Features
The University of Santo Tomas Conservatory of Music Student Constitution and By-Laws features a
total of 20 Articles. It takes into consideration the circumstances of the students and of the Conservatory in
recent times. It also provides for the legal rights and duties of students so that in the performance of their
tasks and the discharge of their responsibilities, they are guided by what is fair, right, and just. It features a
student government composed of two branches: Conservatory of Music Student Council and Conservatory
of Music Student Senate. It includes an article featuring Funds and Project Proposals, definitive election
rules and procedures as well as guidelines in case the need for amendment or revision of the this
Constitution should take place.

ARTICLE I
PURPOSE AND MEMBERSHIP
The purpose of this Constitution is to define the structure and powers of the Conservatory of Music
Student Board (hereinafter referred to as CMSB). In furtherance of this purpose, all persons who are enrolled
as regular or irregular students in the Conservatory of Music are considered to be members of the student
body and may be eligible to be members of any governance organization established by, or under the
authority of, this Constitution. This Constitution covers the student body as defined above.
ARTICLE II
THE CONSERVATORY OF MUSIC STUDENT BOARD
Section 1
There shall be a CMSB in the Conservatory of Music, deriving its authority and power from
the Conservatory of Music student body, which it represents and is a part of.
Section 2
The CMSB shall be the official student government of the University of Santo Tomas
(hereinafter referred to as UST) Conservatory of Music and shall be responsible for
formulating and implementing policies, rules and regulations directly affecting the welfare of
the students, in pursuance of the objectives and principles set forth in this Constitution.
Section 3
The CMSB shall be composed of two bodies: the Conservatory of Music Student Council
(hereinafter referred to as CMSC) and the Conservatory of Music Student Senate
(hereinafter referred to as CMSS).
Section 4
The CMSB shall serve as the channel of communication among the different departments,
block sections and performing groups in the conservatory, and coordinate their activities that
are college-wide in scope and of common interest to the student body.
Section 5
The CMSB shall provide advice and make recommendations to the proper authorities on
matters affecting students welfare.
Section 6
The CMSB shall organize activities and services that will promote the general welfare of the
students.
Section 7
The CMSB shall adopt its own internal rules and government provided they shall not be
inconsistent with this Constitution and existing university rules and policies.
Section 8
The CMSB shall define the position of the Conservatory of Music student body as a whole
on vital and highly controversial issues such as but not limited to tuition fee increases,
violation of students rights as well as issuance of a common stand on issues of national
concern in the field of music, arts and culture.
Section 9
All members of the CMSB are to be held responsible for all their actions in the practice and
exercise of their powers. It is expected that they will use them towards the betterment of the
students in mind.
ARTICLE III
THE CONSERVATORY OF MUSIC STUDENT COUNCIL
Section 1
The CMSC Executive Board is composed of bona fide students of the UST Conservatory of
Music.
Section 2
The CMSC Executive Board shall be composed of the following officers to be elected by the
Conservatory of Music student body:

President;

Vice President;
c.
Secretary;
d.
Treasurer;
e.
Auditor; and,
f.
The term of the said officers shall officially commence on the last day of the 2nd semester of
the outgoing school year and end on the last day of the 2nd semester of the incoming school
year.
Section 3
The CMSC shall perform all tasks relating to the implementation of the policies, rules,
regulations and decisions of the CMSB and this Constitution.
Section 4
The CMSC shall instill the following principles in all its operations and endeavors:

Promote the intellectual, spiritual and socio-cultural well-being of the students of the
Conservatory of Music, the whole university and the Filipino people;

Foster Classical and Contemporary arts and the Filipino cultural heritage through music
education and traditional performance;
e.
Serve as a forum for leadership training whereby the students may put into practice the
principles and ideals of democracy;
f.
Section 5
The CMSC shall have the power to create committees as it may deem necessary in the
fulfillment of its responsibilities.
Section 6
The CMSC shall hold regular meetings at least once a month as prescribed by the President
and as the need arises.
Section 7
The CMSC shall inform the members of the CMSS about the CMSCs activities, especially
those that directly affect the students.
Section 8
Section 9
The CMSC shall allocate, regulate or advise in the disbursement of the Student Activity
Fund and Student Council Fund as it may deem necessary.
Section 10
The CMSC may receive project proposals for activities from the CMSS and reserves the
right to deny the execution of the proposals it receives.
Section 11
The CMSC shall properly endorse all records, documents, projects, equipment and the like
to its duly elected successors before the end of their term.
Section 12
The CMSC shall be given the privilege of drafting new articles, sections, or provisions to
effectuate a constitutional amendment or revision.
ARTICLE IV
THE CONSERVATORY OF MUSIC STUDENT SENATE
Section 1
Section 2
The CMSS shall assist the CMSC in decision-making and implementation of activities.
Section 3
The members of the CMSS shall be composed of bona fide students of the UST
Conservatory of Music.
Section 4

