Organization, Purposes And Jurisdiction
Of The Federation
Article: 1
A General Federation for contracting works and activities shall be
established in the Arab Republic of Egypt, by the name of "Egyptian
Federation for Construction and Building Contractors". The Federation shall
have a juridical personality and shall comprise construction, building,
public works, and land reclamation contractors, as well as the contractors of
installations, dredging, marine installation works and any other works of the
nature of these activities.
The Federation shall not comprise persons whose activities are
restricted to supplying materials necessary for the works referred to in the
previous clause, providing the manpower required therefor, or carrying out
professions or industries necessary therefor or connected therewith.

The Head Office of the Federation shall be based in the city of Cairo.
it may also establish branches and offices inside the Country or abroad.

Article: 3
The purpose of the Federation shall be to safeguard the common good
of its members, represent them before the competent authorities, re-organize
the work conditions, develop its methods, set the controls and traditions
related to exercising the profession in order to protect it and raise its
standard, work for resolving such disputes as shall arise between the
members of the Federation and third parties, propose solutions as necessary
toward achieving that purpose, and assist in realizing the general plan of the
State in the field of its specialization.
Toward achieving that purpose, the federation shall:
(A) Set a charter of honor, and work toward guaranteeing the respect for
practices of the profession, and set the organizational and disciplinary
rules securing the realization of that target.
(B) Set the rules reorganizing the determination, classification, and
arrangement of all members of the Federation according to their
specializations and potentials in the service of the profession, and also
owners of projects and executives of planning agencies, along with
determining the rules and percentages for representing the categories
within which the contractors are classified in the Board of the
Federation.
(C) Work that the Federation's Egyptian members shall have the major part
in implementing the projects so they can have an effective role in
contributing toward the implementation of the state development plans.
(D) Study the economic and technical subjects and issues related to
contracting activities, and provide the members of the Federation with
the results of these studies.
(E) Join in defending the interest of its members before the court and third
parties.
(F) Establish an optional arbitration system which guarantees resolving the
disputes summarily between the members of the Federation, and
between its members and those dealing with them.
(G) Cooperate with similar Arab and foreign organizations and bodies,
strengthen ties and relations with them, exchange experiences, and

The members of the Federation shall pay the following fees and

The Federations General Assembly
Article : 11
The General Assembly of the Federation shall be formed of all active
members recorded at the General Assembly meeting invitation date, and
those settling the subscriptions due thereby up to the last annual
subscription, in addition to Ten members to be appointed by the Minister
concerned, from among individuals of experience whose work is connected
with contracting affairs. The General Assembly shall represent the Higher
Authority concerned with the Federation's Affairs.

Article : 12
The Board of Directors shall call the General Assembly to meet at its
Head Office in Cairo, during the first half of the financial year, in order to
hear and discuss the report of the Board, and that of the Auditors, and to
approve the closing accounts of the previous financial year, as well as look
into the remaining subjects set forth in the Agenda.
Each member of the general Assembly shall have one vote.
The General Assembly shall be called for extraordinary meetings if
so decided by the Board, or upon the demand of the Minister concerned, or
one third of the Assembly members, providing they shall indicate this in
writing in the request submitted thereby.
The Executive Regulations shall determine the terms and conditions
of calling an extraordinary General Assembly meeting.
Article : 13
The General Assembly meetings shall be chaired by the Board
Chairman, and in his absence by the oldest deputy chairman attending the
meeting. The Board of Directors shall be represented in the General
Assembly by the minimum number of its members as prescribed for the
validity of its meeting.
The chairman shall appoint a secretary and two tellers to sort out the
votes, who shall be approved by the General Assembly.
Article : 14
A General Assembly Meeting shall not be valid except if it fulfills the
absolute majority of operating memberships fulfilling the requirements set
forth in Article (11) hereof.
In case the minimum number thus prescribed is not fulfilled at the
first meeting, the General Assembly shall then be called for a second
meeting to be held within thirty days. The second meeting shall be

Management Of The Federation
Article : 19
The Board of Directors of the Federation shall be formed of at least
thirty members, and at most forty five members. A decree of the Minister
concerned shall be issued determining the number of the Board members.
The General Assembly shall elect two - third of the number of members
while the remaining third shall be appointed by a decree of the Minister
concerned, from among individuals who are experienced in the fields of the
Federation work. In all cases, the Governorates shall be represented by at
least one member.
Election of the members shall take place with the proportional
majority of the attending members' votes. The Executive Regulations shall
organize the dates and procedures for nominations and election.

