The Honorable Chief District Judge,

I am a self-represented Plaintiff / Appellant without being an attorney in the above referenced cases
with final order now on appeal at the U.S. Court of Appeals for the 2d Circuit Appeals cases 08-4323411 .
and 10-0822-c~;and make this statement under penalty of perjury pursuant to 28 USC 51746. That the Clerk
of the Second Circuit insists that Declarant is not a properly designated Appellant in the docket of either of
the referenced cases in that the Clerk of the Northern District of New York (NDNY) has not properly
firwarded a record of Declarant's Notice of Appeal in both above referenced cases. Declarant wishes
assistance of your Honor in this Administrative matter as time is of the essence.
Declarant did duly file an Amended Notice of Appeal in each case in a timely manner with the Clerk
d&eNDNY a copy of each is annexed herewith. Declarant has spoken with the NDNY clerk "Wendy" at
the Albany Clerks Ofice who indicated that even were there a possibility to comt the entry it is consider&
beyond the 30 deadline for entry into the docket.
The 08-4323cv appeal is fully briefed by Declarant and awaits an oral argument date now after six
months has passed and we are now informed Declarant is not an Appellant as similarly applies to 10-0822-cv
that hjis not even been given a briefing schedule. Declarant wishes to have the NDNY Clerk properly
annotate the record and duly inform the 2" Circuit Clerk accordingly. Despite the contention of Judge F q n
and the NDNY clerk in the Forione et al. v State o f Californiaet al. NDNY 06-cv-1002 case the respective
counspls listed on the following page consider their clients properly served with the complaint as do we.
Dplarant is adamant as with the Arbor Hill Case v. The Coung ofAlban?,in the NDNY 03cv-502
pdistricting case involving the Voting Rights Act ("VM'7 heard before your Honor that the matter of the
Albany failure to follow the State Constitution and VRA is paramount. Respectfully submitted by:
