ORDINANCE GRANTING FREE HOSPITALIZATION TO ALL RESIDENTS OF
MARIKINA CITY

WHEREAS, Section 15 Article II of the 1987 Constitution states that:
The State shall protect and promote the right to health of the
people and instill health consciousness among them.
WHEREAS, , RA 7160 otherwise known as the Local Government Code of 1991 mandates the
Local Government Units to promote the general welfare of their constituency and enact
ordinances which will promote the general welfare and health of their constituents within their
respective territorial jurisdictions;
WHEREAS, Paragraph (5) Subparagraph (xiv) of Section 458 of RA 7160
otherwise known as the Local Government Code of the Philippines states that:
SECTION 458. Powers, Duties, Functions and Compensation.(a)The Sangguniang Panlungsod, as the legislative body of the
city, shall enact ordinances approve resolutions and appropriate
funds for the general welfare of the city inhabitants x x x
(5) Approve ordinances which shall ensure the effective delivery of
the basic services and facilities as provided for under Section 17 of
this code, and in addition to said services and facilities, shall:

(xiv) Provide for the care of disabled persons, paupers, the aged,
the sick, persons of unsound mind, abandoned minors, juvenile
delinquents, drug dependents, abused children and other needy
disadvantaged persons, particularly children and youth below
eighteen (18) years of age; x x x.
WHEREAS, it is incumbent upon the City Government of Marikina to formulate
policies and adopts certain measure that will help the residents of Marikina to free
access on medical services and facilities.
NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED
BY THE SANGGUNIANG PANLUNGSOD OF MARIKINA in session duly
assembled that:

SECTION 1. This Ordinance grants free hospitalization to all residents of


Marikina City.
SECTION 2. Any officers or employees who are held responsible for the
violation of this Ordinance shall be solidarily liable together with the hospital and
shall be fined by Five Thousand pesos (Php 5,000.00)
SECTION 3. If any provision of this Ordinance is declared void and
unconstitutional the remaining provisions hereof not affected thereby shall remain
in full force and effect.
SECTION 4. Funds necessary for the due execution of this Ordinance shall be
charged from the Office of the Mayor.
SECTION 5. The City Health Office shall promulgate all the necessary rules and
regulations for the implementation of this Ordinance.
SECTION 6. All Ordinances and Resolutions or parts thereof which are
inconsistent with this Ordinance are hereby repealed and modified accordingly.
SECTION 7. This Ordinance shall take effect upon its approval.