The CMSS shall be composed of all duly elected department and first (1 ) year block
section Presidents. The President of the CMSC shall be its presiding officer.
Section 5
The CMSS shall convene in four (4) regular sessions in one (1) academic year: twice in the
first semester and twice in the second semester. The duration of each session shall be a
minimum of two (2) hours. The CMSB Adviser shall be present in these regular sessions.
The schedule of the sessions shall be as follows:
1st session during the 1st Leadership Training Seminar to be conducted by the CMSC
2nd session 3rd Monday of November

The President of the CMSC shall preside over the CMSS meetings and has the privilege to
vote.
Section 7
Section 8
The CMSS shall be given the privilege of drafting ordinances or resolutions in accordance
with the following rules and guidelines:
a.
An ordinance/ resolution shall become a law only if it has been properly deliberated
upon by the CMSS in a session. An ordinance/ resolution shall only be enacted when
the President of the CMSC and the CMSB Adviser have signed it;
b.
Copies of all ordinances/ resolutions shall be forwarded to the President of the CMSC
and to all other parties that may be concerned;
c.
All enacted ordinances/ resolutions must be attached at the end of this Constitution and
By-Laws as Appendices.
Section 9
The CMSS shall be given the privilege of drafting new articles, sections or provisions when a
constitutional amendment or revision takes in effect.
Section 10
The CMSS shall properly endorse all records, documents, projects, equipment and the like
to its duly elected successors.
ARTICLE V
THE CONSERVATORY OF MUSIC STUDENT BOARD ADVISERS
Section 1
The CMSB shall choose at least one faculty member currently teaching at the Conservatory
of Music to be their adviser, provided that said faculty member agrees to take the position.
Section 2
The Adviser should at all-time act as consultant and moderator to the CMSB. He shall, in the
best of his supervisory authority and in coordination with the CMSC, ensure that the policies,
decisions and actions of the CMSB are consistent with existing rules and regulations of the
conservatory and the university, and other related laws.
ARTICLE VI
SEAL AND DOMICILE
Section 1
The CMSB shall have an official seal used for purposes of representing the whole student
government. The small shield represents the CMSC. The balance represents the CMSS.
The lyre represents the Conservatory of Music and its students. All the symbols are
enclosed in a circle which significantly symbolizes the high value of unity in the student
government.
Section 2
The CMSC shall have an official seal used for purposes of representing itself. The shield
represents the commitment and duty of the CMSC to protect and uphold the students rights
and welfare. Inscribed on its top edge is the Latin motto Ducere Est Servire meaning To
Lead is To Serve. It perfectly embodies the principles of the CMSC which is to uphold the
Christian ideals and objectives of the university and servant leadership. The golden tiger
represents the authority and power the CMSC derives from the Conservatory of Music
student body. It further affirms that the CMSC is part of UST. The lyre symbolizes the
Conservatory of Music and it students. The ribbon in the middle enclosing the tiger and lyre
with the text UST-CMSC symbolizes unity and love, the two values the CMSC highly
regards. The seal is in the colors of black and yellow which are the official colors of UST,
and in pink which is the official color of the Conservatory of Music.
Section 3
The CMSS shall have an official seal used for purposes of representing itself. The shield
represents the commitment of the CMSS to protect and uphold students rights and welfare
in all its collective decisions and actions. The balance represents the CMSS as a body which
decides on some legislative matters and upholds fair justice and discretion in its decisions
and actions. The bay leaf wreath represents the value of creativity, knowledge and
resourcefulness exercised and strived to the fullest by the CMSS. The ribbon symbolizes
unity and love. The Latin words VERITAS meaning truth and AEQUITAS meaning justice
are the values that the CMSS highly regards. The lyre represents the Conservatory of Music
and its students.
Section 4
The domicile or permanent legal residence of the CMSB shall be currently where the
Conservatory of Musics domicile-recognized by UST exists.
ARTICLE VII
BILL OF RIGHTS
Section 1
It is the right of every student to be treated by all members of the student body in a manner
that befits his dignity as a person created in the image and likeness of God.
Section 2
Every student shall have all civil rights protected by the laws of the land, and all rights and
privileges guaranteed to him by the policies, rules and regulations of the university or by any
of its agencies.
Section 3
Every student shall have the right to due process. No student shall be denied the equal
protection of the laws.
Section 4
No student shall be discriminated by the student body against solely on account of his
physical and/or mental handicap, socio-economic status, political or religious beliefs and
affiliations, affiliations with known disreputable personalities and/or organizations, sexual
orientation or membership in student organizations, certified rehabilitated drug abusers
provided their conditions were disclosed at the time of their application, and those suffering
from the acquired Immune Deficiency Syndrome.
Section 5
It is the right of every student to express his concerns in formal writing to the Office of the
Dean or to any academic official of the conservatory regarding but not limited to faculty
members, non-teaching personnel, academic standings, university/college policies, students
or any organization or agency within the jurisdiction of the university. Thus, students who
would report such violations or concerns may exercise the right to anonymity only from the
public to protect his person.
Section 6
It is the right of every student to make a written formal evaluation of the performance of their
teachers and non-teaching personnel of the university to be forwarded to the CMSC and/or
Office of the Dean.
Section 7
It is the right of every constituent to avail or use facilities and/or equipment of the
Conservatory of Music, CMSC or of any recognized college-based student organization
subject to the existing policies, rules, and regulations of the respective body.
Section 8
It is the right of every student to have adequate notice of all rules, regulations, policies and
penalties to which they are subjects. All rules, regulations, policies and penalties must be
made available and accessible to all students.
Section 9
It is the right of every student to have access to official records and other pertinent
documents and papers pertaining to official acts, transactions or decisions by the CMSB,
respective departments and recognized organizations of the conservatory affecting his own
interest and welfare.
Section 10
It is the right of every student to be secured within the university premises in their persons,
papers and effects against unauthorized and unreasonable searches and seizures of
whatever nature and purpose.
Section 11
It is the right of every student to utilize print and broadcast media within the jurisdiction of the
university and the conservatory in pursuance of their academic freedom and freedom of
press. These media shall be utilized and published subject to the laws of libel and obscenity,
other rules and regulations of the university and the conservatory.

