The Disadvantage and Advantage of Unfairness in the Justice System
Experience is the mother of wisdom, not only talk about human, but also a
successful country. America is a diverse country which has multiple culture citizens.
Everyone are dreaming about having a better life which causing so many people have
immigrated in the U.S.A for another chance to start a new life. In humans life,
communication is an important skill to learn, we are not only using it to understand each
other but also learn new knowledge. The culture of each country are different, and that is the
interesting about communicating. When people have a different culture, the misunderstanding
of language can cause some serious issues, and the issues may not only just at the person to
persons level, but also bring up to the most serious problem such as that culture will against
culture.
As the level has become higher and serious, different countries will set the certain
character of different countries, and it usually depends on their appearance, general
personality, and education. Especially, people to African American usually be
misunderstanding because of the stereotype. According to Chaney research that data shows
that black male, in particular, is characteristic as aggressive and criminal(Chaney 483).
Before black people did not have confident to stand out for themselves because of the history
that the white has the higher standard than them. In the society, whites were the majority of
the citizen, and other cultural people scared about also being affect by helping them so people
choose to stand at a white side or ignore what have happened. Until Martin Luther King leads

the African American Civil right movement, people started to standing out and fighting for
themselves.
The problem of being stereotype have happened for a long time, because of the
slavery history for African American More important that because of the stereotype, Blacks
have been treated unfairly, not only just limited their actions but also in the justice system.
According to Dreier research about the effect of the riots, society has been changed. After the
1965 and 1996 riots of police brutality have happened which was the time take in Southland
and civil right movement. The government paid more tension about the problem and tried to
calm people down. (Dreier 39) People usually will keep an eye on what they were doing, this
motion of no confidence made Blacks feel unfair about their human right.
The popular example of the flaws in the justice system is police brutality. The main
argument that society is arguing about the race characteristic help police to target those more
likely to be criminals, and police will apprehend more offenders depend on the race of the
target(Ryberg 79). Recently, The news of police brutality has caught all citizens eyes that
made the citizen feel unbelievable about it still happen after all kind of movement and riots
for African Americans human right. This situation is really ironic that people have spent
many years of promotion that everyone has the equal right. The races still will effect the
justice become unfair, and the issues which we all know that can cause unfairness happen in
America justice system and the victims mostly are African Americans and males. As Dreier
mention that riots are the wake-up call for political and business of societys media. That
people need to know that are seething below the surface(Dreier 39).
The reasons why African American and males normally are the target of the
unfairness in a justice system. Discrimination is the main reason of the police brutality, and it
raised the chance to get unfair injustice. Because people are judgemental, they will judge
everyone action and culture in their heart before they really talk or know each other. In the

U.S.A, people have influenced by the media, that Blacks in general, are caricatured as
aggressive and criminal. (Chaney 483). In the criminal movie, people who carry gun or sell
drug normally are Blacks or Latino. People will not feel wired or question about it. Because
of the stereotype, they usually believe that blacks are the bad guy or murder, and this idea is
already ingrained which is difficult to remove. According to Woolards research, most of the
people rather choose white because of the general image that they are more likely to follow
the rule than Blacks(Woolard 223). The research brings out how serious the stereotype are,
although the society has improved a lot, the old idea still cannot be erased.
A gender stereotype is also the popular issues which may cause the unfairness in
criminal justice. In many cases, the target of the victims is normally African Americans male,
not African Americas female which is very curious. According to Riveras research, people
believe that women have a low probability of committing crimes, being arrested, and/or being
incarcerated than men, because of the gender stereotype(Rivera 1100). Although women are
weaker than man, they are still human, The justice should be fair between gender and culture.
Peoples mind have been shaped by many things, that sexual assault only can happen on the
female, and the victims must be male. The social roles may mislead peoples judgment to
unfairness(1110).
The reason why stereotyping in the justice system are disadvantaging society.
People are protesting about the police brutality is unfair because the issues of police brutality,
that almost ninety-seven percent of the cases, that police do not need to get the penalty by
their misconduct or false arrest because of the professional. The jury explained that police
have been trained to when is the time to pull out the gun or arrest the victim. Although that is
correct, we trust their professional. It is really difficult for the family of the victim to accept
this situation or result because their family does not really hurt anybody. He or she got killed
by police because they think that is the correct way to solve the problem, which causes

