10 Specifications
- Specifications shall allow the widest possible competition.Specifications shal
l be generic and shall not include references to brand names,model numbers, cata
logue numbers or similar classifications. However if the procuring agency is con
vinced that the use of or a reference to a brand name or a catalogue number is e
ssential to complete an otherwise incomplete specification,
such use or reference shall be qualified with the words or equivalent
(Provided that this rule shall not apply to procurement made by public
sector commercial concerns on the demand of private sector client specifying, in
writing, a particular brand, model or classification of equipment, machinery or
other objects.)
11. Approval Mechanism
- All procuring agencies shall provide clear authorization and delegation of pow
ers for different categories of procurement and shall only initiate procurements
once approval of the competent authorities concerned has been accorded.

22 Submission of Bids

24. Reservations and preference

25. Bid Security

26. Bid validity

29. Eval Criteria

30. Eval of Bids
- eval accrding to eval criteria and other terms and conditions set in bid docs.

33.Rejection of bids
- Proc agency may reject all bids at any time prior to acceptance of a bid or pr
oposal.

the grounds.
-Proc agency shall incur no liability by invoking above rule.

34. Re bidding
-if proc agency rej all bids under rule 33, may call for re bidding

- results of bids evl be announced in report form giving justification for accep
tance or rej of bids at least ten days prior to award of proc contract.
36. procedures of open competitive bidding
a. single stage one envelope procedure:
- each bid one single envelope containing, separately, financial proposal and te
chnical proposal (if any).

b. Single Stage two envelope procedure
i. Bid shall comprise single pakage containing two separate envelopes. each con
tains separately fin and tech proposal.

iv. fin prop be retained in custody of proc agency unopened
v. tech prop be eval and reject if specs, req not met.
vi. no amendments in tech prop during tech eval

viii. after eval and approval of tech prop, fin prop of only tech accepted prop

c. Two stage bidding procedure
First Stage
i. bidders to submit tech prop without price
ii. tech prop be eval and may be discussed with bidders regarding any deficienci
es and unsatisfactory tech features
iii. after discussions, all bidders be permitted to revise respective tech prop
to meet req of proc agency
iv. proc agency may modify any aspect of tech req or eval criteria communicate
the same to bidders equally.
v. bidders not willing to conform to new tech req be allowed to withdraw.
Second Stage
vi. willing to conform to tech req or not rej firms be invited to submit revised
tech prop with fin proposal.
vii. revised tech prop and fin prop be opened at a time, date and venue announce
d and comm to bidders in advance
viii. revised tech prop and fin prop be eval in the manner prescribed above. low
est evaluated bid be accepted.
Provided sufficient time (not less than prescribed) be given for revision of te
ch prop and prep of fin prop.
d. Two Stage two envelope bid procedure:
First stage

second stage
viii. willing to conform bidders shall submit revised tech prop and supplementar
y fin proposal.
ix. the revised technical proposal along with the original financial proposal an
d supplementary financial proposal shall be opened at a date, time and venue ann
ounced in advance by the procuring agency.
x. eval whole prop and lowest evaluated bid be accepted.
37. Conditions for use of single stage two envelope, two stage and two stage two
envelope bidding procedures.Single stage one envelope bidding procedure shall ordinarily be the main
open competitive bidding procedure used for most of the procurement. Other
appropriate procedures of open competitive bidding shall be selected in the
following circumstances, namely:(a) single stage two envelope bidding procedure shall be used where the bids
are to be evaluated on technical and financial grounds and price is taken into
account after technical evaluation;
(b) two stage bidding procedure shall be adopted in large and complex
contracts where technically unequal proposals are likely to be encountered or
where the procuring agency is aware of its options in the market but, for a give
n

set of performance requirements, there are two or more equally acceptable


technical solutions available to the procuring agency; and
(c) two stage two envelope bidding method shall be used for procurement
where alternative technical proposals are possible, such as certain type of
machinery or equipment or manufacturing plant.
