A PROPOSED ORDINANCE REQUIRING MOTORCYCLE OWNERS AND USERS TO

SECURE THEIR PARKED MOTORCYCLE WITH A SECURITY LOCK AND


PROVIDING PENALTIES THEREOF

Whereas, Section 16 of the General Welfare Clause of Republic Act No. 7160
otherwise known as the Local Government Code of 1991, provides in part that, every
local government unit shall exercise powers necessary for its effective and efficient
governance and those which are essentials to the promotion of the general welfare;
Whereas, Section 451 of the same Code, provides that, the Sanggunian as the
Legislative Body has the power to enact ordinances to maintain peace and order by
enacting measures to prevent and suppress lawless, disorder, riot, violence rebellion, or
sedition and impose penalties for the violation of said Ordinance;
Whereas, the Tuguegarao City Police Station report showed that many cases of
motorcycle theft were reported in the City;
Whereas, there is a need to prevent the notable number of motorcycle theft in
the City. Global motorcycle theft statistics show that motorcycles secured by obvious
security devices actively dissuade thieves to commit crimes. Requiring motorcycle
owners to take some appropriate precautions and use good quality security products
will help lower motorcycle theft.

NOW THEREFORE, be it ORDAINED by the 6th City Council in session ASSEMBLED


to enact:
SECTION 1. TITLE. This ordinance shall be known as TUGUEGARAO CITY
MOTORCYCLE CHAIN LOCK ORDINANCE OF 2015.
SECTION 2. DECLARATION OF POLICY. It is the policy of the City of
Tuguegarao to safeguard the inhabitants against crimes and violence which impede
progress, peace and tranquillity from the community. It aims to prevent crimes in the
City to establish a secured environment, at home, on streets or at work for the entire
populace, investors and stakeholders thus, ensuring economic growth.
SECTION 3. DEFINITION OF TERMS. As used under this ordinance, the following
words or terms shall be defined as follows:
a. Lock shall mean a security device used to deter motorcycle theft such as
U-lock, loop cable, chain padlock etc. , in addition to the motorcycles built-in
lock.
b. Motorcycle - shall mean two-wheeled motor vehicle.
c. Parked Motorcycle- shall mean a motorcycle at full stop with no rider
mounted and no authorized person in direct and actual supervision thereof.
d. PNP shall refer to the Philippine National Police.

SECTION 4. COVERAGE. This Ordinance shall apply to all Motorcycle owners


and users within the territorial jurisdiction of Tuguegaro City.
SECTION 5. IMPOSITION AND IMPLEMENTATION. All motorcycle owners and
users are hereby required to provide a security lock to secure their parked
motorcycles in schools, offices, hospitals and clinics, churches, business
establishments and other parking spaces within the City. The Tuguegarao City-PNP
Station in partnership with the Tuguegarao City Public Order Safety and Security
Office (POSSO) is tasked to implement this Ordinance.
SECTION 6. PERIOD OF COMPLIANCE. Motorcycle owners and users are
hereby given a period of sixty (60) days from the date of approval of this ordinance to
comply with the requirements contained herein.

SECTION 7. PENALTY CLAUSE. The following penalties shall apply to violators


of Section 5 of this Ordinance.
1st Offense: a fine of two hundred fifty pesos (P 250.00)
2nd Offense: a fine of five hundred pesos (P 500.00)
3rd and succeeding Offenses: a fine of seven hundred fifty pesos (P
750.00)

SECTION 8. INFORMATION DISSEMINATION. Let copies of this Ordinance be


furnished to all barangays, schools, government offices, motorcycle clubs,
motorcycle dealers and other concerned offices.
SECTION 9. APPROPRIATIONS. The amount necessary to implement the
provisions of this Ordinance shall be appropriated in the Annual Budget of
Tuguegarao City.
SECTION 10. SEPARABILITY CLAUSE. The provisions of this Ordinance are
hereby declared to be separable and in the event that one or more of the other
provisions are held illegal or unconstitutional, the validity of the other provisions shall
not be affected.
SECTION 11. REPEALING CLAUSE Ordinances, executive orders and other
local legislation inconsistent with this Ordinance are hereby modified or repealed
accordingly.
