major objectives of shariah: what the ehkamaat are leading to it.

2)protection of life
3)protection of intellect
4)protection of progeny/honour.
5)protection of finance.
nations are build around ideologies. ideologies run supreme. you are willing to
give and take lifes for. therefore it comes before life.

rationale behind islamic state and ummah is ideology. distinction is always base
d of ideology. You can only choose your ideology.
for the matter of state all people and humans are equal. the only thing that dif
ferentiates the two is ideology. not the language, race or background
distinction is okay, discrimination is not.
promote all the positives for ideology, and stop all the negatives that hurt the
ideology. protection of deen is also protection of language. you cannot
skip or eradicate arabic and offer namaz. thuss language is also the expression
of your deen.
sub levels of these objectives(choice levels)
- absolute necessity eg:(namaz)
- should have eg:(wuzu)
- good to have eg:(perfume and extra add ons)
sometimes choices are made to improve the lives of others. there are conditions.
the should have can be let go to protect the must have.
constituion says learn arabic. because if you know arabic it will protect deen,
and you won't go to ulema's for everything because
you'd understand and will be able to interpret.
principles of shariah:
1)harj-ruling at one point should not cause defeciency in another point.
2)yasar- ease. the ruling that applies is that of ease. you take the most easies
t way out. the concept of shariah is that it's very difficult
and that it should be complicated. Actually there is a principle based approach
and thus life becomes easy. Asaan wala fatwa do. don't create
complications. otherwise you'll end up driving people away from deen.
islamic state has to be secular. equal treatment for X and Y. then individual co
ncerns of minorities are dealt separately.
majority rights should not be undermined due to minority. but minority rights ha
ve to be taken care of. exceptions are made but laws are made on general
rules. keeping in mind general aspects.
islamic law making is completely independent of state.
