfederalassistancethroughapresidentialemergencyormajordisaster
declaration.Thefederalgovernmentmayprovideassistanceandresourcestothestatewhereneeded.
Federalassistancemaybeextendedtoaidinrecoveryfrommajordisasters.

TheEmergencyOperationsCenter(EOC)willbeactivatedforallincidentsrequiringasignificant
dedicationofresourcesand/orextraordinaryinteragencycoordinationoutsidetherealmofnormalday
todayemergencysituationsrespondedtobelawenforcement,fireandEMSagencies.

Daytodayfunctionsthatdonotcontributedirectlytoresponseactionstoanemergencymaybe
suspendedforthedurationoftheemergency.Theresourcesandeffortsthatwouldnormallybe
requiredforthosefunctionsmaybedivertedtotheaccomplishmentofemergencytasksbytheagency
managingtheuseoftheresources.

TheIncidentCommandsystem(ICS)isthemosteffectivesystemformanagingemergencies.National
FireAcademyICScanbeusedasastandardforEmergencyManagementOperations.

Recordsrequiredtoprotecttherightsofindividuals.Theserecordsinclude:marriagelicensesand
divorcepapers,propertyandlandtitles,taxstatementsandlicenses,andrecordsrequiredbyhealth
fire,lawenforcementandpublicworkstoconductemergencyoperations.

Recordsrequiredtoreestablishnormalgovernmentfunctionsandtoprotecttherightsandinterests
ofgovernment.Appropriatedepartmentheadswillberesponsibleforsecuringdocumentsnecessary
forcontinuingoperationduringtimesofemergencies.

D.RelocationofGovernment

AllcriticalfacilitiesatthecountyandcitylevelsuchastheEOC,lawenforcementfireandthe
courthouseshouldhaveanalternatelocationofevacuationbecomesnecessary.Educationalfacilities,
publicworksbuildings,jails,communicationscenters,firehallsandlawenforcementcentersare
possiblerelocationfacilitiesastheyalreadycontainconsiderablecommunicationequipment.

Atanytime,theBillingsCountyOperationsCentercanbeactivatedbyarequestforoperationsbythe
BillingsCountycommissionorbyarequestfromaStateorFederalagencythroughStateRadio.The
EOCcanalsoberequestedtobemadeoperationalbyanylawenforcementagency,firedepartment,or
ambulanceservice.

ActivationbyCountyCommission
1. ChairmanoftheCountyCommissionplacesatelephonecalltotheCountySherifforEmergency
Manager(EM)directlyrequestingactivationoftheEOC.
2. ChairmanofthecountycommissionrequestsactivationoftheEOCthroughthecountyAuditor,
whointurn,telephones/textstheCountySherifforEM.
3. ChairmanoftheCountyCommissioncallsStateRadioandrequestsapagetotheEMorcounty
SherifftoactivatetheEOC.

H.FunctionalandTaskCoordinators


Significantresponsibilitiescommontoemergenciesanddisastersaregroupedintotenareas,whichare
termedfunctions.Thedepartmentshavingresponsibilitybylawordaytodayresourceandoperational
capabilitywithineachofthesefunctionsareidentifiedandassignedbyspecifictask/responsibility,and
arelistedonsubsequentpages.

Anycounty/cityagencyordepartmentmaybeassignedanemergencymission.Thesupervisorofeach
departmentisresponsiblefortheaccomplishmentofanassignedtaskorfunctionthroughthe
developmentofSOPslocatedattheirfacility.Assignmentoffunctionsandtasksarelistedbyfunctional
area.Inaddition,eachdepartmentisassignedthefollowinggeneraltasks:

1. Providepersonnel,equipment,andfacilitiesona24hourbasis.
2. Planandprovideforthesafetyofemployeesandprotectionofpublicpropertyintheeventof
anemergency.
3. CoordinateactionswiththeCountyEmergencyManagerandwithdepartmentshavingrelated
tasks.
4. Trainpersonnelassignedtoemergencytasksandparticipateinexercisestotestemergency
plansandprocedures.
5. Provideforrecordkeepinganddocumentationoftheemergencyoftheemergencyandactions
taken.
6. Preparedamageassessments.

