Project Description

The enclosed pennit application is being submitted pursuant to the Freshwater Wetlands Protection
Act Rules (N.lA.C. 7:7A) and the Flood Hazard Area Control Act Rules (NJ.A.C. 7:13). The
Borough of Dumont proposes to improve the drainage system at two locations within the Borough.
This project is a continuation of an on-going drainage system improvement project required to
alleviate persistent and damaging flood conditions. This particular portion of the project includes
two separate areas. The fIrst is referred to as Area 5 and consists of the northwest comer of the
Borough in the vicinity of the White Beeches Country Club. The neighborhood around White
Beeches Drive, Berkeley Place, and Cole Court routinely experiences moderate to severe flooding
during storms. The second is referred to as Area 6 and consists of the area around Roosevelt
Avenue and Cooper Avenue. The streets and yards in this neighborhood also routinely experience
moderate to severe flooding during storms. The proposed drainage improvements will affect the
following roads in the Borough of Dumont:

Pursuant to the Borough's request, T & M Associates completed a drainage study for Areas 5 and
6. The objectives of the drainage study were to determine the general nature and cause of the
flooding in each area and to evaluate alternatives that would correct these existing conditions.
Subsequent to evaluating the various alternatives to the project, it was concluded that
improvements in Area 5 will require replacement of the existing undersized drainage system.
The existing system discharges stormwater through two 42-inch pipes into a man-made scour
hole that is located in a golf course. The flow from the scour hole as well as an existing man­
made pond/water trap in the golf course flows into a single elliptical' corrugate d pipe that
ultimately discharges to a larger pond on the course. Outflow from this larger pond is controlled
with an over-flow weir. Once the weir overtops, flow is conveyed into headwaters of Steinal's
Ditch.

The proposed improvements in Area 5 include maintammg and improving the existing
underground system upstream of the two 42-inch pipes. In addition, a new drainage pipe system
with a separate outfall will be installed. The existing headwall associated with the two 42-inch
pipes will be reconstructed in order to accommodate a new 43x68-inch outfall pipe. That is to
say that the twin 42-inch pipes will be replaced with this 43x68-inch pipe. The new outfall and
associated piping is being installed to increase storage capacity of the existing system. No
increase in run-off or volume from the surrounding area will be discharged through the new
outfall. Lastly, accumulated sediment that gets trapped against an exposed utility line will be
removed. To prevent this from happening after the drainage system is improved, the utility line
will be dropped below the invert of the scour hole.

Improvements to the system in Area 6 also require replacement of the existing drainage pipe
system because it is undersized. Similar to Area 5, a new pipe and outfall structure will be
installed to convey a portion of the run-off from the surrounding area. This new pipe and outfall
will discharge into a concrete lined channel located on Prospect Avenue. Conduit outlet
protection will provided at the discharge point of the outfall. Lastly, a concrete bin-wall will be
installed to function as a headwall for the new outfall.

A Flood Hazard Area Individual Permit application is being submitted to authorize installation of
the drainage pipe outfalls. Applications for Freshwater Wetland General Permit Nos. 1 and 11
are also being submitted. Specifically, GP No. 1 is being requested to authorize maintenance and
other regulated activities within the scour hole that is located in the golf course. GP No. 11 is
being requested to authorize installation of the new outfall and scour protection in the concrete
lined channel at Prospect Avenue. Note that no net fill is being proposed in the floodplain in
either Area 5 or 6. The activities proposed at Area 5 will actually result in 73-cubic yards of Net
Cut from the Floodplain. This is associated with removal of the accumulated sediment that gets
trapped by the existing utility line.

The proposed drainage improvements will alleviate the flooding that occurs throughout each of
these areas. As such, the health, safety and welfare of local residents will improve. It should be
noted that completing the proposed project will not result in an increase to the impervious
surface throughout this drainage area nor will its completion disturb greater than I-acre of land.
As such, the project is classified as a Minor project and is exempt from the Phase II Rules for
stormwater management.

The following sections provide further details relative to the permits required for the project:


General Permit No. 1 is required for maintenance of the man-made scour hole at White
Beeches Golf Course. The ditch acts as a sediment trap due to the location of a utility line
that crosses perpendicularly. The ditch does not function properly and is need of cleaning to
maintain flow. This element of the project entails removal of 109 CY of sediment to restore
the storage capacity; replacement of the existing drainage pipes with a new 43x68-inch
outfall pipe; placement of 36 cy of scour protection; and relocation of the existing utility
line three feet below the invert of the scour hole. Lastly, the scour hole will be stabilized
with gabion baskets to prevent erosion and limit downstream impacts.


General Permit No. 11 is required for installation of a 42" outfall at the culvert located on
Prospect Avenue. The outfall will discharge stormwater from a proposed drainage
system along Prospect Avenue and Mckinley Avenue. The outfall will be constructed
through an existing concrete wall in the channel. This channel is concrete-lined and as
such, no wetlands are present.


