Sklaroff, M.D. [the “Petitioner”] files this Petition to Set Aside the Nomination Petition of Armond W. James for Representative in Congress for the 13 District in the Republican Primary of April 26, 2016 [the “Petition”] and, in support thereof, respectfully represents as follows: INTRODUCTION, PARTIES AND JURISDICTION 1. On April 26, 2016, a Primary Election will be held in the Commonwealth of Pennsylvania [the “Primary”], at which Primary-registered voters of the Republican Party will be selecting, inter alia, a candidate to be the Party’s nominee for Representative in Congress for the 13% District in the General Election to be held on November 8, 2016 [the “General Election” 2. Petitioner is a duly-qualified and validly-registered and -enrolled elector of the Republican Party in Pennsylvania, and is a resident of Pennsylvania; his address is 1219 Fairacres Road, Rydal [Abington Township], Pennsylvania, 19046-2911, and he understands that the statements herein are made subject to the penalties of 18 Pa.C.S.A. § 4904 relating to unsworn falsification to authorities. 3. Respondent, Pedro A. Cortés, is the Secretary of the Commonwealth, whose office is located at 305 North Office Building, Harrisburg, PA 17120-0102. 4. __ Respondent, Armond W. James [“James"], who has given his address as 7405 Coventry Ave., Elkins Park, PA 19027-3401, filed on February 16, 2016, a Nomination Petition seeking to be listed on the Republican ballot in the Primary as a candidate for Representative in Congress for the 13 District in the General Election [the “Nomination Petition”). 5. The 87-page Nomination Petition purportedly has 1094 valid and eligible signature-lines; Page I of the Nomination Petition is attached hereto as Exhibit “A.” 5. Numerous [542] signature-lines in the Nomination Petition are invalid and/or ineligible; thus, as few as 552 signature-lines are valid and eligible [pending the vetting of this submission] 7. Original and exclusive jurisdiction over the subject matter of this Petition is vested in the Commonwealth Court of Pennsylvania by the provisions of the Pennsylvania Election Code [the “Election Code”], 25 P.S. § 2937, and the Judicial Code, 42 Pa.C.S.A. § 764, 8. The Pennsylvania Election Code, which governs the matters covered in this Petition, is found at 25 P.S. §§ 2600 er seg. [the “Election Code”]. OBJECTIONS TO NOMINATION PETITION 9. Pursuant to § 2872.1(12) of the Election Code, a candidate for a Political Party’s nomination for Representative in Congress for the 13" District must submit a nomination petition containing at least 1000 “valid signatures of registered and enrolled members of the proper party” in the Commonwealth of Pennsylvania, 10. In addition, §§ 2868 and 2869 of the Election Code specify the requirements for the circulation and signing of the Nomination Petition and the requisite circulator’s affidavit in order for it to be valid; the requirements include, inter alia, that each signer of the Nomination Petition must also personally sign his/her own name and personally complete the rest of the required information on the signature line. 11, __ Specifically, § 2868 notes that the signer “shall add his residence, giving city, borough or township, with street and number, if any, and shall legibly print his name and add the date of signing, expressed in words or numbers: Provided, however, That if the said political district named in the petition lies wholly within any city, borough or township, or is coextensive with same, it shall not be necessary for any signer of a nomination petition to state therein the city, borough or township of his residence.” 12. The 13" Congressional District does not lie wholly within the City of Philadelphia [because it encompasses sections of Montgomery County] and is not coextensive with same [because sections of the City of Philadelphia are within the 1* and 2"! Congressional District). 13, Therefore, each signer of the Nomination Petition must also personally sign his/her own name and personally complete the rest of the required information on the signature line, explicitly including “his residence, giving city, borough or township, with street and number, if any, and shall legibly print his name and add the date of signing, expressed in words or numbers.” 14. Section 2937 of the Election Code sets for the basis upon which a nomination petition can be challenged and contested. See In re Elliott, 362 A. 2d 438 (Pa, Commw. Ct. 1976), aff'd, 466 Pa. 463, 353 A.2d 446 (1976); In re Nomination Petition of Flaherty, 564 Pa. 671, 770 A 2d 327 (2001) 15. _ Petitioner has reviewed the Nomination Petition [a process facilitated by personnel in the Office of the Philadelphia City Commissioner] and, based upon his knowledge, information and belief, avers that the Nomination Petition is invalid and subject to fatal defects (as described herein), that it does not comply with the requirements of the Election Code, and that it should be stricken and set aside. A. James's Nomination Petition Is Defective And Must Be Stricken Because It Fails To Obtain At Least 1000 Signatures From Registered And Enrolled Members Of The Republican Party In The 13" Congressional District. 16. The Nomination Petition is defective, for James failed to obtain at least 1000 signatures from registered and enrolled members of the Republican Party in the 13"* Congressional District. 