The Grand Jury for the District of Maryland charges that:
No later than early 2002, through the date of this Indictment, in the District of Maryland,
and elsewhere, the defendants,

together with others known and unknown to the Grand Jury, did knowingly and willfully
combine, conspire, confederate, and agree with each other and with others known and unknown
to the Grand Jury to knowingly, intentionally, and unlawfully distribute and possess with intent
to distribute one kilogram or more of a mixture or substance containing a detectable amount of
heroin, a Schedule I controlled substance; 280 grams or more of a mixture or substance
containing a detectable amount of cocaine base, a Schedule II controlled substance; 5 kilograms
or more of a mixture or substance containing a detectable amount of cocaine, a Schedule II
controlled substance; a detectable amount of marijuana, a Schedule I controlled substance; a
detectable amount of oxycodone, a Schedule II controlled substance; in violation of Title 21,
United States Code, Section 841(a)(1).
Manner and Means of the Conspiracy
Among the manner and means by which the defendants and others conducted and
participated in the conduct of the conspiracy were the following:
a.

Members of the conspiracy, identified herein as the Hillside Enterprise,

distributed narcotics in Cherry Hill and elsewhere. The primary location for the distribution of
cocaine, cocaine base (commonly known as crack), heroin, oxycodone and marijuana, was the
600 block of Cherry Hill Road in Baltimore City, Maryland, an area known as the Cherry Hill
Shopping Center. Distribution activities were also conducted in other locations throughout

Cherry Hill, and in west and southwest Baltimore City.


b.

Members of the Hillside Enterprise used the proceeds of the sale of

narcotics to purchase firearms, to enrich themselves, and to further the activities of the
organization, including narcotics trafficking.
c.

Members of the Hillside Enterprise used residences in and around Cherry

Hill to cut and package quantities of controlled substances, primarily heroin, cocaine and crack
for distribution. These locations included but were not limited to two locations: A house at 453
Roundview Road and an apartment at 2300 Terra Firma Road in Cherry Hill. Only trusted
members of the Hillside Enterprise were admitted to these locations during the preparation of
controlled substances for sale. Members of the enterprise often distributed small amounts of
controlled substances to the tenants as payment for the use of their homes. Sometimes the tenant
was given cash. In an effort to distinguish their narcotics, members used colored topped vials or
colored the drugs with food coloring.
d.

Members of the Hillside Enterprise committed and caused to be

committed home invasion and street robberies in order to fund their narcotics activities and
intimidate others who would interfere with their enterprise. This included intimidating victims
of their violent acts in order to prevent or hinder prosecutions.
e.

Members of Hillside committed and caused to be committed acts of

violence in furtherance of the organizations activities, including shootings, beatings, murders,


and other violence in order to intimidate others who would interfere with their narcotics
trafficking. Acts of violence were also committed as discipline and sanctions of members
within the Hillside Enterprise for transgressions, real or perceived, against the conspiracy.
f.

Members of the Hillside Enterprise routinely carried firearms in

furtherance of the narcotics conspiracy. Firearms were obtained from persons both inside and
outside of Cherry Hill.
g.

Members of the Hillside Enterprise used gang signs to communicate and

some had tattoos reflecting their allegiance to the conspiracy.


h.

Members of the Hillside Enterprise routinely trespassed in public housing

areas in Cherry Hill for the purpose of distributing narcotics and attacking their rivals. Members
routinely trespassed at the Cherry Hill Shopping Center, where they were banned by the
merchants. Members resisted law enforcement attempts to arrest them, by fleeing in vehicles, by
arguing loudly, and by physically resisting. Members created disturbances in public places, and
threatened shop owners at the Cherry Hill Shopping Center who would call the police or ask
them to move along and sell their controlled substances elsewhere. These intimidation tactics
were designed to strengthen the enterprise, maintain their controlling presence, and to thwart law
enforcement intervention.
Overt Acts
The defendants and members and associates of the Hillside Enterprise committed acts in
furtherance of the Enterprises objectives, to include, but not limited to, the following:
A. 2002 - 2004.
(1)

On or about March 14, 2002, in or near the 800 block of Roundview Road

in Baltimore City, Maryland, BURRELL did possess a firearm, specifically a loaded Rossi, .38
caliber revolver, bearing serial number D443474, and did possess marijuana with the intent to
distribute. BURRELL resisted law enforcement attempts to effect an arrest.
(2)

