Reminders under this Art.172
Par.1- Damage or intent to cause damage is not necessary because the principal
thing punished is the violation of the public faith and the destruction of the truth as
therein solemnly proclaimed.
Lack of malice or intent is a defense in falsification of public document (in some
instance: ex. Case of Pp vs. Unico)
Par.2- Mere falsification of private document is not enough. There must be intent to
cause damage. If the private individual just kept the falsified document in his house,
without delivering or showing it to anyone, destroyed it, he did not prejudice anyone
by mere fact of having it.
He must have counterfeited the document and performs an independent act to
prejudice a third person
Under this art. It is not necessary that the offender profited or hoped to profit by
falsification all the law requires is intent to prejudice another person.
