AFFIDAVIT OF WITNESS
I, Franco Perez, of legal age, Filipino, single and a resident of
Brgy Sta. Maria, Zamboanga City, after having been duly sworn to in
accordance with law, depose and state:
1. That Im the younger brother of the accused Rodrigo Perez,
and Im living with my brother in a rental apartment weve been
occupying since our parents passed away;
2. That Im unemployed and been doing repair jobs for the
community for a small pay in my makeshift hut where I do my
repair jobs from shoe repair to simple mechanic repair, this has
been my livelihood for a very long time;
3. That my brother has been known to the community as the
official resident dairyman, and he has a well earn reputation as
such;
4. That around quarter to 10 oclock in the morning of June 13,
2016, just before finishing his delivery for the day, he pass by
my makeshift hut to check on how my day was so far and to
have a small shot of tuba as he usually do when he pass by
my hut;
5. That around 10:10 am, he passed by again at my hut, I ask him
if he is done in his delivery for today he replied in the
affirmative, he then spend the next 3 hours in my hut with a
friend named Douglas Dougz Velasco drinking Tuba and
talking about our day and other things;
6. That I executed this affidavit to attest the truthfulness of the
foregoing facts and to support the filing of criminal case against
