Religious leaders urge Uhuru not to


assent to election laws

Religious leaders have asked and appealed


to President Uhuru Kenyatta not to assent
to the amended election laws passed by
parliament on Thursday last week.
The leaders drawn from the Supreme
Council of Kenya Muslims (SUPKEM),
National Council of Churches of Kenya
(NCCK), Kenya Conference of Catholic
Bishops-Catholic Justice and Peace Commission and Evangelical Council of Kenya
said the proposed laws would have serious
consequences for the citizens and Kenya
as a country.

In an unprecedented event in the August


House, Jubilee-affiliated Members of Parliament last week forcibly changed Elections Laws (Amended) Act, allowing the
electoral commission to use an alternative
manual system if the electronic voter identification system collapses.
The changes also allow the Independent
Electoral and Boundaries Commission
(IEBC) to come up with a manual system
of transmitting results.

approve the contentious electoral law.
The religious leaders condemned the manner in which the amendments to election
laws were crafted and passed and asked
President Kenyatta not to sign the election
amendments Bill into law. The religious
leaders also called on the opposition led
by RailaOdinga to give dialogue a chance
instead of resorting to demonstrations after
the laws were passed by Parliament.
Calling on the head of state to rise above
partisan politics and provide a unified leadership for the nation, the deputy secretary
general Hassan Ole Naado cautioned the
President against assenting to the proposed law as this will lead to increased
political tensions amidst a charged election
atmosphere.
He said the election amendment bill recently passed by a highly divisive parliament went against the spirit of the constitution and it was prudent that the president is
not seen to be party to a process of enacting illegal legislation.
The constitution clearly stipulates that no
law can be amended before a period of six
months and most importantly, the electoral
law came as a result of a negotiated settlement which involved religious leaders,
the private sector and Parliament and taking back the law to Parliament for another
amendment is subjecting it to mob justice,
he added as he implored on the head of
state not to append his signature to the law
which could have negative ramifications for
the country.
The president should rise above partisan
interests by rejecting those amendments.

Exercise caution on buying inherited property


Due diligence of inherited properties should be made before a
sales agreement to ensure that the rights of beneficiaries are addressed.
Noting that there was an increased trend were properties bequeathed to beneficiaries were illegally being disposed off without following the legal Islamic procedures, the deputy Chief Kadhi
Sheikh Rashid Ali Omar said Islamic law was clear on matters of
disposition of inherited properties as he emphasized that the process should be made without violating the rights of beneficiaries.
In a landmark ruling which he made recently, Sheikh Rashid nullified a sale agreement of a Ksh20 million property based in Nairobis Eastleigh estate on the grounds that rights of inheritors
had not been given due consideration.

The succession case involved the sale of the share of one of the
beneficiaries which was made before the determination of shares
and distribution of the estate to the heirs.
The deputy Chief Kadhi nullified the sale agreement after it became clear that consensus from other heirs of the estate was not
sought and he also rejected the presumption of a gentlemans
agreement on the argument that it does not stand the threshold of
Islamic substantive law.
The Islamic succession law has determined the heirs and their respective portions before distribution of the estate of the deceased
and provided ample space to beneficiaries to adopt their respective
shares through valid contracts after demarcations of the shares,

SUPKEM Western Counties elects new officials


The Supreme Council of Kenya Muslims
(SUPKEM) elections were held in three
counties in Western region and new officials elected to serve and manage the affairs of the local Muslim organizations for
five years.
During the elections held last week, a
new chapter was opened as the new SUPKEM constitutional dispensation begins to
take its toll in the Muslim community where
both youth and women stepped out to
claim their rightful leadership share within
the Muslim community in order to influence change by voicing their concerns.
In BungomaCounty elections held in Webuye ,the Bungoma Muslim Association
(BMA) chairman Cassim Simiyu Werunga
was elected in the peaceful and well attended elections the new chairman of the
council .

Laws that come into place through negotiated processes cannot be brought back by
one side and changed the way it happened
in Parliament, said Ole Naado.
Ole Naado noted that if the Jubilee coalition
had issues with the law, they should have
been taken back to the joint committee that
spearheaded the negotiated process.
''This is unfair and we hope the President
will not sign the disputed law into law as it
creates distrust that will also undermine the
ongoing IEBC Commissioners selection
and any changes to the election law have
to be pursued through the select committee structure,'' he said.
The deputy secretary general said that it
was important before the introduction of a
new legislation adequate and wide consultations be made with stakeholders to ensure that the new laws would not turn out to
be harmful to the citizens and the country
at large.
In a statement, the Evangelical Alliance
of Kenya made a similar call to President
Kenyatta to reconsider the decision to push
for the introduction of fresh drafted election
laws seeking to restore manual system.
The Secretary General Connie Kivuti condemned political leaders' grandstanding on
electoral reforms and urged both Jubilee
and cord leaders to dialogue and resolve
the impasses.
The National Council of Churches of
Kenya(NCCK), deputy secretary general
Nelson Makanda noted that the election
laws were put in place through negotiations
by all political players hence it was prudent
the same was passed and endorsed by all