On or about February 13, 2003, in or near the 2800 block of Spelman

Road in Baltimore City, Maryland, BURRELL did use, carry and discharge a firearm,

specifically a 9 mm firearm, did murder Lamont Johnson, and did attempt to murder another,
Victim #1, both members of a rival organization called Up Da Hill (UDH). This act was
committed in retaliation for the murder of a member of the Hillside Enterprise on January 11,
2003, in the 600 block of Cherry Hill Road.
(3)

On or about February 17, 2003, in or near the 2800 block of Spelman

Road in Baltimore City, Maryland, BURRELL and one or more members of the Hillside
Enterprise did use, carry and discharge firearms, did murder Odell Winkey and Quandre Napper,
and did attempt to murder another, Victim #2, all members of UDH. These acts were committed
in retaliation for the murder of a member of the Hillside Enterprise on January 11, 2003, in the
600 block of Cherry Hill Road.
(4)

On or about December 2, 2004, in or near the 900 block of Coppin Court

in Baltimore City, Maryland, McNUTT did possess with intent to distribute both cocaine base
and marijuana.
(5)

On or about December 8, 2004, in or near the 600 block of Cherry Hill

Road in Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine base.
B. 2005.
(1)

On or about November 17, 2005, in or near the 3000 Belmont Avenue in

Baltimore City, Maryland, McNUTT did possess with intent to distribute cocaine base.
C. 2006.
(1)

On or about January 2, 2006, in or near the 3000 block of Seabury Road in

Baltimore City, Maryland, WHITE did distribute cocaine base.


(2)

On or about January 16, 2006, in or near the 2600 block of Seamon

Avenue in Baltimore City, Maryland, CHERRY did possess a firearm, specifically a loaded PJK

9 mm semi-automatic pistol, bearing serial number B62713.


(3)

On or about January 21, 2006, in or near the 1200 block of Slater Road in

Baltimore City, Maryland, LUSTER, and one or more members of the Hillside Enterprise, did
use, carry and discharge a firearm, and did murder Clyde Tatum, a member of UDH.
(4)

On or about May 11, 2006, in or near the 600 block of Cherry Hill Road in

Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine.
(5)

On or about July 7, 2006, in or near the 2600 block of Seamon Avenue in

Baltimore City, Maryland, BURRELL, and one or more members of the Hillside Enterprise did
possess with intent to distribute heroin.
(6)

On or about September 18, 2006, in or near the 2900 block of Southland

Avenue in Baltimore City, Maryland, LUSTER, and one or more members of the Hillside
Enterprise, did use, carry and discharge a firearm, and did attempt to murder two individuals,
Victim #3 and Victim #4, who were driving through Hillside territory.
(7)

On or about September 19, 2006, in or near the 3000 block of Seabury

Road in Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine and
marijuana.
(8)

On or about November 26, 2006, in or near the 1200 block of Shellbanks

Road in Baltimore City, Maryland, K. LAWSON, and one or more members of the Hillside
Enterprise, did use, carry and discharge a firearm , did murder Bernard Simon, a minor, and did
attempt to murder two other persons, Victim #5 and Victim #6.
(9)

On or about December 4, 2006, in or near the 2600 block of Seamon

Avenue in Baltimore City, Maryland, BURRELL, CHERRY, and one or more members of the
Hillside Enterprise, assaulted law enforcement officers.

(10)

On or about December 15, 2006, in or near the 500 block of Bridgeview

Road in Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine.
D. 2007.
(1)

On or about April 19, 2007, in or near the 2400 block of Seabury Road in

Baltimore City, Maryland, FLOYD, and one or more members of the Hillside Enterprise, did
attempt to commit an armed robbery, did use, carry, and discharge firearms, did murder,
Christopher Wayman, and did attempt to murder another, Victim #7.
(2)

On or about October 31, 2007, in or near the 2500 block of Seabury Road

in Baltimore City, Maryland, on the grounds of the Dr. Carter G. Woodson Elementary School,
ALEWINE did possess a firearm, specifically a loaded Davis Industries, Model P380, .380
caliber, semi-automatic pistol, bearing serial number AR368650.
E. 2008.
(1)

On or about June 1, 2008, in or near the 1100 block of Slater Road in

Baltimore City, Maryland, WILLIAMS, and one or more members of the Hillside Enterprise,
did use, carry and discharge firearms, and did attempt to murder three members of UDH, Victim
#8, Victim #9, and Victim #10.
(2)

On or about July 5, 2008, in or near the 3000 block of Elizabeth Street in

Baltimore City, Maryland, one or more members of the Hillside Enterprise, did use, carry and
discharge firearms, and did attempt to murder two individuals during the commission of a
robbery. One of the two firearms used was the same .45 caliber firearm used by members of
Hillside on June 1, 2008 attempting to murder three members of UDH.
(3)

On or about July 10, 2008, in or near the 600 block of Cherry Hill Road in

Baltimore City, Maryland, LUSTER did possess with intent to distribute cocaine.

