RULEI.MEMBERS:POWERS,DUTIESANDFUNCTIONS
SECTION1.COMPOSITION:
The Sangguniang Panlungsod, the Legislative Body of the City,
shall be composed of the City VICEMAYOR as Presiding Officer, the
regularSanggunianMembers,thePresidentoftheCityChapterofthe
LigangmgaBarangay,thePresidentofthePanlungsodnaPederasyon
ng mga Sangguniang Kabataan, and the sectoral representatives, as
members
In addition thereto, there shall be three (3) sectoral
representatives: one (1) from the Women and, as shall be
determined by the Sanggunian concerned within ninety (90) days
priortotheholdingofthelocalelections,one(1)fromtheagricultural

or industrial workers and one (1) from other sectors, including the
UrbanPoor,indigenousculturalcommunities,ordisabledpersons
The regular members of the Sanggunian Panlungsod and the
sectoral representatives shall be elected in the manner as may be
providedforbylaw.
SECTION 2. POWERS, DUTIES AND FUNCTIONS: The
Sangguniang Panlungsod, as the Legislative Body of the City, shall
enact ordinances, approve resolutions and appropriate funds for the
generalwelfareoftheCityanditsinhabitantspursuanttoSECTION16
oftheLocalGovernmentCode,asamendedandintheproperexercise
ofthecorporatepowersoftheCityasprovidedforunderSECTION22
ofthesameCode.
RULEII.OFFICERS:POWERSANDDUTIES
SECTION1.OFFICERS:ThefollowingshallbetheOfficersofthe
SangguniangPanlungsodoftheCityofMandaluyong.
A.TheVICEMAYOR.TheViceMayorshallbethePresiding
OfficeroftheSanggunian.
I.POWERSANDDUTIES.ThePresidingOfficershall
havethesepowersandduties.
a.Heshallpresideoverallsessionsofthe
Sanggunianwiththerighttovoteonlyto
breakatiehemaynot,however,be
compelledtovote
b.Heshallannouncethebusinessintheorderin
whichitistobeacteduponbythe
Sanggunian
c.Heshallrecognizeanymemberwhois
entitledtothefloor
d.Heshallstateallquestionsbeforethe
Sanggunianandputthesameintoavote,
whenregularlymoved,andannouncethe
resultthereof
e.Heshallassistinexpeditingbusiness
compatiblewiththerightsofthemembers,
allowingbriefremarksincasesofpending
debatablemotions,hemayhowever,co
sponsormeasures
f.Heshallenforceatalltimesorderand
decorum
g.Heshallruleonallpendingquestions,subject
toappealsbyMembersoftheSanggunian,
whichappealsshallnotbedebatable.Any
memberappealingmayexplainhisappealfor
notmorethanfive(5)minutes.Anyrulingon
anappealshallbesubmittedtothe
Sanggunianforitsapprovalordisapproval

emergency
m.IntheeventoftheinabilityofthePresiding
OfficertopresideattheSangguniansession,
thefirsthighestrankingmember,andinhis
inabilityorabsence,thesecondhighest
rankingmembershallbecalledupontoactas
thetemporaryPresidingOfficer.Heshall
certifywithinten(10)daysfromthepassage
ofordinancesenactedandresolutions
adoptedbytheSanggunianinthesession
overwhichhetemporarilypresided.
B.SECRETARYTOTHESANGGUNIAN
a.TheSanggunianshallhaveaSecretarywhoshallbea
careerofficialwiththerankandsalaryequaltoahead
ofdepartmentoroffice.
b.NopersonshallbeappointedSecretarytothe
SanggunianunlessheisacitizenofthePhilippines,a
residentoftheCityofMandaluyong,ofgoodmoral
character,aholderofacollegedegreepreferablyin
law,commerceorpublicadministrationfroma
recognizedcollegeoruniversityandafirstgradecivil
serviceeligibleoritsequivalent.
c.TheSecretarytotheSanggunianshalltakechargeof
theOfficeoftheSecretarytotheSanggunianand
shall:
1.AttendmeetingsoftheSanggunianandkeep

