Maricopa County Board of Supervisors, Denny Barney, Steve Chucri, Andy Kunasek,

Clint Hickman, Steve Gallardo, Maricopa County Recorder and Elections Department,
27
Helen Purcell, and Karen Osborne (the County or County Defendants) respectfully
28
submit this joint motion to inform the Court of the possibility of settlement with respect to
Plaintiffs claims against the County regarding e-pollbook allocation and polling locations
in Maricopa County and to request that all deadlines and proceedings relating to those
claims be continued pending an update no later than the end of next week from the
Plaintiffs and the County regarding the possible settlement. As a result of recent
settlement discussions, counsel for the County Defendants have agreed to recommend that
The Maricopa County Board of Supervisors will not meet before the Reply
deadline, which is August 30, 2016, and Oral Argument, which is September 2, 2016, and

therefore no binding agreement among the Plaintiffs and the County Defendants can
11
potentially be reached until next week. Given the possibility of settlement, however,
12
Plaintiffs and the County believe that it would be inefficient for them and for the Court to
13
move forward with further filings regarding Plaintiffs motion for a preliminary injunction
14
relating to e-pollbook allocation and polling locations in Maricopa County or with the
15
portion of the September 2, 2016 hearing relating to those issues. They accordingly
16
request that the Court continue all deadlines and proceedings relating to Plaintiffs claims
17
regarding e-pollbook allocation and polling locations in Maricopa County, and that they
18
be permitted to send a status report to the Court regarding those claims no later than
19
September 9, 2016.

For clarity, this potential agreement has no bearing on Plaintiffs claims in this case
21
regarding HB2023 or out-of-precinct voting and therefore should not impact any
22
deadlines or the portion of the September 2, 2016 hearing regarding Plaintiffs motion for
23

The Defendants in this case other than the County Defendants do not object to
25
continuance of the deadlines and proceedings relating to the claims against the County
26
regarding e-pollbook allocation and polling locations in Maricopa County. However, the
27
State Defendants and Intervenor-Defendants do not agree that dismissal of the County
28
Defendants from all claims would have no bearing on Plaintiffs claims in this case

voting for the reasons stated in footnote 4 of Secretary of State Michele Reagans

Court continue the filing deadline for Plaintiffs Joint Reply in Support of Their Motion

for Preliminary Injunction on Provisional and Polling Place Allocation Claims (Reply)
18
and postpone oral argument on the claim. Moving parties have jointly advised the Court
19
that they are engaging in settlement negotiations and that there is no further need at this
20
time for the Court to consider Plaintiffs Joint Motion for Preliminary Injunction as to the
21
polling place allocation claim only. Good cause appearing, the Court grants the stipulated
22
motion and hereby orders moving parties to file a status report apprising the Court of the
23
status of the claim by September 9, 2016. All other deadlines remain in effect as to the
24
claim regarding out-of-precinct provisional ballots, which the Court will consider at oral
25