The Board Chairman shall represent the Federation before the court
and third parties. He shall not assume the Board Chairmanship for more
than eight successive years.
Article : 23
The Board of Directors shall meet at least quarterly (every three
months), upon an invitation addressed by the Board Chairman to the
members, in writing, at least fifteen days before the date proposed for the
meeting.
The Board Chairman shall call for a board meeting if so requested by
one fifth of the number of members.
Article : 24
The Board Meeting shall be chaired by the Board Chairman, and in
his absence by the oldest Deputy Chairman attending the meeting.
The Board deliberations shall not be considered valid unless they are
attended by more than half the number of members. The Board's decisions
shall be issued with the absolute majority of attending members. In case of
equal voting, the meeting chairperson shall have the casting vote.
Article : 25
If one or more seats of the Board members become vacant for any
reason whatsoever, the method for electing other members shall be the same
as that followed in electing the members whose seats become vacant, so that
elected members shall be selected from among those obtaining the highest
number of votes next to the votes obtained by the members who were
elected for the Board, providing that the minimum limit required for
representing the Governorates and Branches shall be observed as
determined by the Executive Regulations. The appointment shall however
be brought before the General Assembly to approve it, at the first next
meeting. The term of membership for the member in this case shall be the
period remaining from the period of his predecessor.

In case the seat of the Chairman becomes vacant for any reason the
Minister concerned shall be appointed Chairman for the Board, for the
remaining period.
Article : 26
The Board Shall have the broadest powers in managing and
organizing the Federation. It shall assume issuing the internal regulations
and shall supervise all administrative, technical and financial organizations
and units.
The Board shall in particular assume implementing the resolutions to
be issued by the General Assembly. It may not dispose of the movable
values and real properties forming part of the fixed assets of the Federation
except with the approval of or prior delegation from the General Assembly.
The Board may delegate some of its powers in this respect to the
Board's office.
Article : 27
Before the annual ordinary General Assembly meeting, the Board
shall prepare a comprehensive report on the Federation's activities,
comprising in particular the following:

A report on the Federation's activities during the financial year, and its
financial standing at the close of the year.

They shall be elected with the absolute majority of votes, and in case
this majority is not fulfilled, a re-election process shall then take place in
which case the proportional majority shall be valid. In case a seat of the
office becomes vacant for any of the reasons set forth in item (25) hereof,
election to fill the seat thus becoming vacant, shall take place within fifteen
days from the date it becomes vacant, according to the terms and conditions
prescribed in this Article. In this case, the term of the member shall be the
period remaining from and complementing the term of his predecessor.
Article : 29
Meeting of the office Staff shall be headed by the Board Chairman or
the person replacing him.
Article : 30
The office, within the powers delegated thereto by the Board of
Directors, shall take all procedures ensuring the management and
organization of the Federation. It shall also assume and be concerned with
implementing the decisions of the Board of Directors and the Resolutions of
the General Assembly.
The office may mandate one of its members to carry out a determined
assignment.
Article : 31
The Board of Directors shall appoint from among its members, the
Secretary General of the Federation upon the Proposal of its Chairman.
The Secretary General shall assume the executive presidency of all
agencies of the Federation, and link between them and the staff of the
office.

Control Of Funds And Properties
Of The Federation
Article : 33
The Funds and Properties of the Federation shall be considered
Public Funds, in applying the provisions of the Penal Code, and shall be
subject to the control of General Audit Organization.
Article : 34
The Federation shall have one or more Auditors to be appointed by
the General Assembly which shall also determine the annual remuneration
thereof.
In case there are several auditors, they shall be jointly responsible.
The General Assembly may in all cases change the Auditor/s.
The Executive Regulations shall determine the procedures to be
followed in this respect.

