VIENNA POLICE HIGHLIGHTS

May 28, 2010

The following summary contains various incidents of general interest as well as


vehicular crashes handled by the Town of Vienna, Virginia Police Department from
May 21- May 27, 2010. Readers are reminded that an “arrest” is based upon
probable cause and does not always mean that someone was physically taken into
custody. Furthermore, it does not mean that an individual is automatically guilty of
a crime. Judicial outcomes and post- arrest proceedings can be researched through
the appropriate court’s website.

(VIENNA POLICE HIGHLIGHTS is not meant to be a listing of every incident or call handled by the
Vienna Police, but merely a more substantive summary of several incidents which may be of interest to the
community. Some reports may be outside the date parameters due to extended investigations or other
circumstances. Some cases are not included at all due to ongoing investigations. Please contact MPO Bill

INCIDENTS

Arrest- Warrant Service 10-5209


500 Block Meadow Lane, SW
May 12 9:30 a.m.
MPO Evans and Officer Ruddy responded to a home after learning about an outstanding
warrant for an individual issued by the Town of Herndon. The bench warrant was for
failing to appear at a court proceeding.

James Schweitzer Jr., 40, of Meadow Lane in Vienna was located and arrested. He was
then transported to the Fairfax County Adult Detention Center. There he was held
without bond.

Civil Case/ Improper Towing Connection 10-4913
300 Block Dominion Road, NE
May 17 7:06 p.m.
A vehicle owner reported that while her vehicle was being towed it fell from the lift and
was damaged.

After investigation Officer Ruddy obtained a warrant for Improper Towing Connection
and served it on 28 year old William J. Pennington of Trailside Drive in Springfield,
Virginia. Mr. Pennington was released after signing the summons.

Animal Case 10-5065


1200 Block Kelly Street, SW
May 19 12:15 p.m.
A citizen reported that a neighbor’s dog attacked his dog while out walking.

ACO Barker will follow up on this case.

Arrest- Drunk in Public 10-5039


Center Street at Battle Street, SW
May 21 2:28 a.m.
Officer Lyons briefly observed an individual driving erratically. After conducting a
traffic stop he detected signs of possible impairment.

The driver refused to participate in any field sobriety tests and Officer Lyons placed the
man under arrest for Drunk in Public.

29 year old Nathan David Guilman of Idlewild Blvd. in Fredericksburg, Virginia was
then transported to the Fairfax County Adult Detention Center.

Vandalism Case 10-5072


1400 Block Cottage Street, SW
May 21 1:28 p.m.
A homeowner reported that a hole was observed in a patio canopy. It appeared as though
the hole had been burned through the screen.

Fight Report 10-5148
Peterson Lane Park
500 Block Malcolm Road, NW
May 21 6:15 p.m.
A subject came to Vienna Police Headquarters to report being involved in a fight which
had occurred the previous night.

The complainant reported that he and another high school student agreed to meet at the
park to fight; and they did.

The parents of both boys were notified and briefed on the occurrence.

Destruction of Property 10-5094


200 Block Cedar Lane, SE
May 21 9:30 p.m.
A resident reported that a known subject threw a rock through his front window and then
fled from the scene.

PFC Lewis explained the warrant obtainment procedure to the complainant.

Arrest- Possession of Marijuana 10-5112


Maple Avenue at Westbriar Drive, NE
May 22 2:38 a.m.
Sergeant Juelharte conducted a traffic stop on a vehicle for exceeding the speed limit.
Upon her interaction with the driver she detected the presence of suspected marijuana.

Further investigation revealed the suspected marijuana and various pieces of


paraphernalia.

Marc Alexander Seger, 19, of Sweet Mint Drive in Vienna was issued a summons for
Speeding and Possession of Marijuana. He was released after signing both summonses.

Police Service 10-5151


200 Block Harmony Drive, SW
May 22 3:02 p.m.
A caregiver reported that her client had wandered away from his home.

Officer Ruddy located the man a short distance away and returned him to his home.

