The parties are herein being the aforesaid authors of the trust are
severally called as trustees and collectively the board of trustees
shall mean and include not only the aforesaid trust members of the
board of trustees but also such other persons as may be the board
of trustees in accordance with these witnesses.

WHEREAS the authors of the trust desirous of creating and


establishing a public Charitable trust for promotion Education,
Social, Cultural and Charitable and to
help the poor and
downtrodden and to ameliorate the living condition of poor
destitute and weaker sections of the Society.
NOW THIS DEED OF TRUST WITHESSETH AS FOLLOWS:1.

TRUST FUND:In order to effectuate the said desire, the Trustees have
made over to the trustees a sum of Rs.5,001 (Rupees Five
Thousand and one only) or otherwise and may hereafter be
subject to the trust (hereinafter referred to as trust fund) for
the objects and purposes herein contained concerning the
same

2. NAME OF THE TRUST:The name of the trust shall be SCD SRI ABHIVRUDDI
FOUNDATION
(ENVIORNMENT, PLANTATION PROTECTION, EDUCATION
& RURAL DEVELOPMENT)

03. LOCATION OF THE TRUST OFFICE:The office of the trust shall be situated at Sri.
Nandhagokula, IndiraNagar, Jivanahalli Post, Konde
Bhavi Hoble, Gowribidhanur, Chikkaballapur District.
3. I. JURISDICTION OF THE TRUST:INDIA
4. THE OBJECTS OF THE TRUST ARE AS UNDER:
Health Development :1. To establish & Maintain Hospitals, Clinics, Medical
investigation & research, institutions in rural areas, affording
facilities of Medical relief to the poor.
2. To take-up awareness camps on health & family welfare, HIVAIDS control programmes, & conduct periodical camps to
bring awareness among the people to know about kidney
Disease & others.
3. To help financially to the poor & needy who requires such
assistance for the purpose of medicines, Medical Treatment
and Operation or Post Operation Treatments.

4. Establishing a network of Hospitals and Medical Centers to


provide specific & general treatment to needy & poor
patients on charitable basis.

5. Achieve good Co-ordination & outcome of the care through a


Multi-disciplinary approach with a number of providers with
specialized knowledge.
6. To render assistance to poor patients by making provisions
for Medical assistance healthcare & preventive medical
services.
7. Design & make available education material in prevention,
early diagnosis & treatment options in various medical
diseases.
6. DISABLE DEVELOPMENT:1. To open Schools for mentally Challenged, Blinds, Deaf and
Dumb and Physically Challenged.
2. To help the poor, orphans, physically and mentally
handicapped people, widows and other disabled persons
by providing monetary of any other kind of assistance
either by payment in cash or kind, supply of clothes, food,
shelter and medical assistance.
3. To promote charity, to start charitable Associations for the
poor and needy people. Associations starting from basic
education to primary, middle, high school and academic
collegiate graduation post graduation post graduation
adopting the policies of the state and central government
educational welfare systems, Associations for physical
and mentally challenged children, aged, orphanage,
hostels etc.
4. To take up programmes for the benefit of the Blind,
handicaps and mentally retarded.
5. To promote welfare programmes of Blind, Mentally Retard
Children, physically handicapped and Polio effected
children.
6. To build up community based rehabilitation center and
residential school for mentally retarded children other
handicapped children form poorest of the poor family and

for children from poor destitute families, orphans, deserted


children and like.
7. To take up programmes for the benefit of the Blind,
handicaps and mentally retarded.
8. To work for the well being and progress of the Blind,
handicapped, mentally retarded and disabled persons of
Association.

9. To promote and establish schools and homes for Blind,


orphans, old-age, blinds and deaf personals and mentally
retarded personals. Etc.