17, Attached hereto and incorporated herein as Exhibit “B” is a chart (in the format prescribed by the Court) which describes, with particularity, page-by-page and line-by-line, those signatures on each page of the Nomination Petition that are ineligible and the specific reason or reasons for the challenge of each signature; all are from Philadelphia County, the rationales for challenges of sulators are mainstreamed, and all data have been reformatted to fit onto legal-size [8 ¥ x 11] paper. 18. Without 1000 valid signatures from the 13 Congressional District, James's Nomination Petition fails to meet requirements in the Election Code; the Nomination Petition is, therefore, invalid and must be stricken, B. Objection Based Upon Signatures Accompanied By Additional Information That Appeat ‘To Have Been Written FRAUDULENTLY By One Individual 19, Signatures are supplemented by information that was added subsequently—a pattem that was not limited to signature-pairs [e.g., husband-wife]—and circulators duplicated both others’ and their own signatures; key-pages related thereto are attached hereto and incorporated herein as Exhibit “C.” 20. Therefore, Elections Officials should assess the need for prosecuting circulators Joseph J DeFelice, John Mastrone, Linda Gaynor, Christopher ’Connor, Ken Clipner, Gary Grisofi, Francis A. Rubino, Peter Gozzi, Jr., Lauren Dawn Kusznir and Elijah Myers; a candid depiction of the behavior of Mr. DeFelice ef al. has been attached hereto and incorporated herein as Exhibit “D.” 21. — Multiple additional entries include information that appears to have been written in the hand of another, noting their resemblance to contiguous entries; only identical handwriting was flagged, and excluded from the above designation were entries that could have been due to benign oversights. 22, As a result, Petitioner reserves the right to refer additional data to Elections Officials to assess the need to prosecute additional circulators, after any rehabilitation efforts have been completed. 23. _ Inthe interest of efficiency —and because so many signature-lines had been challenged— those entries that were not technically correct were excluded from the list of challenged entries if the signatures resembled those noted on the registration-form; encompassed were instances when the printed name of elector employed a nickname [e.g., Page 2 Line 28: “Jim” vs. “James”] or when the printed name of elector used abbreviations [e.g., Page 2 Line 17: “M. T. Ferraro”]. Compression allowed for use of 8 ¥4 x 11 [rather than 8 4 x 14] paper without disturbing the width of the four extreme-right columns. Duplicate signatures were designated in ‘{}” in the “Other” column. If a signature-row had two illegible entries [precluding time-consuming ancillary searches}, further analysis was deferred; similarly, if signers [including circulators] were found not to be registered at a stated address, efforts were deferred to discern if those individuals were registered at different addresses. If the signatures matched, any other deviation [such as use of a nickname/initial or use of printing instead of script] was felt to have been mooted; recognized also was the potential for geriatric-age signers to have signatures that were at great-variance with the signatures that had been provided decades prior when registering. In these instances, signatures were flagged when it was difficult to identify any overlapping characters (particularly capital-letters}. Because, candidly, so many signature-lines were challenged, issuing a challenge was deferred ‘when it appeared that the signer had used abbreviations or nicknames [obviating the need for “tehabilitation” efforts to be initiated when the impact thereof would predictably become moot]; this applied to what would otherwise be obvious-errors [Page 2 Line 17, Page 5 Lines 1-3]. Also, individuals designated as “unregistered” included those who had attained an “inactive” status. The threshold to invalidate the petition had been crossed before signature-lines had been checked but, for the sake of completeness, every signature was compared with registration-info, and personnel in the Philadelphia [Voters] Commissioner Office were available over the weekend, ‘The “IHA” and “ILL” designations were denoted by an “*” when the focus was on the signature, rather than on provision of any ancillary data by an individual other than the signer. Similarly, it is not appropriate to penalize petition-signers for errors [even if they have been made knowingly] when provided an opportunity to respond favorably to a request; therefore, the focus must be trained Uupon a circulator who, for example, observes a spouse forging the name of an absent individual. ‘This onus is even more profoundly placed upon a circulator who knowingly signs multiple times, particularly recalling a notarized-pledge; this is not akin to discovering subsequently that a signer ‘was not an actively-registered Republican [who may not have sought a name-change after having been married] for, again, a compulsion to provide/acquire a signature-line may yield abbreviated questioning “in the moment.” Filling a page with obviously supplemented info violates the Code. This is why additional circulators were identified as having falsified the filing [John Mastrone, Linda Gaynor, Christopher O° Connor, and Ken Clipner]; Gestalt-Therapist isn’t needed to note “in-bulk” insertions therein [Page 4 Side 2, Page 19 