Assault Case 10-5157
ACE Vacuum
171 Maple Avenue, East
May 22 4:55 p.m.
A customer purchased a vacuum. After taking the vacuum home the customer attempted
to return it to the store but the return was refused. The customer than grabbed another
vacuum and attempted to leave the store with it.

An employee confronted the customer and asked her to release the vacuum. At some
point the confrontation turned mildly physical.

MPO Evans responded and advised both parties that it was primarily a civil matter. The
laws pertaining to assault were also explained to both parties.

Medical Call 10-5158


100 Block Ross Drive, SW
May 22 5:06 p.m.
A concerned citizen called police to report that an unknown female subject had fallen in
the yard of a nearby unoccupied home.

Fairfax County EMS was summoned and responded to take the woman to an area
hospital for assessment.

Arrest- Drunk in Public 10-5159


100 Block James Drive, SW
May 22 5:12 p.m.
A concerned citizen reported a male that was walking down the street shouting at passing
people. MPO Evans located the subject and observed signs of impairment.

Jose Tomas Lara, 33, of no fixed address was arrested for Drunk in Public and
transported to the Fairfax County Adult Detention Center.

200 Block Cedar Lane, SE
May 22 7:05 p.m.
MPO Shaver observed a man consuming a beer in public. Upon his interaction with the
man and a companion, MPO Shaver determined that both men were intoxicated.

Juan Manuel Peres, 36 of no fixed address and Pedro Castillo Villegas, 45 of Chain
Bridge Road in Vienna were arrested for Drunk in Public. They were both transported to
the Fairfax County Adult Detention Center.

Domestic Dispute 10-5162
300 Block Branch Road, SE
May 22 8:00 p.m.
A brother called to report that he and another brother were involved in a verbal argument.
When the complainant tried to leave the home, the other brother refused to allow it.

PFC Lewis investigated the case and determined that the other brother was concerned
about the complainant’s mental state and was trying to prevent him from driving.

The warrant obtainment process was explained to both parties.

Arrests- Driving While Intoxicated, Refusal to Submit to a Breath Test 10-5165


400 Block Malcolm Road, NW
May 22 9:12 p.m.
Sergeant Smith conducted a traffic stop on a vehicle after observing a traffic infraction.
As the vehicle turned in to a driveway, it struck a parked vehicle. The driver then
attempted to walk away and enter a home. During this time Sergeant Smith observed
signs of possible impairment.

Sergeant Smith detained the driver for further investigation. The driver refused to
perform any field sobriety tests and was arrested for Driving While Intoxicated. Phillip
Angelo Brown, 49, of Malcolm Road in Vienna was then transported to the Fairfax
County Adult Detention Center (ADC).

At the ADC Mr. Brown refused to provide a breath sample. He was then formally
charged with Driving While Intoxicated and Refusal to Submit to a Breath Test.

Injured Person 10-5183


Wolftrap Hotel
May 23 12:16 a.m.
A complainant reported that a woman had jumped from the 3rd story of the Wolftrap
Hotel and landed near the center courtyard area. The woman appeared intoxicated but
was conscious when officers arrived.

The woman was transported to an area hospital for treatment of her non life- threatening
injuries by Fairfax County EMS.

Juvenile Case 10-5217


100 Block Melody Lane, SE
May 23 6:40 p.m.
A mother reported that her 16 year old son had run away.

At approximately 9:30 p.m. the boy returned home and was counseled by MPO Shaver.

Arrests- Driving While Intoxicated, Eluding Police, Refusal to Submit to a Breath
Test, Drunk in Public 10-5220/ 10-5224
200 Block Maple Avenue, East
May 23 8:03 p.m.
MPO Seitz observed a vehicle committing a traffic infraction. As he attempted to conduct
a traffic stop the vehicle fled.

MPO Seitz followed the vehicle for a brief period of time but then ceased following it. A
short time later the vehicle crashed near Chain Bridge Road and Miller Road in Oakton,
Virginia. MPO Seitz witnessed the crash and as the driver exited the vehicle and fled on
foot, he gave chase.

An off- duty deputy sheriff came to assist MPO Seitz in successfully apprehending the
driver. The passenger in the vehicle was then also arrested for Drunk in Public.

