Executive SummarY
purpose: The School Building Needs Commission needs to approve the Guaranteed Maximum
price (GMP) agreement with Gilbane Building Company that has been negotiated by Skanska
and DRA. The GMP amount is 597,757,373 which is the exact same amount that has been
authorized by the MSBA for the project. This amount includes all costs for construction, liability
and workmen's insurance, bonds, fees and builders contingency. This amount does not include
costs for design, FF&E, builders risk insurance and OPM services which are covered in other
areas of the overall project budget. Approval of the GMP agreement will authorize Gilbane to
proceed with all aspects of the project.
Background: The Massachusetts School Building Authority authorized the City of Pittsfield to
construct a new Taconic High school project. The Project Funding agreement (Form 3011)
dated 5127/2075 authorized a construction budget of 597,757,373 for the project. The total
project budget authorized is 5t21,7gg,g2g. ltems included in the amount over and above the
construction costs include but are not limited to design, testing FF&E, moving, OPM, Owner
Contingencies and feasibility studies. Gilbane Building Company was selected in a competitive
process in the summer of 20L5 to be the construction manager for the project. Gilbane has
worked with the OPM and design team over the last year to estimate costs as design was
completed to assure that the project could be built within the budget stipulated by the MSBA.
Beginning in December of 2015, the team started bidding "early packages" needed to keep the
project on schedule. After careful consideration of each of these packages recommendations
were made to the School Building Needs Commission, and after approval, subcontracts were
awarded. To date the following subcontracts have been awarded:

Department has bid all the Filed Sub Bids required by

Massachusetts General Law Chapter L49A. Gilbane will award subcontracts to the low Filed Sub
Bidders. Gilbane has bid the remainder of the non-Filed Sub Bid work, scoped reviewed those
bidders, and is ready to make awards when the GMP is approved by the School Building Needs

The City

of Pittsfield Purchasing

Commission.

Qualifications:
1,. The cost for the contaminated soil removal is not included in the GMP and will be a
change order to Gilbane, which will be funded by the City's budgeted Construction
Contingency.

2.

The cost for unsuitable soil that had to be removed is not included in the GMP and will
be a change order to Gilbane, which will be funded by the City's budgeted Construction
Contingency.

3. There is an outstanding

protest on the electrical Filed Sub Bid work. Resolution has yet
to be reached. The team has a plan to fund any additional costs that may result from the
claim.

Recommendation:

After a thorough review of the bids and documentation submitted by Gilbane Building
Company, Skanska recommends that the City of Pittsfield execute a Guaranteed Maximum
Price contract amendment with Gilbane.
