REGULATION ORDINANCE NO. 2015-231


AN ORDINANCE REQUIRING CYCLISTS OR BICYCLE OR ELECTRONIC
BICYCLE COMMUTERS TO INSTALL FRONT AND REAR LIGHTS OR
REFLECTORS AND PRESCRIBING PENALTIES FOR VIOLATION
THEREOF

WHEREAS, as an alternative to motorized vehicle transportation, some commuters prefer the


use of bicycles as their mode of transportation for it is more beneficial and environmentally friendly;
WHEREAS, the use of bicycles steadily rise as an alternative mean of transportation because
of the increasing prices of oil petroleum products for motorized vehicles when travelling within Iloilo
City;

WHEREAS, it is unavoidable that there are areas in the City of IloilO which are accident prone
or no visible street lights and thus, usually the critical victims of road accidents are the cyclists or bike
commuters~

WHERES, Section 458 (a) of the Local Government Code of 1991 provides that "the
Sangguniang Panlungsod, as the legislative body of the city, shall enact ordinances, approve
resolutions and appropriate funds for the general welfare of the city and its inhabitants xx x".
NOW, THEREFORE, be it ordained by the Sangglllliang Panlungsod of the City of lloilo, that:
ARTICLE !. - TITLE. - This Ordinance shall be known as "AN ORDINANCE
REQUIRING CYCLISTS OR BICYCLE OR ELECTRONIC BICYCLE COMMUTERS TO
INSTALL FRONT AND REAR LIGHTS OR REFLECTORS AND PRESCRIBING PENALTIES
FOR VIOLATION THEREOF".
ARTICLE 2. - DEFINITION OF TERMS. a. Bicycle - a non-motorized vehicle with two wheels held in a frame one behind the other,
propelled by pedals and steered by handlebars attached to the front wheel. This is usually
maneuvered by a person either riding solo or in tandem.
b. Bicycle Commuters - see Cyclists.
c. Cyclists - drivers of bicycle or electronic bicycle.
d. Electronic Bicycle - (also kno\W as E-bike) a bicycle with an integrated electric motor
which can be used for propulsion.
e. Lights - a removable or attached light/s, front and rear portions of the bicycle, to warn
approaching vehicles of the nearness of the cyclist. This shall also include blinkers.
f. Reflector - a piece of glass, metal or other material for reflecting light in a required
direction.
g. Road - a city street/road or a national road open to public traffic and declared by the
National or Local Government
h. Motorized Vehicle- any vehicle who mainly relies on electricity or internal combustion or
engine and oil petroleum products for its function.

Transportation Management and Traffic Regulation Office (TMTRO) - agency in charged
with the apprehension, regulation and implementation of this ordinance.
J. Jloilo City Treasurer's Office- office in-charge of receiving payments of fine.
k. Citation Tickets. -tickets issued by the TMTRO for violation of this ordinance.
ARTICLE 3. - REGULATORY PROVISIONS. - Bicycle must have a front and rear light
for early warning to other motorists. However, such light must be on steady mode especially on areas
with no visible street lights.
In case of unavailability of front and rear night lights, a front and rear reflector will suffice.
ARTICLE 4. - PENALTIES. - Cyclists who shall be caught by the TMTRO without front or
rear lights or any reflector while on road shall be fined the penalty of Php 100.00.
Cyclists caught and meted out this penalty shall be issued by the TMTRO and Iloilo City
Police Office a Citation Ticket and payments of fine shall be made directly to the Iloilo City

Treasurer's Office. Failure to pay for the period of three (3) days from issuance of Citation Ticket, the
City Legal Office shall initiate the filing of the case.
ARTICLE 5. - SEPARABILITY CLAUSE. - In the event that any provision of this
ordinance is declared invalid, the other provisions not affected thereby shall remain in full force and
effect.
ARTICLE 6. - REPEALING CLAUSE. - All local laws, rules and regulations which is
inconsistent with this ordinance are hereby repealed or modified accordingly.
ARTICLE 7. - EFFECTIVITY CLAUSE. - This ordinance shall take effect thirty (30) days
from publication in a local newspaper of general circulation.
