IT IS HEREBY- enacted in the '1-\vilrity-seventh Year of the Republic of India

1. '(1) This Act mat; be called Sze Provincial Insolvency (Utiar Yradesh Short title, ex- f
tent and applicaAmendment) 'Act, 1976.

2. In seclio~l 31 of the
I'l-of in(-in1 Insolvency . k t . 1920, hercit~nlter Amendment of
referred to as the principal Act,section 31 of Act
no. V of 1920.
(a) in sub-section (2) ,(i) for the words "revoked or renewed, the words "revoked,
modified or renewed" shall be substituted ;
(ii) the followi~lgproviso sf~allbe inserted, namely :"Provided that a protection order shall not apply to any debt
referred to in sub-section (I) of section 44" ;
(b) in sub-section ( S ) , in the. proviso, for the words "revoked, the
words "revoked or modified" shall be substituted.
3. In section 44 of d1e principal Act, in sub-section (1). for clause (4. Ameadrncnt of
the iollowing clauses shall be substituted, namely :section 44.
" (d) any liability under any agreement for maintenance or under any
ckaee or order for maintenance passed under any law Eor the time being
in forie ; or
(e) any debt or liability the amount due in respect of which is recoverable from him as arrears of land revenue under the Uttar Pradesh Public
Moneys (Recovery of Dues) Act, 19.72 or under any other law for the
time being in force."

4. (I) The Prosindal ~nsol~ency
(Uttar Pradesh Amendment) Ordinance,
1976,
is
hereby
repealed.

(2) Xot~vithstandingsuch repeal anythin5 done or any action taken under

the przncipal Act as amended by the aforcsald Ordinance shall be deemed to

haw been done or taken under the corresponding provisions of the principd

Act as amended by this Act, as if this Act was in force at dl material times.
