OBJECTIVES:
1. Establish the facts and circumstances surrounding the
stabbing incident;
2. Identify person/s involved;
3. Determine whether or not there were lapses on the part
of on-duty personnel of BuCor and the PNP SAF; and
4. Ascertain their criminal and/or administrative liabilities,
if any.

AUTHORITY
The CIDG launched a probe in response to the request of
the BuCor and the pronouncement of DOJ Undersecretary
Renato Orceo, a few hours after the incident occurred at the
NBP

FACTS OF THE CASE
On September 28, 2016, at around 7:45 AM, an
alleged riot erupted inside the mess hall of Building 14,
NBP, Muntinlupa City, which resulted in the death of convict
Tony Co, and the wounding of high-profile inmates Jaybee
Sebastian, Peter Co, Vicente Sy, and Clarence Dongail.

1. Sworn statements and interviews with personalities
involved (i.e. inmates, SAF, BuCor officials);
2. CCTV footages;
3. Hospital records and medico-legal reports; and
4. Evidence collected by the BuCor at the crime scene.

No riot or tumultuous affray occurred.
What transpired were two (2) separate and
simultaneous stabbing incidents inside the
makeshift room of Tony Co and at the mess hall
area.

The incidents were triggered by separate
causes and there was no showing that they
acted together in a disruptive and tumultuous
manner in carrying out a common purpose.

FINDINGS
Illegal drugs still exist inside Building 14,
based on evidence and the result of the drug test
to the inmates (including deceased inmate Tony
Co) and the records on seized illegal drugs and
paraphernalia from the national penitentiary.

Inmates Clarence Dongail, Edgar Sinco and
Tomas Donina may be held liable for the
incident.

FINDINGS
The on-duty PNP-SAF personnel (present at the
time of the incident) acted with regularity in the
performance of their respective duties and
responsibilities.

The BuCor and NBP Leadership immediately
reacted and the courses of action they have
undertaken in response to the incident were
deemed appropriate.

Personnel of the NBP Investigation Section,
acting within their legal mandate, conducted an
investigation but they have limited knowledge in
crime scene processing, collection and
preservation of evidence because they have no
standard investigative procedures in crime
scene processing.

deployed in all entrances and visiting areas of the
Maximum Security Compound, especially at Building 1.