II. DEVELOPMENT PROGRAMMES:1. To undertake and implement programmes, relating to
watershed rainwater harvest construction of low costlatrines, roads, small bridges, culverts and soil
conservation work.
2. To implement programmes on dry land development,
social forestry environment and ecology
3. To run training centers for the youths and women in rural
areas for skill development self-employment and small
entrepreneurship including training center.
4. To promote hostels for working women, students, old age
home, orphanage, crutches and day care home crutches
for poor people in rural and urban areas.
5. To undertake programmes relating to improvement of
living standards of agricultural labourers bonded labourers,
small framers, rural artisans.
6. To promote programmes for women/various disabled by
way of training in home based food products, tailoring
embroidery craft, kitchen grading, dairy small enterprises,
formation of self-help group leadership, legal, education
and co-operation for the purpose of attaining economic
generation skill development, mutual help, self reliance
and empowerment especially women and others
economically weaker sections.

handicapped deaf and dumb and disabled persons
including their rehabilitation.
8. To provide placement service to the needy persons after
giving suitable training in the concerned field for both
women youth and disabled and handicapped.

implement
various
integrated
development
programmes in rural and undeveloped urban areas. That I

To help encourage and undertake all types of rural
development programmes.

To lay the foundation for proper physical psychosocial
development of urban and rural people

programmes, Deity Development Programmes, Emergency
relief and income generation programmes Urban and Rural
in agriculture, sericulture and Horticulture to poor, small
and marginal farmers.

To promote welfare of animal interaction courses with
animals and settings up of pet hospital.
14.
To promote Borwell, Solar system, Water harvesting,
water conservation programmes.
15.
The objectives of village development plan to develop
the selected village in an integrated manner. This would
include economic development infrastructure development
and other aspects of human development ie., Education,
health, drinking water supply, etc., beside access to
conduct.
16.
The trust will peruse upon local nationalized bank to
grant credit to deserving village by arranging celebrated
securities to safe guard interest of the bank.
17.
Building people & institution for development
innovation up to enable the poor communities for poverty
reduction & self employment.
III. EDUCATION DEVELOPMENT:1. To establish and to run a Nursery. Primary, Anganavadi, High
Schools, CBSC, ICSE schools, Technical institutions,

Graduation, Post Graduation, Adult education, Commerce


training college, Management course, Computer education,
Self employment, Evening
College Vocational Training
center etc.
2. To open School of Nursing, College of Nursing, Pharmacy,
Paramedical Industrial training institution, Residential
Schools, D.Ed, B.Ed., Computer education in Hardware &
Software, B.C.A., M.C.A., B.B.M., M.B.A., Dental college,
Diploma, P.hd., course, Engineering, Law, medical and other
educational institutions.
Fashion Designing, Interior
Designing, Garment Technology and self-employment
training, Job Oriented course, etc.

3. To take up educational programmes and activities for all


categories and disabled, through integrated education and
through special schools.
4. To conduct study tours to place of cultural importance in or
out of India.
5. To open the Dental, Medical, Engineering College.
6. To conduct cultural shows essay painting and competitive,
To open the computer training center.
7. Child labour residential School, day care center De-addiction
center and computer training centers.
8. Shishupalana Kendras, to provide stay homes.
9. To establish Technical and commerce educational
institutions.

To provide education facilities to deserving students,
And to promote training of education activities.

To work with government education department to
impart knowledge on health & safety awareness
programmes.
12.
To provide equal opportunities for education to close
(teacher-children) people from all strata of the society by
providing interaction concessions, scholarships & assistance
to children from poor, needy & deserving family.

To have programme for linking children from poor
families with sponsoring families/individuals/corporate to
provide them food, clothes, Medicare and financial
assistance.

IV. WOMEN AND CHILDREN WELFARE DEVELOPMENT:1. To promote socio economic welfare activities particularly
among women children, disabled of the Society.
2. To Organize and conduct training courses and camps for
betterment of unemployed.
3. To establish home for disabled, destitute women children
rag picker and child labour.
4. To promote welfare programmes to the benefit of disabled
women and economically weaker sections of the Society.
5. To organize women and child development activities.
6. To organize consumer welfare programmes drug abuse
awareness programmes, setting up of arts, crafts and
cultural museums. Welfare of urban and slum dwellers.
7. To ensure welfare of women and children of this Trust.
8. Counseling to kids, school going children of this Trust.
9. Child welfare, women welfare, family welfare and care of
AIDS/HIV affected persons.
10. To open Old-age home for aged people.
11. To implement various integrated development programmes
in rural and undeveloped urban areas. That is SHG for Men
& Women, womens empowerment, self employment
programme.
12. To give financial assistance through Banks to women, SHG
groups.
13. Health service, Nutrition programmes, Adult Education
programmes, Animal husbandry, poultry training, Dairy
Development programmes Emergency relief and income
generation programmes Urban and Rural in agriculture,
sericulture and Horticulture to poor, small and marginal
farmers.

Drama, Dance, Music, Nrithya, Kathakali and Yakshagana
and other literacy arts, etc. to educate dance, drama lovers
in the field of literature, dance and other arts.

and momentous to the young and mature artists.

To establish cultural institutions, to promote fine arts
in respect of learning and allied subjects touching upon
Indian culture, tradition and way of life.

To Conduct Bhajanas, Pujas and other allied activities
to build similar classes and conduct discourses.

To produce documentaries, poster presentation and to
conduct workshop to disseminate the teaching of for the
public at large.

Utilize the guidance, participation and financial
assistance from the established world organization, Central
government, Universities and other institutions in India and
abroad.
36.
To raise loans for the purpose of construction and
carrying out the objects ad purpose of the trust from the
local authority, Nationalized Banks, Credit cooperation,

Government or other financial institutions, so as to create


funds for the trust.
37.
Join and or affiliate or co-operate with, takeover,
amalgamate with or absorb any other institutions or society
having objects similar to those of this trust.
38.
To collect, manage, invest, disburse and deal with the
funds of the trust raised by received donations, conducting
benefit programmes or by any other legal and moral means
and to collect and receive the gifts of all kind from the
individuals, corporate bodies in India and from abroad in
furtherance of the aims and objectives of the trust. And to
do all incidental and useful necessary things that are
essential for the attainment of the above objects.

meritorious students who have succeeded in their field.

RURAL DEVELOPMENT PROGRAMMES:-

1. To organize and establish human resources training centers


in the filed of cultural, self-employment, rural development
or eradication of social evils and promote National
integration.
2. To undertake and implement programmes, relating to
watershed rainwater harvest construction of low costlatrines, roads, small bridges, culverts, soil conservation
work, and contrabands in rural areas.

3. To implement programmes on dry land development, social


forestry environment and ecology.
4. To run training centers for the youths and women in rural
areas for skill development self-employment and small
entrepreneurship including training center.
5. To promote hostels for workingwomen, students old age
home, orphanage, crutches and day care home crutches for
poor people in rural and urban areas.
6. To Promote programmes for women by way of training on

ecological imbalance and to bring un cultivatable land into a
social forestry.

To take to all possible activates for the welfare of the
disabled, aged women youth and children.

To encourage and develop project like agriculture
horticulture waste land development programmed income
generating activities for the poor women in the Association.

20.
Barrow funds from Rastirya Mahila Vikasa, NABARD,
SIDBU BANKS, CAOART, MNGO & RMK finance institutions
Govt and Govt Bodies to promote self-help and women
group for sustainable development.
21.
The organization may accept loans and advances from
Government Agencies, Banks, Corporation, Association,
Local bodies, institutions and other agencies to undertake
development projects and other schemes approved by the
board.
22.
Enabling youth to receive education and knowledge
and Indian Culture freedom constitutions of India five years
plans, projection of environment, populations control.
23.
To take up and receive funds from the state and
central governments or both or non-governmental agencies
and also from Abroad agencies in order to provide the
income generating activities for the poor and the needy.
24.
To establish Nirminthi Kendra as to promote low cost
building technology and interact with the Housing
corporations tow or for the shelter needs of the common
and poor people.
25.
To take paving the way for growth of the coconut
industry (a) insert pests & disease affected gardens. (b)
processing & product of diversification (c) Market Research
and promotion & coir Industry.

