l. The Registrarof the lnternationalCriminal Tribunal for Rwandawishesto bring the following
observationsto the attentionof the AppealsChamberpursuantto Rule 33 (B) of the Rules of
Procedureand Evidence.

Introduction

Z. On 9 June2010, the Appeals Chamber,pursuantto Article 28 of the Statuteof the Tribunal,


issuedan Order in which it instructedthe Registrar,on an urgentbasis,to:

o request the assistanceof Rwandan authorities for the purpose of obtaining all
information relating to the exact natureand basisof the chargesbrought againstPeter
Erlinder;

o reportto the AppealsChamberon the outcomeof this request;and

o provide any information to the Appeals Chamber that is furnished by Rwanda in


responseto this request.

3. On l0 June 2010, the Registrarreportedto the Chamberon the actions taken vis-d-vis Mr.
Erlinder's arrest and attachedall official exchangesbetweenthe Tribunal and the Rwandan
authoritieson this issue.In particular,it is recalledthat upon receipt of a decisionrenderedby
the High Court of Gasaboon the bail hearingfor the Erlinder's caseon 7 June 2010, the
Registrarrequestedthe Rwandanauthoritiesto provide him with a formal copy of the charges
levelledagainstMr. Erlinder. It is alsorecalledthat, following the AppealsChamber'sdecision
instructingthe same diligence, the Registrartransmittedanotherrequestto the same effect,
alongwith copiesof the AppealChamber'sdecision.l

Submission

4. In compliancewith the aboverecalledinstructions,the Registrarwishesto inform the Chamber


that a responsefrom the Rwandanauthoritiesas well as a formal copy of the chargesbrought
againstMr. Erlinder hasyet to be received.

5. In the meantime,mindful of the urgent and delicatecircumstances,the Registrarseizedthe


Office of Legal Affairs regarding the possibility for the ICTR to assertimmunity for Mr.
Erlinder on the basis of the decisionrenderedby the High Court of Gasabo,absenta formal
copy ofthe charges.It appears,in fact, from the decision,that part ofthe reproacheslevelled
againstMr. Erlinder derivesfrom the wordshe spokeand statementshe madein his casebefore
the ICTR. Excerptsof the submissionsof the Prosecutorwho appearedbeforethe GasaboHigh

Court read as follows: "Carl PeterErlinder deniedand minimized the genocideby statingthat
the soldiershe was defending neither plannednor carried out the genocide' The Accused
affirmedthat his clientswere ratherdefendingnationalintegrity.ProsecutionCounselsubmitted
that the Accuseddid not end there, as he deniedand minimized the genocidein other cases"2

The InternationalCriminal Tribunal for Rwanda(ICTR) presentsits complimentsto


the Ministry of Foreign Affairs and Cooperationof the Govemmentof Rwandaand has the
honourto referto its previousNote Verbalesof 31 May 2010,9 and 10 June2010as well as
the responsefrom ProsecutorGeneralMartin Ngogaof 2 June2010 concerningthe arrestin
Kigali, on 28 May 2010, of ProfessorPeterErlinder on allegationsof genocidedenial.
ProfessorErlinder is an Americanlawyer in chargeof the defenceof Mayor Aloys Ntabakuze
beforethe ICTR.

Following the arrest of ProfessorErlinder, the ICTR sought clarification from the
Rwandanauthoritieson the motivesof this arrestthroughits Note Verbale of 3l May 2010.
This requestdrew from the needfor the ICTR to ascertainthe applicability of any immunity
or privilege which Defence Counsel assignedto casesbefore this Tribunal enjoy in the
contextof their mandate.

Having subsequentlylearnedthat ProfessorErlinder underwenta hearingbefore the


High Court of Gasabo,the Tribunal requested,on 9 June,the Rwandanauthoritiesto provide
a formal copy of the chargesleveled againstProfessorErlinder. On 10 June, the ICTR
transmittedanotherNote Verbaleto the sameend in compliancewith an orderof the Appeals
Chambersitting in the caseof Mayor Ntabakuze.The Chambers'decisionwas atiachedto
that Note Verbale.

In the meantime,the ICTR receivedthe decisionon the bail hearingfor the Erlinder's
case held on 7 June 2010 before the High Court of Gasabo.The ICTR notes that the
Prosecutionappearingbefore the High Court made specific referencesto words Professor
Erlinder spoke and statementshe made in his case before the ICTR. Excerpts of those
submissions read as follows: "Carl PeterErlinderdeniedand minimizedthe genocideby
statingthat the soldiershe was defendingneitherplannednor carriedout the genocide.The
Accused affrrmed that his clients were rather defending national integrity. Prosecution
Counsel submittedthat the Accused did not end there, as he denied and minimized the