oftheinhabitantsallordinancesand
resolutionsimmediatelyaftertheirapproval,
andcausethepublicationofthesame
togetherwiththeoriginalversioninthe
mannerprovidedundertheLocalgovernment
Codeof1991
8.Heshallreadorcausetoberead,byhimself
orthroughareaderdesignatedbyhim,all
proposedordinances,motions,memorials,
petitionsandotherdocumentswhichheshall
reporttotheSanggunian,orwhenrequired
bytheSanggunianorbythePresidingOfficer
9.Heshallnotifyofficersandspecialcommittees
oftheirappointmentorcreations
10.Heshalltransmittothepropercommittees
mattersreferredtothembytheSanggunian
11.Heshallsendoutpropernoticesofallcalled
sessions,othermeetingsandpublichearings.
SECTION 2. OTHER OFFICERS. The following are the other
officersofthisSanggunian,towit:
A.MAJORITYFLOORLEADER.ThereshallbeaMajorityFloor
Leaderwhoshallbechosenfromwithintheranksofthe
dominantpartyandwhosefunctionsare,asfollows:

1.Heshallapprovemattersforinclusionintheagenda,
provided,however,thatanyproposedmeasureor
matternotincludedintheagendashallbecalendared
uponwrittenpetitionofthemajorityofthemembers
oftheSanggunian
2.Heshallmoveforapprovalofanyitemintheagenda
orforreferencethereoftothecorresponding
committee,hismotiontothiseffectrequiringno
second,provided,however,thatifthemotionis
objected,thesameyieldstothemotion,duly
seconded,ofanymemberoftheSanggunian
3.Heshallberesponsibleforassigningspeakers
belongingtothedominantpartytosponsorany
particularpieceoflegislationduringsessionsand
4.Heshallberesponsibleforplanningparliamentary
strategiesonthefloor,assigningspeakersbelonging
tothedominantpartyduringdebatesandliningupof
membersbehindpartisanissues.
B.ASSISTANTMAJORITYFLOORLEADER.Heshallbechosen
fromwithintheranksofthedominantpartyandshallactand
performthefunctionsoftheMajorityFloorLeaderinhis
absence.
C.MINORITYFLOORLEADER.Heshallbechosenfromwithinthe
ranksoftheminoritypartyorpartieswhoshallberesponsible
forplanningparliamentarystrategiesoftheirgroupincluding
theliningupofspeakersduringdebates.
SECTION 3. SANGGUNIAN MACE. There shall be a Sanggunian
Mace to be displayed during every session, special or regular, of the
Sanggunian.ThesergeantatarmsoftheSangguniangPanlungsod,if
any, shall take custody and safekeeping of the same and shall be
responsibleforbringingittoSessionHallduringeverysession.
RULEIII.SESSIONSANDQUORUM
SECTION 1. SESSION DEFINED. A session is a meeting which,
although lasting for several hours, is one meeting. The Sanggunian
shall meet in regular sessions at least once a week for transacting
business and when public interest so demands, such number of
special sessions as may be called by the Mayor, ViceMayor or by a
majorityofthemembers.AllSangguniansessionsshallbeopentothe
public unless a closeddoor session is ordered by an affirmative vote
of a majority of the members present, there being a quorum in the
publicinterestorforreasonsofsecurity,decency,ormorality.Notwo
(2)sessions,regularorspecial,maybeheldinasingleday.
InthecaseofspecialsessionsoftheSanggunian,awrittennotice
totheMembersshallbeservedpersonallyatthelattersusualplaceof
residenceatleasttwentyfour(24)hoursbeforethespecialsessionis
held.
Unless, otherwise, concurred in by twothirds (2/3) vote of the

SECTION 2. AGENDA. Matters that may be taken up in the
sessionoftheSanggunianshallbelimitedonlytothoseitemslistedin
same, the nature and substance of which must be described, except
thefollowing:
a.Afterthereadingoftheorderofbusiness,anymember
desiringtodeliveraprivilegespeechany,afterregistration
withtheMajorityFloorLeaderandwithpermissionofthe
PresidingOfficerfirsthad,speakfornotmorethantwenty
minutes,provided,however,thatifmorethanonemember
registersforthispurpose,eachspeakershallbelimitedto
onlyfifteen(15)minutes
b.WiththeconsentoftheSanggunian,urgentmattersmaybe
submittedonthefloor.Urgentmattersaresuchwhich
involvespublicinterest,thedelayintheconsiderationof
whichshallprejudiceessentialactivitiesofthegovernment.
c.Theagendashallbedistributedamongthemembersnotless
thantwo(2)daysprecedingthesession.
RULEV.ACTIONSBYTHESANGGUNIANGPANLUNGSOD
SECTION1.ITEMSINTHEAGENDA:GENERALRULE.Anymotion,
measure or proposal appearing in the agenda for reference to the
corresponding committee shall be subject to debate or discussion
debateoramendment,priortofinalaction.Explanatoryspeechbythe
authornottoexceedten(10)minutes,maybeallowedfollowingthe
readingofaparticularmatterappearingintheagenda.
SECTION 2. ORDINANCE, RESOLUTION PROCEDURE. Before an
ordinance or a resolution may be finally enacted, it shall undergo
threereadings,asfollows:
a.FIRSTREADING,whichshallconsistofthereadingbythe
Secretaryofthenumber,titleoftheproposedordinanceor
resolutionandthenameofitsauthororauthors,afterwhich