To
undertake
implementation,
Execution
and
maintenance of gardens and parks of Govt.
City
corporations & such other public institutions.
27.
To establish & run centers to study to improve & to
train the poor & the marginalized in the field of agriculture,
Animal husbandry, Small scale & cottage industries, job
oriented technical skills and such other allied

activities of focusing on the self activity and total


development of human personality.
28.
To organize training camps in the field of industry
agriculture, sericulture, Horticulture, etc.
29.
To promotion of Agriculture, Horticulture project with
summer camps, to create awareness in technical know-how

for better corp. Yield and to minimize the waste and to


prevent crop diseases.
30.
To development of agriculture in the rural areas to
produce more agriculture products like vegetables & fruit
trees
31.
To provide finance assistance to agriculturist to
develop the agriculture.
32.
To organize training camps in the filed industry
agriculture, sericulture, horticulture. Etc.
33.
To demonstrations & development of kitchens gravely,
priory, forestry, fishering, horticulture, agriculture, coconut,
co products, sheepry and other vocational training.

To establish training institute in various fields or social
welfare, agriculture education, etc.
35.
To establish agriculture, handicrafts, manufacture,
software, information, technology and any other income
generation projects by which self employment opportunities
may be created and engage in exports and important of all
proceeds of members and people associated with the
association and the profit earned may be utilized for
furthering the objects of the association.

To develop agriculture, scientific methods in overall
development and conduct training programmes for village
farmers to get good yields in their fields in agriculture,
horticulture and sericulture, a forestation, co-operating and
in agro-based vocational training such as Dairy farming,
poultry farming, sheep rearing and goat rearing and other
needs for development for such village or villages, the
integral part of integrated development of rural areas
through formal and non-formal means.

relief and income generation programmes Urban and Rural
in agriculture, sericulture and Hotriculture to poor, small
and marginal farmers.

To initiate all such activities as may be necessary for
the promotion of the aforestated objects and in the interest

of the sangha to empower its members to play a useful and


effective role in the development of agriculture and allied
sciences.
39.
To support the Anthroposophy Agriculture and farming
that would benefit the practice of Anthropomorphic
medicine.
40.
To provide food, training in agriculture trades like and
to create self-help awareness and employment opportunity
for poor needy neglected disabled men and women and
their family.
41.
To establishment of information centre to give
information to rural people on agriculture, horticulture and
other development programmes, Government programmes
and facility available, etc.
42.
To promote and programmes to establish marketing
facilities to the products produced by the rural agriculture,
industries, animal husbandry shree shakti and self help
groups etc.
5. TRUSTEES TO RENDER TRUE ACCOUNTS:The trustees shall cause and accurate accounts to be kept
of all moneys received and spent and all materials in respect
thereof in the course of management of trust fund or in
relation to carrying out the objects and purposes of the trust
as well as assets, credits and efforts of the trust.
6. POWERS OF THE TRUSTEES:The Board of trustees shall have the the control and
management of the trust the trustees named above shall be
the first board of trustees who may co-opt or select the other
trustees.
For the furtherance of the objects, i.e. for service the
community in general and to the poor and weaker sections of
the Trust as mentioned in clause 4 the trustees will have the
following powers which will be exercised by them;

a. To accept any donations, contributions, grant or


subscriptions in cash or in kind from any person, body of
persons or trust.
b. To apply the whole or part of the income of the trust or
accumulation thereof in whole or part of the corpus of the
trust fund for nay one or more of the objects of the trust as
the trustees may, in their descripation from time to time,
determine.
c. To convert and deal with investments comprised in the trust
fund and/or to carry the investment for the time being in
the modes prescribed u/s 11 (5) of the I.T. Act, 1961. And
each other provisions and amendments thereof from to
time.
d. To invest and keep invested the trust fund either in the
purchase or mortgage of immovable property including a
flat or in units, shares, stocks, or debentures permitted by
the India Trust Act, 1882 or any other stature, or deposit
with banks, firms and to alter, vary or transpose such
investments form time to time as the trustees may in their
discretions think fit for others of the same or different
nature.
e. To borrow or rise or secure payment of money and also lend
money either with or without security at the discretion of
the trustees.
f. To sell, dispose or alienate or otherwise deal with property
belonging to the trust including property comprising the
trust fund.
g. To borrow money on behalf of the trust and charge the
assets of the trust in respect of such liability incurred on
behalf of the trust.
h. To charge convert or sell any of the trusts property
investment or assets including immovable /moveable
property.
i. To let out premises and immovable property of the trust for
such period and at such rent and on such terms and
conditions as the trustees in their discretions may think fit.
a. Bank Account: To open accounts with any bank
(Nationalized, Co-opt., Scheduled, International Bank or
Private Financial institution), operate such accounts and to
give instruction to the banks and to provide for the opening

and operation of such accounts by President & Treasurer


of the Trust.