adoption of the changes by Parliament,
saying they went against the spirit of the
negotiated electoral reforms reached by
the Joint Parliamentary Select Committee in August. "The President should rise
above politics and act in his capacity [as
Kenya's leader] and the symbol of national
unity to promote cohesion," said chairman,
Reverend Cornelius Korir.
Meanwhile, the Kenya National Commission on Human Rights(KNCHR) has called
for dialogue over the impasse surrounding
the contentious amended election laws
passed by Parliament last week.
In a press statement, the Commission
Vice chairperson George Morara said the
mayhem is unhealthy for the country and
should be contained immediately through
all parties embracing dialogue.
''In the spirit of building a broader consensus on the controversial amendments in
the election laws,we urge President Uhuru
Kenyatta not to assent to the controversial
amendments instead we appeal to him to
immediately call for dialogue involving all
stakeholders to amicably resolve the stalemate for credible elections,'' he said .
Kenyans last week witnessed a showdown
in parliament pitting the Jubilee and CORD
legislators following the controversial
proposed amendments of electoral laws
aimed at introducing manual voter identification and transmission of results in the
event of technological failure during the
2017 elections.
CORD is opposed to the introduction of
manual system citing fears of possible rigging and insists that the elections be managed through electronic system.

in the Muslim community need to be addressed by the mosque committee.
Sheikh Swaleh noted that the many challenges facing the Muslims in the region demanded them to be vigilant and ensure the
elected leaders serve them effectively with
honesty in order to forge ahead in political
and social economic development.
He further called on Muslims in the region
to embrace peace, unity and Islamic brotherhood in order to prosper in the social
economic development.

Government extends
Mandera curfew to contain
insecurity

The government has extended by another


three months a dawn to dusk curfew that
was imposed in several areas of Mandera
County.
Interior Cabinet Secretary Joseph Nkaissery issued the order in a gazette notice
dated December 23, 2016.
This order extends orders issued vide Legal Notice No. 183 of 2016 in respect of
the said areas. Every person who resides
within the subcounty shall except under
and in accordance with the terms and conditions of a written permit granted by the
respective Deputy County Commissioner
for the affected areas remain indoors in
the premises at which they reside or at
such other premises as may be authorised

The extension will take effect from December 28, 2016 to march 28, 2017 affecting
Mandera town, Omar Jillo, Fino, Lafey, Kutulo, Elwak and their environs extending to
20km from the Kenya-Somalia border.
The curfew comes in the wake of terror attack that left 12 people dead at Bishaaro
Lodge in Mandera town in early October.
Mandera town has enjoyed relative calm
during the period of curfew the past three
months although Al Shabaab carried out
several attacks outside the town mainly
targeting communication masts.