people misunderstand about the police, and the relationship becomes really terrible between
each other. In the data, there have many cases of police brutality, which means there have
many families have been through this trading. According to Najdowsk research, criminaljustice-related stereotype threat could fundamentally shape Blacks encounters with the
criminal justice system and provoke racial disparities not explained by the intentions of
police officers, lawyers, or judges. So the government should give an acceptable reason to
convince the citizens. (Najdowsk 464).
However, the police brutality is a problem, it also has some benefit the society.
People may curious how can these tragedies become the advantage. When people start to
notice these events, that is a good start because people cares about what happen in the society.
If they start to protesting for the victims, that means that our education has been improved.
According to Dreiers research, the history of the past century shows that progress is made
when people join together to struggle for change, make stepping stone reforms, and persist so
that each victory builds on the next.(Dreier 54). Every successful country has been through
many problems. After people fight for their right, the country can become better. There also
have another point of view to see police brutality, the punishment to the victim may be
justified as an instrument in the prevention of futures crimes(Ryberg 81).
The improvement of the humans, because the social progress, people mindset for
black males has changed. They started judging the right or wrong depends on the happen of
the event, not the type of human. Before how people react to the racial injustice. Normally,
they choose to ignorant and afraid to stand out. In the Southland, the neighborhood of main
characters hometown choose to forget about what happen, and people also ignorant the
action of the police at that time(Revoyr 60). The neighbor also afraid that they will affect by
the murder event so they choose not to stand up for the victims(60). In todays society, the
way to spread the news became faster than before, and there have more educated people who

can make a sober judgment. People become more care about what happen in the society.
When the issue happens, people choose to film during the event. Then everyone can see what
happen, not just know the news. It can prevent the news lie to people or only show one side
of the problem(Ryberg 90). In this day, protest is a really common action when citizens are
showing they do not agree on what government has decided (90).
Throughout theses police brutality events, we can know out society still needs to
work on stereotype issues. People feel unfair about how police can escape from the penalty of
incident killing people. Actually, everything has many sides, we cannot only see one side, and
the media usually only post one side of the event which will affect people points of view
about the event. The misleading will because more misunderstand, so the government should
create a specific rules or law that can convince the citizen about their decisions. After the
research, I realized that many things have being hide, we are not actually knowing the truth.
That is why the media is really bias, if the video recorder only records the way which only
can benefit the powerful people, the action can misleading everybody. In today's society,
people like to help each other, they become active on joining the action or say their ideas.
After a histiory experience of protesting, everybody knows how to use the protest to get what
they went.I think our government should bring out the law that can give the family an
acceptable reason for the dead of their family.
The way to improve our society, Since the police brutality happened in America
has now become a national phenomenon, the US Department of Justice should be focused on
enforcing the law and administration of justice for these victims, and prevent further trading
happen.(Chaney 502). During the research, I found out the different point of view about the
flaws in the justice. I think a government should improve their justice system which makes
victims family can accept the punishment. Not only police officer are the one to help us
provide a safe and nice society, but also is the everybody responsibility to take care of it. The

media should not only stand at one side. The news should provide full information of what
happening during the events. People are not stupid, they will want to know the truth of the
problem. Although the police have been trained professionally, the misconduct problem is
still their fault. They still need to get some punishment about it, not get away from the
penalty.
Everything has the solution; we need to find one that balances the society is very
difficult. No one wants to be treated unequal, as our mindset growth. We know what is the
real problem. Any progress, we have made will improve our society to a better place. I am
glad that I born in a period of time, that everyone will help each other to fight for their right.
