As per above reference Government Resolution dated 12/12/2012 the revised policy has
been prescribed in respect of renewal of lease expired on the government land in Brihanmumbai
and the copy of said government resolution is enclosed herewith. The said Government
Resolution is available on mumbaicity.nic.in (website) of Collector Mumbai City Office vide
also it is available at Maharashtra.gov.in (website) of the Government of Maharashtra.
Accordingly, the option is open to you to convert the land occupied by lease into
occupant class-2 by occupation right. Therefore, If you desire to hold the said land by occupation
right in occupant class-2 tenure, then you have to furnish such option in the attached prescribed
"Form-B" format upto 30th June, 2013. If you are not willing to hold the said land in the tenure
of Occupant Class-2 by occupation right, then such option has to be submitted in the prescribed
attached format "Form-A" up to 30th June, 2013.
For conversion of the above lease hold land into occupant class-2 tenure by occupation
right, you have to pay the conversion tax on the rate of open land as per below table for annual
market rate applicable to the date of conversion, as follows.

If the purpose is changed/to be changed, permitted while granting lease, then you have to
pay separate conversion tax at the prescribed rate by the government from to time.
Therefore, as per above provisions, the conversion tax of the land occupied by you by
lease hold for commercial purpose is as follows.

If you agree to pay the above conversion tax to the Government, then you may submit
your option on stamp paper of Rs.200/- in the attached prescribed format "format-B" in this
office before dt.30th June, 2013 and submit the undertaking stating there in that the terms and
conditions mentioned in the attached prescribed format "Form-C" are acceptable & agreed to
you.
Also, this is to inform that, after holding the said land as occupant class-2, and then all
provision applicable to land of the occupant class-2 tenure will be attracted. Accordingly, it is
necessary to obtain advance permission of the Competent Authority before doing transaction by
way of sub division, transfer, change of use, pledge of the land etc. also redevelopment of the
land and it is binding to pay the amount of share of government in the unearned income and/or as
it is fee/ premium/ license fee for such prior permission.
After conversion into occupant class-2 tenure by occupation right of the land occupied by
lease hold on the grounds of the provisions of Section 295 of the Maharashtra Land Revenue
Code, 1966, then the question does not arise to charge lease rent on such land hereafter.
However, the non agriculture tax assessment will be made on such land at the prevailing rate as
per Section 262 of the Maharashtra Land Revenue Code, 1966 and Mumbai City Revenue
Assessment Rule 1989 there under and it is binding to pay that amount every year.
The option for holding land by occupant class-2 tenure by occupation right, occupied by
lease basis will be available to the lease holder for two years period from the date of this order
i.e. from date 12/12/2012 to 11/12/2014. It means, you can give option as above before dated
11/12/2014 even after renewal of lease of the said property.
3. If you have not filed the option as above within prescribed time and/or you are not
interested to convert the lease hold land into the tenure of occupant class-2 by occupation right,
then the renewal of your lease hold will be made for 30 years from dt.1/01/2012 as follows.
a)
Since your lease hold has been expired on .., hence the deemed renewal of said
lease will be made up to end of 31/12/2011 after payment of said lease rent at old rate upto 31st
December 2011.
b)
Thereafter the renewal of said lease will be made for 30 years from 1st January 2012.
Therefore, you have to pay the following revised lease rent every year as per formulae mentioned
in Paragraph 4b(1)(a) under the Government Resolution No.Land 2505/C.N.405/L-2 dated
12/12/2012.

As per Paragraph 4b(1) under the reference Government Resolution, the above lease rent
will applicable from 1st January 2012 to 31st December 2016. Thereafter, as per provisions
under 4b(1)(d) the increase will be made considering the rate of Ready Reckoner at that time
after every five years, i.e. 1st January 2017, 1st January 2022 respectively.
d)
But, at this place, this is clarified that, if any type of violation of condition is made in
respect of said lease hold land and/or made irregular transfer, then the separate action will be
initiated in that case and the decision will be passed as per merits of each matter. Thereafter, the
decision will be taken about renewal of said lease hold. The provisions of the said reference
government resolution will not be applicable automatically in such matters. Therefore, due to
said notice, it should not be treated as the said land made in the tenure of occupant class-2 by
occupation right and/or you had obtained any right.
If you have any objection about the amount of said occupation right, then you may
inform the said objection in writing within 15 days time from the receipt of this letter to this
office. If your option would not received within prescribed time, then further action will be
initiated as per rules by treating you have nothing to say therein.

Resolution No.Land 2505/C.N. 405/L-2 dated 12/12/2012 of Revenue & Forest Dept. of the
Government and you letter No. . dt. / / 2013, and after holding the said land as Occupant
Class-2, then all provisions under section 29 of the Maharashtra Land Revenue Code, 1966
applicable to the land of tenure of occupant class-2, also the amendments made in this
connection from time to time by the Government will also applicable to the land granted to me,
which I know and I am aware of it. Therefore, it is necessary to obtain prior permission of
Collector/ Government before doing any type of transactions out of sub division, transfer, change
of use, mortgage of the land and I will necessarily pay the premium/ unearned income/ pledge
fee/ license fee amount charged for such prior permission to the Government and I hereby gives
undertaking to follow the said terms/ conditions.
As per paragraph 4(a) under the above referred Government Resolution dated 12.12.2012
, the option of conversion of government land into occupant class-2 category who occupied the
land by lease in Brihanmumbai was given to the lease holders. As per this option, the period of
those lease hold occupied by lease is expired and/or will be expired within next 5 to 10 years,
then such lease holders have to inform this option to the concerned Collector during the period
from 12.12.2012 up to 11.12.2014.

It is observed the doubts about category of government land and occupant class-2 granted
by lease. The holding right of the land has been clarified in Section 29 of the Maharashtra Land
Revenue Code,1966. Accordingly, three categories (holding right) were mentioned as Occupant
Class-1, Occupant Class-2 and Government Lessee. As per provisions therein, the land of
Occupant Class-1 is transferable and the land of occupant class-2 is non transferable. Also, it is
binding to follow the terms and conditions under the order for granting land of Occupant Class-2.
The prior permission is binding on the facts like transfer of such land, mortgage, change of use,
use for more beneficiary, use carpet Area Index/Transfer of Development Right, sub-lease,
redevelopment etc. It means, this prior permission should be binding to obtain from the
government and/or authority authorized by the Government as owner. The Government has also
power to charge unearned amount/ premium/fee as per prevailing policy while granting such
prior permission.

The terms/conditions mentioned in the Lease Agreement are also binding upon the
government lands granted on lease. If such term/ condition is violated, then the government has
power to initiate action for violation of condition there upon. The lease rent has been charged
every year for the land granted on lease and the right for holding the land is limited up to lease
period. Contrariwise, the land in the category of Occupant Class-2 is in occupation & possession
of the occupiers continuously and before granting such land, the occupation value has to be
deposited. In short, the control of Government on Occupant Class-2 and Government lessee is
nearly similar nature, which is cleared.
As per above referred government resolution, though the lease holder has enforced the
option for conversion of lease hold and into Occupant Class-2, even the , the said land can not
be converted into Occupant Clas-1 (free hold) category, which is cleared. Contrariwise, by
excluding the provisions under section 29 (4) under the Maharashtra Land Revenue Code, 1966,
it has been clarified for non conversation of the land allotted from Occupant Class-2 into
Occupant Class-1 as per government circular No.LND-1092/C.N.14/L-1 dated 1.10.1992.
The said circular should be brought to the notice of all lease holders who are giving
option of occupant class-2 by the Collector, Mumbai City and Collector, Mumbai Suburban.