Students academic freedom shall consist of but not be limited to the following rights:
a.
To conduct researches in connection with academic work, and to freely discuss and
publish their findings and recommendations within the student body;
b.

To express their opinion on any subject of public or general concern which directly or
indirectly affects the student or education system;
e.
Section 15
It is the right of every student to form and join organizations, clubs and groups as long as it
is consistent with the existing university rules and policies.
Section 16

It is the right of the student to be heard and to present evidence on his behalf before an
impartial body;
b.
It is the right of the student to appeal adverse decisions of the said disciplinary
board/authority to the appropriate offices or education agencies and if necessary, to the
courts. He shall be presumed innocent until the contrary is proven;
c.
It is the right of every student subject to any disciplinary, investigative and judicial
proceeding to invoke anonymity from the public to protect his person and dignity.
Proceedings are to be private in nature and should not involve unauthorized
participation of students whether directly or indirectly affected;
d.
It is the right of every student to have a speedy settlement of their cases before all
authorized student-sponsored quasi-judicial bodies except when the delay is imputable
to them.
ARTICLE VIII
DUTIES OF STUDENTS
Section 1
It is the duty of every student to respect UST, observe its Catholic values and traditions,
obey its policies, rules, regulations and statutes as stipulated in the latest publication of the
universitys student handbook, and other rules and regulations that shall be formulated with
just cause and purpose by any agency of the university.
Section 2
It is the duty of every student to respect the Conservatory of Music, observe its traditions,
obey its policies, rules, regulations and statutes as announced or discussed by the
Conservatory of Music administration, and uphold and follow this very Constitution.
Section 3
It is the duty of every student to take care and be responsible in the use of school properties
which include but are not limited to musical instruments, lockers, studios and classrooms.
Section 4
It is the duty of every student to strive and exercise academic excellence, responsibly and
wisely make use of his time in the conservatory in order that he may be of service and value
to himself as a dignified human being, be of service to God, society and his family.
Section 5
It is the duty of every student to vote and actively participate in all student elections,
referenda and plebiscites subject to rules stipulated by this Constitution and the universitys
student handbook.
ARTICLE IX
QUALIFICATIONS AND REQUIREMENTS OF CONSERVATORY OF MUSIC STUDENT
COUNCIL OFFICERS
Section 1
A candidate to be an officer shall possess the following qualifications during the semester of
elections:

Must not have failed subjects with a total of over five (5) units throughout his entire stay
in the conservatory;
d.
Have a continuous residency in the university for at least seven (7) months immediately
preceding the elections.
Section 2
Candidates for President must have prior experience in the Conservatory of Music student
government such as but not limited to department officers and CMSC staff/executive
assistant.
Section 3
A candidate to be an officer must submit the following upon filing for candidacy:

ARTICLE X
DUTIES AND RESPONSIBILITIES OF THE CONSERVATORY OF MUSIC STUDENT COUNCIL
OFFICERS
Section 1
The President shall have the following functions, powers, duties and responsibilities:

