MODEQUILLO v. BREVA (1990)

FACTS:
1. On29January1988,ajudgmentwasrenderedbytheCAentitledSalinas
etalvModequillo,renderingajudgmentinfaovrofpetitionersand
directingthereinrespondentstojointlyandseverallypayitsliabilities.
2. Asthesaidjudgmentbecamefinal,awritofexecutionwasissuedbythe
RTCofDavaotosatisfyjudgmentonthegoodsandchattelsofthe
respondentsModequilloandMalubay.
3. On07July1988,thesheriffleviedonaparcelofresidentialland
registeredinthenameofnowhereinpetitionerModequillo.Thelatter
filedamotiontoquashthelevyofexecutionallegingthereinthatthe
residentiallanfiswherethefamilyhomeisbuiltin1969andthatsuchis
exemotfromexecution,forcedsaleorattachment,providedinArticles
152and153oftheFamilyCode.
4. However,in1988,theRTCdeniedthemotion.AMotionfor
Reconsiderationwasfiledthereofbutwasagaindenied.
5. Hence,thispresentcase.Petitionerassertsthattheresidentialhouseand
lotwasfirstoccupiedashisfamilyresidencein1969andwasduly
constitutedasafamilyhomeundertheFamilyCode.
ISSUE:WONafinaljudgmentoftheCAinanactionfordamagesmaybe
satisfiedbywayofexecutionofafamilyhomeconstitutedundertheFamily
Code?
RULING:

1. UndertheFamilyCode,afamilyhomeisdeemedconstitutedonahouse
andlotfromthetimeitisoccupiedasafamilyresidence.Ifthefamily
actuallyresidesinitspremises,itisthereforeafamilyhomeas
contemplatedbylaw.

UnderArticle162oftheFC,itisprovidedthatallexisitingfamily
residencesatthetimeoftheeffectivityoftheFCareconsideredfamily
homesandareprospectivelyentitledtobenefits;itdoesnotstatethat
theprovisionsofithasaretroactiveeffect,