(4)

On or about July 14, 2008, in or near the 2800 block of Round Road in

Baltimore City, Maryland, K. LAWSON, and one or more members of the Hillside Enterprise,
did use, carry and discharge firearms, specifically (1) a stolen Colt Ruger Blackhawk, .45 caliber
revolver, bearing serial number 4707050; (2) a US Military, 1911 US Navy, .45 caliber, semiautomatic pistol, with an obliterated serial number; and (3) a 9 mm handgun, and did attempt to
murder a member of UDH, Victim #11. The U.S. Military, .45 caliber firearm was also used by
members of Hillside on June 1, 2008, and July 5, 2008.
(5)

On or about July 30, 2008, in the 600 block of Cheraton Road in

Baltimore City, Maryland, S. LAWSON did possess with intent to distribute cocaine.
(6)

On or about August 5, 2008, in or near the 600 block or Cherrycrest Road

in Baltimore City, Maryland, BURRELL did possess with intent to distribute marijuana.
(7)

On or about August 7, 2008, in or near the 2700 block of Carver Road in

Baltimore City, Maryland, on the grounds of the Cherry Hill Elementary School, FLOYD did
use, carry and discharge a firearm, specifically a Ruger .357 magnum revolver, bearing serial
number 15267166.
(8)

On or about October 11, 2008, in or near the 600 block of Cherry Hill

Road in Baltimore City, Maryland, CHERRY assaulted a woman by spitting, punching and
choking her because she did not fuck with Hillside Boys.
F. 2009.
(1)

On or about February 4, 2009, in or near the 600 block of Cherry Hill

Road in Baltimore City, Maryland, BURRELL did possess with intent to distribute cocaine.
(2)

On or about February 11, 2009, in or near the 2400 block of Seabury Road

in Baltimore City, Maryland, JOHNSON did possess with intent to distribute cocaine.

(3)

On or about March 4, 2009, in or near the 500 block of Bridgeview Road

in Baltimore City, Maryland, RICE, and one or more members of the Hillside Enterprise,
did possess cocaine and firearm, specifically a loaded Valor .22 caliber revolver, bearing
serial number 571697.
(4)

On or about March 9, 2009, in or near the 2500 block of Seabury Road in

Baltimore City, Maryland, LUSTER did possess with intent to distribute cocaine.
(5)

On or about April 3, 2009, in or near the 2800 block of Georgetown Road

in Baltimore City, Maryland, CHERRY, and one or more members of the Hillside Enterprise,
did possess with intent to distribute marijuana.
(6)

On or about July 2, 2009, in or near the 2400 block of Seabury Road in

Baltimore City, Maryland, LUSTER did possess with intent to distribute cocaine.
(7)

On or about July 23, 2009, in or near the 600 block of Cheraton Road in

Baltimore City, Maryland, WILLIAMS did possess with intent to distribute both heroin and
marijuana.
(8)

On or about August 11, 2009, in or near the 2800 block of Carver Road in

Baltimore City, Maryland, one or more members of the Hillside Enterprise, did use, carry and
discharge a firearm, and did shoot an innocent bystander, in an attempt to murder a member of
UDH.
(9)

On or about August 15, 2009, in or near the 800 block of Bridgeview

Road in Baltimore City, Maryland, JOHNSON did possess marijuana and a firearm, specifically
a loaded Hi Point Model JHP, .45 caliber semi-automatic pistol, with an obliterated serial
number. The same firearm was used by members of the Hillside Enterprise on August 11, 2009
when they attempted to murder a member of UDH.