A Flood Hazard Area Individual Permit will be submitted for each site to authorize
regulated activities in the floodplains of each drainage area. The project does not require
removal of any vegetation within the Riparian zone.

Statewide General Permit No.1 Compliance Statement

General Permit No.1 authorizes activities in freshwater wetlands and State open waters for the
repair, replacement, or maintenance of a previously authorized, currently serviceable structure, fill,
roadway, utility line, active irrigation or drainage ditch or stormwater management facility lawfully
existing prior to July 1, 1988 or permitted under this chapter.

The proposed project involves improvements to an existing stormwater drainage system within
Area 5 described above. The regulated portion of the project involves improvements to a man­
made scour hole which will convey stormwater from the nearby roadways to headwaters of
Steinal's Ditch.

The Department shall issue a General Permit No.1 based on the following conditions:

1. The activities under General Permit No.1 will not widen, expand or deepen the existing
limits of the scour hole. Although 109 CY of sediment will be removed, 36 CY of gab ion
baskets will be added in order to reconstruct the headwall, replace the twin pipes, and
provide the required degree of scour protection. Accordingly, the net volume of material to
be placed in the scour hole is 73 CY. To ensure that sediment does not accumulate in the
scour hole after the improvements are completed, an existing utility line will be relocated
three feet below the invert of the ditch.

2. Relocation of the gas main below the invert of the ditch will improve water flow and
prevent sediment from accumulating in the future. The proposed scour protection will also
ensure that downstream areas are not subject to sediment accumulation after the project is
completed. The overall area of temporary disturbance is 350 SF (0.008 Acres) and will be
limited to State open waters only. No freshwater wetlands or associated transition areas will
be disturbed during the project. Proper techniques to prevent soil erosion and sedimentation
will be employed during construction.

Please refer to the plans in Attachment E for further details on the proposed project.

Statewide General Permit No. 11 Compliance Statement

General Permit No. 11 authorizes activities in freshwater wetlands, transition areas, and State open
waters necessary to carry out the construction of stormwater and non-stormwater outfall structures,
intake structures, wells, conveyance structures and energy dissipation structures. The Borough is
seeking authorization of a GP No. 11 in order to construct a 42 inch outfall within an existing
concrete-lined channel. The outfall will convey stormwater from a proposed drainage system
within McKinly A venue and Prospect Avenue. The proposed stormwater system will improve
drainage in the area and eliminate localized flooding.

1. Impacts associated with the construction of the new outfall will be negligible due to the fact
that the new structure will be placed in a concrete-lined channel. Specifically, no wetland
or transition area vegetation will be impacted during installation of the structure. Also note
that the project will not require removal of vegetation from the Riparian zone.

2. It is important to note that construction of the outfall structure will not widen or otherwise
expand the channel and will therefore comply with the United States Occupational Safety
and Health Administration safety standards (29 CFR Part 1926, Subpart P).

3. A minimum volume of conduit outlet protection will be placed at the discharge point of the
outfall pipe.

4. The unnamed tributary to Hirshfield Brook is not suitable to support fish or other aquatic
wildlife. Therefore the proposed pipe will not adversely impact such flora or fauna.

Standards for All General Permits:

Pursuant to the Freshwater Wetlands Protection Act Rules (N.J.A.c. 7:7A-4.3), the following
General Permit standards will be met:

1. The activities associated with this request for authorization are associated with a proposed
project or construction activity and are not solely being requested for the purpose of
.
eliminating a natural resource in order to avoid future regulation.
.

2. The regulated activities will not occur in the proximity of a public water supply intake.

3. According to the NIDEP Natural Heritage Program, neither project area contains any
threatened or endangered species or suitable habitats. Although the NHP program lists
red-shouldered hawk as being within 1 mile of Area 5, the proposed activities will not
jeopardize this or any other threatened or endangered species nor will it destroy or
adversely modify the habitat of such species.

4. The activities will neither occur in a component of the Federal, State or Wild and Scenic
River system, nor in a river officially designated by Congress or State Legislature as a
"study river" for possible inclusion in either system while the river is in an official study
status.

5. The proposed project does not involve the discharge of dredged material.

6. Any authorized structure or fill will be maintained as specified in the construction plans.

7. According to the NJDEP Bedrock Geology Map (GIS Digital Data), both site locations are
underlain by the Passaic Formation (JTrps). As per the Flood Hazard Area Protection
Regulations, this formation is not listed as containing acid producing soils that are found in
Coastal Plain geologic formations (NJ.A.C. 7:13-3.7).

8. The activities will not result in a violation of the Flood Hazard Area Control Act Rules
(N.J.A.C. 7:13). An Individual Permit application is being submitted to authorize
construction within the flood hazard area limit at both locations. The disturbances at these
locations are minimal and will not result in the removal of any riparian vegetation.