Obligatory and Recommended Times to send Salawat

It has been established that sending salawat on the Prophet, sallallaahu alayhi
wassallam is a noble deed in Islam, but
we must also be aware that there are
prescribed times for it and times that this
act is not recommended or allowed. Also,
for specific supplications that the Prophet, sallallaahu alayhi wassallam taught
us, we must only say what he narrated
without any modifications.
Ibn Hajar, rahimahullah says, "The wording of dhikrs is tawqeefi (i.e., acts of worship which must be done as prescribed
in the texts), and they have special characteristics that cannot be subject to analogy. So one must adhere to the wording
as it was narrated." [Al-Fath Al-Baari
(11/112)]
The obligatory and recommended times
are as follows:
During the tashahhud in prayer. Shaykh
Al-Albani, rahimahullah gives a detailed
description on sending salah in the
tashahhud as well as some important
notes on this act in general in his book
"The Prophet's Prayer Described".
After the adhan. Abdullah bin 'Amr bin
Al-'As (May Allah be pleased with them)
reported: "I heard the Messenger of Allah sallallaahu alayhi wassallam saying,
'When you hear the adhan, repeat what
the Mu'adhdhin says. Then ask Allah to
exalt my mention because everyone who
does so will receive in return ten rewards
from Allah. Then beseech Allah to grant
me Al-Wasilah, which is a high rank in
Jannah, fitting for only one of Allah's
slaves; and I hope that I will be that man.
If any one asks Al-Wasilah for me, it becomes incumbent upon me to intercede
for him'." [Muslim] In another hadeeth,
Sa'd bin Abu Waqqas (May Allah be
pleased with him) reported: "The Prophet
sallallaahu alayhi wassallam said, 'He
who says after the adhan: {Ash-hadu
an la ilaha illallah Wah-dahu la sharika
Lahu; wa ash-hadu anna Muhammadan
'abduhu wa Rasuluhu, radhitu Billahi
Rabban, wa bi Muhammadin Rasulan,
wa bil Islami Deenan (I testify that there
is no true god except Allah Alone; He
has no partners and that Muhammad is
His slave and Messenger; I am content
with Allah as my Rabb, with Muhammad
as my Messenger and with Islam as my
Deen)}, his sins will be forgiven'." [Muslim]
When entering the masjid. 'I take refuge with Allaah, The Supreme and with
His Noble Face, and His eternal authority
from the accursed devil. In the name of
Allaah, and prayers and peace be upon
the Messenger of Allaah. O Allaah, open
the gates of Your mercy for me.'
When leaving the masjid: 'In the name
of Allah, and prayers and peace be upon
the Messenger of Allaah. O Allaah, I ask
You from Your favor. O Allaah, guard
from the accursed devil.'
Fridays. Aus bin Aus (May Allah be
pleased with him) reported: "The Messenger of Allah sallallaahu alayhi wassal-

lam said, 'Among the best of your days


is Friday; so supplicate Allah more often
for me in it, for your supplications will be
displayed to me'. He was asked: 'O Messenger of Allah! How will our blessings
be displayed to you when your decayed
body will have mixed with the earth?' He
sallallaahu alayhi wassallam replied, 'Allah has prohibited the earth from consuming the bodies of the Prophets'." [Abu
Dawood, Saheeh Al-Albani]
Daily Adhkar (remembrances) of the
morning and evening. Abu Darda (May
Allah be pleased with him) narrated that
the Prophet sallallaahu alayhi wassallam
said, "Whoever sends blessings on me
ten times in the morning and ten times
in the evening will receive my intercession." [Al-Tabarani] This hadeeth is disputed amongst the scholars of hadeeth;
Shaykh Al-Albani declared its chain
weak while Al-Sakhawi and imam ibn'ul
Qayyim declared it authentic. However,
sending salawat on the Prophet sallallaahu alayhi wassallam daily is still recommended based on the hadeeth, as Ibn
Mas'ood (May Allh be pleased with him)
reported: "The Messenger of Allah sallallaahu alayhi wassallam said: 'The people
who will be nearest to me on the Day of
Resurrection (i.e., receive my intercession) will be those who supplicate Allah
more often for me'." [At-Tirmidhi, Hasan
Al-Albani]
When his name is mentioned in a gathering/written form etc. The Prophet, sallallaahu alayhi wassallam said, "The miser is the one in whose presence I am
mentioned but he does not supplicate for
me." [At-Tirmidhi, Saheeh Al-Albani] It is
important to note though that it is established among the scholars that it is not
obligatory to send salawat on the Prophet
sallallaahu alayhi wassallam every time
his name is mentioned. Shaykh Al-Munajjid from IslamQA explains that it says
in Tuhfat al-Muhtaaj, which is a Shaafai
book, it says (2/65): "If the worshiper recites or hears a verse in which the name
of the Prophet (peace and blessings of
Allaah be upon him) is mentioned, it is
not mustahabb to send blessings upon
him, as the author said in a fatwa (i.e.,
al-Nawawi)."
Times When it is not Allowed or Disliked to send Salawat
Imam ibn'ul Qayyim rahimahullah stated,
"Sending blessings upon the Messenger
of Allah sallallaahu alayhi wassallam, although it is one of the best and most beloved of deeds to Allah, every dhikr has
its own place and time, where no other
can take its place." [Jala' al-Afhaam
(1/424)]
These times include:
When slaughtering the animal. The sunnah of slaughtering is to say only "Bismillah Allahu Akbar" meaning, "With the
Name of Allah, Allah is Greater (than
everything else)".
When sneezing. It was narrated from
Nafi' that a man sneezed beside Ibn

