Descriptive questions:
1. Define the performance of contract. Explain the various ways of discharge of contract.
2. Define the contract of guarantee. Explain the different rights and liabilities of surety.

Group 1.

1. X threatened to shoot Y's son if Y did not sign a promissiory note For Rs.20.000 in favour of
X.Is the contract valid?
2. X hired Y to kidnap Z's son in order to make him to enter into contract.s the contract valid?
3. X beats Y to compell him into a contract for Rs.50.000.s the contract valid?
4. Husband threatened to suicide unless wife gave property to his brother.Decide.

actually he mortgaged four.

6. A car dealer put a notice on a car that the mileage is incorrect even though he knew that the

23.F offered by letter to buy his nephews horse for 30 adding, If I hear no more about it, I
shall consider the horse as mine for 30. Nephew did not give any reply, but he told an

uncle. By mistake auctioneer sold the horse. Can F claim from auctionner.?

24: A agreed to purchase 200 tons of wheat from B out of a large stock.A sent his men with
sacks and 150 tons of wheat were put into the sacks.Then there was sudden fire and the entire
stock was gutted.Who bear the loss and why?

25.A goes to a shop and select certain hats .He arranges with the shopkeeper the supply of the
hats to him next morning by a servant of the shop and a months credit for the payment.The hats
destroyed in a fire on the same night.Who should bear the loss?

26.S sells a horse which is delivered to be to B the next week .B is to pay the price on delivery.B
asks his servant to keep the horse separate from the other horses.The horse dies before it is
delivered and paid for.

property is not to pass to B till he has paid the price of the necklace.Without paying the price ,B
sells the necklace to C..Does C get a good title to the necklace.

28. A purchase a car from B and uses it for some time .It turns out that the car sold out by B was
a stolen one and had to be returned to the rightful owner.A brings action against B for the return
of the price.Will he succeed.?

29. A, a farmer simply exhibits oats ( heart healthy breakfast foods) in his farm.B buys the oats
in the belief taht they are old oats.In fat they are new oats.B wants to return the oats and refuse to
pay the price.Decide.

30.A purchase some chocolate from a shop.One of the Chocolate contains a poisonous matter
and as a result A's wife who has eaten it falls seriously ill.What remedy is available to A against
the shopkeeper?

does not correct her mistake.Has she any remedies against the seller.?
Would your decision be different if the lady had told the seller I think they are natural pearls
and therefore,agrees to buy at your price. and the seller was silent.?

33.A whlesale dealer in soaps agrees to sell and to deliver two cases of Luxury toilet sap to a
sub dealer but delivers that quantity of Luxury washing soap.What are the rights of sub
dealer.?

34.A lady who knew that she was allergic to a particular hair dye .She developed particular
dermatitis.She did not disclose her allergy to hair dresser.Is hair dresser liable for breach of
implied condition?

35.A contracts with B to buy 50 easy chairs of certain quality .B delivers 25 chairs of the type
agreed upon and 25 chairs of some other type.What are the rights of A?
