1. Kami, yang bertandatangan di bawah ini, berdasarkan surat kuasa untuk mewakili
dan bertindak untuk dan atas nama (cantumkan nama Peserta Prakualifikasi
atau nama Konsorsium) (selanjutnya disebut "Peserta Prakualifikasi"), telah
memeriksa dan memahami sepenuhnya seluruh isi Dokumen Prakualifikasi, dan
dengan ini mengajukan permohonan untuk dapat mengikuti proses Prakualifikasi
yang diselenggarakan oleh Panitia Pengadaan Barang/Jasa untuk Proyek
Phosphoric Acid & By-Product Plant (selanjutnya disebut "Panitia Pengadaan")
sehubungan dengan pekerjaan-pekerjaan Engineering, Procurement &
Construction (EPC) untuk Phosphoric Acid & By-Product Plant PT KALTIM JORDAN
ABADI (KJA) (selanjutnya disebut sebagai "Proyek") (proses Prakualifikasi
sehubungan dengan Proyek selanjutnya disebut Proses Prakualifikasi).
We, the undersigned, by virtue of official of power of attorney to represent and act

reviewed and fully understood all contents of the Pre-qualification Documents, and
hereby apply to participate in the pre-qualification process conducted by the
Tender Committee for Procurement of Goods/Services for the Project of Phosphoric
Acid & By-Product Plant (hereinafter referred to as the "Tender Committee") in

connection with the Engineering, Procurement & Construction (EPC) works for the
Phosphoric Acid & By-Product Plant of PT KALTIM JORDAN ABADI (KJA)
(hereinafter referred to as the "Project")(Pre-qualification process for the Project
hereinafter referred to as the Pre-qualification Process).
2. Berkaitan dengan hal tersebut di atas, kami dengan ini menyampaikan salinan
dan/atau asli (yang mana yang berlaku) dari dokumen-dokumen yang
dipersyaratkan untuk diserahkan sebagai bagian dari Dokumen Prakualifikasi,
sebagaimana terlampir (Dokumen Prakualifikasi Peserta). Kami sepenuhnya
sanggup dan bersedia untuk menunjukan asli dari salinan dokumen-dokumen
tersebut (untuk salinan dokumen yang telah kami sampaikan), apabila diminta
oleh Panitia Pengadaan.
In respect of the abovementioned, we hereby submit the copy and/or original (as
the case may be) of documents required to be submitted as part of the Prequalification Documents, as attached herewith (Participants Pre-qualification
Document). We are able and willing to show the original of the copy of
documents (for which copies have been submitted by us), if requested by the
Tender Committee.

kewenangan kepada Panitia Pengadaan untuk melakukan pengkajian,
pemeriksaan, penyelidikan dan/atau verifikasi terhadap pernyataan-pernyataan,
data-data, dokumen-dokumen dan informasi-informasi yang disediakan dan
diserahkan oleh kami selaku Peserta Prakualifikasi sehubungan dengan
permohonan ini, serta untuk mendapatkan klarifikasi dan/atau konfirmasi, baik
dari bank(-bank), klien(-klien) kami maupun pihak(-pihak) terkait lainnya berkaitan
dengan aspek finansial, teknis dan lainnya dari permohonan, proposal dan
Dokumen Prakualifikasi Peserta kami.
We fully agree, and therefore hereby grant power of attorney and authority to the
Tender Committee to carry out any review, assesment, investigation and/or
verification on any statements, data, documents and information provided and
submitted by us as the Pre-qualification Participant in respect of this application,
and to obtain any clarification and/or confirmation, either from bank(s), our
client(s) or any other relevant party(ies) in respect of any financial, technical and
other aspects of our application, proposal and Participants Pre-qualification
Documents.