On or about August 19, 2009, in or near the 600 block of Cherry Hill Road

in Baltimore City, Maryland, McNUTT did possess with intent to distribute, and did distribute
cocaine base and heroin.
(11)

On or about August 27, 2009, in or near the 2900 block of Southland Road

in Baltimore City, Maryland, RICE did possess a firearm, specifically a loaded Astra, .357
magnum revolver, bearing serial number 163057.
(12)

On or about September 1, 2009, in or near the 3000 block of Seabury

Road in Baltimore City, Maryland, ALEWINE did possess a firearm, specifically a loaded
Yorktown, .44 magnum revolver, bearing serial number 21712.
(13)

On or about October 19, 2009, in or near the 2900 block of Lakebrook

Circle in Baltimore County, Maryland, WILLIAMS, CONLEY, and one or more members of
the Hillside Enterprise, did use, carry and discharge a firearm, and did attempt to rob a member
of rival enterprise, Lakebrook Circle Boys.
(14)

On or about October 21, 2009, in or near the 3000 block of Bero Road in

Baltimore County, Maryland, WILLIAMS, and one or more members of the Hillside Enterprise,
did use, carry and discharge a firearm, and did attempt to murder a member of rival enterprise,
Lakebrook Circle Boys, Victim #12.
(15)

On or about October 25, 2009, in or near the 3000 block of Bero Road in

Baltimore County, Maryland, WILLIAMS, HORSEY, and one or more members of the
Hillside Enterprise, did use, carry and discharge a firearm, and did murder Tracey Bowers, an
innocent bystander, while attempting to murder a member of rival enterprise, Lakebrook Circle
Boys.

On or about December 28, 2009, in or near the 800 block of Bethune Road

in Baltimore City, Maryland, WILLIAMS, and one or more members of the Hillside Enterprise,
did possess a firearm, specifically a loaded Ruger P89, 9 mm semi-automatic pistol, bearing
serial number 96701. This is one of the firearms used to murder Tracey Bowers on October 25,
2009.
G. 2010.
(1)

On or about April 13, 2010, in or near the 800 block of Coppin Court in

Baltimore City, Maryland, K. LAWSON did possess a firearm, specifically a Smith & Wesson,
.38 caliber revolver, bearing serial number 215444.
(2)

On or about May 2, 2010, in or near the 600 block of Cherry Hill Road in

Baltimore City, Maryland, LUSTER did use, carry and brandish a firearm during the
commission of a robbery.
(3)

On or about May 3, 2010, in or near the 2300 block of Eutaw Place in

Baltimore City, Maryland, RICE, and one or more members of the Hillside Enterprise, did use,
carry and brandish firearms during the commission of a robbery.
(4)

On or about May 22, 2010, in or near the 2900 block of Denham Circle in

Baltimore City, Maryland, CHERRY did use, carry and discharge a firearm, and did murder
Larry Griffin, a member of UDH.
(5)

On or about May 22, 2010, in or near the 600 block of Pitcher Street in

Baltimore City, Maryland, CHERRY did possess a firearm, specifically a loaded Glock 19, 9
mm semi-automatic pistol, bearing serial number MYL-133. This pistol had an extended
magazine and contained 21 rounds. This is the same firearm used to murder Larry Griffin
earlier on the same day.

On or about June 19, 2010, in or near the 600 block of Cherry Hill Road in

Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine.
(7)

On or about June 21, 2010, in or near the 900 block of Seagull Avenue in

Baltimore City, Maryland, WILLIAMS, and one or more members of the Hillside Enterprise,
did possess with intent to distribute both cocaine and heroin.
(8)

On or about September 9, 2010, in or near the 600 block of Cherry Hill

Road in Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine.
(9)

On or about September 26, 2010, in or near the 3100 block of W. North

Avenue in Baltimore City, Maryland, EVANS, HORSEY, and one or more members of the
Hillside Enterprise, committed a robbery.
H. 2011.
(1)

On or about January 16, 2011, in or near the 3000 block of Seabury Road

in Baltimore City, Maryland, BURRELL, and one or more members of the Hillside Enterprise,
did use, carry, and brandish a firearm, specifically a loaded Smith & Wesson, .22 caliber pistol,
with an obliterated serial number, during the commission of a robbery. BURRELL did possess
marijuana.
(2)

On or about April 1, 2011, in or near the 2500 block of Seabury Road in

Baltimore City, Maryland, JOHNSON did possess with intent to distribute heroin.
(3)

On or about June 24, 2011, in or near the 200 block of Reedbird Avenue

in Baltimore City, Maryland, WILLIAMS, HORSEY, and one or more members of the Hillside
Enterprise, did possess with intent to distribute marijuana.
(4)

On or about July 24, 2011, in or near the 2500 block of Seamon Avenue in

Baltimore City, Maryland, K. LAWSON, and HORSEY, did use carry and discharge a firearm,

specifically a 9 mm handgun, and did attempt to murder another member of Hillside Enterprise,
Victim #13, as punishment for having been arrested with marijuana and distribution proceeds.
(5)