I.MutualAidAgreement

1. Intheeventofanyflood,fire,tornadoorotherdeclaredlocalemergency,(naturalorman
made)thatcannotbemetwiththefacilitiesofoneofthecontractingparties,,theother
contractinggovernmentalagencyagrees,uponrequest,tofurnishaidincopingwithsuch
disasterorlocalemergencytotheagencyrequestingaiduponeitheranactualorstandbybasis.
Theextentofaidtobefurnishedunderthisagreementshallbedeterminedsolelybythe
governmentalagencyordepartmentthereoffurnishingsuchaid,anditisunderstoodthatthe
aidsofurnishedmayberecalledatthesolediscretionofthefurnishingagency.

2. Detailsonhowtorequestmutualaid,thenameofacoordinatoranddesignatedalternates
authorizedtosendandreceivesuchrequestsandthelistsofequipmentandpersonnelsubject
tocallwillbecoveredbycorrespondencebetweenthegovernmentalagenciesandthe
departmentsannually.

3. Personnelwhoarefurnishedwillworkasfaraspossibleundertheirownsupervisors,and
equipmentfurnishedwillordinarilybeoperatedbypersonneloftheagencyfurnishingthe
equipment.Generaldirectionsrelativetoworkwillbegivenbytheappropriateofficersofthe
agencyreceivingsuchaid.Intheeventequipmentissentwithoutoperators,strict
accountabilitywillbemaintained,andthereceivingofficialwillberesponsibleforitssupervision
andthepartyreceivingaidforitssafereturn.

4. Partiestothisagreementshallberequiredtopaycompensationtootherpartiestothe
agreementforservicesrenderedhereunder.Thereceivingpartyshallpayallfueloil,incidental
repairs,andfoodandlodgingforoperators.Equipmentoperatingundertheplandevelopedby

theAssociatedGeneralcontractorsshallbereimbursedasoutlinedintheexistingNorthDakota
DepartmentofTransportationequipmentrentalrates(Planbulldozer),excludingprofit.

Volunteerpersonnelmustberegisteredbythesendinggovernmentalagencyandcoveredby
theworkerscompensationinsuranceofthesendinggovernment.

Itismutuallyunderstoodandagreedthatthisagreementdoesnotrelieveanyoftheparties
heretofromthenecessityandobligationofprovidingadequateresourceswithintheirown
areas,andeachpartyheretoagreesthatitshallmaintainreasonableandprudentdiligencein
keepingemergencyequipmentinitspossessionuptoatleastminimumstandardsofrepair.

Itisfurthermutuallyunderstoodandagreedthattheprovisionsofthisagreementwillbe
invokedonlywhen,intheopinionofthecitycouncilorcountycommission,itisdeemed
necessarytodeclareanemergency,ordisasterandtorequestoutsideassistancebecauseallof
thenormalfacilitiesattheircommandhavebeenexhausted,andoutsideassistanceisneeded
tocontroltheemergency.Ifanofficialsuspectsthesituationmayrequireoutsideaid,theother
partiedshouldbeinformedimmediatelysothatresourcescanbeputonstandbystatus.

Theagreementshallnotbeconstruedasordeemedtobeanagreementforthebenefitofany
thirdpartyorparties,andnotheirpartyorpartiesshallhaveanyrightofactionhereunderfor
anycausewhatsoever.Anyservicesperformedorexpendituresmadeinconnectionwith
furnishingmutualaidunderthisagreementbyeitherpartyheretoshallbedeemedexclusively
tobeforthedirectprotectionandbenefitoftheinhabitantsandpropertyofsuchparty.Any
liabilitiesincurredasadirectresultofsupportofareceivinggovernmentshallbebornebythe
receivinggovernment.

AnypartytotheMutualAidAgreementmaywithdrawatanytime,upon30daystoeachofthe
otherparties,andthereafter,suchwithdrawingpartyshallnolongerbeapartytothis
agreement;butthisagreementshallcontinueinforceamongtheremainingparties.