Further investigation by Fairfax County Police determined that the vehicle was taken
from its owner without permission. The Fairfax County Police will follow up on this
aspect of the investigation.

The driver, 30 year old Abran David Flores of Malabar Street in Huntington Park,
California was transported to the Fairfax County Adult Detention Center. There he was
formally charged with Eluding Police, Driving While Intoxicated, and Refusal to Submit
to a Breath Test. He is being held without bond.

The passenger, 30 year old Santos Adelio Rivas- Chavarria, 30, of Georgia Avenue in
Washington, D.C. was arrested for Drunk in Public and transported to the Fairfax County
Adult Detention Center.

Suspicious Event 10-5245


300 Block Mill Street, NE
May 24 1:15 p.m.
A shop owner asked an employee to repair a vehicle. The employee did not want to do
this and began screaming and becoming disorderly.

The business owner asked the employee to leave the shop.

Medical Call 10-5250
Navy Federal Credit Union
820 Follin Lane, SE
May 24 2:14 p.m.
Officer Lyons responded for an individual that was threatening to harm himself. The man
was in the nurse’s area and asked to find help.

Officer Lyons transported the individual to a medical facility for assessment and
treatment.

Vandalism Case/ Juveniles 10-5259


200 Block Whispering Wind Court, SE
May 24 4:55 p.m.
A homeowner observed two juvenile boys throwing eggs at her house. The homeowner
followed the boys as they left the scene as she notified police.

Both boys were located and detained. The complainant did not wish to prosecute the boys
but did want them to restore her home to a clean condition.

After cleaning up the home, the boys, both 14 years of age, were transported to Vienna
Police Headquarters, counseled by Officer Lyons, and released to their parents.

100 Block Pleasant Street, SW
May 24 5:29 p.m.
A citizen notified police about an abandoned and badly damaged bicycle which was left
near a dumpster. Officer Myers responded and placed the bicycle in to the dumpster.

Animal Case 10-5266


900 Block Frederick Street, SW
May 24 6:42 p.m.
A 6 year old boy was bitten on his cheek while playing with a neighbor’s dog.

Fairfax County EMS responded and treated the boy on the scene.

The dog was quarantined in accordance with policy.

800 Block Ninovan Road, SE
May 24 7:58 p.m.
A citizen turned over a bicycle and scooter that had been left on his property.

PFC Simon transported the items to Vienna Police Headquarters for storage pending
retrieval by their owner.

Animal Case 10-5275


100 Block Maple Avenue, East
May 24 11:45 p.m.
A citizen notified MPO Burchfield about a deer which had been struck on the roadway.
MPO Burchfield located the deceased deer and took custody of it.

The deer was placed in to a police van and was transported to an alternate location for
disposal.

Police Service 10-5282


200 Block Cedar Lane, SE
May 25 2:00 a.m.
A citizen advised that her roommate was having a loud argument with his girlfriend and
she could not sleep.

MPO Burchfield responded and addressed the noise issue with all parties involved. The
matter was successfully resolved.

Domestic Assault 10-5319


100 Block Patrick Street, SE
May 25 5:00 p.m.
An adult male reported that his brother, also an adult, had assaulted him. The assault
occurred after the complainant refused to loan his brother some money.

The assailant had fled prior to police arrival.

The warrant obtainment process was explained to the victim.

Assault/ Threats Toward Law Enforcement 10-5362
700 Block Cottage Street, SW
May 25 10:00 p.m.
A citizen notified police regarding a threat towards a Vienna Police Officer which had
been posted on Facebook. The threat targeted the officer’s family.

This case is still being investigated.

Trespassing Case 10-5337


Glyndon Park
300 Glyndon Street, NE
May 26 12:55 a.m.
PFC Simon discovered an individual that was sleeping on top of a picnic table inside the
park after hours. After identifying the man and checking to see if he was wanted, he was
given a warning about being in the park after dark. The man left the park without
incident.