itshallbereferredbythePresidingOfficertotheappropriate
committeeorcommitteeswithoutdebate,provided,however,
thatuponmotion,dulyseconded,theproponentmaybe

b.SECONDREADING,atwhichtheproposedordinanceor
resolution,afterhavingbeensponsoredonthefloorbythe
committeechairmanorbyanycommitteememberdesignated
forthepurpose,shallbereadinfullinthemanner
recommendedbythecommitteeorcommittees,whereupon
themeasureshouldbesubject,firsttodebate,andthento
amendmentsandallproperparliamentarymotions.
c.THIRDREADING,atwhichnodebateoramendmentsshallbe
allowed,butthetitleoftheproposedordinanceorresolution
shallbereadandthequestionuponitspassageshallbe
immediatelytaken.Aresolutionshallbeenactedinthe
mannerprescribedforordinancebutitneednotgothrougha
thirdreadingforitsfinalconsiderationunlessitpartakesof
thenatureofanordinanceorunlessdecidedotherwisebya
majorityofallthemembers.
RULEVI.MINUTES
SECTION 1. THE MINUTES OF THE SANGGUNIAN. The record of
the proceedings of the Sanggunian shall be referred to as the
"MINUTES". It shall comprise a clear and succinct account of the
businesstransactedandtheactionstakenthereon.Theminutesshall
containthefollowing:
1.Natureofsessionheld(whetherspecialorregular)
2.NameofSangguniangPanlungsodoftheCityofMandaluyong
3.Date,timeandplaceofsession
4.ProperStatementofPresenceofPresidingOfficerand
members
5.Statementwhetherminutesofprevioussessionswere
approved,readingsdispensedwithandthedatesofsaid
sessioncitingcorrections
6.Title,numberandauthorsofeveryresolutionsorordinances,
iftheresolutionsorordinanceswerenotapproved
unanimously,abriefstatementoftheminorityopinion
nominalvoting
7.Allmainmotions(exceptthosewithdrawn)
8.Pointsoforderandappeals,whethersustainedorlost
9.VetomessageoftheMayor,infull
10.Timeofmeetingandadjournment
The minutes shall be signed by the Secretary and
authenticatedbythePresidingofficer.Itshallbeenteredina
good wellbound record book and the corresponding date of
approvalordisapprovalpropertyplacedtherein.

RULEVII.COMMITTEESOFTHESANGGUNIANGPANLUNGSOD
SECTION 1. COMMITTEE DEFINED. A committee constitutes one
ormorepersonsappointed,designatedorelectedbytheSanggunian
to consider, investigate, recommend or take appropriate action on
mattersorsubjectsreferredtoit.
a.ThePresidingOfficershallnotbeamemberofanystanding
committee.
Provided, however, that he may be designated by the
Sanggunian as Chairman of a special committee for special
purposes.
SECTION2.COMPOSITION.Acommitteeshallbecomposedofa
Chairmanandsuchnumberofmembersasmaybedeterminedbythe
Sanggunian,butalwaysintheoddnumbers.
SECTION 3. COMMITTEE PROCEDURE. The Committee shall
functionasfollows:
a.TheChairmanshallfromtimetotime,convenethecommittee
toameeting.Provided,however,thatiftheChairmanis
absentorshallneglectordeclinetoconvenesuchmeeting,
thecommitteemayneverthelessmeetuponthewritten
petitionofthemajorityofthemembersthereof.
b.Anypersonshallhavetherighttoappearatcommittee
meetingsandpresenthisviewonthematterbeforeit,atsuch
reasonabletimes,asupontherequest,thecommitteemay
schedule.
c.Duringfinaldeliberations,nopersonsshallbepresentexcept
thecommitteemembersandsuchemployeesofthe
Sanggunianasarenecessarytofacilitatetheperformanceof
itsfunctions
d.Allquestionsbeforethecommitteeshallbeputintoavote
unlessotherwisepreviouslyagreedupon.
e.Afterfinaldeliberationsandvoting,thecommitteeshall
prepare,forsubmissiontotheSanggunian,areporttobe
signedbytheChairmanandthemembersthereof.Any
memberdissentingfromthereportshallsubmit,inwriting,
hisreasonstherefore.
Provided, however, that if by reason of urgency, a verbal
reportissubmittedbyaChairmantoacommitteeconcerned,
said verbal report shall be considered the report of the
committeeunlessobjectedto,beatleasttwo(2)membersof
thecommittee.
SECTION 4. SPECIAL COMMITTEE. There shall be special
committee created from time to time by the Sanggunian for special
purposes. Special committees shall cease to exist as soon as the