Side 1, Page 25 Side 1, and Page 85 Page 1). ‘This misconduct is compounded further by Gary Grisofi; he twice acquired the signatures of Valerie Vitello [37-16 & 41-10] and Kody Rissiter [37-10 & 41-13]. He truly “trumped” these duplicates by, himself, signing-off twice [37-1 & 41-14]. Not to be outdone, Francis A. Rubino cnticed his wife [along with himself] to sign-off on triplicate petitions [Pages 65, 70 & 73], pethaps enticing an out-of-district relative to sign-on (again, duplicated), plus a fourth person. It appears that two circulators [Peter Gozzi, Jr. and Lauren Dawn Kusznir] traveled in-tandem, for how else can one explain the homology of their acquisition of five [5] identical signatures, indeed, on the very same day [Pages 54 & 58]? They did little to hide this aberrance, noting that the signatures appear in-sequence, almost as if one petition had been photostatted for a cohort. Included in this recitation is Elijah Myers, for it is doubtful he had forgotten he had signed on 1/30/2016 [13-3] when he signed his own petition on 2/8/2016 [11-1]. It is suspected that the limits-of-time precluded cross-ruffing other petitions, but the egregious nature of these abuses should suffice to suggest the need to probe the entire petition-acquisition process that occurred. Informal conversations with elections-personnel have suggested that this type of concer is not considered to be of sufficient priority to warrant devoting attention of law-enforcement personnel who are otherwise occupied pursuing perpetrators of more serious crimes. Yet, such corruption cannot be tolerated in a free society that reveres the ballot-box, and it is recalled that another case [of more than two decades ago] riddled with comparable felonies yielded the award of a victory to the apparent-loser in Pennsylvania’s First Senatorial District [coincidentally also in NE-Philly] following extensive federal-court litigation. In short, it is possible that the “tone” of what has ‘occurred was set by “the man at the top” but, regardless, all perpetrators should be probed. Rationale for Referral to Attorney General: Joseph J. DeFelice, Executive Director Philadelphia Republican Party Itis galling that approximately half of the signature-lines have been flagged as potentially-faulty, particularly when many technical violations were ignored if the signature appeared to be OK; concern with a circulator who appears not to be registered [Page 35] is the only borderline filing. Itis shocking that the circulators are not neophytes; indeed, Mr. DeFelice is an experienced and respected party-leader, whose ascendancy was welcomed as a reform that would turn-around a heretofore-ignored philosophical-force that exists in a polity that—just like most other major “American cities perpetuates problems with major quality-of-life decrements [crime/education]. Therefore, it is desirable to probe the six filings that he provided [#2, #3, #27, #36, #47 & #62] because they are emblematic of the unforced-errors that infest the political system which rarely are pursued [whether due to “prosecutorial discretion” or to a desire to maintain the status quo). Noting that he was armed, presumably, with street-lists and that he acquired signatures in his Northeast-Philly neighborhood, it seems to be inexcusable that he has abandoned any semblance of a role-model posture when he violated so many facets of his signed notarized statement. Consider incontrovertible evidence that “someone” wrote the identical information on lines 8/9 [see Page 2], presumably in his presence; either he feigned ignorance of a black-letter statute or he simply didn’t think such deviations therefrom would be highlighted [for whatever reason(s)]. ‘Also, how he could accept a scribbled-loop as a signature on line 10, and how he could accept spouses [presumably] forging signatures of absent individuals, this is just appalling. And he even approached a non-registered individual for anther scribbled signature on line 16, along with spouses who are Democrats on lines 26/27. Finally, challenging 14/20 signature-lines for their containing information that has been inserted “in the hand of another” [6 of which are signatures] reflects the possibility that he has set a “cultural” tone that other GOP-circulators mirrored. Along with the IHA-pattem, Page 3 has another unregistered voter plus [correctible]illegibility. ‘And Page 27 has two more unregistered voters [and 4 more IHA-violations]. Also, Page 36 has a Democrat [and 4 more IHA-violations]. Pages 47 and 62 have more IHA-violations, primarily of the fill-in-the-blanks variety. Obviously, this petition has not yet to have been vetted by Messrs. DeFelice and Jones, although its contents have resulted from delicate conversations with personnel in the offices of the Philadelphia Commissioner. But, overall, assuming these data are found to be valid, it would appear that a pattem of ignoring the Election Code has emerged; ‘elections [e.g., Stinson/Marks, also in NE-Philly] have been overturned in comparable situations. {Lam not an attorney, but I have gamered electoral experience during the past two decades as a GOP Committee-Person in Abington 7-2 [MontCo]; I have found myself on both “sides” of petition-challenge/validation events. I have completed this task assisted only by staffers despite having already tagged far more signature-lines than would be needed to achieve the overt-goal.