Open Door 10-5341


300 Block Center Street, South
May 26 6:05 a.m.
A Vienna Police dispatcher noticed a ladder on top of a roof. Officer Ruddy investigated
and found that the ladder lead to an open door. An interior search of the building was met
with negative results. The manager of the building was notified regarding the event.

Arrest- Drunk in Public 10-5366


200 Block Cedar Lane, SE
May 26 4:56 p.m.
A concerned citizen called to report an apparently intoxicated male lying on the sidewalk
of the Cedar Lane Shopping Center. MPO Evans and Officer Finelli located the
individual and determined that the individual was in fact intoxicated.

Juan Manuel Peres, 36, of Cedar Lane in Vienna was arrested for Drunk in Public and
transported to the Fairfax County Adult Detention Center.

Suspicious Event 10-5377


100 Block James Drive, SE
May 27 12:34 a.m.
A citizen reported that an unknown object had struck a window in her home. The window
cracked in a spider web pattern. It is unknown what may have occurred as the exterior
screen covering the window was not damaged.

Towed Vehicle 10-5384
Dominion Road at Ayrhill Avenue, NE
May 27 10:16 a.m.
Officer Ruddy towed a vehicle which was parked in violation of a “No Parking” sign.
Attempts to contact the owner were met with negative results.

Found Property 10-5412


Giant Food Store
359 Maple Avenue, SE
May 27 6:16 p.m.
A citizen found a wallet in the parking lot of the store.

Attempts to contact the wallet’s owner were met with negative results. The wallet was
placed in to storage pending retrieval by its owner.

Vienna Dog Park
700 Courthouse Road, SW
May 27 6:46 p.m.
MPO Shaver and MPO Seitz responded for an apparently intoxicated male at the Vienna
Dog Park.

Upon their arrival the officers located the individual and after a brief investigation placed
Wayne Haight, 48 of Lewis Street in Vienna under arrest for Drunk in Public.

Mr. Haight was then transported to the Fairfax County Adult Detention Center.

CRASHES

Hit and Run 10-5020


Parking Lot of 150 Maple Avenue, SW
May 20 4:00 p.m.
A legally parked vehicle was struck by another unknown vehicle. The driver of the
striking vehicle left no contact information.

Hit and Run 10-5079


Parking Lot near 221 Dominion Road, NE
May 21 3:16 p.m.
While parked an unknown vehicle struck a citizen’s car. The striking driver left no
contact information.

Parking Lot of 521 Maple Avenue, West 10-5192
May 23 3:55 a.m.
A light pole in a parking lot was struck as the driver was distracted by observing a police
officer in the area.

Park Street at Casmar Street, SE 10-5306


May 25 2:54 p.m.
One vehicle (a car) had stopped for a school bus discharging passengers. Another vehicle
did not stop in time and struck the rear of the stopped car.

MEDIA RELEASES

Media Release- Updated With Results


Even though the weather was far less than desirable on Saturday May 22, 2010 Officers
and Troopers participating in Operation Extra Eyes for DWI’s conducted 226 vehicle
stops.

As a result of those 226 stops, 32 drivers were given field sobriety tests, 9 were
ultimately arrested for DWI, and 252 summonses and warnings were issued.

The original Media Advisory which was sent out on May 19, 2010 is below:

Operation Extra Eyes for DWI’s

On May 22, 2010 at 7:00 p.m. seven police agencies from Northern Virginia will team up
in a collaborative effort to conduct saturation patrols to detect and arrest drunk drivers.
Extra Eyes for DWI’s will involve officers and resources from the City of Falls Church
Police, Metropolitan Washington Airports Authority Police, Town of Vienna Police,
County of Fairfax Police, City of Fairfax Police, The United States Park Police and
Troopers from the Virginia State Police.

In the midst of the spring prom and graduation season law enforcement officers from
local, state, regional, and federal agencies will saturate the streets in several Northern
Virginia jurisdictions with personnel specifically targeting drunk drivers. Prior to the start
of the event Debbie Sausville, a M.A.D.D. mother who lost her step-daughter to an
alcohol related crash, will address the officers at a gathering.

Cruisers from all involved agencies, participating officers and