b. Accounts and Audit:


1. The Managing Trustees shall maintain true and correct
account of all the trust income, investment and all
outgoing expenses.
2. The year of account shall be the financial year
commencing from 1st April and ending 31st March.
3. The accounts of the trust shall be audited every year by
the chartered accountant, appointed for the above
purpose by the board of trustees and audited statement
of the account together with auditor report shall be laid
before the board of trustees for approval.
c. To appoint constituted attorneys or agents and delegate to
such attorneys or agents all or any of the powers vested in
them under these presents and from time to time remove
such attorneys or agents and appoint other or others in
his/her or their place.
d. The Managing Trustee shall appoint/cancel the trustees.
e. To make, vary, alter, add on or modify schemes, rules and
regulations for carrying out the objects hereof and of
having, any trust at any place in furtherance of the objects
of the trust and otherwise for giving effect to the objects of
the trust.
f. To set apart or accumulate the whole or part of the income
or corpus of the trust fund or part thereof for any
subscription or donation made by them.
g. To accept from Government, Non-Government, Local Bodies,
Societies and to borrow loan from Banks (Nationalized/Cooperative) individuals Grants, Donations, Borrow Loans,
Subscriptions or any property movable or immovable for
furtherance of the objectives of he Trust.
h. To Join, Co-operate or amalgamate this trust with other or
others having kindred or allied objects upon such terms and

conditions as the trustees may in their discretion think fit


particularly having regard to the objectives of the Trust.
i. Managing trustee shall arrange for the publication in any
maner trusts journal, documents as may be considered fit
in the furtherance of its objectives and Managing trustee
shall have powers to fix its price also the rates of
advertisements from time to time.

j. To enter into the contract or engagement on behalf of the


trust.
k. To frame bye-laws and such other regulations as required
for achieving the objectives of the trust.
7. The trustees shall be chargeable only for such money, stocks,
shares and funds as shall actually come in to their hands. A
trustee shall not be answerable or accountable for neglect,
default, acts of commission or omission of the other trustees
nor of any banker or other person with wham the trust
properties or any securities comprised in the trust fund have
been deposited or kept.
The trustees herein shall stand indemnified against any act
done in good faith and without negligence.
8. REMUNERATION TRUSTEES:The trustees will not be entitled to receive any
remuneration as trustee but may reimburse to themselves all
expenses actually incurred by them in connection with the
trust of their duties relating thereto, the funds and the income
of the trust shall be solely utilized for the achievement of its
objectives and no portion of it shall be utilized for payments of
the trustees by way of profit interest dividends, etc.
9. NUMBER OF TRUSTEES:The number of the governing body of the trust shall be
Minimum Two and maximum Nine including Lifetime Trustees
and trustees of the Trust. The trustee shall not except for the

purpose or filling any vacancy, act so long as the number is


below the said minimum.
10.

APPOINTMENT OF TRUSTEES:-

The majority of Trustees shall be at liberty to appoint


additional Trustees.
The Board of Trustees shall be first trustee of this trust and
they shall be trustees for their respective lifetime.

A person shall cease to be a trustee either.


a) If he/she without leave of absence does not attend three
consecutive meetings of the trustees or for one calendar
year, whichever is longer, or
b) If he/she is requested to resign by all other trustees or
c) If he/she acts or does any things prejudicial to the objects of
the trust, in the opinion of all other trustees.
d) If she/she dies.
e) Upon expiry of the period up to which the board of trustees
have nominated the trustee.
f) If the he/she convicted of any criminal offence in the past.
11.

NOTICE PERIOD:-

Every Trustee will be at liberty to resign on giving one


months of his/her intention to do so.
12. MEETING & PROCEEDING OF THE TRUST:
1) That trustees shall ordinarily meet once in 12 months or as
often as may be necessary for the satisfactory conduct of
the activities of the trust.
2) The 07 days notice shall be given in writing for the meeting
of trustees.
3) A minutes books shall be kept by the Secretary of entry to
the office of every new trustee and of all proceedings of the
meeting of the board trustees shall be entered in the
minute book and shall be sign by the Managing Trustee of
the trust.
13.

