SIR: *NOT AUDIBLE* in the submission of an affidavit, you can still retain your Filipino
citizenship. In those two cases, the court found out that the parties used their non-filipino
passport. And so the court said, if thats the case then it is as if you are then again repudiating
your filipino citizenship. Because the idea guys is like this: you retain your filipino citizenship,
that is a one sided affair. You are deemed to have repudiated your other citizenship and retained
your filipino citizenship. But as to whether or not you have, in the eyes of the other state,
whether or not you have in fact repudiated their citizenship, that is a matter left to them. But as
far as philippines is concerned, you are deemed to have repudiated that kind of citizenship and
you have retained your philippine citizenship as one and only citizenship. But the problem is if
you still avail the benefits of the other citizenship than you are deemed to have repudiaated
philippine citizenship. Okay now, are finally starting with..what are the elements of the state

discussing what? As an element of the state, we start discussing the government and we will
start with the legislative department.

What is legislative power?
STUDENT: it is defined in the constitution in sec 1 art 6..legislative power in the congress of the
philippines which shall consist of senate and house of representative
SIR: ah no no..what is legislative power?
STUDENT: power that is vested in the congress. The power to make and enact laws
SIR: so in more legal sounding terms, it is the power to propose, enact, amend and repeal laws.
Legislative comes from the latin term Lex-law, legis of the law. Okay? Who can exercise the
power of legislation?
STUDENT: senate and house of representatives
SIR: aside from that..
STUDENT: also the people
SIR: ok, so it can be by the people and the congress. When we say congress, we mean the two
houses of congress: senate and house of representative or the senate and lower house. Naa
bay upper house?
STUDENT: NAA SIR.
SIR: really? Do we use the term upper house? No, it is more of the lower house. For me, there
is no lower because they are equal branches of the legislative department. none is superior than
the other. Of course we are done with this one, right? How can the people exercise the power of
legislation?
STUDENT: by peoples initiative
SIR: okay, the power of the people to propose amendments to the constitution through the
congress. Amendments only, people cannot revise constitution through initiative. Or the power
of legislation,the people can also propose and enact legislation but it must be subjected to
referendum. Okay?
> By initiative we mean either: 1. Initiative on the constitution, that is possible. 2. We also have
initiative on the statutes. National level, is provided for by law, people can propose laws. 3.

Initiative on local legislation 4. Indirect initiative that proposition is sent to congress or sent to
any local legislative body or such body to consider to pass such legislation. The people also
exercise legislative power through referendum and by referendum you mean what? It is the
power of the people to approve or reject legislation and it must be done through an election. By
congress, thats it. It can be done by congress acting as a body. What are the 2 houses of
congress: senate and house of representatives.
Sec.1 art6 states that legislative power shall be vested in the congress of the philippines which
shall consist of the senate and the house of representatives, except to the extent reserved to
the people by provision on initiative and referendum.
So lets ask who can be..ah no, what is the composition of the senate?
STUDENT: aRT.6 SEC2. the senate shall be composed of twenty four senators who shall be
elected at large by the qualified voters of the philippines as may be provided by law.