'Umar (May Allah be pleased with them) and


said, "Alhamdulillah was-salaam 'alaa Rasul
Allah (Praise be to Allah and peace be upon
the Messenger of Allah)." Ibn 'Umar (May Allah
be pleased with him) said: "And I say, 'Alhamdulillah was-salaam 'alaa Rasul Allah (Praise
be to Allah and peace be upon the Messenger
of Allah)' but this is not what the Messenger
of Allah sallallaahu alayhi wassallam taught us.
He taught us to say: 'Alhamdulillahi 'alaa kulli
haal (Praise be to Allah in all situations)'." [AlTirmidhi, Saheeh Al-Albani]
When bowing (ruku') or prostrating (sujood)
in prayer, or any times in the salah other than
the tashahhud. If you come upon an ayah in
the Qur'an that has the name or mention of the
Prophet sallallaahu alayhi wassallam.
The Messenger of Allah, sallallaahu alayhi
wassallam loved this ummah so much so that
on his deathbed he kept repeating "ummati,
ummati" meaning, "my Ummah! my Ummah!"
He, sallallaahu alayhi wassallam, is the one
who said, "I wish to see my brothers!" The
Companions said, "O Messenger of Allah! Are
not we your brothers?" He, sallallaahu alayhi
wassallam said, "You are my Companions, but
my brothers are those who have not come into
the world yet." [Muslim] He is the one who
made dua for you after every prayer, so dear
brothers and sisters, let us return a dua for him.
A'ishah, radiallahu anha narrated "Once, when
I saw the Prophet in a good mood, I said to him:
'O Messenger of Allah! Supplicate to Allah for
me!' So, he said: 'O Allah! Forgive A'ishah, her
past and future sins, what she has hidden, as
well as what she has made apparent'. So, I began smiling, to the point that my head fell into
the lap of the Messenger of Allah sallallaahu
alayhi wassallam out of joy. The Messenger of
Allah said to me: 'Does my supplication make
you happy?' I replied: 'And how can your supplication not make me happy?' He then said:
'By Allah, it is the supplication that I make for
my Ummah in every prayer'." [Narrated in Al
Bazzaar, Hasan Al-Albani]

Infidelity and misplaced blame in the Muslim Community

Infidelity is a major topic that too often, like many other embarrassing elements of our community, gets brushed under the rug.
Imams routinely have to deal with couples where one spouse is
being unfaithful. I don't believe that it's a greater epidemic in the
Muslim community than society at large, but it is probably almost
just as bad.
In our community, we have the following :
A. As a defense mechanism, the cheating spouse will often talk
his/her spouse down and belittle them in order to deflect from their
own major sin while also gaining sympathy from the onlookers.
Under the influence of cultures that place unfair expectations and
blame on the wife, many women are likely to be blamed for not
keeping their husbands happy, even at times by their own families. This approach, of course, is completely devoid of any Islamic
precedent or Prophetic tradition. The Prophet salallahu alayhi wa
sallam never chastised the spouse of an adulterer for not doing
enough to stop them from cheating.According to John and Julie
Gottman's 40 years of marital research, there is one common denominator that tends to begin the cascade toward betrayal in a
marriage: When one spouse attempts to connect with the other
and the other spouse turns away from this while negatively comparing, this is the first step toward betrayal. A negative comparison
sounds something like this, Who needs this frustration? I could
do so much better with someone else. This type of belittling and
justification, while imagining oneself as innocent, deteriorates trust
and starts people on the downward spiral toward infidelity.
B. Often, men who are unfaithful will try to right the wrong by
marrying the person they were unfaithful with, at times without
even fulfilling the requirements of a marriage. This is where the all
too common secret second wife comes into the picture.
Or many men ditch the first wife and make it seem like the woman
they were cheating with just came into the picture. Alas, even the
most practicing Muslims will forsake all principles and beliefs regarding Islamic marriage holding weird Skype Nikahs without
the most basic conditions of a marriage contract being met. They
will continue to beat up on the first spouse for making them do it.

The very idea of a secret marriage defeats the purpose. The


Prophet salallahu alayhi wa sallam taught us to publicize the marriage for so many different reasons. One of them is that the man
with a secret second wife often may have seven or eight other
second wives. In a very awkward scenario that I witnessed a
few years ago, a brother in the community sought the help of an
imam to pursue a sister who was secretly married to that very
same imam.
In looking at the research, how many affairs become lasting relationships? Dr. Frank Pittman, an expert on treating affairs, found
that the divorce rate of those who marry the person they were
unfaithful with is 75%. What was the major reason for these divorces? A lack of trust. How can you trust someone who chose to
be with you by cheating on someone they had previously committed to?
Can't cheat Allah
A piece of advice to the brothers and sisters who are cheating
on their spouses: There is no justification for adultery, and victim
shaming here won't save you from being held accountable by Allah on the Day of Judgment. No human being will bear the burden
of another on the Day of Judgment. Seeking validation from backward cultural elements or friends that are just as unfaithful as you
won't change the creed.
Allah says in the Qur'an in Surah Al-'Isr' 17:32 And do not
approach unlawful sexual intercourse. Indeed, it is ever an
immorality and is evil as a way.
In an authentic Hadith, the Prophet of Allah said: The one who
cheats is not one of us. (Sahih Muslim).
Nothing that started with the deception of Shaytan will suddenly
gain the blessing of Allah. If you were unfaithful, you need to sincerely seek forgiveness from your Creator and the people you've
hurt with your infidelity. You need to fully accept blame for your sin,
and start taking the necessary steps to try to fix things.

