Dear Ayanda,
SUBJECT: Request for comment regarding Koornfontein Rehabilitation Trust and Shiva Uranium
It has come to our attention that Tegeta Exploration and Resource requested and received permission from the
Department of Mineral Resources to access the funds in the Koornfontein Rehabilitation Trust (IT 7563/2007)
a trust set up to provide for Koornfontein mines environmental liability. As such, we have the following
questions:

It is our understanding that Tegeta Exploration and Resources submitted a request to the Department
of Mineral Resources to access the funds in the Koornfontein Rehabilitation Trust fund for mining
rehabilitation purposes. On what basis did Tegeta request permission to access these funds?
AmaBhungane has seen a letter signed by Mr. Joel Raphela dated 5 May 2016 in which permission was
granted to access these funds. Would you like to comment on why permission was granted?
Did Minister Zwane also sign off on this request?
What rehabilitation work was or is currently being carried out at Koornfontein? And how much of the
rehabilitation trust fund has been spent to date?
What is the current balance of the Koornfontein Rehabilitation Trust fund, and which bank currently
holds the trust fund?
What reports or documents did Tegeta submit at the time in order to support their application to
access these funds?

In addition to this, I have one outstanding issues regarding the environmental liability of Oakbay Resources and
Energy (the company that owns Shiva Uranium and Brakfontein Colliery), specifically:

What is liability assessment of Oakbay Resources and Energy as submitted to and/or approved by the
Department?

It would be greatly appreciated if you could come back to me by the close of business tomorrow (Thursday 3
November).