Complaints Arbitration, And
Disciplinary Committees
Article : 35
A permanent contestation committee shall be formed by a decision of
the Board of Directors, and shall be headed by the Board Chairman or the

The Disciplinary Body shall have the power to impose any of the
following sanctions:
(A) Warning.
(B) Elimination from the exercise of a particular activity in contracting
works.
(C) Elimination from the Federation for a period not exceeding one year.
The Disciplinary Body's decisions shall be final.
Article : 39
No sanction shall be inflicted on a member of the Federation except
after conducting an investigation with him in writing, hearing his statements
or those of his representative, and securing a defence therefor. The
Disciplinary Body may delegate one of its members to conduct such
investigation.
Article : 40
The Executive Regulations shall organize the rules and set the
procedures for the exercise of the Disciplinary Body's works.

General Rules
Article : 42
The provisions of laws concerning Meetings shall not apply to
meetings of the members of the Federation, its Branches and its different
committees, when these meetings are not held to deal with their occupations
affairs.
Article : 43
Subject to the provisions of the Labour Law, the Federation's Board
of Directors shall set the Regulations organizing the personnel affairs in the
Federation. The said regulations shall be approved by the Minister
concerned, and shall define the rules for appointing the workers of the
Federation, their salaries and wages increases as well as their promotions, in
addition to other material and in kind privileges.

Article : 44
Subject to the provisions of the law on legal profession and Civil and
Commercial Procedures Law, no one may represent the concerned parties
and attend for them before the experts of the courts, to discuss issues
connected with contracting works and activities, except the members
concerned who are recorded in the table provided therefor in the Federation.
These shall represent each other in appearing before the aforementioned
experts. The Executive Regulations shall organize this table and the
conditions for entry in it.
Article : 45
The Board of the Federation may be dissolved by virtue of a decree
of the Minister Concerned, if a violation of the provisions of the present law
is committed thereby. The new Board shall be formed within at most six
months from the date the decree dissolving the previous Board is issued.
The Board may also be dissolved if a resolution for dissolving it is
issued by the General Assembly with the approval of at least two thirds of
the members, upon the approval of the Minister concerned.
On dissolving the Board of Directors a decree shall be issued from
the Minister Concerned, forming a committee to manage the works of the
Federation pending formation of the new Board of Directors.
Part - 8
Penalties
Article : 46
Subject to any stricter penalty prescribed in the Penal Code or in any
other law, whoever commits any of the following acts shall be liable to pay
a fine of not less than One Thousand Pounds and not more than Ten
Thousand Pounds.

In all cases, the Court shall pass its ruling for cancellation of the
contracts signed as a result of any of those acts.
The proceeds of the fines prescribed in this Article shall devolve to
the account for Funding the Economical Housing Projects in the Ministry of
Housing.
A Ruling shall further be passed against the violator to pay an
indemnity to the Federation, equal to the amount of initiation fees and
annual subscription plus the value of duty stamps due thereon.
Part - 9
Transitional Provisions
Article : 47
In exception to the provisions of Article (19), the first Board of
Directors shall be formed by a Decree of the Minister concerned within two
months from the date the present law comes into force.
This first Board of Directors shall set the rules on classification,
arrangement and representation percentages of the different categories in
the Board of the Federation. These rules shall not be valid except after their
approval by the Minister concerned.
This Board shall exercise the powers prescribed for the Board of the
Federation under the present law, in addition to carrying out all procedures
ensuring the enforcement of its provisions.

Concerning

Part - 1
Method of the Federation's Exercise of its
Powers Toward Fulfilling its Purposes
Article : 1
The Board of the Federation shall set a Charter of Honour which
secures respect to the traditions of the profession, and binds its members
after its approval by the General assembly of the Federation.
Article : 2
The Federation shall establish a General Register in which to record
all active members of the Federation, and subsidiary registers for recording
the members according to their specializations in construction and building
works. Each of these specializations shall be considered a specific branch
in applying the provisions of the law, and the Board of the Federation shall
determine the categories belonging to each branch according to the
capability of each such category to serve the profession.
The Federation shall also establish a register to record correspondent
members from among the foreign contractors during the period of their
activities in Egypt.
Article : 3
Subject to the provisions of Contracts in Contractual Engagement
funded through loans or grants and approved by the People's Assembly, no
works falling within the contracting activities and amounting to more than
fifty thousand Egyptian pounds for each operation shall be assigned except
to active members of the Federation.