9. The proposed project does not include an increase in new impervious cover at either site.
The proposed improvements at Area 5 intend to improve the flood storage of an existing
scour hole; the project will not adversely impact stormwater runoff or quality. In addition,
the total area of land disturbance is less than 1 acre. As designed, the proposed project
does not need to comply with the Department's Phase 2 Stormwater Management Rules.

10. No dredging activities are proposed for this project. Excavated material will not be
deposited in freshwater wetlands, transition areas, State open waters or other
environmentally sensitive areas.

11. The proposed project involves the placement of 36 CY of erosion and scour protection in
Area 5. Soil erosion techniques will be utilized where required. As designed, the
proposed project complies with the Standards for Soil Erosion and Sediment Control
(N.J.A.c. 2:90).

12. Best Management Practices will be followed where possible.

13. The general permit activity complies with the Department's Water Quality Management
Planning Rules at N.J.A.C. 7:15.
14. Timing restrictions do not apply to this project. The proposed project will not introduce
sediment to a stream or cause a trout-associated stream to become turbid.

15. The proposed project will not take place in a vernal habitat or a transition area adjacent to
a vernal habitat.

can find a copy of these rules in the county law library in your county courthouse.

As a part of the NJDEP's review of the application, NJDEP personnel may visit the property and the portion of any neighboring property
that lies within 150 feet of the property line to perform a site inspection. This site inspection will involve only a visual inspection and
possibly rninor soil borings using a 4" diameter hand auger. The inspection will not result in any damage to vegetation or to property
improvements. The NJDEP welcomes any comments you may have on the application. If you wish to comment on the application,
comments should be submitted to the NJDEP in writing within 15 days after you receive this letter. However, written comments will
continue to be accepted until the NJDEP makes a decision on the application. Comments can not be accepted by telephone. Please submit

Experience: Well rounded professional experience including state and federal wetlands
regulatory compliance issues and permitting; wetland delineation; wetland
restoration and mitigation; preparation of Environmental Impact Statements;
stream restoration; fisheries management; and ecological risk assessment.

Mr. Nathanson has performed approximately 200 wetland delineations and


prepared Wetland Delineation Reports for submission to the New Jersey
Department of Environmental Protection and the New York State Department of
Environmental Conservation for the past eight years. Experience includes a
working knowledge of NJDEP, NYSDEC, and USACOE regulations and
methodologies including Freshwater and Coastal Wetlands, Stream
Encroachment, CAFRA, and NJPDES processes.

Mr. Nathanson assisted in the ongoing restoration of approximately 20,000 acres


of coastal and freshwater wetlands associated with the Delaware Bay Estuary
System. He also played an instrumental role in the selection of mitigation sites
and subsequent restoration of wetlands in the New York-New Jersey Harbor that
were impacted during a dredging project and navigation channel improvement
project.

Mr. Nathanson is also experienced in marine and freshwater ecology, vegetation


analysis, wildlife assessment, habitat assessment, and fisheries management. He
has developed numerous natural resource inventories, ecological risk assessments,
and mitigation plans for clients in both the public and private sectors.

Prior to joining T & M Associates in July 2002, Mr. Nathanson served as a Project
Scientist and Manager for DRS Corporation in Wayne, NJ from 1998 to 2002. Mr.
Nathanson also has worked for the NJDEP Bureau of Shellfisheries as well as the
National Marine Fisheries Service.

Experience: Mr. Howard has gained experience in the field of environmental consulting through
his participation in three consecutive professional internship programs at T&M
Associates. Mr. Howard continues to develop his professional skills in performing
wetland delineations and preparing environmental documents included with State and
Federal permit applications. He continues to gain extensive experience by preparing
and obtaining Freshwater and Coastal Wetland Permits, Letters of Interpretation,
CAFRA and Waterfront Development Permits, Pinelands, and US Army Corps of
Engineers approvals.

In addition, Mr. Howard supports our firm with his knowledge of Geographic
Information Systems (GIS) technology, Global Positioning System (GPS) surveying
equipment, and his ability to process Electronic Data Deliverables. Mr. Howard has
experience in operating oil/water interface probes as well as experience in stormwater
sampling and pH meter testing.

Mr. Howard currently has publications pending in two international academic journals
(Paleontologia Electronica and Torrey Botanical Society Journal). Mr. Howard was a
member of the School of Theoretical and Applied Science Research-Honors of
Distinction program at Ramapo College of New Jersey.

In 2007, Mr. Howard received a scholarship from the United States Department of
Agriculture for outstanding work in an environmental field. Prior to joining T &M
Associates in January 2008, he attended Ramapo College of New Jersey located in
Mahwah, NJ from 2005 to 2008. Matt graduated early in 2008 as part of the class of
2009 with Magna Cum Laude distinction and a cumulative GPA of 3.71.
Additionally, Mr. Howard received an award for excellence in the major of
Environmental Science which is given to one person per graduating class who
finishes at the top of the class. In the Fall of 2009 Matt began taking graduate level
courses at Richard Stockton College of New Jersey in their Professional Science
Master's program and is expected to graduate in the Spring of 2011.
