othersaroundthistime,setaprecedentthatmenmaynotuseTitleIXtoclaimsex
discriminationwhentheirprogramsarecutforbudgetaryreasons.

CongresspassestheEquityinAthleticsDisclosureAct,whichrequiresfederallyfunded
coedinstitutionstosubmitannualreportsabouttheirathleticsprogramstobettermonitor
TitleIXcompliance.

Inresponsetogrowingconcernthatschoolsarecuttingmen'sprogramstoreach
proportionality,theOfficeforCivilRightsissuesguidelineselaboratingonthethree
prongtestintroducedinits1979memo.Itconfirmsthatinstitutionscanchoosewhichof
thethreeconditionstheyplantomeetinordertoprovidenondiscriminatoryparticipation