Article : 4
The Federation shall work toward realizing cooperation and
strengthening relations and ties with Arab and Foreign Organizations and
Bodies which exercise an activity similar to that of the Federation, through
the establishment of liaison offices in the country to which such Arab and
Foreign bodies and organizations belong. Toward realizing such purpose,
the Federation shall arrange to:

Giving technical and legal opinions in the disputes arising between its
members, or between a member of the Federation and a third party, in
order to resolve them amicably, the most possible.

Assigning one or more lawyers and counsels to defend the rights of its
members in the cases and according to the conditions to be determined
by the Board of Directors.

Resources Of The Federation
Article : 10
Members of the Federation shall pay the following fees and
subscriptions:
(A) Registration fees from all members according to their categories in the
classification determined by the board of directors, and also fees of
their re-registration, as follows:

L.E. 1000.- (One Thousand Egyptian Pounds) for the First and
Second Categories.
L.E. 900.- (Nine Hundred Egyptian Pounds) for the Third and
Fourth Categories
L.E. 800.- (Eight Hundred Egyptian Pounds) for the Fifth and
Sixth Categories.

Chapter: 1
General Assembly of the Federation
Article : 12
The General Assembly of the Federation shall hold, at the
convocation of the Board of Directors, an Ordinary Meeting at the Head
Office of the Federation, during the first half of the financial year, to look
into the following matters:

Article : 17
Minutes shall be drawn up comprising an adequate summary of the
General Assembly's discussions, and all that takes place during the
meeting, in addition to quorum of attendance and the resolutions passed by
the General Assembly, as well as the number of votes, whether those
approving or disapproving such resolutions, and all points the members
will ask to record in the minutes.
The Minutes shall be signed by the Chairman, the Secretary, the
Votes Sorters, and the Auditors. Those signing the Minutes shall be
responsible for the validity of the data in the Assembly's two books,
namely, the attendance register, and the Session Minutes Register. Those of
them who are members of the Board of Directors shall be responsible for
the conformity of these books to the provisions of the law and these
regulations.
Minutes of the General Assembly Meetings shall be drawn up and
recorded regularly following each session, in a special book which shall be
clear of all voids, blanks, margin writings, erasures or interlineations.
The pages of this book shall be signed serially, and before being
used, each paper thereof shall be stamped with the seal of the Federation
and signed by the officer in charge.
No new book shall be registered except after submitting the former
book in order to annotate thereon that it has been closed, then the closure of
such book shall be recorded in the registers provided for the purpose in the
Federation.
The Federation shall keep all documents which support the data
mentioned in the books and registers.
Chapter : 2
Board of Directors
Article : 18
The Federation's Board of Directors shall be formed of at least Thirty
Members and at most Forty Five Members, as determined by
a decree of the Minister concerned.

The Board of the Federation shall determine the places for carrying
out the elections, at the Head office of the Federation and locations of the
large gatherings of active members contractors of the federation which lie
beyond the regional jurisdiction of the Federation's Head Office in Cairo,
and its Branches. The door for Nomination shall be closed fifteen days after
opening it.
Closing the Nomination Door shall take place in the presence of
committees to be formed by the Board of the Federation from among its
members or other members of the Federation. These Committees shall
prepare a detailed report of the procedures as taken in accordance with the
provisions of the law and its executive regulations.
Article : 22
Nomination applications shall be submitted in the name of (The
Board Chairman of the Federation), on the Form prepared for the purpose.
The Form shall be delivered by the applicant himself, or by virtue of an
approved proxy, to the General Secretariat of the Federation, in Cairo, or to
the Branches and Offices thereof, against issuing a receipt acknowledging
the submission of the application accordingly, within the date determined
in the previous article, and during the official duty hours.
A special register shall be provided in which to record the names of
nomination applicants, and the date and hour the application is submitted.

