AN ACT PROVIDING FOR EXPIRATION OF MARRIAGE CONTRACT

SECTION 1. Title This Act shall be known as Expiration of Marriage Contract Act of
2016.
SECTION 2. Declaration of Policy It is hereby declared the Policy of the State to
provide for an expiration of marriage contracts in order to offer the best option for
married couples with no children to terminate unhealthy marriages at no cost.
SECTION 3. Definitions Expiration of Marriage Contracts shall allow married
couples to terminate unhealthy marriages and its renewal ensures a predictable
source of revenue for the State.
a. Marriage Article 1 of the Family Code is hereby amended to read as
follows:
Marriage is a special contract of momentary union between a man and
a woman entered into in accordance with the law for the establishment of
conjugal and family life. It is the foundation of the family and an inviolable
social institution whose nature, consequences and incidents are governed
by law and not subject to stipulation, except that marriage settlements
may fix the property relations during the marriage within the limits
provided by this Code.
b. Unhealthy Marriage Is when the spouse becomes detrimental to the
other spouses well-being. It is also a marriage that lacks time, effort and
communication to keep it healthy. It also refers to spouses that come
across physical violence, adultery, homosexuality, manipulative,
hypertensive, vicious and cruel kind of spouse.
c. Expiration Marriage contracts are valid for a period of 10 years and shall
expire on the date of marriage occurring in the 10 th year of marriage.
d. Renewal Marriage contracts are renewable 150 days prior to expiration
date. Two consecutive renewals shall render the marriage permanent.
SECTION 4. Statement of Objectives The Expiration of Marriage License, shall be
implemented in accordance with the following objectives:
a. To relieve any emotional and economic hardship of the spouses arising
from the breakdown of the marriage.
b. To emancipate the spouse from physical violence, adulterous,
homosexual, manipulative, hypersensitive, vicious and cruel spouse.
c. To attain dissolution of marriage with no cost.
SECTION 5. Rationale of the Expiration of Marriage Contract This Act shall apply to
valid marriages that are solemnized in the Philippines from the month of September
2016. This Act shall serve as the means to relieve the spouses from any emotional
and economic hardship of the spouses arising from the breakdown of the marriage;
To emancipate the spouse from physical violence, adulterous, homosexual,
manipulative, hypersensitive, vicious and cruel spouse with no cost. Marriage

contracts are valid for a period of 10 years and shall expire on the date of marriage
occurring in the 10th year of marriage. Marriage contracts are renewable 150 days
prior to expiration date. Two consecutive renewals shall render the marriage
permanent. The period of 10 years shall serve as an observation period of the
spouses behavior by which the couple may decide whether to renew their marriage
contract or not. This Act shall be limited to spouses with no children.
SECTION 7. Separability Clause - If for any reason or reasons, any part or provisions
of this Code shall be held to be unconstitutional or invalid, other parts or provisions
thereof which are not affected thereby shall continue to be in full foce and effect.
SECTION 8. Repealing Clause All laws, executive orders, rules and regulations or
any provisions, inconsistent with this Act are hereby repealed.
SECTION 9. Effectivity Clause This Act shall take effect upon its approval.