Work hard in studies , Kisumu Muslim students told


Muslim students in education institutions in Kisumu County have been
urged to work extra hard in their studies to be successful members of the
society.
The sentiments were made by the Kisumu Nominated Member of County
Assembly Farida Salim who pointed out
that the myriads of challenges facing
the Muslim ummah can be addressed
through investing in education.
Addressing participants at the closing
of a two day Muslim Youth Summit at
Ummu Salama girls Institute in Kisumu
on Sunday last week, Farida encouraged Muslim students to take their
education seriously and focus more
on their studies in order to excel in their
educational endeavours.
Farida told Muslim students to put more
emphasis on education saying that
communities which have made tremendous achievements have made it possible through education.
She singled out education as one of the
way to contribute to the empowerment
of Muslims in order to participate fully
in development and national affairs for
social economic development.
While
commending the performance of Muslim students in national
examinations,she advised students to
consult with their parents in making career choices which she said should be
based on societal benefits.
In her remarks the chair-lady of the
Kisumu based Sisters With A Mission
(SWAM) Muslim development group
Rehema Akidah advised Muslim students in institutions of learning to stick
to Islamic values and principles for
prosperity.
She commended the participants from
secondary schools and universities for
turning up for the event where they

were equipped with the knowledge and skills


that will help them address the challenges of
the contemporary world and tap into the opportunities of the 21st century.
On his part, the Nairobi Area Muslim Students Association(NAMSA) Coordinator
Umar Sakwa paid tributes to Sisters With A
Mission(SWAM) Muslim group for its efforts
in organizing the youth summit and pledged
that NAMSA will partner with the group in its
future endeavours.
The two days Muslim youth summit was
organized by the Sisters With A Mission
(SWAM) in partnership with NAMSA and attracted over 150 students from secondary
schools and universities.

Female inmates support


Please keep in contact regularly. We women inmates feel unworthy. Its very vital to have help to build some confidence and
self worth. It helps when someone sticks around for a while and
don't disappear. Some organisations come and go and this feels
like youve been abandoned, forgotten and not very valuable. For
sure, Ummah Foundation is a value organisation for inmates and
my own interaction with Ummah Foundation has been very positive, it is reassuring that these good people are not just doing a tick
the box experience, but genuinely have a caring heart. Its great to
see a friendly face at the gate when your family and everyone in
the community is against you.
Those are the lovely and touchy words of one lady at Langata
Women Prison who is serving a life sentence and had a lot of joy
after Ummah Foundation paid a visit to the ladies incarcerated

between the prison walls.


All the 800 ladies at Langata maximum, Medium and Remand
sections benefitted fully from this visit regardless of their religious
affiliations.
Indeed Ummah Foundation has been there all these years caring
and taking care of our inmates. We understand that being an offender is because of the society and what has been done can only
be undone if our correctional institutions can take into consideration that inmates are human too. They need care and motivation
as they are still part and parcel of the society. Subjecting them to
inhumane conditions can have adverse effects on their healing
journey and result into dejection and resentment. Within our programs we factor women by providing them with one year supply of

Those who are incarcerated and have
little children are also given attention
as diapers, children clothes and learning materials are provided to the day
care centre that is within the prison.
This affords the mothers to go on with
their daily activities and work without
worrying about their young ones.
Apart from Langata Women Prison,
we also visited Machakos women
Prison that houses 68 inmates. They
received the same items that were
given to Langata prison.
With the same zeal, Ummah Foundation is on its trail to visit nearly all the
female prisons across the country so
that the benefit can extend to all inmates.
We are very privileged to have gotten the eye of donors, well wishers
and volunteers who are proud to be
associated with this noble project that
touches the hearts of many. We appreciate the efforts and cooperation
that is accorded to us by the Prison
Authorities in facilitating our access to
these security areas.
We thank Madam Wanini Kireri, the
Assistant Commissioner General who
has been very instrumental in making
sure that this project comes to fruition.
We sincerely appreciate her.
