WHEREAS, Section 2A of RA 7277 otherwise known as the Magna Carta for Disabled
Persons provides that "Disabled persons are part of the Philippine society, thus the Senate shall give
full support to the improvement of the total well-being of disabled persons and their integration into
the mainstream of society. Toward this end, the State shall adopt policies ensuring the rehabilitation,
self-development and self-reliance of disabled persons",
WHEREAS, pursuant to the aforementioned law "the State shall advocate for and encourage
respect for disabled persons to facilitate integration of disabled persons into the mainstream of society,.
The State shall exert all efforts to remove all social, cultural, economic, environmental and attitudinal
barriers that are prejudicial to disabled persons",

WHEREAS, in order to promote the rights of persons with disabilities (PWDs) to participate
fully in the social life and the development of the societies in which Lliey live a.id the enjoyment of the
opportunities available to other citizens,
WHEREAS, Batas Pambansa Blg. 344, "An Act to Enhance the Mobility of Disabled Persons
by Requiring Certain Buildings, Institutions, Establishment and Public Utilities to Install Facilities and
Other Devices" promotes the realization of rights of disabled persons to participate fully in the social
life and the development of the societies,
WHEREAS, through the passage of this Ordinance, it will encourage assistance, strengthen
mobility and accessibility especially during emergency cases not only for the benefit of persons with
disabilities but also for the elderly and pregnant women. relevantly included as vulnerable individuals
in times of disaster, emergency situations and during hazardous cases.
NOW, TIIBREFORE, be it ordained by the Sangguniang Panlungsod of lloilo City that:
SECTION 1. Title. - This ordinance shall be known as the "Accessibility Ordinance of
Person~ with Disabiliry, Elderly, and l)regnanr Tf'umen"
SECTION 2. Coverage. - All public and private buildings for public use, educational
institutions, airports, sports and recreation centers and complexes, shopping centers or commercial
establishments, public parking places, \Vork-places, public utilities, government buildings and the like
within lloilo City shall within the pt;::riod of 5 years upon effectivity of this ordinance, be renovated to
qualify as PWD, elderly, and pregnant women-friendly buildings as duly defined in this act.
SECTION 3. Scope. - No license or permit for the construction, repair or renovation of public
and pnvate buildings for public use, educational institutions, airports, sports and recreation centers and
complexes, shopping centers or commercial establishments, public parking places, work-places, public
utilities, government buildings, industrial buildings and the like within lloilo City, shall be granted or
issued, unless the owner or opt;::rator thereof shall install and incorporate in such building,
establishment, institution or public utility, such architectural facilities or structural features as shall
reasonably enhance the mobiiity of disabled persons, elderly and pregnai1t wu1r1e11 such ru; sidewalks,
ramps, railings and the like.
SECTION 4. Definition of Terms. ~ The terms belo\V shall have the meanings ascribed to
them in this section. Any word or term not defined shall be given their plain and customary meanings,
unless the context requires otherwise, and shall be interpreted in a manner consistent with the purpose
and spirit of this Ordinance.

a. Disability
- shall mean (1) a physical or mental impairment that substantially limits
one or more psychological, physiological or anatomical function of an individual or
activities of such individual; (2) a record of such an impainnent; or (3) being regarded
as having such an itnpainnent;
b. Elderly - any resident citizen of the Philippines at least sixty (60) years of age;
c. Handicap
- refers to a disadvaniage for a given individual resulting from an
impairment or a disability, that limits or prevents the functions or activity, that is
considered normal given the age and sex of the individual;

d. Impairment - any loss, diminution or aberration of psychological, physiological, or


anatomical structure of function;

Persons with Disabilities (PVlDs) - refer to those suffering from restriction of different
abilities, as a result of a mental, physical or sensory impairment, to perform an activity
in the manner or within the range considered normal for a human being~

g. PWD. Elderly, and Pregnant Women-Friendly Building - means an accessible building


which has features that enable PWDs, the elderly, the pregnant women and those with
mobility challenges to make lISe of the primary functions for which a structure is built
For a building to be compliant with this ordinance, it must have the following features,
to wit ramps, washrooms and toilets, parking areas and stalls, sidewalks, signage, nonskid flooring, doors and entrances, stairs, corridors, and handrails, among others. For
buildings containing tlve floors or higher, there must also be an easily located elevator.
Furthermore, fire escape or emergency exits must also be accessible for those
individuals with mobility challenges. The use of the Universal Design for the
aforementioned features is highly recommended, otherwise, the standards stipulated
under the Implementing Rules and Regulations of R.P. 344 should apply.
h. Universal Design - refers to a design concept that recognizes, respects, values and
attempts to accommodate the broadest possible spectrum of human ability in the design
of buildings and environments; also refers to broad-spectrum ideas meant to produce
buildings, and environments that are inherently accessible to older people, pregnant
women, people without disabilities, and Qople \\ith disabilitie:).

SECTION 5. Prohibited Acts. The following are the prohibited acts under this ordinance:
Non-compliance of an establishment within five years of the installation of the features of a
PWD, Elderly and Pregnant Women-friendly building as stipulated under Paragraph G, Section
4 herein.
b. Non-compliance with the design standards stipulated under the IRR of BP 344 with regard to
the accessibility features installed in the building or in lieu thereof, non-use of the Universal
Design concept.
c. The grant of pennits or licenses for buildings or establishments considered as not PWD,
Elderly and Prt:btflfilll Women-frit:ndiy.

SECTION 6. Penalties. Any person, including the heads of implementing agencies, it may be
local or national, violating any provision of this act, upon conviction by a court of competent
jurisdiction, shall su1Ter the fuiiuwing penailies as:
a. for the first violation, a fine of three thousand and five hundred pesos (P3,500) or
imprisonment of not less than six (6) months, or both at the discretion of the court;
b. for the second violation, a fine of four thousand and five hundred pesos (P4,500.00) or
imprisonment of not less than six (6) months, or both at the discretion of the court;

c. for the third violation~ five thousand pesos (P5,000.00) or imprisonment of not less than
six (6) months, or both at the discretion of the court; and
d. for any subsequent vioiation, iive thousand pesos (?5,000.0-0) or cance11ationfrevocation
of license, or both at the discretion of the court~
e. If the violator is a corporation, organization or any similar entity, the officials thereof
directly involved shall be liable therefore.
f. This is without prejudice to the penalties imposed under R.A. 7277
SECTION 7. Implementing Office. The City Engineer's Office under the building officer is
hereby tasked to impletnent the provisions of this ordinance with regards to the approval of
building/construction pennit.
The Business and Licensing Office (BPLO) is hereby tasked to impiement this ordinance with
regards to the business pennits.

SECTION 8. Implementing Rules. The City Mayor, from time to time, issue rules and
regulations as he may deem fit and necessary for the effective implementation of this ordinance.

SECTlON 9.

Repealing Clause. All existing city ordinances or part thereof which 1s

inconsistent with the provisions of this Ordinance, are hereby repealed or modified accordingly.

SECTION 10. Separability Clause. If for any reason or reasons, any part of this Ordinance
is declared unconstitutional or invalid, the other portions or provisions hereof, which are not affected
thereby, shall continue in full force and effect.

SECTION 11. Effectivity. This ordinance shall take effect immediately upon its approval and
publication.