The Specific Branch and the Category under which the applicant is

Article : 27
The electoral committee shall mark its sign next to the names of
members assuming the elections operation, in the electors' Statements
provided and distributed by the Federation to the Electoral Committees.
The committee shall also mark its sign on the voting cards which are
carried by the electors, to indicate their attendance and exercise of their
election right.
A member carrying his own election card shall not be allowed to
exercise his electoral right except after checking his identification, and
insuring that his name is indicated in the electors lists, and recording that in
the elections report.
Article : 28
After the expiry of the time determined for the elections, the Door of
the Committees shall be closed, and the number and names of electors still
found inside the Committees offices shall then be counted and recorded in
the elections report. The committees shall continue to perform their work,
until these electors have given their votes.
Article : 29
After completing the elections, the boxes shall be sealed with red wax
and the seal of the federation. Each Electoral Committee shall draw up
a report on the procedures followed in the elections operation.
The report shall indicate the number of active members who have
exercised their electoral rights, the number of election papers used, and
those which have not been used.
The committee shall also prepare a list of the members who failed to
perform their electoral duty before it.
These papers shall then be placed in an envelope and sealed with red
wax and the seal of the Federation. The keys to the boxes and election
reports shall be put in a separate envelope which shall also be sealed with
red wax by the Seal of the Federation.

The boxes and the envelopes shall then be transported to the Head
Office of the Federation where they shall be sorted out.
Article : 30
Votes shall be sorted out by a committee headed by at least an
Assistant Counselor from the concerned Legal Opinion Department in the
State Council, with the membership of two Board Members among those
who are not nominated or participating in the electoral committees. The
process of sorting out the votes shall then take place after insuring that the
seals on the cases and envelopes as mentioned in the previous article, are
intact, and in the presence of whoever desires among the nominated
members or their delegates. All Candidate shall have the right to delegate
an active member of the Federation to deputies for him in attending the
process of sorting out the votes.
The votes sorting out process and the relevant result shall be recorded
in a report to be drawn up and signed by the Sorting out committee and
approved by the Committee Supervising the elections as formed by
a decision of the Federation's Board of Directors and chaired by the
Secretary General. The report shall be drawn up accordingly, and the
Federation shall maintain the papers and report on the process of sorting
out the votes inside envelopes sealed with red wax and the Seal of the
Federation.
Article : 31
A Nominee who obtains the largest number of valid votes of attending
members shall be considered Winner, in case of equal voting, a ballot shall
be carried out between them, by the Sorting Out Committee and the
Committee Supervising the Elections, together, in the presence of those
nominees obtaining equal votes, or their delegates. A report on these
procedures and results shall be drawn up.
Article : 32
The result of sorting out the votes shall be announced once the
Federation's Board of Directors has approved the elections result at the
Head Office of the Federation, in Cairo, and at the Branches and Offices, as
well as in the press.

Part 4
Control of the Federation's Funds
Article : 33
The Federation's Funds are considered Public Funds and Properties, in
applying the provisions of the Penal Code. They shall be subject to the
Central Audit Organization Control, according to the law.
Article : 34
The Federation shall have one or more Auditors fulfilling the
conditions and requirements prescribed in the law on exercising the
profession of accountancy and auditing, to be appointed by the General
Assembly and whose annual remuneration shall also be determined
thereby. In case of several Auditors, they shall be accountable jointly,
according to the law.
In case a motivated proposal is submitted to the General Assembly for
changing the Auditor, according to the procedures and dates prescribed in
article (16) of the law, the Board Chairman of the Federation shall notify
the Auditor of the text and causes of the proposal. The Auditor shall then
have the right to submit the aspects of his defense in writing to the
Federation, at least three days before the General Assembly Meeting.
The proposal for changing the Auditor, the causes for such proposal
and the memorandum of defense submitted by the Auditor shall be
submitted to the General Assembly, and the latter shall issue its proposal in
this respect after discussing and hearing the aspects of the Auditor's defense
as displayed during the session.
Article : 35
The Auditor shall be invited to attend the Board of Directors' sessions
during which the Federation's balance sheets or accounts are examined and
considered, or any other session the Board decides to invite him to attend in
order to consult him matters lying within his specializations.
The Auditor shall be invited according to the same conditions and
dates as observed in the convocations sent out to the Board Members.