On or about August 1, 2011, in or near the 2900 block of Waterview

Avenue in Baltimore City, Maryland, DUKES did attempt to murder a law enforcement officer,
Victim #14, with a motor vehicle. K. LAWSON was in the vehicle with DUKES.
(6)

On or about August 24, 2011, in or near the 600 block of Cherry Hill Road

in Baltimore City, Maryland, EVANS, and one or more members of the Hillside Enterprise, did
use, carry and brandish a firearm during the commission of a robbery.
(7)

On or about October 17, 2011, in the 800 block of Seagull Road in

Baltimore City, Maryland, CONLEY did possess with intent to distribute cocaine.
(8)

On or about October 19, 2011, in or near the 700 block of Cherry Hill

Road in Baltimore City, Maryland, JOHNSON did possess with intent to distribute cocaine.
(9)

On or about November 5, 2011, in or near the 600 block of Cherry Hill

Road in Baltimore City, Maryland, JOHNSON did possess with intent to distribute cocaine.
(10)

On or about November 27, 2011, in or near the toll plaza, northbound at

the Baltimore Harbor Tunnel on I-895 in Baltimore City, Maryland, WILLIAMS, McNUTT
and one or more members in the Hillside Enterprise did possess marijuana and paraphernalia
used for the packaging and distribution of controlled substances, specifically, four digital scales,
screen strainers, multiple empty ziplock bags in assorted colors, multiple empty glass vials, and
multiple vial caps in assorted colors.
I. 2012.
(1)

On or about January 13, 2012, in or near the 400 block of Roundview

Road in Baltimore City, Maryland, McNUTT, JOHNSON, WILLIAMS and CONLEY did

assault another member or associate of the Hillside Enterprise as punishment for mishandling a
quantity of controlled substances. In addition to other implements, the defendants used sticks, a
hammer, and a brick or cinder block to strike their associate upon the head. At a later date,
WILLIAMS and one or more members of the Hillside Enterprise used intimidation and caused
the victim to recant.
(2)

On or about January 18, 2012, in or near the 2100 block of W. Patapsco

Avenue in Baltimore City, Maryland, McNUTT, JOHNSON and CONLEY did possess heroin,
and one .22 caliber round of ammunition.
(3)

On or about January 22, 2012, in or near the 3300 block of Winterbourne

Avenue in Baltimore City, Maryland, McNUTT did possess three firearms, specifically (1) a
loaded, Taurus .357 magnum revolver, bearing serial number 5240279; (2) a loaded, Hi Point .45
caliber semi-automatic pistol, bearing serial number X4154483; and (3) a loaded Walther .22
long rifle, semi-automatic pistol, bearing serial number L095580.
(4)

On or about February 10, 2012, in or near the 600 block of Cherrycrest

Road in Baltimore City, Maryland, WHITE did possess with intent to distribute both cocaine
base and marijuana.
(5)

On or about March 6, 2012, in or near the 3000 block of Seamon Avenue

in Baltimore City, Maryland, ALEWINE did possess with intent to distribute marijuana, a scale,
and packaging paraphernalia used for the distribution of controlled substances.
(6)

On or about June 2, 2012, in or near the 2500 block of Terra Firma Road

in Baltimore City, Maryland, DUKES did possess with intent to distribute cocaine.

On or about June 13, 2012, in or near the 600 block of Cherry Hill Road in

Baltimore City, Maryland, WHITE did distribute and possess with intent to distribute both
cocaine and marijuana.
(8)

On or about June 21, 2012, in or near the 700 block of Reedbird Avenue

in Baltimore City Maryland, WHITE did possess with intent to distribute cocaine.
(9)

On or about July 5, 2012, in or near the 400 block of Roundview Road in

Baltimore City, Maryland, WHITE did possess with intent to distribute cocaine.
(10)

On or about August 6, 2012, in or near the 2700 block of Giles Road in

Baltimore City, Maryland, WILLIAMS, FLOYD, ALEWINE, DUKES and one or more

Terra Firma Road in Baltimore City, Maryland, K. LAWSON, BURRELL, TRUEHART,


RODGERS, SEAWELL, ALEWINE, and one or more members of the Hillside Enterprise,
prepared a quantity of controlled substances for distribution in Cherry Hill. TRUEHART did
distribute one vial of cocaine to the tenant as payment for the use of the apartment.

or more members of the Hillside Enterprise, prepared a quantity of controlled substances for

Bonner, an associate of the Hillside Enterprise in retaliation for an attack on LUSTER by a
