ARTICLE III

BILL OF RIGHTS
Due Process - No person shall be deprived of life, liberty, or property
without due process of law.

Equal Protection of the law refers to equality in the enjoyment of


similar rights and priveleges granted by the law .

Right Against unreasonable searches and seizures - The


right of the people to be secure in their persons, houses, papers.

Happens when it is done without a court order or search warrant /


warrant of arrest.

Right to privacy of communication and correspondence The privacy of communication and correspondence shall be inviolable except
upon lawful order of the court, or when public safety or order requires
otherwise, as prescribed by law.

Any evidence obtained in violation of this or the preceding section shall


be inadmissible for any purpose in any proceeding.

Freedom of speech - No law shall be passed abridging the freedom of


speech, of expression, or of the press, or the right of the people.

Feedom of Religion - The free exercise and enjoyment of religious


profession and worship, without discrimination or preference, shall forever be
allowed.

No religious test shall be required for the exercise of civil or political


rights.

Liberty of Adobe and Travel - The liberty of abode refers to the


freedom to choose where one should reside . while liberty of travel means
the freedom to move from one place to another without interference from
anybody .
Right to information on matters of public concern - The right of the people to
information on matters of public concern shall be recognized.

Right of every citizen to have access to the records of the


government .

Right to Association - The right of the people, including those


employed in the public and private sectors, to form unions, associations, or
societies for purposes not contrary to law shall not be abridged.

Any Filipino citizen can join any society or group.

Right to just compensation - Private property shall not be taken for


public use without just compensation.

Non impairment of contacts- No law impairing the obligation of


contracts shall be passed.

Free of Access to courts - Free access to the courts and quasi-judicial


bodies and adequate legal assistance shall not be denied to any person by
reason of poverty.
Rights of a person under custodial investigation - Any person under
investigation for the commission of an offense shall have the right to be
informed of his right to remain silent and to have competent and
independent counsel preferably of his own choice.
- If the person cannot afford the services of counsel, he must be provided
with one. These rights cannot be waived except in writing and in the
presence of counsel.

RIGHTS OF THE ACCUSED IN CRIMINAL CASES


Right to Bail security is required by the court

in court before judgement is rendered.

Right to Presumption of Innocence criminal offense is always


presumed to be innocent
.- Guilt of an accused rest on the prosecuting attorney or fiscal

Right to be Heard Himself and Counsel Accused has the right


to defend himself personality or thought his lawyer .

Right to be informed of the Nature and Cause of


Accusation accused has the right to know the charges filed against him
so that he may be able to prepare for his defense in court .

Right to speedy Trial Disposition of cases before all judicial , quasijudicial or administrative bodies .

Right to Confrontation of Witnesses right to mee the witnesses


against him face to face .

Right to compulsory production of witnesses and Evidence


right to demand the presence of witnesses during the trial .
Subpoena requiring a to appear in the court .

Trial in the Absence of the Accused one of the ways which


criminal case can be resolved speedily .

Right to Appeal in Criminal Cases HE HAS RIGHT TO APPEAL HIS


CASE TO HIGHER COURT.

Right against cruel and unsual punishment . imposition of


excessive fine and the infliction or inhuman or degrading punishment .

Right against self-incrimination - No person shall be compelled to


be a witness against himself.

Right Againts Double Jeopardy - No person shall be twice put in


jeopardy of punishment for the same offense. If an act is punished by a law
and an ordinance, conviction or acquittal under either shall constitute a bar
to another prosecution for the same act

Right against the Death Penalty shall not imposed unless for
compelling reasons involving heinous crimes .

Right against Detention due to political beliefs and


aspirations - espousing political beliefs and aspirations.

Non suspension of the privilege of habeas corpus - The


privilege of the writ of habeas corpus shall not be suspended except in cases
of invasion or rebellion, when the public safety requires it.

Non imprisonment Due to Dept - No person shall be imprisoned for


debt or non-payment of a poll tax.

Non passage of ex post facto and bill of attainder No ex


post facto law or bill of attainder shall be enacted.