Have the right to create and dissolve standing ad hoc committees and appoint
chairperson of each with the cooperation of the CMSC;
c.
d.
Convene the CMSS after all departments and block sections elections;
e.
Request members of the CMSS for irregular meetings if he wish to address that body;
f.
Be the presiding officer of the CMSS, attends all its meetings and participate in all its
discussions;
g.
h.
Present to the student body the CMSCs programs and guidelines of its policies;
i.
Approve the allocation of funds for activities and expenses of the CMSB for the
academic year in concurrence with the Treasurer and the CMSC;
j.
Has the duty to be fully acquainted on the proper format, procedures or systems as
inherent to the function of the CMSBs responsibilities such as but not limited to
submitting project proposals, holding fund raisers, student grievances, etc.;
k.
Serves as the direct representative of the Conservatory of Music to the Central Student
Council of the university;
l.
Has the power to appoint any of the CMSC officers to fill up the vacancies in case of
vacancy in any CMSC position. He shall appoint a new member of the CMSC to fill up
the remaining vacancies in concurrence with the COMELEC;
m.
n.
Ensure the student body or the basic units of the CMSB cooperates in accordance with
the parameters set by this Constitution;
o.
Exercise other powers which are inherent to his office, and shall perform other duties
as necessary or incidental to the performance of his function or as the CMSC and
CMSS may provide.
Section 2
The Vice President shall have the following functions, powers, duties and responsibilities:
a.
Be the first (1st) among the Executive Board to adapt the role of the President if the
latter is unable to perform his duties and responsibilities;
b.
Has the duty to be fully acquainted on the proper format, procedures or systems as
inherent to the function of the CMSBs responsibilities such as but not limited to
submitting project proposals, holding fund raisers, student grievances, etc.;
c.
Section 3
Perform such other functions as required by his office or as the President may assign.
The Secretary shall have the following functions, powers, duties and responsibilities:
a.

Be responsible for the safekeeping of the records and documents of the CMSB;
c.
Record the minutes and attendance of all the meetings of the CMSB;

d.
Furnish copies of the minutes of the meetings to the members of the CMSC on the
immediately succeeding meeting and provide copies of other records and documents
upon request by any member of the CMSB;
e.
Issue official correspondence of the CMSC to various units and organizations within and
outside the College;
f.
Has the duty to be fully acquainted on the proper format, procedures or systems as
inherent to the function of the CMSBs responsibilities such as but not limited to
submitting project proposals, holding fund raisers, student grievances, etc.;
g.
Prepare reports of all activities, plans and accomplishments of the CMSC every
semester as certified by the President and submit the same to the CMSS;
h.
Perform such other functions as may be required by his office or as the President may
assign.
Section 4
The Treasurer shall have the following functions, power, duties, and responsibilities:
a.
Keep in trust and confidence all the funds and properties of the CMSC;
b.
Collect and receive all dues required by the CMSC and all receivables from other
sources and issue official receipts as acknowledgement thereof;
c.
Shall allocate funds for activities and expenses of the CMSC for the academic year in
concurrence with the President and the CMSC;
d.
Deliver official receipts and sales invoices of the CMSC to the Office of the Vice Rector
of Finance;
e.
f.
Keep a complete and accurate record of receipts, disbursements and other transactions
in the corresponding books of account of the CMSC;
g.
Provide the Auditor with a copy of all financial records as soon as they are prepared;
h.
Formulate and forward to the Auditor a financial report to be finally approved by the
President;
i.
Forward to the Auditor a performance and financial report at the end of each semester
or during a request of any;
j.
Perform such other functions as may be required by his office or as the President may
assign.
Section 4
The Auditor shall have the following functions, powers, duties and responsibilities:
a.

Inspect the financial records of the CMSB especially after each of its activities, to see if
there are any anomalies or discrepancies in the records and in the disbursement and
keeping of funds;
c.
d.
Certify and attest in writing the veracity and correctness of the records if they are
possessed with such;

e.
Report in writing any discovered anomaly or discrepancy to the President and CMSB
Adviser;
f.
Audit the Treasurers financial report, and certify or reject it based on his investigation
and inspection of the records as a protective and constructive service to the students;
g.
Submit to the President a certified performance and the Treasurers official financial
report at the end of each semester or upon the request of any;
h.
Submit a certified financial report to the incoming CMSC officers at the end of the
school year;
i.
j.
Assume the powers and functions of the Treasurer when the latter is unable to perform
his duties and responsibilities;
k.
Perform such other functions as may be required by his office or as the President may
assign.
Section 6
The Public Relations Officer has the following functions, powers, duties, and responsibilities:
a.

Ensure the proper announcement of the activities of the CMSB to the student body
through a student bulletin, calendar and electronic/digital information dissemination;
c.
Promote, advertise and market the activities of the Conservatory of Music which would
greatly benefit with the participation of persons within and outside the domicile of the
CMSB;
d.
Make sure that the members of the CMSB are well informed of all its activities and
meetings;
e.
Secure and maintain an updated directory of all the students of the conservatory and
provide the same when needed;
f.
g.
Has the responsibility over the maintenance and order of the whiteboards/bulletin
boards within the Conservatory of Music which the CMSC has jurisdiction of;
h.
Perform such other functions as may be required by his office or as the President may
assign.
ARTICLE XI
DEPARTMENTS, BLOCK SECTIONS AND RECOGNIZED ORGANIZATIONS

Section 1
The departments and first (1 ) year block sections shall be the basic units of the CMSB.
Section 2
The following groups shall comprise the different departments and block sections inside the
conservatory, as stated in Section 1:

The departments shall be composed and subject to the participation of all regular and
irregular students enrolled in the conservatory according to their majors. The only block

The departments will each have an official seal used for purposes of representing their
respective departments.
a.
The logo features the crown of the Classical guitar with a torch embedded on it. The
crown, sometimes called the head, resembles the fine and elite music that the Classical
guitar repertoire has. The three flames on top of the torch symbolize Artistry,
Musicianship and Scholarship. The circle border displays the rosette of the Classical
guitar which showcases the luthier's artistic side. The color black best symbolizes the
character of the department. It imposes elegance, power and mystery. It perfectly
represents the boundless limitation of the Classical guitar and its repertoire.
b.
The book represents education and knowledge while the quarter note within the book
represents music thus giving life to the Music Education Department logo. The color
emerald green represents harmony, balance, growth and hope. It also suggests
abundance and wealth in many forms most especially in emotional and creative ideas.
The lyre in the middle section of the book was derived from UST Conservatory of Music
logo.

Musicology Department;
The logo depicts the unique character of the Musicology Department. The lyre
symbolizes the Conservatory of Music. The color orange, which is the departments
official color, symbolizes the departments creativity, expression, fascination and
enthusiasm.
d.
The logo includes a minimalist illustration of a grand piano including the empty
accompanying piano bench. The empty piano bench symbolizes the welcoming and
challenging pursuit of a music student to improve his craft of singing with his fingers on
the piano. Typography is not included in this logo because like music, the logo shows
that it can be understood without words. The blue hue in the background symbolizes
confidence in performance, calmness in relaxation (technique-wise) and power to
conquer the instrument. The two shades of blue symbolize the different level of
achieving the aforementioned characteristics.

The instruments in the logo sound independently but when played together create a
new synergized sound that cannot be heard if one is missing.
f.
The Treble Clef, a symbol most standardly used in written music, also represents a
conductor wielding a baton. Beside it lies a silver-colored quill pen, as used by the
founding composers in music history. The quill also represents the Bass Clef, a symbol
in which when combined with the Treble, creates the Grand Staff, and thus, would
represent Music Theory.

The human with his arms extended and mouth open shows the art of beautiful singing
while the mask is associated with the art of drama. These depict the two (2) fields of
music, which are Voice and Musical Theater, under the Vocal Performance Department.
The official color of the department is purple which represents the departments nobility,
grandeur and devotion.
Section 5
The departments, block sections and recognized college-based organizations shall have the
following elected officers:
a.

Vice President;

Secretary;

Treasurer;
e.
Auditor; and,
f.
The term of the said officers shall officially commence on the last day of the 2
the outgoing school year and end on the last day of the 2

Section 6
Each department and block section, in coordination with its coordinator/adviser, may
formulate its own rules governing its operation provided that they shall be consistent with
this Constitution.
Section 7

It is the duty of all the department and first (1st) year block section officers to implement all
the rules, regulations and resolutions promulgated by the CMSB.

Section 9
ARTICLE XII
QUALIFICATIONS AND REQUIREMENTS OF DEPARTMENT AND BLOCK SECTION
OFFICERS
Section 1
A candidate to be an officer shall possess the following qualifications during the semester of
elections:

immediately preceding the elections;
d.
Must not be an officer of any organization, department or block section inside the
conservatory;
e.
Have a continuous residency in the university for at least seven (7) months immediately
preceding the elections, provided that the candidate running for a position in a block
section shall be exempted from this rule.
Section 2
A candidate to be an officer for a department must submit the following upon filing for
candidacy:

Good scholastic record of the previous semester provided by the Office of the Dean or a
print-out of his grades of the previous semester. This print-out can be taken from
viewing ones grade online using USTs student services website.
ARTICLE XIII
DUTIES AND RESPONSIBILITIES OF DEPARTMENT AND BLOCK SECTION OFFICERS
Section 1
The President shall have the following functions, powers, duties and responsibilities:
a.
Be primarily responsible for the overall well-being and discipline of the department/block
section;
b.

Exercise command authority over all officers and be responsible for their actions in the
discharge of their duties;
d.

e.
Ensure that the departments/block sections concerns are communicated to the proper
authorities and advocate for the just resolution of the same;
f.
Ensure the efficient and effective announcement and implementation of the CMSB
services and projects to the department/block section;
g.
For block section Presidents, follow up the attendance of the professor when he does
not arrive in the classroom at the appointed time of his subject;
h.
i.
Regularly attend meetings of the CMSS and when unable to do so, send a
representative duly authorized in his stead;
j.
k.
Verify with the Office of the Dean regarding the appointed Coordinator/Adviser within
the first semester;
l.
m. Coordinate with and update the assigned Coordinator/Adviser regarding any concern;
n.
Has the power to appoint any of his department/block section officers to fill up the
vacancies in case of vacancy in any position within his department/block section. He
shall appoint a new officer from the student body of his department/block section to fill
up the remaining vacancies in concurrence with the COMELEC;
o.
Section 2
Perform other functions as may be required by his office or as the CMSB may assign.
The Vice President shall have the following functions, powers, duties and responsibilities:

For Block Section Vice Presidents, be primarily responsible for coordinating the
maintenance, physical cleanliness and orderliness of the classroom;
c.
Assist advisers and professors in carrying and setting up any equipment required such
as laptops and the like;
d.
Check for any possessions left in the room after the department or block section leaves
an area and ensure its return to the proper owner;
e.
Report to the maintenance staff any spill or mess that demands their assistance in
cleaning up;
f.
Report in writing to the Office of the Dean any faulty equipment in the classroom such
as chairs, air-conditioning units, fans and the like;
g.
Perform such other functions as may be required by his office or as the President may
assign.
Section 3
The Secretary shall have the following functions, powers, duties and responsibilities:
a.
Take custody of all documents such as handouts, announcements, memoranda and the
like issued to or by the department or block section,;
b.
Prepare the seat plan in subjects where the adviser or professor requires one;

c.
Prepare a directory of the department/block section at the start of classes and maintain
its accuracy throughout the academic year;
d.
Keep a record of and take the attendance in every subject and report absences to the
respective professors;
e.
f.
Perform such other functions as may be required by his office or as the President may
assign.
Section 4
The Treasurer shall have the following functions, powers, duties and responsibilities:
a.

Ensure the prompt payment of the departments or block sections financial obligations
to the CMSC and other bodies;
c.
Formulate and implement, in coordination with the President, systems of collecting and
disbursing funds;
d.
e.
Present an accounting of all finances upon the request of any concerned party;
f.
Photocopy materials needed by the department or block section, and demand an official
receipt for such;
g.
Perform such other functions as may be required by his office or as the President may
assign.
Section 5
The Auditor shall have the following functions, powers, duties and responsibilities:
a.
Receive a copy of all financial reports of the department/block section which he belongs
to;
b.
Inspect the financial records of the department/block section which he belongs to,
especially after each of its activities, to see if there are any anomalies or discrepancies
in the records and in the disbursement and keeping of funds;
c.
d.
Certify and attest to the department/block section to the veracity and correctness of the
records if they are possessed with such;
e.
f.
Assume the powers and functions of the Treasurer when the latter is unable to perform
the latter are duties and responsibilities;
g.
Perform such other functions as may be required by his office or as the President may
assign.
Section 6
The Public Relations Officer shall have the following functions, powers, duties and
responsibilities:

Create online means of disseminating information and maintain such throughout the
academic year;
c.
Perform such other functions as may be required by his office or as the President or
CMSB may assign.
ARTICLE XIV
COMMISSION ON ELECTION
Section 1

The members of the COMELEC shall elect from them a Representative to the Central
COMELEC. Once a representative is elected, he automatically forfeits his membership in
the local COMELEC and shall serve as a commissioner of the Central COMELEC.
Section 3
The following are the qualifications for the members of the COMELEC:
a.

Enrolled with a total of at least fifteen (15) units excluding PE and NSTP;
c.
d.
Must be of known probity and integrity, not having been found guilty of violating the
rules on general conduct of the university as certified by the Office of the Dean or
SWDB Coordinator of the Conservatory of Music;
e.
Had not been a candidate for any elective position in the immediately preceding
elections;
f.
Have a continuous residency in the university for at least seven (7) months;
g.
The Chairperson of the COMELEC shall be elected by and among the members of the
COMELEC.

Section 4
No members of the COMELEC shall hold office in the university or college during his term.
Neither shall he be affiliated with any society, association or organization, directly or
indirectly involved into politics or directly affiliated or identified to any political party, fraternity
and sorority within the university or college.
Section 5
The COMELEC shall administer all department and block section officers elections, and all
authorized, local referenda and plebiscites, and administer or supervise the election of
officers of recognized college-based societies or organization.
Section 6
a.
To govern and implement such rules, regulations and guidelines related to the conduct
of elections, and to set up measures and procedures to make sure that such rules and
regulations are followed;
b.
To discipline erring members and relief from duties may be done but only after proper
investigation and due process has been applied;
c.
To exclude unauthorized persons from those rooms or places where poll or the
canvassing of votes are being held;
d.
To summon the parties in a controversy pending before it and to take testimony of the
complainant, defendant and witnesses in the investigation or hearing before it;
e.
f.
To report to the Central COMELEC violations of the provisions of the Student Election
Code of 2011 on the conduct of political campaign, and election propaganda;
g.
To display candidates for Executive Board of CMSC if they fail to meet the requirements
prescribed;
h.
To proclaim the result of the elections as stated in the Student Election Code 2011.
The COMELEC shall perform such other functions as may be necessary for the full
implementation of the Student Election Code 2011, consider the requirements of free, fair,
honest and orderly elections.
In an election where majority of the voters voted for abstain for a position, the COMELEC
shall call for a special elections for the position to be held in the first month of the semester
immediately subsequent to the election. The COMELEC shall administer the special
elections.
ARTICLE XV
ELECTIONS
Section 1
The COMELEC shall be the administrators of all CMSC, department and block section
elections and all authorized local referenda and plebiscites, and shall administer or
supervise the election of officers of recognized college-based organizations.