4. Kami membuat dan mengajukan permohonan ini dengan sepenuhnya memahami

dan menyetujui bahwa:

that:
a. Panitia Pengadaan, tanpa adanya kewajiban untuk memberikan penjelasan
lebih lanjut apapun, berhak sepenuhnya untuk membatalkan proses
Prakualifikasi; dan
The Tender Committee, without obligation to provide any further explanation,
shall be fully entitled to cancel the Pre-qualification process; and

b. Panitia Pengadaan, dalam hal apapun, tidak dapat dituntut atas tindakan
pembatalan tersebut dan tidak berkewajiban untuk memberitahu Peserta
Prakualifikasi tentang alasan(-alasan) pembatalan tersebut.
The Tender Committee shall, in no event, be sued for such cancellation and is
not under any obligation to provide the Pre-qualification Participant with any
explanation concerning reason(s) for such cancellation.
5. Selanjutnya, kami dengan ini menyatakan bahwa:
a.
seluruh dokumen dan setiap informasi, data dan/atau pernyataan yang

terdapat di dalam dokumen-dokumen tersebut, yang telah atau akan
disampaikan oleh kami dalam proses pengadaan barang/jasa sehubungan
dengan Proyek (termasuk dokumen-dokumen yang disampaikan dalam Proses
Prakualifikasi) adalah tepat, benar dan tidak menyesatkan. Apabila dikemudian
hari dokumen-dokumen dan setiap informasi, data dan/atau pernyataan yang
terdapat di dalam dokumen-dokumen tersebut dapat dibuktikan tidak tepat,
benar atau menyesatkan, maka kami setuju dan tidak keberatan untuk
dikenakan sanksi berupa diskualifikasi (digugurkan) sebagai peserta
Prakualifikasi dan dimasukan ke dalam daftar hitam (blacklist) KJA;
b.
setiap pernyataan yang dibuat dan/atau informasi serta data dalam Dokumen
Prakualifikasi Peserta yang kami ajukan selaku Peserta Prakualifikasi kepada
Panitia Pengadaan adalah lengkap, benar, tepat serta tidak menyesatkan
dalam setiap rinciannya. Setiap pernyataan, informasi dan/atau data yang
terbukti tidak lengkap, tidak benar, tidak tepat dan/atau menyesatkan akan
mengakibatkan Dokumen Prakualifikasi Peserta yang kami sampaikan kepada
Panitia Pengadaan dinyatakan batal demi hukum.

a. all documents and any information, data and/or statements contained in such
documents that have been or will be submitted in the process of procurement
of goods/services with regard to the Project (including documents submmitted
in the Pre-qualification Process) are accurate, true/correct and not misleading.
In the event that in the future such documents and any information, data
and/or statement contained in such documents are proven inaccurate,
untrue/incorrect and misleading, then we agree and have no objection to have
sanctions imposed upon us, i.e. to be disqualified as the Pre-qualification
participant and to be listed in KJAs blacklist;
b. any statement made and/or information and data contained in the Prequalification Documents submitted by us as Pre-qualification participant to the
Tender Committee are complete, true/correct, accurate and not misleading in any
details. Any statement, information and/or data proven to be incomplete,
incorrect/untrue, inaccurate and/or misleading, shall cause the Participants
Pre-qualification Documents submitted by us to the Tender Committee to be

declared null and void.

facilities such as power plant and
steam, cooling water system, waste
water treatment, storage system,
etc. to be set up by KJA (collectively,
the Project);
(A) Bidder/Kontraktor telah ikut serta

Abadi (KJA) yang bertujuan

that the Project is required to be
constructed and completed in
accordance
with
the
design
capacities,
specifications,
performance guarantee, terms and
conditions
stipulated
in

Engineering,
Procurement
and
Construction Contract to be entered
into with regard to the Project (EPC
Contract) and other Project related
documents. Therefore, in the event
that the Bidder/Contractor is
declared as the winner of the tender
and has signed and entered into the
EPC Contract, the Bidder/Contractor
shall be obliged to complete the
Project in accordance with such
design capacities, specifications,
performance guarantee, terms and
conditions, including in this matter,
to carry out any and all repairs,
replacements,
modifications,
adjustments, alterations, changes,
additions and retests to ensure that
the Project is completed in
accordance
with
the
design
capacities,
specifications,
performance guarantees as well as
terms and conditions set forth in the
EPC Contract and other Project
related documents;
(B) Bidder/Kontraktor
sepenuhnya
menyadari bahwa Proyek wajib
dibangun dan diselesaikan sesuai

spesifikasi-spesifikasi,
kinerja yang dijamin (performance
guarantee) dan syarat-syarat serta

Procurement and Construction

mengadakan pelelangan pekerjaanpekerjaan Engineering, Procurement
& Construction (EPC) sehubungan
dengan Proyek Pabrik Asam Fosfat &
By-Product KJA ("Proyek"). Berkaitan
dengan hal tersebut, KJA melalui
panitia lelang KJA (Panitia Lelang),
bermaksud melakukan pengadaan
barang/jasa
untuk
Proyek
menggunakan metode pelelangan
terbatas dengan proses prakualifikasi
(Prakualifikasi) untuk memilih,
menunjuk dan menugaskan satu atau
lebih kontraktor EPC(-kontraktor EPC)
yang memiliki pengetahuan, keahlian,
kualifikasi teknis pengalaman serta
kemampuan
keuangan
yang
dipersyaratkan
pada
pekerjaan
sejenis ("EPC Contractor").
(KJA) intends to conduct a

tender/bidding
for
Engineering,
Procurement & Construction (EPC)
works of its Phosphoric Acid & ByProduct Plant Project (the "Project"). In
resepect thereof, KJA through its tender
committee (Tender Committee),
intends to conduct a procurement of
goods/services for the Project using
limited bidding method with a prequalification process (the Prequalification) to select, appoint and
assign one or more EPC contractor(s)
who have the required knowledge,
expertise,
technical
qualification,
experience and financial capability in
similar work (the "EPC Contractor").
(B) BAHWA,
berdasarkan

a consortium (Consortium) for the
purposes of participating in the
bidding/tender
process,

subsequently if the Consortium is
selected and declared as the winner of
the bidding/tender, to perform or
carry out the engineering, procurement
& construction (EPC) works in
accordance with the terms and
conditions of the Project EPC contract
and other Project related documents.
2. Berkaitan

5. In the event that KJA has declared that

the Consortium has passed the Prequalification process, the Parties agree
that the Parties shall sign and enter into
a consortium agreement with the
format, procedures and minimum
terms and conditions to be further
stipulated by KJA (the Consortium
Agreement) and shall submit the
certified true copy of the Consortium
Agreement to KJA no later than thirty
(30) calendar days prior to the deadline
of the submission date of the
Administrative and Technical Proposal
Documents.
6. Para Pihak dengan ini sepakat bahwa

Perjanjian Konsorsium sebagaimana
dimaksud dalam Butir 5 di atas tunduk
sepenuhnya pada setiap perubahan,
penambahan, dan/atau penyesuaian
yang diwajibkan oleh KJA melalui
Panitia Lelang. Sehubungan dengan
tersebut, Para Pihak sepakat dan
mengikatkan diri mereka untuk
membuat perubahan, penambahan,
dan/atau penyesuaian yang diwajibkan
tersebut.

Point 5 above shall be fully subject to
any amendment, addition and/or
adjustment required by KJA through the
Tender Committee. In respect thereof,

pada tanggal laporan keuangan, lalu dihitung aspek kuantitatif atas jumlah total
tersebut. Dengan demikian, sebagai hasilnya hanya ada 1 (satu) skor untuk setiap
konsorsium.
Total skor minimum yang harus dipenuhi oleh konsorsium atas penilaian terhadap
aspek kuantitatif dan kualitatif tersebut adalah 70.
Lampiran perhitungan ini (Lampiran 6) dibuat dalam 2(dua) bahasa, Bahasa Indonesia
dan Bahasa Inggris. Apabila terdapat perbedaan penafsiran maka yang digunakan
sebagai acuan adalah Bahasa Indonesia.

Liquidity ratio measures the capability of a company in settle the short term loan
which has been over due. A liquid company is a company wh able to settle all of

liability. This ratio indicates the amount of the current asset value which is funded