Sanggunianshallhavereceivedtheirreports.Specialcommitteesshall
be independent of other committees but may adopt the procedure
prescribedintheprecedingsectionhereof.
SECTION 5. STANDING COMMITTEES OF THE SANGGUNIAN.
Unless otherwise agreed upon, the Sanggunian shall constitute the
following standing committees, with powers and prerogatives herein
stated:
1.COMMITTEEONAPPROPRIATIONS
Withgeneraljurisdictionover:
1.Allmatterspertainingtofundsfortheexpendituresof
theCityGovernmentandforthepaymentofpublic
indebtedness,claimsagainstthegovernment,
appropriationofpublicfundsandmatterspertaining
topublicexpenditures.
2.COMMITTEEONWAYSANDMEANS
With general jurisdiction over all matters pertaining to
revenue taxes, fees, loans, study and revision of tax
measuresandothersourcesandformsofrevenue.
3.COMMITTEEONLAWS,PEACEANDORDERANDPUBLIC
SAFETY.
Withgeneraljurisdictionover:
1.allmattersrelatingtotheRulesoftheSanggunian,
creationandreorganizationofCommittees
2.allmatterspertainingtothelegalityorvalidityof
measuresorproposalsaswellasallmattersrelating
tothelegalaspectsofactiontakenbyorsubmittedto
theSanggunian
3.allmattersconcerningthepoliceandfirestations
includingitsofficersandmen
4.allmatterspertainingtotrafficlaws,rulesand
regulationsanditsenforcement
5.allmatterspertainingtothecityjailanditsinmates
and
6.allmatterspertainingtothepreventionand/or
suppressionoflawlessness,riot,violence,rebellionor
seditionandpublicdisorder.
4.COMMITTEEONHEALTH,PUBLICWELFAREAND
ENVIRONMENTALPROTECTION
Withgeneraljurisdictiononmattersrelatingtothehealthand
welfare of the residents including measures mandatory to
existing city ordinances and resolutions on sanitation,
hospitalsandotheralliedhealthandsanitymeasures.

RULEVIII.GENERALRULESOFORDINANCES,RESOLUTIONS,
MOTIONS,COMMUNICATIONS,PETITIONSANDOTHERMATTERS
SECTION 1. PROPOSAL ORDINANCES, RESOLUTIONS, MOTIONS
AND OTHER MATTERS. These shall be signed by their authors and
shall be filed with the Secretary at least two (2) days before each
sessionwhoshallimmediatelytransmitthesametotheMajorityFloor
Leader for inclusion in the agenda. All communications and other
mattersendorsedbytheMayortotheSanggunian,aswellaspetitions
received from residents of the City, shall be transmitted by the
SecretarytotheMajorityFloorLeaderforthesamepurpose.
a.Afterdueconsiderationoftheproposedordinance,resolution,
motion,petitionorothermatter,theCommitteeconcerned
shallreportthesametotheSanggunian.
b.Duringtheconsiderationofthemeasuresmentionedinthe
nextprecedingparagraph,thesameshallbesubjectedto
debate,amendmentandallproperparliamentaryprocedures.
SECTION 2. DISCUSSION, INTERPELLATION. Main speeches
during the discussion of any measure shall be limited to twenty (20)
minutesforeachspeakerandrebuttalspeechesshallbelimitedtoten
(10) minutes. After three have spoken in favor and two against the
measure, alternately, or only one speech shall have been delivered
and none against, a motion to close the general debate shall be in
order.
Ifsaidmotionisapproved,theSanggunianshallthenproceedto
consider amendments under the five (5)minute rule. Only one
member being allowed to deliver a speech in favor and another
against the amendments. Any member desiring to amend and
amendment shall also be allowed five (5) minutes and another
opposing it another five (5) minutes, after which discussion shall be
terminated.TheSanggunianmay,byavoteofthemajority,closeall