Article : 36
No Pluralism which combines the Auditor's work and the membership
of the Board or any permanent technical, administrative, or consulatory
work with the Federation shall be acceptable.
The auditor may not be a partner to any member exercising an activity
of those prescribed in the previous clause, nor to an employee or relative
thereof up to the fourth degree.

Permanent Committee for Contestations
Article : 40
A permanent committee for contestations shall be formed by virtue of
a decision of the Board of Directors, under the Board Chairman, or his
delegated assignee from among the Board Members, and the membership
of a Judiciary Man with at least the grade of Counselor, to be appointed by
the Concerned Authority, and the Head of the Federation's Legal
Committee as well as two of the Federation's Engineer-Members.
This Committee shall be concerned with the following:

the purpose, according to the numbers and dates of delivering them against
a receipt acknowledging their delivery.
The foregoing complaints shall be referred to the permanent
contestations committee, within three days from the date of submitting
them or the date of closing the nominations door, according to each case, in
order to issue a final decision thereon, within thirty days from the date of
referring them to the committee.
The committee shall then have the right to fulfill whatever data or
information it would require, and resort to the assistance of men of
experience, in exercising its powers.
Article : 42
Appeals against the results of elections to the Membership of the
Board of Directors and to the Federation's office shall be submitted to the
Board Chairman, within three days from the date of announcing the result.
These contestations shall be recorded in a register to be provided for
that purpose, under serial numbers on the dates of their submission, against
a receipt acknowledging their delivery and showing their entry number and
date, and the number of attachment to the contestation.
The contestations shall then be referred to the permanent committee
for contestations in order to issue a final decision thereon within thirty days
from the date of their referral to the committee.
The committee shall have the right to hear the statements of concerned
people and study such documents they put forward, in order to issue its
decision in the contestations referred to it.

Arbitration Committee
Article : 43
Members of the Federation may seek to resolve the disputes and
litigations arising between them or between these members and third
parties, through the Arbitration Committee of the Federation, by virtue of

Either party to the litigation subject of the arbitration shall have the
right to obtain a copy of the arbitrament passed in the dispute, from the
Federation, after settling the administrative expenses due, as determined by
a decision of the Federation's Board of Directors.
Article : 56
The remuneration payable to the members of the Arbitration
Committee shall be determined according to the rules to be issued by
a decision of the Arbitration Office Staff, and shall be settled by the
Federation out of the fees collected thereby, subject to the Arbitration
Committee's Arbitrament which comprises a determination of the party
committed to bear these fees.
Article : 57
The Arbitration Committee shall be concerned with examining and
considering the explanation inquiries or disputes concerning the
implementation of rules, which arise from implementing the arbitraments
issued thereby. The decision of the Committee, in this respect shall be final
and binding to the parties to the dispute.
Chapter: 3
Disciplinary Body
Article : 58
A Disciplinary Body shall be formed by a decision of the Board of
Directors, as set forth in article (37) of the law, to assume the powers
defined therein.
Article : 59
A member of the Federation to whom is attributed the perpetration of
one of the violations prescribed in the law shall be referred to the
Disciplinary Body of the Federation upon the request of the Minister
concerned, the General Assembly of the Federation, the Board of Directors,
or the Board Chairman.

Referring the member in that case to the Disciplinary Body shall take
place by virtue of a decision from the Board Chairman, or one of his
Deputies, and the Secretariat General of the Federation shall notify the
member of referring him to the Disciplinary Body, by a registered letter
with acknowledgment of receipt comprising the matters attributed to him
and the date, time and place the investigation will be conducted with him,
in the matters attributed thereto.
The member shall have the right to put forward the aspects of his
defence and submit the documents in support thereof, and also accompany
with him a lawyer to attend the investigation to be conducted with him,
unless the disciplinary body decides to conduct such investigations in
camera.
The decisions to be issued by the Disciplinary Body shall be final and
the member shall be notified, in writing, of the decision issued in his
respect, and a copy thereof shall be hand - delivered to him against his
signature whereby he acknowledges receipt thereof, or by virtue of
a registered letter with acknowledgment of receipt.