Section 2
The officers of the CMSC for the incoming school year shall be elected by officially enrolled
students.
Section 3
All elections for positions in the CMSC shall be by online voting only.
Section 4
All elections for positions in the departments and block sections shall be by manual balloting
only.
Section 5
The COMELEC will advise the CMSC of the election dates for the department officers which
should be done at least two (2) consecutive weekdays before the last two (2) weeks of the
current school year.
Section 6
The elections for block section officers and recognized college-based organizations shall be

done within one (1) week after the first (1 ) day of classes of the new school year.
Section 7

The election in a department shall be declared successful if it reaches the simple majority of
the total population of the department based from the master list acquired by the COMELEC
from the administration. Otherwise, a special election shall be administered following the
same rules or provisions as of the first elections.
Section 9
The master list authenticated and received from the Conservatory of Music administration by
the COMELEC shall be accessible to the public or to the concerned during the time of
elections.

The right of the students to abstain from voting any candidate running for office shall be
recognized and shall reflect in the form and content of any ballot used for elections.

Any CMSC, department and block section officer may be re-elected for no more than a
second term for the same position.
Section 14
Only the students who are included in the official list of members of political party may run
for a position in the CMSC under the banner of that political party; provided that political

parties may submit an updated list of its members to the COMELEC, two (2) days before the
deadline of filling of certificates of candidacy.
Section 15
Faculty members must restrain themselves from supporting, in any manner, any candidate
or political party; provided that a faculty member who is an alumnus of a registered political
party may provide consultation and financial assistance to his political party.
Section 16
Room to room campaign by candidates is only allowed within the written approval of the
Office of the Dean.
Section 17
Campaigns may be conducted only during the period set by the COMELEC. Violators of the
said provision will be sanctioned.
Section 18
The COMELEC is required to call a special/snap election within fifteen (15) days after a
vacancy occurs in order to elect an officer to serve the unexpired term. This vacancy must
arise three (3) months or more before the regular election.
ARTICLE XVI
TENURE AND VACANCY
Section 1
All duly elected officers of the CMSB shall serve for a term of one (1) academic year.
Section 2
In case of vacancy in the position of the President, the Vice President shall become the
President. The COMELEC shall hold special elections to fill in the vacancy in the position of
the Vice President.
Section 3
In case of vacancy in the position of the President and the Vice President at the same time,
the Secretary shall become the President and shall have the power to appoint his Vice
President from any of the elected members of the CMSC, department or block section. The
COMELEC will hold special elections to fill in the vacancy in the position of the Secretary
and the previous position of the newly appointed Vice President.
Section 4
In case of vacancy in any position where the President is still in office, the latter has the
power to appoint any of his officers to fill up the vacancies. He shall appoint a new member
of the CMSC, department or block section to fill up the remaining vacancies in concurrence
with the COMELEC.
Section 5
In case all positions in the CMSC become vacant, the CMSS shall inform the student body
of such thus the COMELEC shall administrate a snap election following the stipulations of
Article IX and Article XV.
Section 6
Any member of the CMSB may resign from his office only for grave and just reasons,
provided that he shall inform the CMSB Adviser in writing, copies of which shall be given to
the Office of the Dean, COMELEC and his constituents of the reasons for and the effective

date of such; after the resignation is accepted, it is the responsibility of the member to
properly endorse his responsibilities to his replacement. The COMELEC shall administer
special elections to fill in any permanent vacancies subject to this very article.
Section 7
Any CMSB officer removed or stepped down from office shall thereafter be permanently
disqualified from holding any position in the CMSB and of being elected to a vacant position
in his organization/department/block section within the current academic year.
ARTICLE XVI
REMOVAL FROM OFFICE
Section 1
It is the responsibility of the officers of the CMSB that the official body they represent
functions accordingly for the welfare of its constituents. Any officer that is evaluated by his
colleagues to be: (1) negligent of his duty and/or (2) unethical, abusive and unprofessional in
behavior, must be consulted and upon the choice of the said officer, be given a chance to
improve on his wrongdoing. Otherwise, he must be formally asked to accept a proposal
written or verbal for resignation for the best of his current pre-occupations and of the
CMSB.
Section 2
Removal from office may likewise be directly called for by the student body through initiative
upon a petition of at least twenty percent (25%) of the total student population of their
respective body - for CMSC officers, whole student populace of the Conservatory of Music
based from the records from the Conservatory of Music administration, and for department
and block section officers, populace only of their respective department and block section.
Such campaign of the student body must have a definite schedule and must be made and
done in public for the whole populace of the Conservatory of Music and/or department/block
section to be informed. The campaign must be done not earlier than fifteen (15) class days
and not later than and can be extended until the thirty-first (31st) class day since the
beginning of the campaign. Furthermore, the COMELEC must also be consulted to
authenticate the said petition otherwise the said petition will not be recognized.
Section 3
The concerned member of the CMSB and his complainants shall be given the opportunity to
personally present testimony, evidence and witnesses in his behalf before the student body.
ARTICLE XVIII
FUNDS AND PROJECT PROPOSALS
Section 1
The fund of the CMSC is derived from two sources, namely: Student Council Fund
(hereinafter referred to as SCF) and Student Activity Fund (hereinafter referred to as SAF).
Both are allocated by the UST Treasurers Office during semestral registration and are
included in what the student is paying for in his other fees during enrolment.