debate at any time during the debate on all other amendments, the
motion for which shall not be debatable. This does not, however,
precludefurtheramendmentstobedecidedwithoutdebate.
After a general debate is closed, and the amendments disposed
of,themainmeasuresshallbevoteduponforfinalapproval.
No member shall be allowed to deliver more than once main
speechoronerebuttalspeechduringtheconsiderationofanymotion.
SECTION 3. MOTIONS AND THEIR PRECEDENCE. Unless
withdrawnbytheauthoronthedayofsubmission,everymotionfiled
shallbeincludedintheagenda.
a.Whenaverbalmotionispresented,thePresidingOfficershall
statesametotheCouncil.Ifinwriting,heshallcauseittobe
readbytheSecretarybeforebeingdebatedupon.Themotion
shallthenbeconsideredashavingbeenbroughttothe
attentionoftheCouncil.Itmaybewithdrawnatanytime
beforeadecisionishadthereonoranyamendmenttoitis
presentedthereto.
b.Iftherearequestionsunderdebate,noothermainmotions,
excepttoadjourntodeclarearecessortolayonthetable,
shallbeentertained.Theselattermotionsshallbedecided
withoutdebate.
c.Motionstopostponetoacertainday,todeferortopostpone
indefinitelyshallhaveprecedenceintheforegoingorder.
d.Nomotiontopostponetoacertainday,todeferorto
postponeindefinitely,whichhavingfailedofpassage,shall
againbeallowedonthesamedayandatthesamestageof
thequestion.
e.Whenageneraldebateonamotionorpropositionisclosed,a
motiontoamendandamotiontoamendanamendmentshall
beinorder.Itshallalsobeinordertoofferafurther
amendmentby"substitution"provided,however,thatthe
lattershallnotbevoteduponuntilaftertheoriginalmotionor
propositionisdisposedof.Anyamendmentmaybewithdrawn
beforeadecisionishadthereon.
f.Nomotionorpropositiononasubjectdifferentfromthat
underconstitutionshallbeadmittedundercolorof
amendments.
g.Beforeaquestioncouldbethesubjectofdiscussion,such
question,onmotiondulyseconded,shallbedividedifit
includespropositionssodistinctinsubstancethatwhenoneis
takenaway,anothersubstantivepropositionremains.
h.Amotiontostrikeoutandinsertisindivisiblebutamotionto
strikeoutbeinglost,shallneitherprecludeamendmentnor
motiontostrikeoutandinsert.
i.AmotiontoreadanypartoftheRulesisequivalenttoacall
toorderandshalltakeprecedenceoveranymotionexceptto
adjourn.
j.Whenvotingonamotionisnotdebatable,nootherremarks

SECTION 4. QUESTIONS OF PRIVILEGE: PROCEDURE. Questions

relatingtoadjournmentandrecess.
A.QUESTIONSOFPRIVILEGE:Whatconstitutes:
1.Questionsofsuchurgencyandrequiringimmediate
actionmayinterruptamembersspeech,asfor
example,whenanymotionorreportthatisbeing
readcannotbeheardinapartoftheSessionHall.
2.Questionsofpersonalprivilegesmustrelatetooneas
aMemberoftheSanggunianorelserelatetocharge
againsthischaracterwhichiftrue,woulddisqualify
himfrombecomingamemberoftheSanggunian.
a.PRIVILEGESOFTHESANGGUNIAN:
1.Thoserelatingtotheorganizationof
theSanggunian.
2.Thoserelatingtothecomfortofthe
MembersoftheSanggunianlike
seating,lighting,ventilating,etc.,of
theSessionHall.
3.Thoserelatingtothefreedomfrom
noiseandconductofofficersorother
employees.
4.Thoserelatingtopunishmentofa
Memberfordisorderlyconductor
otheroffenses.
5.Thoserelatingtotheaccuracyof
publishedreportsofproceedings.
B.PRIVILEGEDQUESTION:WHATAREINCLUDED:Privileged
questionsshallinclude,besidesquestionofprivilege,acallfor
theorderofthedayandprivilegemotionsrelatingto
adjournmentandrecess.
1.Acallfortheorderofthedayshallbeademandthat
theSanggunianconformtoitsorderofbusiness,a
motiontotheeffectrequiringnosecond.
2.Anymembershallhavetherighttodemandthatthe
orderofbusinessbeconformedto.
3.Anymemberwhoshallcallfortheorderoftheday
whenthereisnodeviationfromtheorderofbusiness
shallbedeclaredoutoforder.
SECTION5.DEBATE,DECORUMANDPROCEDURES.Forpurposes
ofdecorum,thefollowingrulesshallbeobserved:

a.Duringdebates,amembershallconfinehimselftothe
questionbeforetheSanggunianandshallavoidpersonalities.
Heshallobserveproperdecorumduringtheentire
proceedings.
b.Inreferringtoanothermember,thelattershallalwaysbe
referredtobyhisofficialtitlesoras"thememberswhospoke
last".
c.Beforeanymattershallbedebatedupon,amotionshould
firstbemadedulysecondedandstatedbythe"Chair".
d.Itshallonlybethe"Chair"whocanruleanyverbalmotionof
otherotherwise,theChairshallstatethequestionbeforethe
Councilforconsiderationandapproval.
e.Anymembermaymodifyamotionthroughsuggestions.The
movant,withtheconsentofthe"seconder"shallhavethe
righttomakesuchmodificationsashepleasesorwithdraws
initsentirelyamotionbeforethePresidingOfficerstatethe
question.
f.Forpurposesofobtainingthefloor,amembershallriseand
thenaddressthePresidingOfficer,"Mr.PresidentorMr.
Chairman".Themembercandosoonlyafteraformer
memberhasyieldedthefloor.
g.ThePresidingOfficershallbetheonlyauthoritytorecognize
anymemberbyannouncingthelattersnameasasignof
recognitiontothefloor.
h.WhentwoormoreMembersriseatthesametime,the
memberwhosenameisfirstcalledbythe"Chair"shallbe
entitledtothefloor.
i.Anymembersponsoringanymeasureunderconsideration
mayopenandclosethedebatewheregeneraldebatehas
beenorderedthereon.
j.WordsdesiredtobeexceptedbyanyMembershallbestated
aloudbythePresidingOfficer:Provided,however,thatthe
memberwhoutteredthesame
k.shallnotbeheldtoanswernorbesubjecttocensurebythe
Sanggunianiffurtherdebateoranotherbusinessintervenes.
l.WhentheSanggunianisinsession,nomembershallpass
betweenanotherwhohasthefloorandthe"Chair".
m.Nomembershallwalkoutoforacrossthesessionhallwhen
thePresidingOfficerisaddressingtheSanggunian.
SECTION 6. VOTING. If the question is undebatable, or debate
hasbeenclosedbyorderoftheSanggunian,the"Chair",immediately
afterstatingthequestion,shallputsametoavote,allowingonlysuch
timeformemberstoriseiftheywishtostateamotionofhigherrank.
a.ThePresidingOfficershallrisetoitaquestionintoavoteand
shalldoitinthisform:"Asmanyasareinfavor(asquestion
maybe),sayAYEandafteraffirmativevoiceisexpressed,"As
manyasareopposed,sayNAY".Ifhedoubtsoradivisionis

