DECLARATION OF DERRICK ROSE

2 I, Derrick Rose, declare as follows:

I am a party in the above-entitled action. I have personal knowledge of

4 the facts set forth below and, if called as a witness, I could and would competently
5 testify thereto.

On August 26, 2013, I sent a driver to pick Plaintiff up and bring her to

7 my rental home in Beverly Hills.

8

3.

At that point, I had been casually dating and having consensual sexual

9 intercourse with Plaintiff for several years.

4.

Plaintiff, who appeared at the home with a friend, did not appear drunk

11 when she arrived at the home.

I observed Plaintiff drink small amounts of tequila when she was at the

She did not appear to me to be intoxicated at any time during the

13 home.

Plaintiff poured all of the alcohol (tequila) that was consumed while

17 she was at the Beverly Hills home.

I did not pour tequila, nor did I observe Randall Hampton or Ryan

19 Allen pouring tequila.

I did not add Rohypnol or any other drugs to Plaintiffs drinks or the

21 drinks of anyone else at the Beverly Hills home the night of August 26, 2013.

I did not observe Randall Hampton, Ryan Allen, or anyone else add

23 Rohypnol or other drugs to Plaintiffs drinks or the drinks of anyone else at the
24 Beverly Hills home the night of August 26, 2013.

11.

There were no drugs at the Beverly Hills home that night.

12.

I did not conspire with either Randall Hampton or Ryan Allen to drug