QUORUM:-

The trustees may, from time to time, frame rules for the
conduct and regulation of the meetings of the trustees.
In the absence of such regulations:
The Managing trustee shall decide all matters.
The managing Trustee decision in the meeting shall be
final.

14.

AMALGAMATION:If the trust desire to amalgamate with another trust having


similar objectives the governing body shall give proposal in
writing to the trustees of the trust, such proposal shall be
consider in the general body meeting of the trust convened for
this propose.

15.

INVESTMENT:-

The funds of the Trust shall invested in the modes specified


under the provisions of Sec.13(1)(d) r.w.s 11(5) of the I.T. Act,
1961 as amended from time
16.

ACCOUNTS:There shall be maintenance of accounts of the Trust. A


Chartered Accountant shall duly audit the accounts. Every
year the Accounts shall be closed 31st March.

17.

AMENDEMENT:-

No amendment to the Memorandum of Trust, Rules and


regulations of the Trust shall be made which may prove to be
repugnant to the provisions of Sec.2(15), 11,12,13 and 80G of
the income Tax. Act, 1961 as amended form time to time.
Further no amendment shall be carried out without the prior
approval of the commissioner of Income Tax, Karnataka Circle.
18.

DISSOLUTION:In the event of dissolution or winding up of the Trust the


assets remaining as on the date of dissolutions shall under no

circumstances be distributed among the members of the


Managing committee/Governing body but the same shall
transferred to another charitable Trust/Trust whose objects are
similar to those of this Trust and which enjoys recognition u/s .
80G of the I.T. Act. 1961 as amended from time to time.

19.

CLAUSE:6:The benefits of the Trust shall be open to all irrespective of


the caste creed or religion.

20.

CLAUSE:7:The funds and income of the Trust shall be solely utilized


for the achievement of the objective and no portion of its shall
be utilized for payments of the members by way of profit,
interest and dividends.
21. The Trust funds and profits should be used for the purpose
of reaching the goal and objects of the Trust us/7 of income Tax
Act, 1961. The Trust working profit, interest, part of interest
should not be distributed of or paid to the members of the
Trust.
22. To reach the Trust goal and object achievement for all
round development and activities to achieve the Trust can
receive foreign donations funds under F.C (R) is exclusively
earmarked for incoming foreign funds.
23.
The Trust received donations form foreign countries and
its utilization is to be duly filled in the prescribed format and to
be submitted to the office concerned. The donations received
on any academic year should be submitted compulsory in the
prescribed form.
24.

POWERTS OF THE EXECUTIVE COMMITTEE:-

CHAIRMAN: He shall advice the Executive committee


and shall preside over the meeting.
MANAGAING TRUSTEE:-

He /she shall be over all in charge of the Trust and the


General body meetings, All the policies and programmes shall
be formulated and implemented only through him/her in
consultation with executive committee.
He/she shall be the chief executive head of the trust.
In his/her absence he/she shall depute the Trustees with
suitable advice to deliberate on all major or minor matters
concerning the Trust. He/she shall

countersign the annual reports audited statement of accounts


& such other documents along with the Trustees and auditors.
He/she shall advice on divestment of surplus funds in Govt,
Securities, Autonomous Govt, Bodies, Private financial
Companies, etc, and he/she shall advice on borrowing/lending
of finance for the trust either on interest or without interest
and authorizes the Secretary on all financial matters in the
interest of the trust.
Under the guidance & advice of Trustees he/she be
authorized to appoint, dismiss, reinstate any of the employee.
And can appoint temporary substitute staff and fix their
remuneration.
He/she shall grant leave of absence, and
generally endure smooth function of the trust.
He/she shall generally be in charge of the office and the
custodian of all documents bank passbooks, cheque books,
security documents and oversee the day-to-day expenses of
the trust.
He/she shall execute all deeds, documents, contract and
engagements behalf of the trust.