Section 2
The current value of the SCF and SAF the student pays varies according to what has been
proposed or approved by the former CMSC president of the past school year to the Office of
the Dean and Central Student Council.
Section 3
The SCF is primarily allocated for the proper function of the office of the CMSC such as
acquisition of school/office materials and equipment. It can be allotted by the CMSC for
other justifiable reasons such as contingency fund or community service. Aside from the
students, the fund is subject to the scrutiny of the UST Treasurers office.
Section 4
The SAF is primarily allotted for activities and projects for the welfare of the students. Aside
from the students, the fund is subject to the scrutiny of the Dean and of the UST Treasurers
office.
Section 5
Activities or projects requiring financial support from the SAF proposed by either the CMSS,
departments, block sections or of any concerned student must file their proposal to the
CMSC which reserves the right to deny or endorse the said activity or project. The nature of
the activities or projects must at least be one of the following:

Justifiable activity or project which is congruent with the ideals and objectives set by this
Constitution but does not fall under at least one of the three (3) above will be subject to the
endorsement and approval of the CMSC President and stipulations by the university
administration.
Section 6
The CMSC should be informed either formally or informally by the respective proposing
person/s or body of his project-intention at least 2 months prior to the actual date of the
activity. Likewise, for the activity or project of the respective proposing person/s or body to
be carried out successfully on time of his intended date, he must already file for recognition
at the CMSC office at least one (1) month prior to the actual date of the activity to take into
account the processing of printed documents.
Section 7
The following are the standard requirements needed when filing for an activity or project:

VI. Project Duration enumerates the specific date and time the project will begin
and end;
VII. Project Beneficiaries the person or group who will benefit from the activity or
project;
VIII. Proposed Budget a table of expenses to be incurred in order for the activity or
project to be carried out efficiently;
IX. Signatories: Project Head, Project Financial Head/Treasurer, CMSC President,
Department Coordinator/Professor (if necessary), CMSB Adviser (if necessary),
Dean and Regent.

ARTICLE XIX
AMENDMENTS, REVISIONS AND RATIFICATION OF THE CONSTITUTION
Section 1
The call for an amendment is approved when a simple majority vote of the CMSS and in
addition to that, a simple majority vote of the members of the CMSC is achieved. Without the
said necessary votes of both bodies, amendment proceedings open to the public and
ratification must not proceed.
Section 2
Section 3
In any case the provision in either Section 1 or Section 2 is fulfilled, only then can
amendment proceedings open to the public can proceed. The CMSC, in concurrence with
the CMSS, will be the constitutional commission or legislative body responsible in
formulating the amendments or revisions of the Constitution.
Section 4
a.
The COMELEC will conduct a plebiscite involving all the members of the CMSB.
Ratification can be achieved when a simple majority of the total number of officers
agreeing to the amended constitution is reached. The COMELEC may ask/designate
members of the student body in conducting the said plebiscite. The definite schedule of

the plebiscite must be announced to the public and must be done or declared finished
not earlier than ten (10) days and not later than and can be proposed to be extended
until the thirty-first (31st) class day since the beginning of the plebiscite;
b.
The COMELEC will conduct a plebiscite involving all the members of the student body.
Ratification can be achieved when at least twenty-five percent (25%) of the student
population of the Conservatory of Music based from either a recognized master list of
the COMELEC, votes in agreeing to the amended Constitution. The COMELEC may
ask the CMSB for any aid it may require in conducting the said plebiscite. The definite
schedule of the plebiscite must be announced to the public and must be done or
declared finished not earlier than fifteen (15) class days and not later than and can be

proposed to be extended until the thirty-first (31 ) class day since the beginning of the
plebiscite.
ARTICLE XX
EFFECTIVITY AND TRANSITORY PROVISIONS
Section 1
This Constitution and By-Laws of the University Of Santo Tomas Conservatory Of Music
shall be effective immediately after approval.
Section 2
The official members of the CMSB under this Constitution shall be composed of the elected
officers of AY 2014-2015 who approved this Constitution. The outgoing officers of the said
student government shall observe a transitory phase in anticipation of the day of the
approval. All resources of the outgoing student government AY 2014-2015 should be
forwarded to the newly elected officers of the CMSB on or before the last day of the
academic year.