Article : 60
The Federation shall prepare a Roll for recording the experts who will
attend for the parties concerned before the Court Experts, in order to
discuss the matters connected with contracting works.
In order to be recorded in the Experts Roll, an expert shall be holder of
a higher qualification in the field of his experience, and the period of his
experience shall not be less than twenty years.
An application for entry in this Roll shall be submitted to the
Federation's Board Chairman, and shall be referred to the Permanent
Committee for Contestations to issue a final decision in respect thereof.

Remarks:
(a) Percentages included in the technical studies attached hereto are
related to the total contract value that shall conform to the books
and documents of the person in charge (General Contractor).
(b) These percentages represent the tax value for the value added as
a rendered service as per the Presidential Decree No. 77 for the
Year 1992.
(c) The department shall submit the letters requested by the members
of the federation indicating that he is subject to the tax. The tax
value shall be stated in the progressive payment certificate.
(d) The Federation shall notify its members, who have not yet been
registered, so as to promptly get themselves registered at the sales
tax department, during the period ending in April 1994, subject to
sending lists of the names of the members enrolled in the

(e) The dues pertaining to the tax levied as of 18/4/1993 (date of

On The Research On The Application Of Sales Tax
As Per Presidential Decree NO. 77 Of The Year 1992
Application of Presidential Decree No. 77/1992:
This Memorandum shows the value of the Sales Tax on the total
value of contractings for building works, including the percentage of the
Main Contractor and all percentages of the sub-contractors.
In order that the building works cover all types of contracts in the
field of construction, building and civil works, the following definitions
shall be introduced:
First - Building Sector, which includes:
(a) Economical/medium/special housing
(b) Administrative buildings and the like, including police stations and
centers, military wards/prisons.
(c) Hospitals, rescue centers and health units.
(d) Hotels and touristic offices and villages.
(e) Clubs, swimming pools, fences, playgrounds and light buildings.
(f) Banks.
(g) Different factories, stores, concrete warehouses, and depots, concrete
siles, power stations and sanitary drainage stations.
(h) Maintenance and refurbishing works, including supplies and
installations without any electromechanical provisions and equipment.
Second - Special Building Sector, including:
Luxury housing (metal trusses, metal silos, mechanical foundations,
prefabricated buildings), including supplies and installation.
Third - Electromechanical Works and Building Provision Sector, which
include:
Factory equipment and machines, conditioning works, elevator
works, transformers and generators, high pressure and medium pressure
switchboards, fire, theft and firefighting warnings, aerials and acoustics,
communication sets, broadcasting and telephone exchanges, different types
of pumps, boilers, water purifying, and treating equipment, medical
equipment and provisions and control and measuring apparatuses.

(3) The building sector (First Sector) does not include any provisions or
electro-mechanical equipment. But, since these provisions or
equipment are necessary for such buildings, the tax is to be applied in
this sector, after separation between buildings, provisions and electromechanical equipment, in the same way as that adopted in the first
sector separately and in the third sector separately for each of the two
work types.
(4) In the sector of private buildings (Second Sector) and all the other
sectors, except for the first sector, if the sub-contractor wants to
contract directly with the service caller, he is then treated as a main
contractor without the need for a sub-contractor. The main contractor
is expected to do what is expected in the utility sector (Fourth Sector)
and in the Petroleum Sector (Fifth Sector), i.e. do all the works with
100% self operation; in which case he is treated as a main contractor
without the need for any sub-contractors.
The following tables show the tax value for each sector whether
there is a sub-contractor or not. The tax value was set under the previous
principles for the first sector, e.g. value of materials and labour as an added
value and other added value represented in profits, tool and equipment
consumption.
If the labour percentages were recorded under Ministerial Decree
No. 74 of the year 1988, then the application was undertaken on the basis
of using mechanical equipment, which situation is established through the
nature of the works in all sectors from second through fifth ones.