calledfor,theSanggunianshalldivide.Thoseinthe
affirmativeshallfirstrisefromtheirseatsorraisetheirhands,
andthenthoseinthenegative.
b.WhenthePresidingOfficerasksifthereisanyobjectiontoa
motionforapprovalofanyordinanceorresolutiondirecting
thepaymentofmoneyorcreatingliability,andnoone
registershisobjectionthereto,theSecretaryshallenterinthe
recordasvotingaffirmatively,thenamesofalltheMembers
presenttothatparticulartime,thishavingtheeffectofa
nominalvoting.
c.Nomembercanvoteonaquestioninwhichhehasadirector
personalpecuniaryinterest.Thisdoesnot,however,preclude
anyMemberfromvotingforhimselfforanypositionwithinthe
SangguniangPanlungsod.
d.AMembercanchangehisvoteonlybeforethe"Chair"
announcestheresultofthevoting.Aftertheannouncement,a
Membercanchangehisvoteonlybyunanimousconsent.
e.Anymembermayexplainhisvotenottoexceedfive(5)
minutes.
f.NomembercouldbecompelledtovoteHemay,however,
abstain.
g.AvotebyAYESandNAYSshallbeenteredintheminutesthis
havingtheeffectofanominalvotingevenafteravoteby
divisionhasbeenhad,attherequestofanymember
h.Nomotionorquestion,exceptonthepresenceofquorum
shallbeentertainedduringthevoting.
SECTION 7. RECONSIDERATION. When a report, motion,
resolution or proposed ordinance has been adopted or lost, only a
Memberwhovotedwiththeprevailingsideshallbeentitledtopresent
amotionforreconsiderationwhenthematterisstillwithinthecontrol
oftheSanggunian.Provided,however,thataMemberwhovotedwith
theminoritymaypresentamotionforreconsideration,ifsecondedby
a Member from the prevailing side. Any Member who abstain from
votingshallhaveabsolutelynorighttoaskforreconsideration.
RULEIX.DECLARATIONOFOUTOFORDERREFUSALTO
ABIDE:PUNISHMENT
SECTION 1. Any Member of the Sanggunian who shall fail to
observe the rules as prescribed herein shall be declared out of order
andifhehasthefloor,maybecompelledtotakehisseat.Incaseof
refusal to abide by the ruling of the Chair, the Sanggunian upon
motion of any Member and duly seconded, may officially reprimand
theerringMemberwhichreprimandshallappearintheMinutesofthe
SessionoftheSanggunian.Thesamepunishmentmaybeimposedfor
dereliction of duty, as when a Member refuses to attend the Session
afteraquorumisquestioned.
For other disorderly behavior and absences without justifiable
cause for four (4) consecutive sessions, a Member may likewise be
censured, reprimanded, or excluded from the session suspended for

notmorethansixty(60)days,orexpelled:Provided,thatthepenalty
of suspension or expulsion shall require the concurrence of at least
twothirds(2/3)voteofalltheSanggunianMembers:
Provided,further,thatamemberconvictedbyfinaljudgmentto
imprisonmentofatleastone(1)yearforanycrimeinvolvingmoral
turpitudeshallbeautomaticallyexpelledfromtheSanggunian.
RULEX.SUSPENSIONOFRULES
AnypartoftheseRulesrelatingtotheorderofbusiness,business
procedure,andlikeproceduralmatters,maybesuspendedbygeneral
consentorbytwothirdsvoteofthememberspresent.Arulemaybe
suspended to take up a question that has been postponed to some
othertimeortoadvanceitsconsiderationintheorderofbusinessor,
generally,todeviatefromtheregularprocedureofdoingbusiness,so
that the Council may be able to act with dispatch on important and
urgent matters without violating its own rules. In any case, the
suspension shall be for a purpose connected with the immediate
pendingquestionandnobusinessexceptthatdirectlyconnectedwith
thequestionforwhichtherulehasbeensuspendedcanbetakenup
during the period of such suspension. Once the business for which a
rulehasbeensuspendedisdisposedof,thesuspensionlosesitseffect
andtherulebecomeseffectiveagain.
RULEXI.SUPPLEMENTALRULES
SECTION1.TheRulesofProcedureandParliamentarypoliciesof
the Legislative Bodies of the Philippines and Parliamentary Rules by
Orendain shall serve as supplementary authorities of the Sanggunian
insofarastheyarecompatiblewiththeserulesandstandingorders.
RULEXII.AMENDMENTS
SECTION1.AnyamendmentstotheseRulesshallbepresentedin
writing and shall be adopted by a vote of twothirds (2/3) of all the
Members of the Sanggunian, Provided, however, that no amendment
to these Rules shall be presented within three (3) months from their
promulgation.
RULEXIII.REPEALINGCLAUSE
SECTION 1. Any and/or all previous resolutions inconsistent
herewith are hereby deemed repealed, modified or amended
accordingly.
RULEXIV.DATEOFEFFECTIVITY
SECTION 1. These Rules shall take effect immediately upon
approval.
ADOPTED on this 13th day of August 1998 in the City of
Mandaluyong.
