Case study: Minimum Wages Act ,1948.

On 28.01.2014, matter stood settled between the workman and the management
in the court in terms of statements of workman Sh. Ram Prasad Yadav and Sh. A. K.
Ahooja, adv. for management in the following terms:
"Statement of Sh. Ram Prasad Yadav S/o Late Sh. Baldev Prasad. On SA Today, in
the course of court proceedings I have settled all my disputes with the management
acting through Mr. A. K. Ahooja, ld. counsel for the management. It has been agreed
that management shall pay a sum of Rs. 85,000/ to me on 31.01.2014 towards
satisfaction of all my claims / dues of any nature whatsoever against the
management including my claims before the Authority appointed under the
Minimum Wages Act, 1948 at Karampura, Delhi. After payment of Rs.85,000/ by the
management to me I shall be left with no claims / dues against the management
and I shall withdraw the case filed before the Authority appointed under the
Minimum Wages Act, 1948 at Karampura, Delhi. Settlement ahs been arrived at with
my own free will and consent without any force, coercion etc. from any corner
whatsoever. I have been made to understand the terms of settlement in Hindi by
the Court as well as by my ld. counsel. Court may pass settlement award
accordingly."
"Statement of workman Sh. Ram Prasad Yadav S/o Late Sh. Baldev Prasad.
On SA Today, I have received a sum of Rs.34,000/ in cash and Rs.51,000/ through
cheque no. 003074 dated 12.02.2014 drawn on HDFC Bank, Plot No. 4, Capital Trust
House II, Maa Anandamayi Marg, Okhla Industrial Area, Phase - II, New Delhi
(photocopy of the same Ex. X) in terms of settlement arrived on 28.01.2014. In
terms of settlement arrived at on 28.01.2014 I undertake to withdraw the case filed
by me before the Authority appointed under the Minimum Wages Act,1948 at
Karampura, Delhi. I undertake to present the above cheque for encashment only
after the withdrawal of case filed by me before the Authority appointed under the
Minimum Wages Act,1948 at Karampura, Delhi. If I present the cheque before
withdrawal of the case filed by me before the Authority appointed under the
Minimum Wages Act,1948 at Karampura, Delhi Court / management shall be at
liberty to present the case as per law for violating the statement made on oath
before the Court. It has further been agreed today that if cheque given by the
management and presented by me after withdrawal of case filed by me before the
Authority appointed under the Minimum Wages Act,1948 at Karampura, Delhi is
dishonoured for any reason, I shall be at liberty to get the present case revived and
in such eventuality cash payment of Rs.34,000/ paid to me today shall stand Page 3

Vs M/s Premier Sheild Pvt. Ltd. ID No. 427/12 forfeited in my favour. After the
encashment of abovesaid cheque I shall be left with no claims / dues of any nature

whatsoever including claims made by me in the statementofclaim filed before the


Court. Accordingly, an award may be passed in terms of settlement. "
